Victim's compensation

I don't believe the government should pay the victim's any amount for what 
happened on 9 eleven.  Please explain how it is the airline's fault or the 
government's responsibility. The airlines were not negligent.  These people 
did not bring anything on board they were not allowed to do.  What happens if 
the next time, God forbid, 100,000 people lose their lives.  What happens in 
Israel when a terrorist kills himself along with innocent people.  Is the 
Israel government to blame?

Benefits for Gay and Lesbian Victims of 9/11


I am appalled by the stance that the government has
taken regarding giving benefits to Gay and Lesbian
Americans who lost their life partner in the tragic
events of 9/11.  

Apparently it would be too time consuming to clearly
outline who should receive death benefits of those
killed in the 9/11 attacks, so you are defaulting to
individual state laws to decide
it... unfortunately, most state laws do not recognize
domestic partners and/or same-sex marriages. Which
basically means partners of Gays and lesbians killed
at the WTC or Pennsylvania or the Pentagon are pretty
much out of luck. 

Hiding behind the guise of following state law is
despicable.  Especially since you are bending the
rules for victims who are not even legal citizens of
the United States.

If this is the way the government is going to proceed,
then you should have the courage to visit
each and every partner of a gay and lesbian victim of
9/11 and personally explain to them why their
relationship does not "qualify" as a legitimate one;
explain to them why their grief is less than those of
heterosexuals; and why, in the so-called Land of the
Free, where we are supposedly fighting for everyone's
individual freedom on a daily basis in foreign lands,
you can systematically limit our fellow citizen's
freedom to choose who he/she can and cannot love.

I am always proud to be an American, but I am
increasingly embarrassed by the actions of my
government regarding the Gay and Lesbian population.  
Especially since they are a community of very active
voters.  If for no other reason than your re-election
concerns, you should do something to correct this
injustice.

9//11 Fund Exclusion of Gay Partners

I am truly horrified that Mr Feinberg would think to discriminate against gay partners under the cloak of state laws. After all of the gay heroes killed 9/11, to slap their loved ones in the face this way is reprehensible.  I implore the fund to reconsider and treat gay partners with the dignity and fairness they deserve.

You truly are bigots in the same fashion as the killers who murdered             .  How can you blatently discriminate against 
homosexual/same-sex couples and not honor their commitment and love for one 
another when it comes to the distribution of financial compensation to 
9/11's survivors' families and loved ones.

It is this exact kind of shameful, unholy discrimination that lead to the 
terrorist acts on 9/11.  Your discrimination of this love only perpetuates 
the evil that you are trying to compensate for.  You even provide 
compensation to aliens not belonging to this country.

comments on the comp plan

my name is and my son was killed in the north tower. The federal government should help the parents and the brothers and sisters of the victims. The rest of our life's will be filled with pain. We will forgive grief our son. brother will always be with out his brother. When and I die he will be alone. Try walking in our shoes and then you will get the full picture. You should walk in the shoes of everyone connected with 9/11 to understand how we all feel. I would like you to read the letter I sent today to our President.

