Serious Concerns with Fund's Rules

   

To Kenneth R. Feinberg,

I am writing on behalf of my sister,    , whose husband
    was killed in the World Trade Center on September 11th.
Like many others     worked as a     at     on the
    floor.      now has three small children ages 3, 5, and 7 to care
for and support alone.  I am writing to express my serious concerns and
objections to the Department of Justice's (DOJ) "Interim Final Regulations
Governing Payments Under the September 11th Victim Compensation Fund."

I have read the letter that Congressman Marty Meehan sent to you on behalf
of the victims.  I couldn't voice my concerns and objections any better than
he did in his letter.  I urge you to strongly consider his objections and
recommendations.

Specifically I believe it is important to establish a substantial meaningful
minimum that all victims will receive.  The figure of $250,000 per person
for non-economic damages is completely unacceptable and sends a statement to
the victims that their losses are not valued in either a legal or humane
way.  I also want to voice my concern and bewilderment regarding why you
have capped the incomes to be used in the calculations at $231,000.  I have
read and re-read the original bill and I can't find anything in it that
required this type of cap on economic losses.  I can only assume that this
limit was set to appease those who object to the "government supporting
these people."  Those who have this view need to be reminded that this bill
was put in place primarily to protect the airlines and secondarily to
address the fact that the victims would have no recourse to sue for just
compensation.  Please do not give into this pressure of public opinion.  All
of these families are entitled to be compensated for the full extent of
their economic and non-economic losses since they really have no other
recourse at this point.

I realize that you have a tremendously difficult job to do in balancing
everyone's needs and concerns.  However, I urge you to do the very best that
you can on behalf of all the victims.  I have seen first hand how painful
their situations are and how much they want to move on with their lives.
However, they have a lifetime in front of them in which they must support
their families that will need tremendous care and attention for years to
come.  By fairly and fully compensating them for non-economic and economic
losses, they can move on with the rest of their lives.

The deaths on September 11th were the result of an attack on America. 
Please do not discriminate against the unmarried partners of September 11th

Excluding gay family members?

Dear sirs,

When I learned of the utter hypocrisy being practiced by the September 11th 
fund in refusing (I think you are calling it "limiting") compensation to the 
partners of gay victims, I was very disappointed in my country.  What 
disturbs me most is not only the fact that gay relationships and gay 
partners are being discriminated against - that has been going on for quite 
a long time - but rather that the reasons for doing so are being asserted on 
a legal basis.  Since gay relationships aren't recognized by federal law, 
they cannot be included in a federal compensation fund.  By this logic, 
however, since illegal immigrants are not even recognized as citizens of 
this country under federal law, they too should not receive compensation 
from a government fund.  Furthermore, since unborn children do not even 
exist yet, and it is often unsure if a fetus will survive to birth, they 
should not be counted as family members at all, and therefore not receive 
compensation either.  Surprisingly, the latter two categories of people are 
included in the victims' compensation fund.  Regular, law abiding, American 
citizens who are gay, on the other hand, are being completely ignored.  It 
is clear that their suffering is at least equal to that of illegal immigrant 
families and unborn fetuses, but the fund chooses not to recognize this.

The main problem with homosexual discrimination in the US is that it is 
constantly denied and camouflaged behind legal terms and the "official" 
definition of a "spouse."  The case of the 9/11 fund's discrimination is so 
clearly an example of hypocrisy that it makes me ashamed of my country.  As 
an American, I believe in our country and I love the opportunities it 
provides, but I cringe at the fact that we carry out wars to "liberate" 
countries like Afghanistan and Iraq from repressive regimes while we at home 
restrict the freedom, liberty, and rights of a significant portion of our 
own population.

September 11th was indeed a turning point for the "American identity" and an 
opportunity to move forward toward true unity and solidarity.  It is just a 
shame to see an institution directly associated with that turning point, the 
9-11 fund, contributing to the emotional, legal, social, and psychological 
division of the American people.  I thought we had moved beyond such 
divisive practices.

equal treatment

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Help all victims of terrorist attack


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11 terrorist
attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex unions.
They suffer just as grievously for their deceased loved ones as do other
survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups and
individuals who would have the Department of Justice limit compensation to
survivors of heterosexual unions.  They are interested in a political victory,
not humane assistance.

This Fund is intended for humane purposes; it is not a political statement, Mr.
Zwick.

The 9/11 Fund and Gays

The 9/11 Fund should be for the closest relation or companion of those who
sacrificed in that horrific period, regardless of sexual orientation. Just
as generously extending compensation to illegal aliens' families is an
appropriate liberal act, providing compensation to 'significant others' is
no less reasonable, and should be done. Fair to one must be fair to all,

Is it true?


Is it true that you are going to discriminate against gay partners of the 
deceased victims of 9/11 because of certain state laws?  Shame on you.  9/11 
happened to the entire world because of  misguided religious discrimination 
by fanatics.  You are continuing the discrimination on a different level but 
bottom line is that it is still discrimination. Didn't you learn anything?  
Isn't it time this all stopped? There is no precedence for what happened to 
us and therefore there should be no precedence for how the monies are 
allocated other than the fact that EVERY victim's loved ones should receive 
compensation.  Love has absolutely no boundaries.  It does not discriminate 
nor does it follow state rules.

