Justice help all terrorist victims


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11 terrorist
attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex
unions.  They suffer just as grievously for their deceased loved ones as do
other survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups and
individuals who would have the Department of Justice limit compensation to
survivors of heterosexual unions.  They are interested in a political
victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political statement,
Mr. Zwick.

Dear Mr. Zwick

I have recently joined the " Fiancees and Domestic Partners of 911 Support
Group". Together we all face the same suffering and pain as that of a 
spouse. Our suffering is compounded even further for the lack of
recognition that we so sorely deserve.

In the September 11th attack on the WTC my fiancee, &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp , who
worked for &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp as a &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp , lost her life in the South Tower. We had
a strong loving relationship, lived together for two years, and were to be
married Oct. 13th before this horrible event took place. Since the attacks I 
have relocated from east Brunswick, New Jersey to the Chicago land area.
My life as well as others in the group has been turned upside down and inside
out as a direct result of the attacks. There are many other domestic
partners and or fiancee who have suffered the loss of their loved one in
this tragic event.

Mr. Ken Feinburg, the Special Master, indicated that he would not recognize
domestic partners or fiancee when distributing funds. In a meeting in New
Jersey, he said that he was to follow the laws of domicile when it comes
time to who will get compensated. We feel that he should recognize fiancee
and domestic partners since they do indeed make up a family unit. We also
feel that most public officials are in agreement on this point. We ask that
you support us in giving the fiancee and domestic partners the same right
to collect from the Victims Compensation Fund.

Victim's Compensation Fund

Dear Mr. Feinberg:

The following comments are in response to the interim guidelines established for the September 11th Victim Compensation Fund of 2001:

On September 11, 2001, my 21 year-old son,     was brutally murdered at the World Trade Center.  As a result, my life and the lives of my husband and other children will never be the same.  In our society, it is the right of individuals to be compensated for pain inflicted upon them by culpable parties.  In its effort to protect the airline industry, Congress essentially took away that right from me by limiting the amount of any award to insurance coverage. In return, Congress enacted legislation to compensate me for    s murder.  The interim guidelines, however, do not permit appropriate compensation.

While I agree that all families deserve the same amount of compensation for pain and suffering, the amount recommended is absolutely inappropriate and hurtful.  The amount of $250,000 minimizes the pain and suffering my son, and each of the other murdered victims, endured.  I urge you to increase the amount for pain and suffering to $2,000,000 per claim.  While no amount will fully compensate us for    s death, a significant award will acknowledge our degree of grief and loss.  

Additionally, although the interim guidelines provide for compensation to victims children, there is no mention of compensation to siblings.  My son lived at home with his parents and two sisters.  My daughters are devastated.  They are suffering as though they have lost a parent.  I urge you to acknowledge their pain by allowing additional compensation for siblings who lived in the same household with single victims.

Finally, I urge you to make the final guidelines clear and unambiguous.  Since the act of applying to the fund includes waiving ones right to pursue litigation, one must know absolutely the amount of compensation to expect in return.  The interim guidelines appear to indicate the claimants award may be determined by the claimants financial need. If this is the case, it is another travesty.  My level of financial security should have absolutely no bearing on compensation for my sons murder.

Thank you for providing this opportunity to comment on the interim guidelines.  Please consider the above recommendations in order to make this the compassionate, healing measure Congress intended.

Help same sex partners of terrorist victims


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11 terrorist
attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex unions.
They suffer just as grievously for their deceased loved ones as do other
survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups and
individuals who would have the Department of Justice limit compensation to
survivors of heterosexual unions.  They are interested in a political victory,
not humane assistance.

This Fund is intended for humane purposes; it is not a political statement, Mr.
Zwick.

I can see the Tax Payers helping all the victims of 9-11 WHO NEED help. But people die every day around us by all kinds of means and receive no help at all. Many can't afford to even put their loved ones away, they sure don't get rich or life made easy for them.
The 9-11 family members have become bellies without a bottom, they want the rainbow to go with their pot of gold. They can sell out, move, get a job and move on with life just like the rest of the World has to. Time of feeling sorry is long over, time for a big pay-day because of this is stupid and selling death.

