September 11th Fund


If what I have just read regarding same-sex partners of gay men and women
that died in the September 11th not being eligible for benefits (the same
benefits that are being extended to illegal immigrants mind you!)is true,
then as an American citizen I am appalled and disgusted by my government
allowing such a horrible mistake to be made. It can not be possible that we
as a country have learned nothing about love and acceptance after this
horrendous tragedy.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

important issues.

I strongly urge you to provide benefits to all Ameican families who lost a
loved-one as a result of the 9/11 catastrophe. This includes gay and lesbian
americans. 

To not provide this group's children and spouses with benefits would be
immoral and simply a terrible thing to do. They love each other just as any
other couple or child loves a loved-one. If you do not, I will do everything
in my power to publicize this terrible injustice and how the Bush

To the Attorney General, 

Sir, I am very grateful for the kindness and compassion which you expressed to me at our recent meeting at the Cathedral of the Holy Cross at the conclusion of the Red Mass in Boston. I have related to my family, and many others your personal, warm and moving expression of support and condolence which is very helpful to all of us in dealing with this tragic event.

To the other Justice Department officials involved,

     We are the widower and stepfather of September 11th terrorist attack victim            ,
a 41-year-old wife and mother of two young daughters.              was a passenger on American Airlines            , en route to Los Angeles on a business trip along with six coworkers. We are writing today to
comment on the rules and regulations being drafted for the U.S. Victim Compensation Fund.

     First let us say that we are grateful to Congress for creating the Fund, and to all of the people at the
U.S. Justice Department for their hard work in drafting the Fund's regulations.  The Fund's existence is a
great comfort to us and our family.  

     Nothing could ever replace            .             children have lost the loving, caring relationship and the guidance that she was able to provide her 3 1/2 and 7 year-old daughters.             mother wakes up each morning not being able to believe that she can no longer talk to her beautiful baby.

               was a significant contributor to the income of the household.  Though no amount of money could make up for what has happened, hopefully the Fund will be able to provide             children and family with the long-term financial security they lost when             was killed.  

     We believe there are two things that could help ensure the Fund gives our family their full security: individual consideration of claims and a prohibition on deducting charitable contributions from claim awards.

Individual Consideration of Claims:

               was an individual; she was a human being and had very unique characteristics, as did all the
individuals who were lost.  Each family has different economic losses related to the tragedy.  It is only fair for all of these circumstances to be considered when deciding on a claim.  

     We understand that the people administering the Fund have a limited time to hear cases. We are told, however, that there are ways to make the hearing process streamlined, yet still individualized.  We ask that you make every effort to do so.

     Families deserve to have their individual circumstances heard, and to have their losses fully and individually compensated, as Congress has promised.             , and of course, each of the victims, had special and different relationships with their spouse, children, parents, friends and communities, and to chart or otherwise depersonalize these relationships would be an affront.  Please do not reduce the realities of families' terrible losses to a "grid" or "matrix" system that does not take the merits of every case, and the devastating losses of every family, into account.

Charitable Gifts Should Not Be Subtracted:

     Please do not allow charitable gifts to be subtracted from Fund awards.  People gave those charitable gifts in order to help our family and others in an emergency situation.  There is no reason our family, or any other victim's family, should be penalized for the American public's generosity.  It is hard to believe that any donor intended that their gifts be used to subsidize the Fund.

     The compensation the Fund provides is supposed to ensure the future of             children and the families of others who have suffered irreparable losses. Reducing that compensation will have a direct affect on             children's lives and the lives of thousands of other children.  There is no reason that these children should be shortchanged any more than they have been already. 

     In addition, this is not money our family would have received under the Fund anyway.  Charitable gifts have covered short-term expenses that the Fund was not designed to cover   like the costs associated with family members' time lost at work due to the tragedy.  

     One last note: We hope that arrangements will be made for hearings to be held in many cities throughout the U.S. so that victims are not burdened with the costs of travel.

     We thank you for taking the time to consider our thoughts on these matters.  The job you are doing is extremely important   for victims, their families, and our nation.

Use of Structured Settlements on Behalf of Victims

A large percentage of victims of personal bodily injury and/or dependent 
families of decedants in personal injury litigation today take advantage of 
the opportunity to have a "structured settlement" pursuant to Section 
104(a)2 of the Internal Revenue Code.
The structure allows a portion of the cash settlement which they might 
otherwise receive to be made to a life insurance company which provides 
either lifetime monthly payments or more complex "structures" of payments 
including college funds and retirement funds.  Many major life companies 
offer these type of contracts.  The United States already offers such 
payment plans to victims of Vaccine Injuries and many Americans who may have 
been injured by alleged negligence of United States employees.  The Torts 
Branch of the Department of Justice is very familiary with these plans and 
their use to the benefit of the families involved.  A comprehensive approach 
to the victims of 9-11 should include such plans

