Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Equal access to crisis relief!


December  19, 2001

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Help ALL Victims of Sept. 11

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund." 
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

important issues.

Dear Special Master Feinberg:

     I am writing today to share the concerns of &amp;nbsp , one of my constituents who
lost
her husband on September 11. I have enclosed a copy of her correspondence for your review.

     &amp;nbsp husband, &amp;nbsp , worked in the &amp;nbsp but
tragically was in the World Trade Center on September 11 and was one of the victims of the
terrorist
attacks. &amp;nbsp objects to the interim final regulations governing payments under the
September 11
Victim Compensation Fund.  She feels that they do not conform to the language and intent of the
Air
Transportation Safety and System Stabilization Act, P.L. 107-42, which created the fund.  Mrs.               believes that the method of alculating economic damages is flawed and does not adequately compensate families for their actual economic losses.

     While we can do nothing to bring back lost loved ones, I am sure you agree that we can ease some of the financial burden placed on these families by these tragic events.  Therefore, I would strongly urge you to take Mrs.              's concerns into account as you promulgate the final rule.

My husband &amp;nbsp worked for &amp;nbsp .  He was associated with the &amp;nbsp office
located
in the &amp;nbsp .  &amp;nbsp however located him at the World Trade Center on
September 11, 2001 and he was one of the many victims on that day.  &amp;nbsp and I were high school
sweethearts and just celebrated our 25th wedding anniversary.  He has been a part of my life for
the
past 31 years and now I find my life altered forever.  He had discussed several times with me
how you
held a consulting position with the firm prior to your election to Congress.  He had nothing but
good
things to say.  I hope this email finds its way to you.

I am writing to express my serious concerns and objections to the Department of Justice's (DOJ)
"Interim Final Regulations Governing Payments Under the September 11th Victim
Compensation
Fund."  The airline bailout act gave the airlines $15 billion in cash and loan guarantees and
capped the
airlines's liability for the September 11 crashes at the limits of their insurance coverage.  Because
of this
cap, the damage caused by the crashes greatly exceed the private fund available to compensate
victims
and their families.  Thus for the vast majority of victims and families, the cap has the effect of
eliminating
the right that they would otherwise have to sure the airlines Congress set up the fund to ensure
that the
airline bailout would not come at the expense of the victim's families.  The act mandates full and
fair
compensation to victims and their families for their actual economic and non-economic damages. 
DOJ
has ignored this mandate and instead has written arbitrary regulations that will result in
compensation
levels far below the losses actual suffered by the victims and their families.  In fact, many
families' total
compensation from the  fund and all collateral sources combined will not even fully replace lost
income. 
In effect, these families will not receive any of the non-economic compensation required by the
statute. 
After collateral sources are deducted, as required by the statute, some families would receive
nothing
from the fund under the interim final regulations.  DOJ's formula allows for non-economic
awards at
only one-tenth the level paid in  comparable cases, even though Congress explicitly enumerated a
broader range of non-economic damages than could be recovered in any single jurisdiction. 
DOJ's
formula for non-economic damages is $250,000 for the person killed and $50,000 for the spouse
and
each dependent.  In a wide variety of air crash and terrorism cases, however, judges, juries, and
mediators commonly have proved non-economic damages awards well into the seven-figure
range.

Independent economists have found serious flaws in DOJ's method of calculating economic
damages,
including use of outdated and inapplicable worklife and life-cycle earnings data.  DOJ greatly
underestimates promotions and other increases in earning for victims.  If relies on civil service
and
military retirement system actuarial data that track federal worker incomes and pension
requirements,
not the higher-paying private sector career paths followed by the bast majority of the victims. 
The
interim final regulations also arbitrarily cap a victim's income at $231,000 a year.  Combined
with the
faulty methodology described above, the income cap would result in some families receiving
compensation for less than 25% of their actual economic losses.  Under DOJ's rules, a family's
award
may be increased above the "presumptive" award only by a showing of  "extraordinary
circumstances"
  beyond those suffered by other victims or victims' families.   This high burden of proof makes a
charade of the right to a hearing provided by the statute. DOJ should fulfill the act's intent by
revising
the rules to compensate victims and their families for the types of damages specified by
Congress, at
levels comparable to those provided in the tort system the fund was designed to replace.  While
DOJ
has a shown flexibility on some aspects of the rules, it is resisting the victims' and families'
requests for
significant changes.  If the proposed regulations are not changed significantly, victims widows
will have
to sell their homes, deplete their children's college funds, and give up their plans of being
full-time
parents while their children are young.  Many families, anticipating little relief from the fund,
will decide
to sue the airlines and others, despite the handicap of the liability limits.  We do not believe these
are the
outcomes Congress intended.