Hello,

I have heard that you will not be giving the same reparations to families
and partners of gay and lesbian relationships. I think this is disgusting
and people like you make me ashamed to be an American. It is not your right
to judge people, but you were elected to treat them fairly, that is your
job, that is what we pay you for. Even people who are not Americans, illegal
aliens are going to be given more than these gay and lesbians...I am glad
that we are taking care of people who are not American who suffered in this
attack, but to omit or treat differently a group of people because you don't
like who they sleep with is frankly unconstitutional. Many gay and lesbian
lives were lost, many of whom fought bravely to save us from even more death
and disaster. I would think that we as Americans should embrace our
differences and have more compassion for our peers as we would the the
people we love in our own lives. I will continue to protest this and I will
make it known on my website and I will march on Washington if I have to. You
are not God, you are the government, you are acting a lot like the people
who caused this tragedy to begin with. The Taliban executed gay and
lesbians, you are acting much like they did executing their inalienable
rights, trying to make them invisible and unimportant, remember this...gays
and lesbians are a part of your community whether you like it or not, they
vote and they contribute significantly to our economy. And contrary to what
you might think no one knows the word of God, no man has the right to judge
another human being as God would, just who the hell do you think you are?
This is the meat of what revolutions are made of.

September 11 Victim Compensation Fund

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund." 
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

equal rights for gays

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

I am disgusted that my tax dollars are going to pay these people.  They do not deserve federal funds any more than anyone else who dies in a tragedy. Dear Mr. Feinberg:

In an interview with Wolf Blitzer on CNN, you were asked whether you would make the decision to enter the compensation fund if you lost a loved one in the September 11th terrorist attacks.  You hesitated before you answered.  Your first response was that you could not, try as you might, place yourself in that position.  Your final answer was that you guess - with a pause  guess you would choose to enter the fund.  This was not exactly a ringing endorsement of the fund.  We understand your hesitation.

As difficult as it may be for you to place yourself in our position, it is your responsibility and your obligation to do so. Place yourself in the position of the newly single parent who must wake up each morning and deal first with the immense and sick sense of dread and loss, the realization that another day without your loved one must be endured, and in many cases the knowledge that you will never even have the solace of burying their your loved one.  Then consider the challenge each widow or widower must face as they meet each demand placed before them that day, taking care of children who are experiencing a tremendous loss, and all of the daily responsibilities that accompany the raising of children, jobs, bills to pay, and more.  These challenges often must be faced after sleepless nights and horrible nightmares. Think of the parents who have faced the most difficult challenge any parent can, the loss of a child.  Their lives will never be the same. Consider the person who was about to get married to one who perished and whose dreams and future were dashed to the ground in seconds. Consider those who are domestic partners, who suffer the profound loss of a loved one but are also not contemplated in your program  .  

Now try to imagine how these individuals will answer the question posed to you, an attorney, when they do not have your experience or skill and when they are suffering in a most extraordinary and unrelenting way.  Their private grief is coupled with an enormous burden of public grief.  There is no relief. There is only paperwork, persistent publicity, and now the burden of appearing ungrateful, a burden which has been imposed by a government that now appears to be more concerned about protecting airlines and insurance companies than holding these bodies legally responsible for their failure to provide secure travel and freedom from this kind of tragedy.

I lost my brother, a firefighter, in this terrible attack.  I am not in the position of those described above, although my parents and my brothers fiancée are in those positions. My grief is deep and I suffer daily as I experience my own pain and observe that of my parents, my brothers fiancée, my siblings, our spouses and children.  We siblings will get nothing for our pain under your plan and I realize that it would be impossible to compensate everyone.  I also know that is our responsibility as family and as a nation, and especially your responsibility as the special master, to protect and care for these very vulnerable victims. 

