Sunday, January 13, 2002 1:56 PM Salaries One of my largest concerns about the victim compensation fund is the determination of income. I was fortunate to receive my husband's salary for the entire year of 2001. Consequently this was also my husbands largest salary to date. I feel that 2001 salaries should be considered if there is a way to determine what the total compensation would have been. My husband had taken on many additional responsibilities within his company and was fully compensated with his 2001 salary. Considering my husband would have continued to receive this salary in addition to annual increases, I feel that the income for 2001 should be considered. The second issue I have regarding the victim compensation, is in reference to the reduction of the award by the amount of life insurance your spouse may have had. I do not feel that my family should be penialized because my husband decided to purchase life insurance. It seems to me that the way the program is set up, only familes who do not have life insurance stand to benefit from the compensation program. If this is the case, I feel maybe the program should be changed to distribute equal shares of the compensation to the families without any salary considerations and deductions. An equal share for everyone regardless of their economic status. Thursday, March 21, 2002 2:39 PM Claim Status Dear Special Master, I've just visited your web site and see that a whole new set of rules have been issued along with a lot more paperwork. Can't begin to tell you how frustrating this all becomes when you're trying so hard to move on with your life. Initially submitted a claim in December and resubmitted in February 2002 after being advised by &nbsp that my claim was incomplete. Never received any notification thereafter and have never been issued a claim number. As I look over this new paperwork, I quickly see that I am now required to request information from the IRS concerning my son's previous year's tax returns, obtain information concerning his previous employers' address/phone number, etc., attach documentation for such things as Death Gratuity Payments, Burial Costs, end of year pay statements, etc. In short, I have just printed 33 pages of instructions and forms related to what was once a relatively simple claim process. My son was a 23 year old &nbsp in the United States Navy at the time of his death. He had been in the Navy since January 1999. He always filed his taxes via the telephone, using TELETAX and never kept any types of records. He was simply a carefree, hard working, fun loving young man who had no reason to keep any such records. He had a $250,000 government life insurance policy (SGLI) that he made payable in equal shares to his younger sister and his step brother who is presently a sophomore at . For me to adequately complete your new forms is entirely too cumbersome. I ask you to try to imagine accurately obtaining information concerning subsistence allowances, bonus information, SGLI Premiums he paid, etc. I have coordinated this claim with your office for the past three months and no one has so much as issued me a claim number or advised me as to whether my claim is now complete and accurate. I no longer desire to pursue this issue as I now intend to simply turn everything over to an Attorney and have him pursue legal action. I am confident that I can simply grant him a Power of Attorney to gather information on my behalf, alleviating me of such burdens. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Wednesday, January 23, 2002 9:37 PM (no subject) I am a member of the Families of September 11, and we represent a large group of fiancées/domestic partners. Since this fund was legislated federally and is distributing federal funds we feel we should be treated equally as spouses (since we all had set wedding dates and our fiancées had already asked us to be their wives/husbands). When this fund was set up by congressional legislation last September it was to compensate not only for earnings and pain/suffering (which we are the only ones who suffered a financial loss), but also for 'loss of companionship", "loss of domestic service" etc. This should apply to us as fiancées /domestic partners as well. We are concerned with the exclusive effect of this proposal. It appears, however, to have been the intention of the Act to limit compensation to "relatives." If this is construed to mean relatives at law, many deserving individuals with close relationships in fact (i.e., co-habiting partners, survivors of engaged couples, step-children, etc.) who are injured survivors will be excluded. The regulations should more broadly define "relative" to include de facto relatives. If we are not taken into account then the money will solely be awarded to the parents of the victim, who were not affected financially. You cannot expect that the parents will "do-the-right-thing" and share the award with their son's/daughter's fiancée/domestic partner. We have already seen many cases where people have already not taken the "morally correct" approach. We need to be recognized because our partners/fiancées had promised to take care of us forever, just as a spouse. A spouse is the first recipient of the fund, and a fiancée/domestic partner should receive the identical rights of a spouse and not be punished because they were cheated out of their wedding. Many gay and lesbians died in the terror attacks. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airlines industry and imposed restrictions on the rights of the victims' relatives to sue the airlines in court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precise because of the jobs they held, and where they worked-the World Trade Center, the Financial Capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly, commensurate with the support they provided their families before their death. 2. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Rep. Peter King, "...every death is tragic, A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come-is a horror these families will never escape from... The Special Master cannot take it upon himself to restrict the rights of the families." Although I am pleased that the government is establishing a "fund" to compensate those victims and families directly affected by the attack; I do see some flaws with this process: Why is it taking so long to get this started? The families need money now, not later. How can you actually say to a family who lost a loved one that " any life insurance proceeds that you received will be deducted from the government compensation"? It looks like you are "punishing" the families who had life insurance! This is unacceptable. My father (as well as any other individual who had life insurance) paid alot of money for this coverage. Life insurance proceeds should not be subtracted from the amount the "fund" pays out to the families. We are at war & Bush has said "he will use every means possible to bring down the terrorists". I commend him for this BUT he should "every means" possible to FULLY compensate the victims & their families. Why would a family who has gone through such an emotional time, have to sign a waiver (to not sue the airlines) BEFORE they find out how much compensation they will receive? This is unfair to all of us! If we sign the waiver not to sue- it sets us up to receive a minimal amount of compensation. Give us a compensation figure that you will pay us & let us decide if it is acceptable. If we believe it is acceptable, then we will sign the waiver not to sue. Lastly, everyone has done an excellent job of helping the families. Don't give yourself a black eye by screwing this up. We already have enough misery, so please don't make this process any harder. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner."
