Comments of the interim rules

 The DOJ and the Special Master fashioned the yearly income to be the
average salary of 1998,99,2000 this is
  contrary to the spirit of the law.

 This procedure is grossly unfair (and should be repealed) to young
people who are at the early stages of their
  careers in business.

 For these young people, the salary can double from year to year as
their labor skills and working knowledge are
  mastered.

 The fair and just process would be to calculate the economic loss on
the victim's actual pre-tax earnings salary of
  Sept. 10,2001 INSTEAD OF the three-year period 1998-2000
consideration.

 It would be a crime to maintain the three-year consideration,
because you victimize once again those dead people
  who through education, extra work effort,. or both, strived to
improve their economic remuneration.

Appalled!

As a registered and voting Republican home and rental property owner, (The
folks who pay your salaries while you give the world away to corporate
America and anyone else who can pay the lobbyist) I am appalled that we¹re
doing separate but unequal representation on victim¹s compensation!

If the following is not accurate you¹d better do a great job of getting the
story out about how fair you are treating folks because as I see it if an
unborn lump and an illegal is worth something but my gay bothers and sisters
aren¹t then it¹s time to take my time and money elsewhere!

³Even fetuses and illegal aliens will be receiving benefits
under this problem - heck, they've even promised to overlook
federal law and NOT arrest and kick out the families of
illegal aliens, nor will they punish American companies that
hired illegals in violation of federal labor laws.

But when  it comes to gay and lesbian heroes of the day -           who helped bring down the flight in Pennsylvania,           .           who died in the line of
duty when the first tower fell, and           who was
          (there
are many more) - we are told the law is the law and no
exceptions can be made.²

Justice help all terrorist victims


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex
unions.  They suffer just as grievously for their deceased loved ones
as do other survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups
and individuals who would have the Department of Justice limit
compensation to survivors of heterosexual unions.  They are interested
in a political victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.

Special consideration for children

1.Consideration should be given to funding education for youngsters who have suffered the loss of one or both parents-Many of whom are infants at this time. Consideration should be given towards paying for special schooling if need be at this time;to fund tuition for post High school education be it college or graduate schoolong-law,medicine,etc. and.or technical/trade school education.
Placing the funding in special interest bearing accounts similar to accounts place in trust for infants who have been awarded personal injury damages/ Special Court appointed guardians or a special Department of Justice Office designed to administeer funds on behalf of infants.

Victim Compensation

 1)  When Personal Representative files a claim they should be advised
of the amount of the award that will be offered and then elect to accept
this amount or reject it and proceed in other venues. Filing initial
claim should not waive right to file future lawsuits. This should be
waived only on acceptance of award.

Another Complaint

I to cannot believe the surviving family members of 9-11 on the television talking about filing bankruptcy, when I would suspect that most victims of the attacks carried a healthy life insurance policy.  I also do not approve of the proposed plan that the amount dispersed would be in proportion to the income, (position) of the deceased.  Is one life worth more than another? 
I have lost family members (brother at age 18 and father at age 42) unexpectedly, (not related to 9-11)  so I understand the grief and pain of the families, but I do not understand this feeling that they should all become millionaires because of this tragedy.  Maybe fighting over the money gives them a direction to point the anger and grief that they feel.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Final Rule re: Gays and Lesbians

While I understand and respect the idea of honoring state statutes about
domestic partner benefits in relation to 9-11 aid funds, I think the federal
government can and should, in this case, take the high ground and see the
big picture. There are many cases in which federal policies have been ahead
of states, and while big government is not the goal, a just visionary
government is. I do not believe you will be sued by states if you give aid
to those who lost loved ones on 9-11. If on the off chance you are, the
suits can have no merit simply because a one-time financial aid contribution
is not in violation of anything. Thank you for reviewing this matter once
again, with a wide open heart.

Victim Compensation

I am an American Citizen living in downtown Manhattan. I witnessed the entire 
tragic event of 9/11 from my roof and have been working diligently, ever 
since, to help in any way possible. I've donated time to the service tables 
at Saint Vincent's Hospital, I've collected money as well as donated food and 
clothing to the ground zero rescue workers. I have never been prouder to be 
an American.