You cannot abandon your responsibility by saying that you will never be able to put yourselves in the victims shoes.  As special master, you have a choice to make.  You can truly try to compensate the victims or you can hide behind rhetoric suggesting that because it is impossible for you to stand in our shoes and because  no amount of money will ever compensate for the loss of  our loved ones, that somehow you are relieved of your obligation to accomplish this task.  You have made the decision to offer victims an insulting amount for non-economic pain and suffering. You have permitted the public to be misled into thinking that all families were going to receive a substantial amount of money when this is simply not true.  You have created an untenable situation for victims who must now become active, in a time of great distress and grief, to fight for something that is clearly deserved  freedom from financial worries which are a direct result of the failure of this country to adequately protect its citizens. This rule amounts to an abandonment of your duty to provide the fair and just compensation that Congress intended to offer these victims. 

As special master, you can make a choice not to try to reduce the cost of a fund that was originally supposed to compensate 6000 victims.

As special master, you can choose to consider the true cost of raising a child beyond age 18 rather than reducing the award by consumption factors.  Realistically, most parents are financially responsible for their children through age 21.

As special master, you can choose to tell the American public and these families, by awarding appropriate economic and non-economic compensation, that these firefighters, police officers and other rescue workers are indeed national heroes and that their families will be taken care of by the government.  Otherwise, you will leave a legacy of disenchantment with public service for who would encourage their child to choose such a career when these heroes lives are so devalued?

I am an attorney and one thing is clear to me.  No one in our profession was prepared to deal with the extraordinary and catastrophic results of this type of terrorist attack and its aftermath.  That is why the American Bar Association put a moratorium on lawsuits. Highly experience lawyers were not sure how to proceed in this situation.  How, then, is the average lay person, without the benefit of legal expertise, supposed to make a decision in this situation?  As you clearly displayed by your reaction to Mr. Blitzers question, it is a terribly difficult position for a victim. 

Your job is a difficult one and I do believe you want to do the right thing.  You still have the opportunity to do so.  Please do not abandon these victims!  Make this fund a worthwhile reflection of the American spirit of generosity that was displayed by so many of our citizens.

EQUAL ACCESS TO CRISIS RELIEF

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Please don't discriminate against the Homosexual heroes that died
defending this great country.             heroics on flight 93 have been as well documented as his sexuality, yet his loved ones are to
receive less than that of an illegal alien?  This doesn't seem right. It
doesn't seem American.
This must surely be a time to unify our country. I ask that you treat
one as all and distribute the funds accordingly.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already  announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these
very important issues.

Help all victims of terrorist attack


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex
unions.  They suffer just as grievously for their deceased loved ones
as do other survivors, and their need for assistance is just as
great.

Please do not give in to the importuning of callous homophobic groups
and individuals who would have the Department of Justice limit
compensation to survivors of heterosexual unions.  They are
interested in a political victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place. 

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already  announced that they will not discriminate against
gay and lesbian families. The Department of Justice should
do the same.

very important

Why is Mr. Feinberg being a bigot?


I just heard that a very anti-American member of your staff, Kenneth
Feinberg, is planning on limiting what kind of compensation goes to gay and
lesbian victims of the September 11 terrorist attacks.  And the way the
rules read, gays and lesbians will probably get nothing.

I was sad to hear that you even had such an obviously unAmerican scumbag of
this type on your staff.  To think that there are people who would deprive
any victim of 9/11 assistance reminds me of how this country does not treat
everyone equally.

Please tell Mr. Feinberg that if indeed he plans on limiting what kind of
compensation goes to gay and lesbian victims of 9/11 he must also limit
compensation for all other Americans.  I have gay friends who are victims
and to see that the very help they need will be deprived because of bigotry
and hatred, especially in American where these victims were killed BECAUSE
THEY WERE AMERICAN.  I guess Mr. Feinberg now has the power to decide who is
"more" American than another.  It's amazing he ever got into the role he is
in, was he hired by idiots?

If he can't do that, tell him I highly suggest he go step down and let
someone American handle the job.
