Sept 11 Victims Compensation Fund
Dear Mr. Kenneth Zwick:
Thank you and your staff for your efforts in establishing and
administering this Fund. Please find below my thoughts regarding the Victims
Compensation Fund as permitted under the â??commentsâ?? deadlines which have
been set forth.
1. Calculation of loss should be consistent and straightforward. Â A loss is
a loss regardless of its implications: i.e. the calculation of economic and
non-economic losses to an offspringâ??s estate through the death of that
offspring should be no different from the calculation of loss to a family
person who had created different obligations.
2. Some linkages, like a grid, between categories of victims families and
dollar amounts of payment may be necessary due to the planned 120 day
turnaround target. But these should be created with enough fine
differentiations to enable frequent close matches to circumstances without
need for special hearings. Supporting documentation should be fairly simply
to submit.
3. However, a hearing/comment opportunity should be provided for those
extraordinary situations which you cannot predict today. You can generate new
streamlining rules for these as the learning process moves forward.
4. An individual's foresight in providing his estate with private life
insurance or the estate's good fortune in receiving a charitable grant should
be outside the considerations for the fund's payout amounts.