I want to address the fact that the government has forgotten about the parents and brothers and sisters of the victims of 9/11.  I want you to understand our lives since 9/11.What is our life as parents like?  In order to tell you that I have to give you some background. On 9/11 my wife ran out of when she learned that there was a fire in one of the twin towers. She did not know that a plane flew into the building yet. When she got outside she could see that the top of the building on fire. Our son worked in on the floor of 1 WTC. fell to the ground crying. She might not have made it through that day except for a man that moved her away from the burning building. The man would helped my wife was who might have just saved my wifes life. My wife watched her son being burnt alive while I watched it on the television. Not many parents can say that they saw their son killed over and over. Thank G-d for that. You do not have any idea what that was like and still is to this day. Pictures of the World Trade Center will be in newspapers and on TV for a long time. 9/11 has become a word. That day is burned into our brain as well as our heart. We were forced to watch on television the repeated shots of the plane going into the Trade Center while we waited for news that never came. Our son, had disappeared.
Our son was married for 5 years. He had a two-year-old son.  On September 15, his wife gave birth to twin girls. never saw his two babies. His daughters will never know what a great father would have been to them. There was no one better than him. He was looking forward to the birth of his new daughter. We joked about how loud he would be when gave birth. He said they would hear him in California. I told him that he was wrong and that they would hear him around the world
As parents but not next of kin we are the forgotten people. The American people have poured their hearts out to the wifes and husbands of people who were killed that day. They also poured their hearts out to the children left behind. I am very glad that they are being taken care of my sons family.
Now let me tell you about the forgotten people. These are the parents of those killed that day. They are also the brothers and sisters of those killed that day. When flags were given to next of kin they were excluded. A flag would have cost $11.50 cents and would have helped us feel like the country knows about our lose and how great our lose is. We are not even worth that. When urns were given to next of kin they were excluded. In short we are not part of the process when it comes to our children. Is this the message that you want to give to us? How can you not recognize the fact that we have lost someone more precious to us than life itself? Life is not suppose be like this. We are not supposed to bury our children. In this case we do not even get to bury our son. I have heard two fathers say" Thank g-d that they found my sons body. How sick is that but you know what, they are right. They have some sort of closure. But still their lose is great. 
We are going to grief counselors and to support groups to help us to deal with our lives. We are told that losing a child is the greatest loss that there can be yet our government does not care. You do not know who we are. You have not made an attempt to find us and help us. No one is government has lifted a finger to try to find and help us. This is not a contest to see who can hurt the most. During the past 4 months we have come in contact with a number of parents that have had loses like ours. We have seen one woman who is unable to work because she sells a product and needs to always be perky to make a sale. Who wants to buy from her when see is crying all the time? She has not worked in 4 months .We have seen one man who lost his job because of the effects of 9/11 as well as his son. His wife and daughter are afraid that he might do harm to himself. We have seen the relationship between in laws dissolve and erode. While this is a small sampling of parents I think that there are thousands of parents that need help to make it through life. We are trying to deal with our pain. As parents we will need help for the rest of our lifes to get through this. Our loss will always be with us. The government has turned their backs on us. We need you to acknowledge our loss. We feel that no one cares about us. This makes our lose much worse. We hear about the fireman. We hear about the policemen. We hear about the wifes. We hear about the children. Sometimes we even hear about the victims. We never hear about the parents. We never hear about the brothers and sisters. Is their lose any less of a lose than a wifes loss. Who is going to help us deal with our pain? 
We did not just raise and then forget about him. Yes he did marry and had started a family but is was still our son for life, how ever short it was. A parent or a brother or sister will always be the parents and the brother or sister. A wife can be a widow or a wife again. 
We have seen over the last few months the effect of losing a child has on parents. We cannot make it through the day without crying. We cannot stand in long lines without having an anxiety attack. We carry pills to help us if need them. We have many triggers that cause us to cry. If we see a father with a young child we cry. If it is our birthdays we cry because our sons or daughters will not be calling. Tomorrow is our anniversary and will not be calling. He will not be coming to take us out to celebrate. This has made us cry over this weekend. In short almost anything can cause us to cry. When a parent loses a child a part of the parent dies. It feels like a hole opened in our body and we cannot seem to seal that hole.  
Please consider how we as parents feel and acknowledge our great lose. If this had happened to a child of yours you would feel the same thing that we feel every minute of every day. You would need the same help that we will need for the rest of our lifes or what is left of them. 
Last week we went to a meeting set up by a group that works with self-support groups around the country. They had people from the Pam Am flight and people from the Lebanon attack and others. The thing that stuck me the most was how hard it was for the father who lost his son over 18 years ago in Lebanon to speak to us. He tried to hold back the tears but could not do it. We will never stop crying for our children lost on 9/11. How can we go on? The answer is that we have to. We have to go on for our other children and our wifes or husbands no matter how we are suffering. 
Let me tell you what happens in a normal day to us. You get up in the morning and take a shower and cry while you do so. No one can hear you so it is a good place to cry. You have breakfast and maybe you cry. Then you get in your car and drive to work. Half of the trip you cry and try to see the road at the same time. At work you cry during the day. You go to the bank to make a deposit. You start shaking from being in line. The bank employees know what happens to me. They take the deposit and I go sit down while they get me some water. I take a pill and after about 15 minutes I can leave the bank. This condition was not there before death. You go home after work and you cry when you see a beautiful sunset and you cry because your son is part of that sunset. You have dinner and then a few more cries and it is time to go to sleep. You think of your son as you close your eyes. You hope that you will dream about him tonight. This is our life. Talk to other parents and you will find the same thing happening to them. There is nothing that can bring back our son.  The government does not know who we are. There is no list of parents that are not next of kin. There is no list of the brothers or sisters. We hope that one day the government will find a way to say that they are sorry for our loss. We hope that someday you walk in our shoes for a few moments to see what life is like for the parents. Only then could you understand the life that is now ours. A few weeks ago a person kill herself because her husband died on 9/11. Each person in our support group understood why she did what she did. Life is so hard for each of us every minute of everyday.
We think about 9/11 everyday. Our sons and daughters went to work and never came home. They disappeared. The building they worked in disappeared. We ask ourselves, How can that be? 
We ask you to help us coupe with our pain. We do not know what the answer is but we do know the great suffering that each parent goes through ever moment of their lifes. Now and forever.