Please contact Attorney General John D. Ashcroft and Special Master Kenneth R. Feinberg and
tell
them your concerns that the interim final regulations fail to conform to the language and intent of
the act.
With the regulations soon to become final,  I believe that only the swift and strong support of
Congress
can avert unnecessary financial and emotional damage.

Compensation for all hurt by 9-11

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund." 
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a diswasher in one of the restaraunts destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayers money went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian famillies are especially vulerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in a traumatic predicament of having to prove that their union is legitimate. Fortunaely, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should 
do the same.

ALL Victims deserve help!!!!!

Dear sir or madam,
I cannot convey with enough urgency how strongly I feel about the need to confer help and assistance to all those affected by the tragedies that shook our nation.  It disgusts me and shocks me that in this time of mourning there are those who are so bigoted that they would seek to deny compensation to families whose lifestyle they find morally objectionable.  Personally, I have no problem at all with homosexuality and support equal rights and responsibilities for gays and lesbians.  Even if I hated all of them, however, this would not be the time for me to try and deny them compensation that heterosexuals who also lost loved ones are going to receive.  If the bigots succeed in denying these rights to homosexuals, it will tear this country apart.  Please, do everything in your power to treat homosexuals and hetersexuals equally in this time or sadness.  It is likely that Jerry Falwell and Osama bin Laden will both be upset at homosexuals being treated like human beings, but it is the right thing to do.  Thank

Sept.11th Fund Comment

Dear Mr. Zwick,

I heard that you are accepting comments about the use of the September 11 
Victim Compensation Fund. I would like to say that I believe your fund should 
follow guidelines similar to the ones established by Gov. Pataki of NY. The 
NY guidelines allow compensation to all those who were "sharing living 
expenses, day-to-day activities and the emotional bonds of family" regardless 
of marital status or sexual orientation.

My home state of Virginia is refusing to allow any money to go to the gay and 
lesbian life partners of victims in the Pentagon crash, and I know that is 
causing great hardship (on top of horrible grief) to a number of g&amp;l families 
left behind. One woman is losing her house because she can't make the 
payments. It's so unfair. People build lives together and do all they can to 
support each other, and then not only are their lives torn apart by 
terrorists but our own government refuses help. That's just one of the 
reasons I voted against the current state administration in the election four 
weeks ago.

Please be fair. Recognize ALL the families, not just the ones 
and want to recognize, and take care of ALL the Americans 
bereaved and financially deprived by the attacks.

September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

about your efforts to ensure that all surviving victims of the September 11

mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

I am outraged that gay and lesbian partners of those 
who died on September 11 are not automatically going to 
receive the same benefits as heterosexual spouses. 
I urge you to take action by stopping this un-American behavior. Please
ensure that gay and lesbian partners receive the same benefits as
heterosexual spouses. I ask also for a response to my email and some steps
being taken to ensure this absolute American right. 
The events of September 11 have show us that all Americans are equal. Either
they be African-Americans, Italian-Americans or Gay-Americans. Please keep
this nation strong and not divided !

September 11th Victim Compensation Fund of 2001

Ladies and Gentlemen,

Please accept this e-mail as my comments upon the proposed regulations intended to implement the above legislation.  

I am the son-in-law of          , who tragically perished in the World Trade Center terrorist attack on September 11th.           was a stockbroker with           on the 104th Floor of the South Tower.  He was a Wall Street veteran of over three (3) decades.  He is survived by his wonderful wife,          , and his two daughters,         , and           (my wife).  I mention these facts in order to remind the Department of Justice that we are dealing with people here.  What you do in this process is critically important to the families that are still grieving, and who are looking to you for thoughtful, compassionate treatment in a often-times impersonal process.

