This is because (1) the projected economic and non-economic loss figures are unrealistically low; and (2) the Fund reduces any award by the amount of money a victim's family receives from a "collateral source." When Congress passed the Air Transportation Safety and System Stabilization Act on September 22, 2001, it severely restricted September 11th victims' right to sue the airlines, which bear ultimate responsibility for the tragedy because of lax security procedures. In exchange for denying victims the right to sue, Congress provided the September 11th Victim Compensation Fund of 2001. The Fund is supposed to compensate the victims' families for the types of losses that would have been recoverable in a lawsuit, but without the burden and delay of litigation. The Interim Rule/Regulation also describes the intention of the law: "The Fund is designed to provide a no-fault alternative to tort litigation for individuals who were physically injured or killed as a result of the aircraft hijackings and crashes on September 11, 2001" {Interim Rule/Regulation, Summary Paragraph A.1.}. "The attached regulations have two objectives: (1) To provide fair, predictable and consistent compensation to the victims of September 11 and the families throughout the life of the program; and (2) to do so in an expedited, efficient manner without unnecessary bureaucracy and needless demands on the victims." {Interim Rule/Regulation, Supplementary Information.}. The Interim Final Rule fails to meet the intent of Congress, however, because many victims' families will net nothing after collateral source funds are subtracted from the already undervalued economic and non-economic loss projections. The Interim Final Rule understates economic loss by underestimating the lifetime earning potential of victims at all income levels. Noted economists at the National Association of Forensic Economists showed that all the Interim Final Rule uses outdated statistics and inappropriate methods to arrive at low estimates of our loved one's future earnings. An analysis done by one of these economists showed that the actual earnings growth for firefighters is 27% higher than the DOJ estimate, the actual earnings growth of all college educated workers is 30% higher than the DOJ indicates, and actual earnings growth for financial professionals is more than 100% higher than the DOJ estimate. The Interim Final Rule also falls short of Congress's goals for non-economic loss. The figure for presumed non-economic loss compensation of $250,000 plus an additional of $50,00 for the spouse and each dependent is rationalized as being roughly equivalent to the amounts received by public safety officers who were killed while on duty, or members of the military who are killed in the line of duty while serving our nation. With all due respect to such public safety officers and military personnel, they choose to go into harm's way and their loss is not the result of corporate negligence. On the other hand, the September 11 victims are victims of negligent airline security. Perhaps more realistic guidance as to the value of non-economic loss can be found in other air crash disaster awards. For Example, non-economic losses recovered in other air crash and terrorism cases commonly result in awards of between $2 million and $5 million. A more reasonable projection of non-economic loss is probably somewhere between the current proposal and the historical litigation result. The Interim Final Rule reduces and compensation awards by the amount of any funds received from collateral sources, including life insurance. The Interim Final Rule does this because Congress included such a provision in the Air Transportation Safety and System Stabilization Act. That does not make it fair; that does not make it right. In many states, the law on "the collateral source rule" has been well settled for over one hundred years. Under that rule, damages recoverable for personal injury or death, caused by the negligence of another, cannot be reduced because of compensation received by proceeds of an insurance policy. This is because the wrongdoer owes full compensation for the injuries inflicted by them and any payment by a collateral source in no way relieves the wrongdoer of their obligation. In this instance, the airlines and others at fault owe full compensation for the injuries resulting from their negligence. Any payment by a collateral source in no way relieves the airline and others at fault of their obligation. This collateral source rule, which has been a fundamental part of tort victim compensation for over a hundred years, needs to be incorporated into the September 11 Victim Compensation Fund. The Interim Final Rule needs to be adjusted to provide fair, balanced and acceptable economic and non-economic loss projections. The economic loss charts need to be increased and expanded depending upon the deceased's job field. The non-economic loss amounts also need to be increased into a range that accounts for the tragic way in which these innocent victims dies and the shattered lives they left behind. Collateral source recoveries need to be excluded from consideration by the Fund. Without these changes, the intent of Congress will not be fulfilled because there will be no reason for many of the September 11 victim families to participate in the Fund. Without these changes, it will be better for many victim families to take a chance at litigation rather than sign on to a Fund through which they will receive nothing but a waiver of their right to sue. Please rectify these inequities. Give the victim families a reason to participate in this Fund rather than litigate. Change the Interim Final Rule to provide