 Some states recognize such relationships and upon proof of the

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars
per year might receive thousands of times as much compensation as the survivors of a dishwasher in
one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent
worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It
would be a double blow to the survivors to first lose their loved one and then watch as most of the
taxpayer money went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

Comments to Sept 11 Victim Comp Fund

Dear Special Master Feinberg;

I am very much interested in the Sept 11 Victim Compensation Fund.  My
husband was killed while at work on the          floor of World Trade Center Building II on that dreadful day.  I have reviewed the interim rules and procedures for claim submission to the above referenced fund and submit the
following comments.

I am pleased that our government has made an attempt to compensate victims
and families of deceased victims to the September 11th tragedies and to do
so as painlessly and expeditiously as possible.  While I commend these
efforts I am dismayed at 1) the amount of the 'presumed noneconomic loss',
2) the offset of the award by collateral sources and 3) the requirement that
claim submission waives the right of the claimant to file a civil action for
damages sustained.

1) In light of this horrific tragedy - one most unimaginable - an award of
$250,000 for noneconomic losses seems paltry and an insult to the heroic and
patriotic efforts of the victims.  Nothing less than 1 million dollars
should be considered.

2) Reducing the amount of the total award by collateral sources such as life
insurance policies and pension plans is unfair.  These benefits were of
course provided in the event of death but should in no way be considered a
source of compensation in settling wrongful death suits or claims.
Individuals who had the forethought to provide for their families after
death should not be penalized for doing just that.  Congress and the
President should amend the Act to do away with reducing the award by these
sources.

3) It was my understanding that this legislation was enacted to help bailout
the airline industry.  Why on earth then would legislation prohibit civil
suit against other potentially negligible parties, such as the owner(s) of
the World Trade Center Buildings, the City and State of New York, the Port
Authority of New York and New Jersey and Omar Bin Laden?  If in fact the
legislation was intended to bailout all of these entities, then the award
should be far greater than the estimated minimum of $500,000 to families of
deceased victims.

Finally, I'm sure it is the objective of the Fund to have a great number of
the victims and families of victims submit to the Fund.  I think however
that the rules and procedures of this Act as they are currently written will
have the exact opposite affect.

Insurance Offset

Some people have objected strongly as to the fairness of offsetting
insurance proceeds against compensation from the fund.  Since the purpose of
the fund is to make survivors of victims insofar as possibly financially
whole, and not to make the survivors of the foresightful better off than the
survivors of the less prepared, this argument is without merit.  However, to
assuage their sense of unfairness I recommend that the formula be altered so
that for those who are the named beneficiaries of life insurance policies,
their award include the cost of premiums paid.

