Comments on Sept 11th Victim Compensation Fund of 2001
My comments on the processes and regulations for implementing the Victim
Compensation Fund are:
1. Collateral sources which are deducted from the Fund compensation should
only be life insurance, pension funds, death benefit payments and payments
by Federal, State or local governments, as stated in the law. Funds
received from charitable organizations should not be deducted.
2. A claimant should be required to waive their right to file a civil
action only after a determination is made as to the amount of compensation
that they will receive from the Fund, and the claimant accepts this
determination. If the claimant is dissatisfied with the amount they would
receive from the Fund, they should be able to waive their right to receive
this amount and be allowed to file a civil action.
3. The claimant should be able to file an appeal of the amount initially
determined to paid to them from the fund. If they are dissatisfied with
the results of the appeal, they should be able to waive their right to
receive this amount and be allowed to file a civil action.