economic and non-economic amounts at fair, balanced and acceptable levels; do not offset Fund awards by collateral source recoveries; establish a fair appeal process. Finally, please include the specific calculation formulas, statistics and assumptions within the rule or the explanatory materials. Saturday, March 16, 2002 12:26 AM Fw: Sept 11 fund discrimination I am concerned about apparent efforts by homosexuals to try and reap inappropriate political benefit from the tragedy of Sept. 11. In particular, I'm referring to their belief that friends/partners of homosexuals who died in the plane crashes should receive compensation. Why should live-in friends of homosexuals who died be given special consideration? To do so would be discriminating against heterosexuals. Just because homosexuals live together doesn't make them special, just as two heterosexual friends who might choose to live together aren't special. Homosexuals who live together and call themselves partners should not be given consideration above and beyond that given to heterosexuals -- be they male or female -- who choose to live together without the benefit of marriage. I'm all for treating homosexuals as heterosexuals are treated. However, to give homosexuals special treatment is discriminating against heterosexuals. Therefore, it would be completely wrong and would open the government to class action lawsuits to compensate any friend a homosexual victim leaves behind, without also compensating any friend a heterosexual victim leaves behind. Please don't allow militant homosexuals to succeed in their twisted and politically self-serving efforts to equate lack of monetary support for friends homosexual victims leave behind with supposed discrimination against the homosexuals who died that day. The Special Master should have been at my house this Tuesday when the police informed me that the "remains" of my husband had been identified through DNA. The "remains" consisted of a piece of his skull. There is no monetary award that will replace my husband, but my children should NEVER want for anything for the rest of their lives. It would be unkind and unfair not to include life time partners in the same plans as married spouses of straight people. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Pataki and Attorney General Eliot Spitzer today announced the filing of formal objections to the federal regulations governing the September 11th Victims Compensation Fund. The objections note that the regulations unfairly exclude many victims from participating in the fund, provide inadequate compensation to other victims and contain numerous other, important flaws. Last week the Governor and Attorney General participated at a family rally to gather comments on the proposed compensation plan from family organizations representing survivors of the thousands of victims killed in the September 11 terrorist attacks. The objections were submitted to the U.S. Department of Justice (DOJ) and Special Master Kenneth Feinberg, who is considering possible changes to the regulations. "The interim regulations prevent many victims of the September 11 attacks from receiving the full and fair compensation they were promised by Congress," Governor Pataki said. "I urge the Special Master to listen carefully to the families and make changes to his plan so the loved ones of those who died on September 11 are treated fairly. "We have all been inspired by the courage of the families of those who died and we will continue to stand with them and do everything we can to support them," the Governor said. Attorney General Spitzer said, "Simply stated, the interim regulations violate federal law. Undocumented aliens, domestic partners of the deceased, and individuals who were injured in the September 11th attacks are just three of the many groups who are effectively excluded from the compensation fund, despite the clear intent of Congress that all victims and their families should receive benefits. There is no legal basis for many of the provisions in the regulations, and they must be amended. "Since September 11th, we have been fighting on behalf of all of the victims and their family members, not just those in New York, but throughout the country," Spitzer added. "If allowed to stand, these regulations will perpetuate the tremendous hardships that these devastated families are now experiencing. We will not rest until these regulations are changed and all the victims and their families are allowed to seek full and fair compensation from the fund." The following is a list of the most significant changes to the regulations recommended by Governor Pataki and Attorney General Spitzer: SUMMARY OF PROPOSED CHANGES TO VICTIM COMPENSATION FUND REGULATIONS 1.. Allow all injured victims to apply for benefits. The current regulations require injured victims to prove that they are disabled. Many victims who suffered significant injuries have continued to work in order to support their families, and thus cannot meet this stringent definition. The regulations must be changes to permit all injured victims to file claims, including those who continued to work despite their injuries. 2.. Eliminate the requirement for contemporaneous medical records. Many injured victims are not eligible for compensation because they were treated at emergency triage locations, and thus cannot submit "contemporaneous" medical records as required by the regulations. These victims should be allowed to file claims and submit other documentation proving their injuries and the treatment they received. 