I provide comments in response to your "Notice of Inquiry and Advance Notice of Rulemaking", by following the Topic # format laid out therein.  Specifically, I submit the following:

Topics #1 &amp; 2: 
The claim form should be simple, short and standard.  It should use plain English and not legalese.  If something is missing from the claim, the claimant should be notified in writing and given a reasonable amount of time to correct the deficiency.

Topic #3: 
a)  The Special Master should not be allowed to delay the decision beyond the 120 days mandated by the Act.  Otherwise, a system will develop like in other federal benefit hearings where the hearing officer will influence everyone to give more time (or be afraid of an adverse decision).

b)  The Special Master should not be allowed to dismiss a claim until they have given the claimant notice of a deficiency in the form or materials filed by certified mail, return receipt requested and allowed a reasonable time for the claimant to correct the deficiency.

c)  Every claimant should be permitted the option of an oral hearing before a hearing officer learned in the law (ie. a lawyer).  Every claimant should be given his or her "day in court."

d)  Every claimant should be permitted the right to appeal any rulings regarding legal issues (ie. interpretation of the regulations or Act language) to the Special Master. The Standard of Review should be de novo, just as an appeal from a trial court to an appellate court is when questions of law are at issue.

e)  Every claimant should have the option of having a court reporter transcribe the record from the hearing.

f)  Hearings should generally be located in the City where the tragedy occurred, unless a claimant has a hardship due to geographical location. Most claimants are probably close to the metropolitan area where the tragedy occurred.

Topic #4: 
Fees of legal counsel and experts needed to present the claim should be paid for from the Fund.  Claimants should not have their compensation further reduced by legal and expert costs.  These costs should be considered an economic loss of the claimant.

Topic #6:
a)  Every Claimant should be given the option of utilizing a standard method for calculating economic losses.  This may enable some claimants to avoid having to hire expensive experts to prepare complex econometric analyses of lost income.  It should not be mandatory, however, and any reasonably reliable method should be accepted as proof of economic loss.

b)  No standard method should be used for determining non-economic losses.  Mental anguish, pain and suffering, loss of companionship, etc. are not readily capable of a standard formulaic calculation.  Each claimant is different.  Each victim of the tragedies was different.  You cannot stick this type of claim into a box.

c)  Economic Loss - Any information about the employee's prospects for bonuses, promotions, salary increases, etc. should be admitted into evidence at the hearing.  The prospects may be based upon performance evaluations, evaluations of success in the job for the first 8 months of 2001, future plans of the business and any other documentary, anecdotal or testimonial evidence.  Since direct supervisory personnel and personnel records of the employee may not have survived the tragedies, the hearing officer should apply a very liberal approach to allowing evidence on this subject (eg. hearsay of management personnel, sample transactions reflecting exemplary jog performance, etc.).

d)  Economic Loss - Calculations should be based upon the number of past years necessary to accurately reflect the skills and ability of the employee.  This may be 2 years, or it may be 5 years.  If an employee or his company had a bad year last year, then this should not be assumed to be a consistent trend.  In addition, employees rarely stay with the same company for decades at a time - so the prospect of an employee leaving his Sept. 11th employer to make more money should be permitted as an argument.  

e)  Economic Loss - PLEASE ALLOW ECONOMIC LOSS TO BE BASED UPON GROSS INCOME - unless all awards will be free from Federal, State and Local government taxation.

f)  Noneconomic Loss - How can you draw distinctions between the victims of the World Trade Center tragedy?  If someone was killed instantly, does that mean that they suffered any less than if someone died of smoke inhalation.  People went through horrific circumstances regardless of where they were.  Victims should stand together as one - to do otherwise threatens to bring about a downward spiral of selfish claims about how one person's loved one suffered more so the claimant should be paid more.  The U.S. Government should not encourage this type of silliness.

g)  Noneconomic Loss - DO NOT SET ANY LOSS AMOUNT FOR CLASSES OF INDIVIDUALS: determine losses on a claim-by-claim basis.  See b) above for further explanation.

h)  Collateral Sources - ***THIS IS THE MOST IMPORTANT ISSUE***
For purposes of Section 405(b)(6) of the Act, the operative phrase is "collateral source compensation".  In addition, Section 402 (4) expressly states that a collateral source includes "all" such sources.  Usually, the meaning of a federal law is determined by reviewing the Congressional Committee report.  It is my understanding that there was no report on the Act because of the speed with which it was passed by Congress.  Thus, the DOJ should look to the common and ordinary meaning of the words at issue.