Equal Rights

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Dear Sen. Boxer,

     I wanted to write to let you know I moved to California a year and a half ago, making this
state my new home.  I lost my dad who worked in the World Trade Center and my mom passed
on a few years ago as well and I am an only child.  Therefore I have to deal with everything
myself now.  So I wanted to get on your radar screen, since I have been feeling like I might fall
through the cracks.  Recently I got a letter from Gov. Pataki and the NY State World Trade
Center Relief Fund, which was designed for us.  But of all the forms they sent me, I don't fall
under any category - I am not my dad's spouse, I am not a child or a child who is dependent.  As a
print reporter covering the television industry I don't make that much money, so my dad had to
help subsidize me with some money each month for living expenses here in L.A. I called the 800
number for the NYS WTC Fund and the worker said I don't get anything.
     Now I am working with Red Cross to help me.  I have many bills, including lawyers I had
to hire in NY State to help me with everything out there.  I also have to pay back some loans my
dad had, which is not legally my problem, but in a sense there is no one else to deal with my
dad's estate except me.  I am the only next of kin, as I said.  So I did get a $5,000 check from
United Way of L.A. and the told me I had to wait till they heard further word from the Sept. 11
Fund they set up, because I told them I had to help pay for a loan my dad took out, could they
help me further...So last week they had the press conference with George Clooney and the United
Way people and NYS Attorney General Elliott Spitzer, they said they were opening up $78
million of the total money raised for us victims.  That day I called my L.A. Chapter of United
Way, spoke to the woman I had dealt with, who was professional, but could have been kinder
and
more compassionate to my plight, esp. since they are supposed to be a humanitarian
organization. 
She said I didn't qualify for the $10,000 they said on the press conference, because I am not
totally  dependent on my dad.  But the people of America donated that money to go to people like
me and it is a frustrating process.  I guess if my dad had life insurance it wouldn't be such a big
deal, but after my mom died, he and jointly made a decision to cancel the life insurance to go to
other more important living expenses.
     I just want also to make sure that your office knows my name and that in the future I and
my dad will not be forgotten, when time comes to do a memorial as well.  Even though I want to
remain low-key, I do want representation from your office.  Being 3,000 miles away from ground
zero, it has been hard even to get my dad's mail forwarded, with all the anthrax scare and I found
my address was even written wrong by some of the NY offices.  I do have a contact in NYS
Gov.'s office, but I find them all in NY state very overwhelmed and swamped.
     I have always admired you and felt that you really speak on behalf of the people in our
state.  If you are ever in town, feel free to call me or meet with me, if you need.  That would be
nice.  This whole thing will be a long process.
     Enclosed is an editorial article I felt the need to write for my readers in a New England
town I used to be a newspaper reporter in, who had heard about what happened to me, even
though I am trying to maintain whatever privacy I have left.  I wanted to share it with you.  I did
not mention his name in my article because of security reasons and all that security fraud people

article I wrote for readers of a former newspaper where I was a reporter.

   I moved to California a year and a half ago, making this state my new home. I lost my dad who

    I called           , as you said in your letter and gave the correct spelling of my dad's
name and also asked her about more funding, since I have to help pay an equity loan that my dad
took out.  Without paying it back, it is hard to sell our house in NY and even though I am not
legally responsible for his debts, I am the only one who has to deal with everything, since I am
the
only next of kin. I had to hire and will have to pay for NY lawyers to help me with everything.
When I first called           , she said they wouldn't know any more info until the Sept. 11
Fund was opened up.  I called her last week, the day George Clooney held the press conference to
ask her if I can qualify for that $10,000 they announced.  Firstly, I want to say she was 
professional, which should be a given.  But it wouldn't hurt your organization to have more
compassion and kindness in the tone of your workers, since you are supposed to be a charitable
and humanitarian organization. 
     While the $10,000 would help me greatly, $41,000 would help me just break even to be
honest, since the equity loan is big, and I have proof of how much it is on paper from the bank
statements, if you need (the equity loan off the house is actually more than $41,000).  After my
mom died, my dad and I jointly made the decision to cancel his life insurance policy to put that
money into more important living expenses. So you can imagine I have many things to deal with
on my
own and help from your Sept. 11 Fund would be greatly appreciated.            had said I
might not qualify because I was not totally dependent on my dad. But he did help me with living
expenses just to help be be able to live in L.A. So I was partly dependent.
     I find it tough to look at Mayor's Guiliani's decision to open the Twin Tower Fund to just give
families of NY firefighters $100,000. For those of us who lost innocent loved ones whose only
fault was reporting to work on Sept.11th. I've have had to actively seek out help at a time when I
am just trying to get through life day by day. My dad wasn't a cop or firefighter, so he wasn't in a
brotherhood to speak out for him, as they do for themselves. It's not a question of becoming rich
from this awful tragedy I have been through, it's merely that the funding would help me deal with
debts and other hardships that I didn't even think about until Sept. 11 and just break even. It is
especially frustrating when the Sept. 11 Fund was opened up in the name of the tragedy and
supposed to help us, the victims left with this mess we have to deal with, and the American
people
wanted it to go to us. They said they are opening up $78 million of the Sept. 11 Fund. Please
contact me if you can help me with at least the $10,000 they mentioned in last week's press