3.. Eliminate the requirement that injured victims seek medical care within 24 hours. The first priority of many injured victims was to reunite with their families, and many did not seek medical treatment until September 12th or thereafter. Similarly, many firefighters, police officers and other emergency personnel continued for days to search for victims at the site, despite injuries that they sustained. The requirement for medical treatment within 24 hours must be eliminated to allow all of these individuals to file claims. 4.. Prohibit the INS from using claim information in deportation proceedings. The Department of Justice oversees both the victim compensation fund and the Immigration and Naturalization Service (INS). As a result, undocumented aliens -- including both injured victims and the families of deceased immigrants -- are understandably afraid that if they file a compensation claim with the Special Master, the information will be provided to INS and will result in deportation proceedings. The regulations therefore must contain a confidentiality provision that prohibits the INS from using claim information in deportation proceedings. 5.. Ensure that domestic partners are eligible for compensation. Many of the victims had fiancés, domestic partners, or were in other committed relationships, and the regulations must clarify that these individuals are eligible for compensation. 6.. Advise claimants of their expected award before requiring a waiver of legal rights. Under the current regulations, victims and their families are forced to waive their right to commence litigation as soon as their claim is deemed "substantially complete." Unfortunately, they may later learn that they were not eligible to file a claim, or that they will receive only a minimal award. This is particularly true for the families of police officers, firefighters and other emergency personnel, whose awards will be substantially reduced by "collateral source" payments. Congress intended the claim process to be a viable alternative to litigation, not a "trap for the unwary" in which unsuspecting victims are induced to file claims and waive their legal rights, and then receive little or nothing in return. The regulations must ensure that claimants receive notice of the expected compensation, so that they can make informed decisions about whether to waive the right to sue. 7.. Allow victims to prove their individualized losses. The federal law requires the Special Master to make awards based upon the "individual circumstances" of the claim. The regulations, in contrast, create "presumed awards" and prevent victims from receiving more than those predetermined amounts unless they can prove "extraordinary circumstances." These unwarranted limits on recoveries must be eliminated. 8.. Eliminate the 2-hour time limit on hearings. The federal law provides victims and their families with the right to have a hearing, including the presentation of witnesses. The regulations, however, place an unwarranted 2-hour time limit on hearings. It is appalling that the Special Master is giving spouses and other family members of those killed in the September 11th attacks a mere 2 hours to explain the emotional, physical and financial impact of the loss of their loved ones. This 2-hour time limit must be removed. 9.. The presumed awards for non-economic damages are too low. The DOJ regulations determine -- before hearing any evidence from any victim -- that all individuals killed in the attacks are presumed to have suffered exactly $250,000 in non-economic losses. In addition to failing to consider the individual circumstances of the victims, this amount is clearly too low to fairly compensate victims for their physical pain, emotional anguish, disfigurement, loss of companionship, loss of enjoyment of life, and other non-monetary losses. The amount should at least be doubled, and families of victims should be allowed to prove their individual non-economic damages. 10.. Charitable contributions should not reduce the amount of compensation. The regulations give the Special Master the authority to reduce an award by the amount of charitable contributions received. When the American people donated to charity in response to the September 11th attacks, they intended those funds to benefit the victims, not the federal treasury. The regulations must make clear that charitable payments, including those made by New York State's World Trade Center Relief Fund, should never be used to reduce awards to victims. 11.. Collateral source payments should offset only related losses. The regulations reduce awards by the amount of collateral compensation that the claimant has received, even if the collateral compensation was unrelated to the damages for which recovery is sought. For example, Congress made clear that victims of the September 11th attacks should be compensated for both economic and non-economic losses. Pension benefits, life insurance and other "collateral source" payments are intended only to cover economic losses, and thus should not be used to reduce the non-economic portion of the award to the victim. 12.. Authorize appeals of compensation awards. The regulations do not provide any mechanism for appealing compensation awards, even if the award is unconscionably low and clearly contrary to the weight of the evidence. I am 55 and retired early to stay home to take care of my mother who is legally blind and frail. We sent in $50 to the Salvation Army as soon as 9/11 occurred. After hearing the families of the victims decrying the outcome of the financial remuneration that they are going to receive, it makes my blood boil and we will most certainly never ever send a dime to any victim's fund anymore. The outright greed of these people is unbelievable. I don't expect anyone to take care of me for the rest of my life.
