Revised e-mail

I am outraged about an article I just finished reading in the 1-26-02 edition of the Denver Post newspaper entitled "9-11 Families Recoil At E-Mails Painting Them As Greedy." In this article, AP Reporter Shannon McCaffrey notes that according to Special Master Kenneth Feinberg, the fund's "average award will be $1.6 million, although final details are still being worked out." McCaffrey's article then cites a number of examples of victims' survivors who are not satisfied with the amount of what they believe to be their entitlement. For example, McCaffrey cites the case of &nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp, a widower whose husband was killed at the World Trade Center site. &nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp complains because she "has figured that under the fund she would be entitled to about 1.1 million. But her husband's life insurance and supplemental policy from his employer total $1.4 million, so she fears she will get nothing from the government." (Underline added).

My outrage is twofold. First, I disagree with the stated purpose behind the government's creation of the fund -- to limit the civil liability of the airlines and other entities arising from the 9-11-01 terrorist attacks. The creation of the fund for this purpose pre-determines that the airlines were negligent and therefore responsible for thousands of deaths because they did not prevent the terrorist attacks. This is an absurd conclusion. Neither the CIA, the FBI, the NSA nor the US Military, entities charged with the responsibility of preventing such attacks, saw the attacks coming. Nevertheless, by virtue of creating the fund, it is apparent that Congress feels like the airlines dropped the ball on this one and are civilly liable. ABSURD!!!!. This was a unique and hopefully one-time occurrence -- one that was impossible to predict -- BY ANYONE including the US Government!!!! It is time for all involved to get a reality check -- sometimes, bad things happen for no particular reason and because of no one's fault.

My second source of outrage arises from the families' feeling of entitlement. I am quite sure that people in Bakersfield, CA, Sidney, NE, Baton Rouge, LA, Mobile AL and a number of American cities also died on 09-11-01. Where do survivors of these victims go to collect their government payoff? Better yet, since my father died when I was 11 years old and I have collected nothing from the government, where do I go to collect my entitlement? Since I am now 36 years of age, all of the interest accruing on my entitlement must have pushed the figure over 2.5 million by now? I cannot wait to get the money and take my family to Disney Land.

Please do not misunderstand me. I truly feel sorry for the families who lost loved ones on 9-11-01. However, I do not feel sorry for a lady who, because she is collecting $1.4 million in private insurance proceeds, might not be able to collect her government entitlement of $1.1 million. She and others like her are GREEDY PROFITEERS whose voices do not deserve to be heard. If anyone is at fault here, it is Bin Laden and his Al Queda organization. Sue their pants off and I hope each survivor collects $1.6 trillion. Until then, do not use my tax revenue to pay off greedy people like &nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp.

Discrimination in distribution of disaster funds

I think it is a disgrace and a glaring example of bigotry that the
distribution of disaster funds collected following the 911 tragedy will
not be equitably apportioned to the significant others of the gay and
lesbian patriots lost in the twin-tower disaster.

How can the honor of gay heroes like and be so callously desecrated?

9/11 Relief Fund

December 20, 2001

Dear Mr. Kenneth Zwick,

I write to you as a member of Amnesty International, a worldwide human
rights movement committed to ensuring respect for the basic human rights of
people without discrimination, in support of equal access to benefits under
the September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.

As you consider rules for administering the relief fund, I ask you to
please apply basic international human rights standards, and the general
principle of equality, by including among relatives eligible for
compensation those who lost their life partners, as well as de facto
parents or children, without regard to sexual orientation or marital
status. The State of New York has already adopted such a policy, granting
compensation benefits "on a showing of mutual interdependence with the
victim, in recognition that anyone who shared with the victim living
expenses, day to day activities and the emotional bonds of family deserves
help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Sincerely,

How dare you claim to be MY government of the people, by the people and FOR the people when you dare to attempt to discriminate against families of gays and lesbians??? These families have the same grief, sadness, and needs of anyone else. You would attempt to nullify their feelings by using state's laws against providing compensation for families of the dead and injured victims of Sept. 11 due to your own predjudice. You do not speak for me when you do this.

SHAME,SHAME,SHAME!!!!!

Just another outrage!