Please Support Equal Access to Crisis Relief for Same Sex
Partners

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Not providing gays and lesbians the full benefits of
others affected by 9/11 is an outrageous display of
bigotry and hatred.  "United We Stand"??...isn't that
supposed to include ALL Americans?  You should be
ashamed to use this horrendous tradegy as another way

Please assure equal access to crisi belief benefits for surviving gay and lesbian partners

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Hello,


I am so saddened by most of the victims survivor, stories. I hope my voice is heard.  My family donates to the victim~survivor fund regularly, including things like Burger King!  We are not wealthy, but to me, what's $1.00 at each trip to my daughter's favorite fast food restaurant!  My opinion, is that regardless of income, life insurance policies, etc., the people in our country gave money to help the families, regardless of anything else!  Please give equally!  Somehow, there must be a way!  Noone's family, in this tradgedy should have a price tag put on thier lives!  People need to apply by certain dates.   But after so many months, split the whole pot between them!  Our country was generous!  This is USA!  Share it fairly!

Gay Benefits...


To Whom It May Concern:

I am reacting to Kenneth Feinberg's comments on "Meet the Press" as reported on About.com in regards to the distribution of benefits to gay and lesbian persons.

I would like to think that all benefits paid from this fund would disregard any nationality, religion, race, gender or sexual preference.  Surely compassion for the victims families in the wake of heroism is greater than any existing law, national or state?

Gay and Lesbian Citizens - September 11 Fund


To Whom It May Concern:

I am appalled that our "just" government is once again targeting gay and
lesbian citizens, this time the survivors and families of 9/11.  How could
they possibly be anything less than equal in the eyes of God?

I donated to a 9/11 fund, the one that was advertised on television with all
the musicians last fall.  Let me say this:  I gave from the bottom of my
heart and pocket book so that the terrible pain and loss of this event can
be soothed.  No one mentioned anything about discrimination; they were just
more than happy to take my money for the good of ALL.

I do not know if this is the same fund, but it really doesn't matter.  As a
taxpaying, law abiding citizen of these United States I implore you to do
the right thing and give equally among all those in need.  Do not dare to do
anything but that with my money.  If the individual States have a hard time
with that, well maybe it's time for them to begin recognizing ALL people as
being equal.

How is the world ever to be "righted" when racism and discrimination are
still running rampant in our own society.  It's time to wake up and realize
that we are all in this together - gay, straight, black, yellow or white.
Without diversity this would be a sad and lonely Earth.

Dear Mr. Zwick:
My comments  relate to the implications of the two paragraphs copied below.
It is in the best interest of the victims families that compensation be
disbursed on the basis of objective, equitable formulas that take into the
number and ages of dependents, future educational expenses for children, and
regional costs of living.  The data the go into these determinations, and the
presumptive awards, should definitely be communicated to the families to aid in
their decisions to file.  Knowledge is empowering, secrecy is demoralizing.  (An
unfortunate side effect is that  speculation about these figures by the media
tends to generates much unwanted "advice" and in some cases "envy" directed
toward the families)   

My husband worked for the             for 17 years, rising to
the rank of Lieutenant of             .  We have
two young children, and I also work full-time.  My husband's salary as a civil
servant was modest, and he needed to work a second job to supplement our incomes
in order to live in the New York City area (we reside in the Bronx).  Despite
his low salary, he took great comfort in knowing that his benefits were
outstanding.  He paid the maximum into optional life insurance, deferred
compensation retirement, and disability programs.  He planned very well "for the
future," with the knowledge that something adverse could happen to him.

I am very concerned that compensation from "collateral sources" that my husband
procured on our behalf, through the very hazardous nature of his work and good
financial  planning, will be subtracted from funds awarded to our family.  My
children are 6 and 8, and there is a long road ahead of us with unforeseeable
expenses.  I expect all families to be treated fairly, and not penalized for
benefits they earned prior to the tragic events of September 11.

Topic #6: Nature and Amount of Compensation. 
Section 405(b) of the statute indicates that the Special Master shall determine
the amount of compensation based on "the harm to the claimant, the facts of the
claim, and the individual circumstances of the claimant." Yet each of the
perhaps thousands of determinations must be made in a very short period of time.
Moreover, such determinations should be founded on consistent and clear
principles that treat each claimant fairly. The Department invites comments that
identify the practical means to achieve these results all within the very short
time period that Congress has permitted. Among other topics, the Department
would welcome comment on whether and how schedules or statistical methodologies
should be developed and used in reaching a determination for each claimant
within the mandated time period. In addition, comments are welcomed on whether
publication of such schedules or hypothetical or presumptive awards for classes
of individuals would assist potential claimants in determining whether to file. 


