Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. There is no denying that it was a tragedy of unparallel evil that has had an impact on all Americans. It changed the world that we live in, forever. Despite the magnitude of this despicable event, I take great exception to the enormity of the funds ($4.6 billion) that will be provided by the government to the victim's families. I, like millions of people, gave generously to charitable organizations directing that the donations be used exclusively to help those directly affected. Now, I am being asked to donate additional funds through my taxes. It seems to me that the one and a half billion dollars that has been donated to charities, plus life insurance benefits, plus social security benefits, plus retirement benefits, plus tax relief, plus free college educations, etcetera, etcetera, should be enough to provide sufficient relief to families of victims. It disturbs me that a very dangerous precedent has been established. In these unsettled times we hear a great deal about the potential for terrorism with chemicals and biological agents. It is conceivable that many thousands of people might be killed in the future in this manner. Without even trying, over 5000 people were killed by nerve destroying chemicals in Bhopal, India. Is our government prepared to hand out money to many thousands of victims? Were not the terrorist actions of the past just as tragic as September11th. What about the 270 victims of Pan Am 103 over Lockerbie? What about the servicemen killed in the barracks in Lebanon? What about the 17 sailors killed on The Cole in Yemen? What about the 224 people killed in the embassies in Tanzania and Kenya? What about the six people killed in the World Trade Center in 1993? What about the 19 servicemen killed by a bomb in Dhahran, Saudi Arabia in 1996? How about the 168 people killed in Oklahoma City? Did they not have the same disastrous impact on families of the victims? You surely will hear from their families, if you haven't already. Aside from the magnitude of September 11th, what make it more tragic than the catastrophes mentioned above? Is it any less tragic than the seven families whose loved ones were killed by a runaway van on the streets of New York last week or the 30 year old mother that died of cancer leaving a husband and baby? Death is heartbreaking in any form. I have heard that the reason for the government assistance is to eliminate the potential for legal suits against the airlines, the World Trade Center and others. Experts agree that the likelihood of successful litigation is remote. The Al Qaeda is responsible and how is one to sue them? I do business all over the United States and I am hearing unanimous agreement that the government has made a terrible mistake with this package of relief. My colleagues at work, my friends, my family and my neighbors also speak this sentiment. We want to know what you had in mind when you voted to provide our tax dollars after we all made generous contributions to aid those families. I feel confident that my letter is just one of many that you have and will receive on this subject. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I am aware that 18 Congressmen have recently written a letter to you asking that you include unborn babies who died in the 9-11 attack as "victims" whose surviving family members are eligible for help under the September 11th Victim Compensation Fund of 2001" that is part of Public Law 107-42. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Sunday, January 13, 2002 5:43 PM comments on Interim Final Rule 13 January 2002 To: The Special Master of the September 11 Victim Compensation Fund: Re: Interim Final Rule After reviewing the Interim Final Rule that is published on the Victim Compensation Fund Web site, I am concerned that the Interim Final Rule as presently written is not consistent with the spirit and intent of the fund. My husband, &nbsp, killed while working at the World Trade Center on September 11, 2001, was financially responsible and deeply concerned for my welfare and, therefore, secured life insurance to protect me in case he died. It appears that based on &nbsp's age (57) and income, the amount of my collateral sources is greater than the award projected by the published charts. It is my understanding that the award includes both economic and non-economic loss (also referred to as "pain and suffering"). I do not believe that life insurance purchased by any victim should be part of the collateral sources that are to offset any award. Furthermore, I believe that any collateral sources should offset ONLY economic loss and that everyone should receive the non-economic loss amount that has been specified for "pain and suffering" regardless of the victim's economic situation. The Interim Final Rule (and perhaps the law) is unfair for those people who used their money to prepare for the unexpected. In a recent meeting with U. S. Senators from NJ, I learned that perhaps the legislators acted in haste when drawing up the guidelines for the law. I believe it is the current administration's desire to foster and strengthen self-reliant families. Reducing the award by the amount of insurance a victim carried seems in opposition to this desire. The Interim Final Rule appears to favor those who did not purchase life insurance to protect their families and those who have no dependents and no need for life insurance. Indeed, I find it reprehensible that our taking care of ourselves should result in exclusion from a Fund that is supposedly equitable to all. The proposed disbursement of the Fund provides no real motivation for me to waive my right to sue. Specifically, by including the amount for "pain and suffering" in the total from which "collateral sources" are subtracted, some families may receive nothing for their loss. I believe the people most likely to sue are those in a financial situation that does not require immediate monies from the Fund and can withstand a wait of 10 years or more while the lawsuit is in court. Those are the same people who are apt to have had purchased life insurance and thus are most likely to have high collateral sources. The idea of purchasing life insurance is to cover economic loss in case of death, so one might expect life insurance to offset the economic loss. However, life insurance does not generally address non-economic loss, while the Fund implies that it does. By allowing the "pain and suffering" award to be eliminated by collateral sources, you are motivating the individuals most capable of bringing legal action to do just that. Please consider adjusting the guidelines to provide at least the minimum "pain and suffering" award to all victims, regardless of collateral sources. Friday, January 25, 2002 7:58 PM Victim Compensation I would just like to say, I think compensation from the United States Government for the families of the victims is wrong. This attack was not the fault of our government. People should realize this. Stop and think about the families of our service members who perish in the line of duty, what compensation do they receive? Khobar Towers, the Marine Barracks in Lebanon, those who gave their lives in Vietnam, Desert Storm and every other conflict. The service member makes up only 3% of the population, yet they defend 97%. You want to talk about unjustice, put on some boots and come ruck twenty-five miles with my men. You want to talk about being owed by your government, then step up and be willing to defend that same government. These people have my sympathies, but not my support.