That is until I heard that you and your fund are denying equal benefits to 
the gay and lesbian partners of those who died on September 11th. Your fund 
has decided to bypass Federal Laws and pay illegal aliens without any arrest 
or deportment, but say that you will follow each state's laws regarding gay 
and lesbian civil rights to the letter. Essentially, you are denying benefits 
to Gay Americans who were victimized by these terrorist attacks because in 
most cases the legal systems don't recognize gay and lesbian civil rights. 

This decision speaks to your fund's hypocrisy and is evidence of your 
anti-American goals. Your bigotry victimizes many Americans and furthers the 
evil work of the terrorists.

victims fund

Hi,
Just a word from a taxpayer about all of this money being paid to victims. 
The taxpayers are footing the bill for a disaster that occurred.  Why are
we just now paying people for this?  We didn't pay for the bombing of the
US Kohl, or the bombing of the trade center before, or the oklahoma city
bombing, or any floods, tornados, or the earthquake in california so I'm
confused as to why we are paying now.  I thought people were supposed to be
responsible and have life insurance and or put something aside for a rainy
day.  I'm not saying these people are not suffering but I do think they are
getting money because they are the movers and shakers of wall street vs.
the good ol boys from oklahoma.  If anybody deserves anything its the fire
fighters and police who willing risked their lives.  But then what about
the soldiers fighting right now-if they die do we pay their families 1.6
million?   What happened to being responsible for decisions that you made. 
Is everybody entitled to a perfect life and if they don't get it then they
can sue somebody?   You've opened up a can of worms.  Standby to ram - its
going to be a mess.

Comments Regarding the Federal Victims Compensation Program


Dear Special Master Feinberg:

As a parent, my flesh and blood was murdered on 9/11. All who lost loved ones 
that day must be compensated in a fair and just way. Being a mother and a 
widow I can't say which loss is greater: The loss of a husband or the loss of 
a son.

Have you asked yourself what would it be like not to see a future for your 
own family member?

All give some but some give all.
My son did that along with his fellow firefighters. We who are left behind 
also gave part of ourselves that day.

All uniformed services families---including parents---should get fair 
compensation.
We will not be forgotten. Hear our voices now.

exclusion of gays from 9/11 fund is wrong


To Whom It May Concern:

I am writing to express my disappointment and disbelief that gay and lesbian 
partners of those killed in the 9/11 attacks will not be receiving the same 
benefits as their heterosexual counterparts.  It is an outrage that the 
administrators of the 9/11 Fund have chosen to perpetrate such 
discrimination.  Discrimination against lesbians and gays is wrong under any 
circumstances, but is made all the more aggregious by the hypocricy here: as 
Americans put aside differences to unite around American ideals of freedom, 
justice, democracy, and equality, government administrators deny benefits to 
the grieving partners of some of the dead on the basis of those differences.  
This is a wrong and unjust policy.  The 9/11 terrorists did not discriminate 
among the passengers and workers in the planes and buildings who were killed 
in the attacks, nor should the 9/11 Fund discriminate in its distribution of 
benefits to those whose loved ones were murdered.  

I am aware that legalities are being consciously overlooked to provide 
benefits to the families of illegal immigrants and even to fetuses (which to 
my knowledge do not enjoy the rights of personhood under the law).  The 
decision to grant benefits to the families of illegal immigrants is just, as 
all victims' families deserve compensation.  While certain legal sticking 
points are being cited to justify the denial of benefits to gay and lesbian 
partners, the extension of benefits to the families of illegal workers 
undercuts this argument. 

Full benefits must be extended to the gay and lesbian partners of those 
Americans killed in the terrorist events of September 11th.  To deny these 
Americans the same rights, privleges, and benefits extended to other 
Americans (and in fact other non-citizens) undermines the most basic American 
principles of equality under the law.  Worse yet, to make these biased and 
discriminatory distinctions among Americans now creates precisely the kind of 
division which weakens our country against its fundamentalist attackers.  
Divided from within, we will easily fall.  