How long will it take to truly have a country free of prejudice, special interest, and outright hate. Maybe we should consider changing some our landmarks . . . "yearning to be free" to be "yearning to be free (if your heterosexual).

OUTRAGEOUS! We protect our country, pay our taxes, save lives, teach our children. . . yet you still want to take our home away from us. STOP IT NOW!

A very concerned citizen of the home of the brave and land of the free. . . . Or should it be "home of the brave and land of the free (heterosexuals only need apply)".

Give the benefits to all, without regard for sexual orientation, race, religion, ideology, economic status, and especially how you may be feeling today.

An outraged and concerned citizen

December 19, 2001

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.

As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Sincerely,

Individual Comment

              <text>Tuesday, January 15, 2002 11:56 AM
(no subject)

January 15, 2002
To Our Elected Officials:

In the immediate aftermath of the tragic attack of The United States, on
September 11, Congress enacted the Victims" Compensation Fund of 2001 P.L.
107-42, to compensate the relatives of the victims of that brutal attack. As
you know, this Fund was enacted as part of a comprehensive package which
bailed out the airline industry and imposed restrictions of the rights of the
victims" relatives to recover damages from court. We implore upon you, as our
elected officials, to demand changes to the interim rules issued by Kenneth
Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules
fail to satisfy the letter or the spirit of the legislation, which was
enacted.

Specifically, we request that you act on our behalf and demand the following
changes to the interim rules:

1. Remove arbitrary income limits.
The arbitrary income limits imposed by the Special Master are not only unfair
but also inconsistent with the letter and the spirit of the law. Those
victims from the financial industry are specifically harmed by this limit.
They were targeted and murdered precisely because of the jobs they held and
where they worked-the World Trade Center, the Financial capital of the world,
the embodiment of financial success. Those who achieved such success should
see that reflected in their awards. They personified American Business and
commerce, democracy and freedom. We ask that you demand that Mr. Feinberg
lift the arbitrary income limits so that each family can be treated fairly;
commensurate with the support they provided their families before their
death.

2. Increase non-economic rewards.
Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and
suffering, no matter what the extent of the pain and suffering. This is
unacceptable. In the words of Congressman Peter King,"Å every death is tragic.
A murder is particularly tragic. But to have your love one murdered in a
burning building in full view of the world - in a scene which will be
repeated in the media for decades to come - is a horror these families will
never escape fromÅ The Special Master cannot take it upon himself to restrict
the rights of the families." Therefore, we request that the interim rules be
amended to more appropriately compensate the victims' families' for the
immeasurable pain and suffering endured by our loved ones. As Mayor Giuliani
stated in his farewell address: "we have an obligation to the people who did
dieÅ Their families need to be protected just as if they had been alive,
financially and every other way that we can help and assist their familiesÅ
There should be no compromise about that everÅ " We request that the interim
rules be amended and that compensation for pain and suffering more accurately
reflect that horror which was suffered. Justice demands no less.

Sincerely,
Individual Comment
Jackson, NJ

Dear Sir: Tragic as it is, I do not feel that the US taxpayer is
in no way responsible for the events of 9 11. If so, how and in
what manner? I feel these awards at our expense are nothing more
than a "bail out" for the insurance companys. The insurance
companies are in the business of insuring so let the taxpayers stand
aside and let them do their job. These "awards" set a very bad
president. We did not place any awards for the Oklahoma bomings, the USS
Cole, or at any other event in history of which I am aware. Where does
it end? My son is a policeman. If he is killed by a terrorist , do my
grandchildren receive 1.65 million dollars? How many people have to
be killed at one time for their relatives to receive awards? Are
one, two, two hundred lives any less precious than any others? I feel
the victim's relatives should receive only what they would be entitled
to if they were killed on the job and not one cent more, and not one
cent of taxpayer's money. Please don't do this to the taxpayer.
Respectfully,
Individual Comment
Soddy Daisy, Tn.

Special Master Kenneth R. Feinberg
September 11th Victim Compensation Fund
U.S. Department of Justice
950 Pennsylvania Avenue NW
Washington, DC 20530

Dear Mr. Feinberg:

I am writing on behalf of the surviving families of victims of the September 11 terrorist
attacks. Please ensure fair treatment of all families, including children and significant
others of low-income workers and gay and lesbian victims.