"All" is defined as "every; as much as possible."  Webster's Third New International Dictionary at 54.  "Collateral" is defined as "accompanying as a secondary fact, activity, or agency but usually extrinsic to a main consideration."  Id. at 444.  "Source" is defined as "a point of origin or procurement; a point of emanation." Id. at 2177.  "Compensation" is defined as "something that makes up for a loss."  Id. at 463.  Thus, the definition for the term "collateral source compensation" could be "every secondary source of payments, which arose from the same basis that a claimant would be entitled to payments for under the Act."

BUT THAT IS NOT THE END OF THE ANALYSIS.  Section 405(b)(6) also requires that the "collateral source compensation" be "as a result of the terrorist-related aircraft crashes of September 11, 2001."  This should be interepreted to mean as a "DIRECT" result of the crashes.  Any payments received as an indirect result of the crashes should not be included in the reduction of the award.  Payments that might be received as a direct result of the crashes might include Workers Compensation benefits and Employee line of duty death benefits.  Indirect payments received as an indirect result of the crashes would include standard life insurance, pension benefits, 401k plans, Employee Stock ownership plans, Annuities, etc. - all of which would have been received if the person had died for a reason other than the crashes.

The "Collateral Source Rule" applied by courts in most States is intended to prevent double recovery.  Thus, it would make sense that a Workers Compensation award would be deducted from an award under the Act.  Since many other employee benefits received by survivors of the victims of the crashes would not constitute a double recovery, however, the Regulations should reflect that such benefits are NOT to be deducted from the Special Master's award.

Please Explain to me..................

I am having a real hard time understanding the reasoning behind 
the 
$1.6 million pay outs to the families of 9/11.  Why would it be 
the airlines 
fault?  Didn't all the hijackers follow (at that time) all the 
legal requirements?  Why is the government held liable for the 
deaths?  Let me qualify that I have a great deal of emotional 
identification for their losses on 9/11, but life is not a 
guarantee certainty for any one.  That's why there are certain 
entities like Life Insurance, 401 Ks, Social Security, Pension's, 
etc., to provide economic security for those left behind.

My story is not special nor do I wish it to be special.  In the 
summer of 1990, I recently moved to Phoenix, AZ and became a third 
party contractor for IBM.  I also was a member of the USAF 
Reserves.  As a trained medic in a ATH (Air Transport Hospital)
unit, located at Luke AFB, AZ.  

The civilian job I held had great promise for a future with a 
possible income in the 6-figures.  All that changed on February 2, 
1991 at 11:15am.  As I stood on a street corner (had just come 
from the base postal office), I was struck from behind by a 
British Service vehicle.  I was medically retired from the 
military in June 1992 at 100%.  Yes I receive a decent disability 
income, but nowhere near the income I would be making today.  No I 
did not lose my life but I did lose my bread winner status.  I 
have suffered great emotional distress.  Not only from the career 
ending injury but from the process of gathering the help everyone 
said I deserve.  

So it is why I wonder "why is it again that these people are 
entitled to $1.6 million?"  It just makes me cry when I hear them 
complain "it isn't nearly enough!"

Victim Fund

It is unfortunate that the 9/11 Victim Fund will not be shared with our gay and
lesbian brothers and sisters.  We overlook Federal immigration laws:  illegal
aliens' families shall receive relief; the families will not be deported; the
companies who employed the aliens will not be charged with violation national
labor laws.  However, the Direct of the Fun apparently will adhere strictly  to
State laws to maintain the discrimination of gays and lesbians.  I highly doubt
that Congress meant to sanction this discrimination during a national crisis;
it shocks me that the Department of Justice does.