Collateral Sources: Section 405(b)(6) provides that the Special Master shall
reduce the amount of compensation by the amount of the collateral source
compensation the claimant has received or is entitled to receive as a result of
the terrorist-related aircraft crashes of September 11, 2001. The Department
invites comments on how to determine what constitutes a "collateral source" for
purposes of this provision, and other related issues. For example, the
Department appreciates the strong policy reasons for excluding charitable
contributions from the definition of "collateral sources" and invites comment
regarding whether the Act indeed permits the Department to exclude such
contributions from the definition. Similarly, the Department invites comments on
whether "in kind" and/or material contributions could or should be considered
collateral sources. Finally, the Department invites comments on how to determine
whether potential future collateral source payments are ones that individuals
are "entitled to receive" for purposes of Section 405(b)(6).

This is so wrong!  Why should the victims families receive any type of compensation?  I am enraged!   Would my family receive any compensation if I, Joe nobody, were killed in a tragedy in my small town?  My death would be just as traumatic to them.  What happened on Sept.  11, is a tragedy, but any death is a tragedy to any surviving family member.  I cannot justify my tax dollars being spent to compensate these survivors up to several million dollars each.  I realize this e-mail will have no effect of what is happening, but nevertheless, I am still against it.

Fund payments for lesbians and gays


I am shocked and distressed to hear of the Fund's cop-out regarding making 
payments to the families of lesbian, gay, bisexual and transgendered people 
killed or injured in the terrible events of September 11

Please review your stance and find a way to make sure that the families of 
these people are not double punished.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year
might receive thousands of times as much compensation as the survivors of a dishwasher in one of the
restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth
of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would
be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer
money went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because
the option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

very important issues.

The Victim Compensation Fund


I am outraged that gay and lesbian partners of those who died on September 11 are not automatically going to receive the same benefits as heterosexual spouses!  FETUSES and ILLEGAL ALIENS are covered!!  When it comes to gay and lesbian heroes of the day,           ,            and           , to mention three although there are many more, we are told that no exceptions can be made.  An exception is being made for the families of illegal aliens.  In addition, American companies that hired illegal aliens, in violation of federal law, have been exempted from prosecution!  Once again, selective discrimination is sponsored by our government.  We must compensate every family who lost a gay and/or lesbian loved one, whether they are gay or not.  The Department of Justice must take the correct position and not become involved in supporting this outrageous policy.

Comment to Interim Rule

Dear Mr Kenneth Zwick,

I am writing to you on behalf of a friend whose
husband died in the attack on the World Trade Center. 
He was one of the many whose access route out of the
building was cut off after the aircraft crashed into
the floors below where he worked at WTC 1.

1) Please ensure that there are no caps on earnings or
the awards issued.  Her husband worked hard to achieve
where he got and his accomplishments should not be
belittled.

2) Give due consideration to earnings made in 2001 in
your calculation of the award.  This can be
extrapolated from the 9 months of salary actually
earned.  Her husband, like most of the victims, was
young and just reaching the prime of his career.  
2001 earnings would be more indicative of his salary
going forward. 

3) Where possible minimize or eliminate collateral
source deductions.  For example, the future stream of
social security payments terminates once a spouse
starts working.  This outcome may be inevitable given
the size of current presumptive awards.

4) Compensate adequately for a victims childs
economic and non-economic loss.  It should be noted
that just deducting social security payments received
by one of her children, the combined economic and
non-economic award attributable to that child would be
more than eliminated, i.e. the child will owe the
government money. 

5) If it is at all possible, provide a fairer
non-economic loss amount.  The amount that is
currently offered does not begin to take into account
the immeasurable pain and suffering endured by my
friend, her late husband and her children.

6) Finally, make the compensation amount known to
families prior to requiring them to waive their rights
to sue.

The government in passing legislation after the event
has limited the ability of families to seek redress
from airlines and other potential defendants.  As
such, please meet your obligations to these victims
families and compensate them fairly for lives that
were devastated on September 11.

Compensation for 9-11 victims

I am horrified, outraged, and ashamed to learn that the U.S. government is
planning to withhold compensation for the domestic partners of homosexual
victims of the 9-11 terrorist attacks.  Did the gay and lesbian victims of
9-11 suffer any less than heterosexual victims in the final minutes of their
lives?  Do their surviving partners experience any less grief, or economic
loss, than the family members of heterosexual victims?  Is the U.S. Dept. of
Justice so completely callow and so rigid in its heterosexist morality that
it will refuse to treat all the victims of this tragedy equally?

As an American citizen, and a person of conscience, I demand that the DOJ
treat all surviving spouses and domestic partners equally in its
compensation plan.  To do otherwise is to make a mockery of justice.

September 11th Fund

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.