compensation for ALL victims

It is unbelievable to me that some would deny compensation to victims of the terrorist attacks of September 11th because they are the companions or children of gay or lesbian couples.  What a sad commentary that intolerance and bigotry could victimize these innocent people all over again.

Please ensure that no one is excluded from compensation for this tragedy.

Exclusion of Gay &amp; Lesbian Victims on 9/11

and administering the "September 11 Victim Compensation Fund." 
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

allocated money to victims

We were extremely upset when we heard about this "quiet" act to compensate
the victims of the World Trade Center.  This is unprecedented and in
consideration of the amount of money that many of Americans sent to
different organizations to help, we are wondering why the government would
take more money out of our pockets - without our permission - to do this? 
We have heard the amount of money many are being given.

On a personal note, my husband was without a job for a year because of
cancer.   We had bills we incurred through this, not to mention the money
we lost due to his not working, which caused great hardship on us.  We gave
to those in NYC even though we didn't have a lot, but now the government is
stepping in and doing even more.  This is not a wise move in our opinion
and we feel it is wrong.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

9-11 Fund, please do not discriminate

Dear Sir,

I have recently been informed that the partners of
gay-Americans who were killed in the 9-11 terrorist
acts are not going to be receiving compensation from
the 9-11 fund.  I AM TOTALLY OUTRAGED BY THIS.  I am a
gay-American, and I contributed $100 of my money to
help ALL Americans affected, not just the ones you see
fit based upon your personal bias.  If you are willing
to overlook the laws regarding illegal aliens, then
you must overlook the biased laws regarding partners
of gay-Americans.  You cannot have it both ways; that
is simple discrimination, and is horrible given the
times we (ALL of us) face as Americans today.

In recent interviews, the head of the September 11
Victim Compensation Fund (a fund created by Congress
to help the families of those who died on September
11) has made clear that the partners of gay and
lesbian heroes of September 11 will not necessarily
receive the same benefits as the spouses of
heterosexual victims of the horrible terror attacks.  
EVEN FETUSES AND ILLEGAL ALIENS ARE COVERED!!!
Even fetuses and illegal aliens will be receiving
benefits under this problem - they've even promised to
overlook federal law and NOT arrest and kick out the
families of illegal aliens, nor will they punish
American companies that hired illegals in violation of
federal labor laws.  But when it comes to gay and
lesbian heroes of the day -              who helped
bring down the flight in Pennsylvania,             who died in the line of duty when the first tower fell, and            
who was             of the plane that crashed into the
            (there are many more) - we are told the law
is the law and no exceptions can be made.

If September 11 has taught us anything, it's that our 
patriotism and love of country transcend our

September 11 was the day that "hyphenated-Americans"
were no more, and rather than being Italian-Americans,
African-Americans or gay-Americans, we were now simply
Americans, all of us together as one American family.

Please do what is right:  distribute funds to ALL
those affected by this terrible act of hatred.  Please
do not commit a second act of hatred by discriminating
against other fellow Americans.