It seems particularly unfair to me that the families of low-income workers might receive
far less in compensation than families of those who earned salaries in the six figures.
Please ensure that a high minimum compensation level is set to lessen the disparities
between the poor and the rich. The taxpayer money should not go primarily to those who
were already well off financially in the first place.

Please also ensure that gays and lesbians are recognized as grieving survivors as well,
with full rights to equal compensation for this tragic loss of life. The Red Cross and the
State of New York have already stated they will not discriminate against gay and lesbian
families. The Department of Justice should be equally just.

Thank you for your careful consideration of these matters. I look forward to hearing from
you.

                                        Sincerely,
Individual Comment
Issaquah, WA

Partners of gay 9-11 victims are Americans too!

I think it's reprehensible that our government is discriminating against gay American citizens by denying the partners of gay 9-11 victims compensation. It is particularly abhorrent to me that gays are being singled out for this discrimination when the government has chosen to "bend the rules" for other NON-Americans, like illegal aliens. I'm glad the illegal aliens are being compensated, but why should gays who ARE tax-paying American citizens be overlooked and denied rightful compensation?

Please, I beg you, reconsider the fund's position on this to ensure that all Americans are compensated at this tragic time. Thank you for your consideration.

Bigotry

Dear Sirs,

I am appalled that as a taxpayer, I am involuntarily bailing out all the
victims of Sept. 11, including fetuses and illegal, undocumented workers,
when the only thing that seems to guarantee one exclusion from benefitting
from this fund is being in the long term gay or lesbian domestic partner of
one of those killed. This is a clear case of convenient bigotry. You hide
behind the fascade of "state laws" when the fact that you are willing to
extend benefits to law breakers belies the bigotry that lurks behind this
policy. I am ashamed of you!

I am also curious whether I will be expected to shelve out money to
compensate future victims of terror. There will certainly be many more!
Why not victims of all kinds of violence? How about the families of the
embassy workers? How about abused or tortured women? How about the family
of &nbsp ? How about the surviviors of the next airline crash or

Special Master Kenneth R. Feinberg
September 11th Victim Compensation Fund
U.S. Department of Justice
950 Pennsylvania Avenue NW
Washington, DC 20530

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families. Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

Sincerely,
Individual Comment
Burton, WA

I am horrified by the small-mindedness of Mr. Ashcroft and Mr.
Feinberg in restricting 911 funds from compensating the domestic
partners of gay victims. This is not patriotic, this is right-wing
stupidity.

Kenneth L. Zwick, Director
Office of Management Programs, Civil Division

U.S. Department of Justice

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Sincerely,

Individual Comment

Crisis Benefits

December 21, 2001

We were attacked by people who diregarded our
freedoms in the US, let's not discriminate against our own people. That
would make us no better than our attackers.

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Sincerely,

Individual Comment
New York, NY

I am sending this email because I have heard that partners of gays and
lesbians who lost their lives on September 11, 2001 will not be compensated
as will the families of the heterosexual victims of 9/11. I firmly believe
that many who contributed to this fund did so with the belief that there
would not be such discrimination in the distribution of compensation. It is
appalling that conservative political views will undo the unprecedented unity
which the US has experienced since the terrorist attacks. I believed that the
deliberately divisive (and, quite frankly, demented) comments made by
and were dismissed by all intelligent, understanding, and rational human beings. It is extremely disheartening to learn that others share their prejudices, and will use their power to block those deserving families of the gays and lesbians who lost their lives from receiving
adequate and appropriate compensation. I hope this decision will be reconsidered, and reversed.

sincerely,

Subject: SHOULD FAMILIES OF ILLEGAL IMMIGRANTS WHO DIED ON 9-11 GET
MONEY FROM THE FEDERAL VICTIMS' FUND?

I recently went to www.vote.com and I voted no on the subject.

I know you might say why? Because if they are illegal aliens that are trying to live in the U.S. illegally should not get compensation because it is straight.

They are not citizens of the United States.

They should go by the legal way to enter the U.S. If they were U.S. citizens, then they should get compensation.

So I voted no on the issue.