As fractious a nation as we are, we unite not around a motherland or a shared 
lifestyle or a common racial identity or a single religion, but around the 
ideals of freedom, justice, democracy, and equality under the law.  These 
ideals must be upheld now, or we ourselves continue the work of our 
attackers.  By perpetrating discrimination and economic violence against our 
gay and lesbian brothers and sisters, we further undermine our strength, our 
spirit, and our righteousness as a nation.

victims compensation fund

I am appalled at the attitude of the victims families.  The help they are
receiving from taxpayers is not a right but compensation for their
suffering.  It is a gift that I believe at this point amounts to welfare.
 These people are able to work and be productive citizens in our society.
 Other victims of this nature do not and have not received compensation. 
Some families will not receive a thing.  Why are they not putting energy
in that direction.  These family members should be grateful, instead what
we are seeing amounts to greed.  I feel sorry for these people and our
government for wanting to help out.  Maybe next time we won't rush to
help out people in this kind of situation.  I am afraid this sets a
precedent.

To Kenneth L. Zwick, Department of Justice:

In the immediate aftermath of the tragic attack of The United States, on September 11,
Congress enacted the Victims "Compensation Fund of 2001 P.L. 107-42, to compensate the
relatives of the victims of that brutal attack.  As you know, this Fund was enacted as part of a
comprehensive package which bailed out the airline industry and imposed restrictions of the
rights of the victims" relatives to recover damages from court.  We implore upon you, as our
elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special
Master. As it stands, Mr.Feinberg's self imposed rules failto satisfy the letter or the
spirit of the legislation, which was enacted.

Specifically, we request that you act on our behalf and demand the following changes to the
interim rules:

1. Remove arbitrary income limits.
The arbitrary income limits imposed by the Special Master are not only unfair but also
inconsistent with the letter and the spirit of the law.  Those victims from the financial industry
are specifically harmed by this limit.  They were targeted and murdered precisely because of the
jobs they held and where they worked-the World Trade Center, the Financial capital of the
world, the embodiment of financial success.  Those who achieved such success should see that
reflected in their awards.  They personified American Business and commerce, democracy and
freedom.  We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that
each family can be treated fairly; commensurate with the support they provided their families
before their death.

2. Increase non-economic rewards.
Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no
matter what the extent of the pain and suffering.  This is unacceptable.  In the words of
Congressman Peter King,"Severy death is tragic. A murder is particularly tragic.  But to have
your love one murdered in a burning building in full view of the world - in a scene which will be
repeated in the media for decades to come - is a horror these families will never escape
from The Special Master cannot take it upon himself to restrict the rights of the families."
Therefore, we request that the immeasurable pain and suffering endured by our loved ones.  As
Mayor Giuliani stated in his farewell address: "we have an obligation to the people who did
Die.  Their families need to be protected just as if they had been alive, financially and every
other way that we can help and assist their families.  There should be no compromise about
that ever." We request that the interim rules be amended and that compensation for pain and
suffering more accurately reflect that horror which was suffered.  Justice demands no less.

I'm appalled at the decision by the US Government to further punish gay and lesbian Americans who have lost loved ones in the 9-11 attacks.

It's sickening that Ashcroft and the Justice Department are willing to bend laws to allow the flow of cash to help every possible victim except gays.  Apparently, we don't pay taxes, adopt unwanted children, educate, mend the sick, or even fight and die for this nation.  And apparently, it's not enough for America to kick us out of the military, deny us visitation rights, force us to pay a larger share of taxes, refuse to marry us, and equate us with alcoholics and pedophiles.

I'm ashamed of the antics of our leaders.  Every victim of this tragedy should be compensated,  period.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

As you develop the rules by which the funds provided in the Air Transportation
Safety and System Stabilization Act, please make sure that funds are made
available to non-traditional families and partners of those affected by the

heterosexual people, who have suffered emotional and financial loss or hardship.

9/11 FUND UNFAIR TO Homosexual Americans

To whom it may concern,

I am outraged that gay and lesbian partners of those 
who died on September 11 are not automatically going
to receive the same benefits as heterosexual 
spouses.  This is the time to honour all those victims
