Monday, November 05, 2001 6:03 PM Victims Fund Being as this fund was set up to avoid litigation against airlines and other entities, I believe the following should be considered for each case: If the intent of this fund is to prevent litigation then you will need to pay a large sum to the families. I would suggest researching amounts won by survivor's of airplane crashes and terrorist acts in the past five years. You could contact any member of the Products Liability division of Perkins Coie, LLC in Washington, DC or even in Seattle for this information. Everyone hurts after losing someone in their family. Everyone who lost someone lost them the same way. Everyone is enduring a loss committed with criminal intent. For these reasons I believe a base amount of compensation should be set. At least three million dollars for each victim should be put into a trust fund and/or annuity to be given to family members. Any good accutuary and accountant team could come up with a formula that would provide continued support for the family into the future. Also this could benefit children of the victims. Then look at other donations the family received. If the family received no other monies then they would be entitled to another amount in addition to the million dollars. However, I believe that many people have received funding from pensions, insurance policies, charities, etc. If monetary support has come from the victim's family that should not be included in determining further amounts. I ask you to consider my points regarding the september 11th relief funds. Atrocious amounts of people were killed on September 11th. Many of these people had families for which they cared for and had families that could not survive without them. The loss of a mother or father, husband or wife, is emotionally crippling. Such a loss could cause a person to not be able to go back to their job. Furthermore, the loss of that income is another economic blow to a family. Families that have lost a parent, or worse both parents, cannot go on without financial compensation. It is not only married families that need help, however. There were many gay and lesbian people killed in the attacks. The gay and lesbian people that have seeked compensation have recieved mixed results in recieving them. The State of New York has already adopted a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." These gay and lesbian people in most cases did not have a legal marriage, for homosexual unions are not granted in most states. This does not mean, however, that they were not economically and emotionally effected by the attacks. They loved the people they lost just as much as a husband loves his wife and a child loves his parents, if not more. These people should not be overlooked due to the legality of their relationship, but their relationship hould be observed and respected as equal to a heterosexual union. The emotional and financial losses that they recieved were no less than that of a married couple's, and this can not go ignored. He was a senior vice president of technology for , a subsidiary of . My husband was 39 years old. We have one child, our daughter who turned 10 years old on Sept. 22. Because of the salary cap imposed by the Special Master, which does not even match my husband's base salary, let alone allow for bonus and other benefits, and because of the generous insurance policies of and &nbsp&nbsp&nbsp&nbsp , I and our daughter will receive nothing from the income compensation portion of the fund if the fund remains as currently structured. I am older than my husband (I am 48), have worked only part time in recent years for an hourly wage in a much less in-demand field and as such my earning potential is much much lower than his. I had understood that Congress' intent was to as much as possible, and within reason, try to maintain the economic level which existed before the attacks. In my case, if the restrictions remain as they currently are written, our economic level will in no way be reflective of my husband's support. I plead with you to raise the annual salary cap for calculating the economic portion of the award to at least twice the current level and to not deduct insurance and other benefit payments. I am appalled that this tragedy is being used by members of the far right to forward an agenda. Sunday, December 23, 2001 5:51 PM Compensation Fund My son was a victim of the attacks. He was 30 and single. He worked for &nbsp&nbsp&nbsp&nbsp. The assumptions in the table for his lifetime income are way to low. For some of the other class of victims, you may be forcing them to make a poor financial decision because they need the money immediately to survive. It seems that you have set the matrix low on purpose in an effort to save the American taxpayers money. Judging by the amount of money the American people donated to relief agencies, you have made a gross error on their desires. This was not the tone of the bill that Congress passed. The non-economic awards of $250,000 are pitiful. The emergency workers have already gotten $250,000 from the Department of Justice, so they get to double dip, so to speak. Remember, the emergency workers know their risk when they pursue their careers in public service. The civilians just went to work on September 11th to support their families. They were also taxpayers supporting the emergiency workers. The civilians, under normal circumstances, would all file wrongful death suits and the amounts awarded would be far greater. Think if there were only 300 victims instead of 3000. You would have to agree that the amount set is way to low. I realize we can all request hearings. You have set the plan up to encourage hearings and that will result in 3000 hearings over a two year period. That is 6 hearings a day, at 2 hours a hearing, 12 hours of hearings a day for 2 years. That is clearly not the intention of the act. I would hope, over the next several weeks, you would reconsider your matrix and your non-economic awards. Once figures have been set to paper, there will be a reluctance by judges to deviate from those numbers. It is like a departmental budget awarding 5% raises to everyone. Everyone may not deserve a raise and some people may deserve more. Those that do not deserve a raise will not get it, but those that deserve more will not be given an additional share so the departmental budget will come in under projections. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." By many eyewitness accounts of surviving coworkers, she stepped out of her role as an administrative assistant to help evacuate them by, keeping calm and order, directing them to stairwells and holding the stairwell door open for them to pass through. Would she have survived if she hadn't stopped to help others? We'll never know. Was she a hero? I'd like to believe that she was. But we do know that my sister, along with thousands of others, were innocent victims who lost their lives in the most diabolical and violent attack on the American mainland in this country's history. There is no doubt that she and her coworkers experienced unthinkable horror before their deaths - our family fears, but dare not speak of, the pain &nbsp&nbsp&nbsp&nbsp may have suffered. To date her body has not been recovered. I have been informed by &nbsp&nbsp&nbsp&nbsp who promised to determine for the families what happened to their loved ones that they will not "engage in any exercise" to recreate the events in Tower Two. Will I ever know? I am in agony over this. I witnessed it on television live. So my father lost his eldest child and his three surviving children lost a sister - and we are all trying to be brave for each other. Although our family has come together as a result of losing &nbsp&nbsp&nbsp&nbsp , the fabric of our family, what we hold dearest to our being, has been torn apart forever. Only those who lost a loved one that day truly understand, the rest of you are left to comfort us and to fear that this may happen again. Our pain is not limited to losing &nbsp&nbsp&nbsp&nbsp . We are bonded forever with the families of the other victims of this senseless tragedy through pain. Our hearts go out to all of them. And as Americans, we are all outraged. Indeed, the American people have responded to this outrage with both a renewed sense of nationalism, and empathy for the victims and the survivors as expressed in the form of generous donations to charities and funds. We are extremely grateful to and humbled by all who have done so. But my father has received very little monies from charities or from these funds. You advised us not to worry. There would be a federal Victim's Compensation Fund to assist my father in not "begging" from charity and not having face the emotional pain of going through the legal system. Yet it now appears that my father may receive ZERO compensation from this Fund due to its overall design, especially, the insurance offset rules. I do not believe that the Government of our great nation, including both of you, intended that my father or any other families of the innocent victims of this terrible tragedy, receive ZERO compensation. I had always believed that this Fund was established to protect the Airline industry including limiting tort liability yet provide meaningful compensation to victims as part of a national response to the terrorist attacks that is reflective of litigated/settled tort claim outcomes. Unfortunately media coverage of this issue has painted the families in a negative light. I am concerned that the families have lost confidence in this Fund because of the Whitehouse's silence to the families' outcries for help and to the Special Master's limited response to the families' comments to date. With all due respects to both of you, please consider revising the proposed Fund to eliminate the insurance offsets, not include charitable offsets, eliminate vague discretion that is hurtful to families outcomes e.g. review on a case by case basis, increase the non-economic compensation and replace the formulaic tables to be reflective of more current data. In other words, reshape the Victims Compensation Fund to make it attractive to the families to want to take it and know that they are being treated fairly. Hopefully, this can be done in a manner in which both sides can save face, find a win/win solution and show the rest of the world that America cares for its people. This internal conflict sends a poor message to the rest of the world that at its heart Americans are "greedy" and only enhances sympathies for the terrorists claims and actions. It has been awful for all of us. In conclusion, this is the worst letter I have ever had to write. I am heartbroken beyond any definition of that word I knew or believe to have understood before. This letter is about the memory of my sister, &nbsp&nbsp&nbsp&nbsp . She was the kindest, gentlest woman a person could know. She was my only sister. Kenneth Feinberg says partners of gay and lesbian victims will be eligible only if their state recognizes their same-sex unions. Fat chance of a lot of that happening. Has Mr. Feinberg ever been to Mississippi, Alabama, Georgia, Texas, Utah or Wyoming? We can die like others and we can suffer, endure pain and loss like others.