9/11 Victims Relief Fund - Fair distribution


December  19, 2001

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Inadequacy/ injustice of current fund

     I am deeply disappointed by the current fund guidelines.  My brother, &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp , was murdered in this horrific attack on the WTC on Sept.11.  I feel that your current limits are  an inadequate underestimation of both the economic and non-economic lossses his family will experience.
     First, I feel that reducing the compensation by insurance premiums trivializes the prudent investments these hard-working victims made to provide for their families.  Taking this investment from them is victimizing them yet one more time in their deaths.  It undermines our society's work ethics of industriousness and  responsibility in that it  penalizes the victims for choosing to provide for their families with life insurance.  
     Second, reducing their compensation by Social Security payments once again penalizes the victims for being hard-working, dedicated citizens.  My brother had been paying into Social Security since he was a young teenager. The cumulative investments into this system by he and his employers are sizable.  To take this investment from him makes a mockery of the system and essentially deprives him of his rightful investment.  If the fund were still to implement this policy, it should at least compensate for the entire contributions  made by the victims and their employers into Social Security.
     Third, it is unfair to choose a three year salary average to determine future projected earnings.  This fails to recognize recent promotions and concomitant salary increases.  I could understand your using an averaging of salaries when commissions are involved, but for those victims who had a predetermined salary (and bonus), you are once again penalizing them in death for having lived the American ideals of working hard and getting ahead in life.  Oh that they had lived to continue to do so!  Sadly, though, their potential will never be realized.  Please don't rob them of what they had already accomplished by failing to accept their salaries as of September11th as the true reflection of their current earnings potential.
     Finally, I am saddened by your failure to attach a greater value to the non-economic losses which the families have suffered.  Although we all know that there is no figure which could ever reflect the tremendous losses which have overwhelmed the families of the victims, the current calculations are incredulous.  In our democratic society with a judicial system that attaches multimillion dollar settlements for "pain and suffering" scenarios which are far less painful and sorrowful than those of 9/11, the fund has a moral responsibility to exhibit a greater sensitivity to the families' grief than they are currently demonstrating.  Although I know that  this issue is not intended to be a major one in the way the compensation fund has been set up, it deserves far more value than it is currently receiving.  These innocent victims died because they were American.  And they died, in part, because their beloved country failed to protect them.  We must not camouflage this fund under the guise of a benevolent gesture by our country.  Rather, we must be frank in our acceptance that although they were random targets of blind hatred, there was unequivocal negligence by other parties which also played a role in the wrongful deaths of these innocent victims.
      Unless the victims' compensation fund takes these issues into account, our family will be unable to accept it.                                                                                              Thank you for your attention to my comments.

September 11 Victims Relief Fund

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Please don't discriminate - the terrorists didn't

In recent interviews, the head of the September 11 Victim
Compensation Fund has made clear that the partners of gay and
lesbian heroes of September 11 will not necessarily receive
the same benefits as the spouses of heterosexual victims of
the horrible terror attacks.  DID THESE PEOPLE NOT SUFFER
THE SAME FATE ON THAT HORRIBLE DAY?

Even fetuses and illegal aliens will be receiving benefits
under this program.

But when  it comes to gay and lesbian heroes of the day - &amp;nbsp who helped bring down the flight in Pennsylvania, &amp;nbsp . &amp;nbsp who died in the line of
duty when the first tower fell, and &amp;nbsp who was
&amp;nbsp of the plane that crashed into the Pentagon (there
are many more) - we are told the law is the law and no
exceptions can be made.

If September 11 has taught us anything, it's that our
patriotism and love of country transcend our differences and
unite us all.  We were told that September 11 was the day
that "hyphenated-Americans" were no more, and rather than
being Italian-Americans, African-Americans or gay-Americans,
we were now simply Americans, all of us together as one
American family.  Apparently, that family just got a divorce.

The hyphens seem not to matter when our government wants to
use our heroism to inspire others, but when it comes time to
actually aid the families of those heroes, the hyphens come
back with a vengeance, and it seems that some American heroes
are now more equal than others.

Discrimination is un-American.  I am outraged that gay and
lesbian partners of those who died on September 11 are not
automatically going to receive the same benefits as heterosexual
spouses.

Don't let their deaths be in vain.  Show TRUE American spirit.
Tell the world that in America, Truly, we are ALL Equal.

Please Help End All Discrimination

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

 comments on compensation from the government`s fund of 1.1 million dollars she`s entitled to, she would not receive much of it because of the Insurance her husband and employer is paying her totals 1.4 million ,and she fears she will get nothing from the Gov. This makes me boil, how many widows has 1.4 million dollars upon the death of her husband? This is a greedy &amp;nbsp, and deserves not getting rich over the death of her husband. Give her burial exp. and six mos. paying her bills and tell her to get a job.

Protect Traditional Marriage

Dear Mr. Zwick:

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation.
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died.
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have?Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution." 
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."
