Good Plan

While it is profoundly horrendous, the loss that so many families suffered in this single tragedy, the compensation plan outlined appears reasonable to me.  Although I did not lose any loved one in this disaster, I have lost loved ones in other ways.

Americans lose loved ones, old and young, each and every day, many of them in accidents and violence no less horrendous than those who died in these terrorist acts.  But for those families, there is no "Big Brother" to even attempt to assure their future, beyond what they as a family may actually have created in areas of insurance, retirement or alternate incomes.  

Make no mistake, the whole of America wants these families to be assisted and are heartfeltly in favor of this fund from the government and also that the families should benefit directly from the ARC WTC Victims Fund, but America is also a country that recognizes greed when it raises it's ugly head.  While reading the AP description of the this Federal Victims Compensation Fund, I was repulsed to see the quote of one woman (&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp, whose dissatisfaction with the fund as outlined so far was very apparent) that said in speaking of her husband, "No amount of money is ever going to replace him but my children should never have to want for anything."  That unfortunately has the ring of greed in it.  If her husband died in some other unfortunate manner, (as people have continued to do since 9/11) would they have had enough personal resources to make her comment come true?  Perhaps, perhaps not.  It's not for me to say.

It is true that there is not enough money in the world to fully compensate for the loss of a loved one, a mate, a son or daughter, aunt, uncle, grandfather, or grandmother, or grandchildren.  What about the soldiers killed so far in Afganistan.  Aren't they part and parcel of this tragedy too.  How much will the fund pay their families? Nothing, I know.  And that is the point. But until the government gets into the business of compensating every family, every time any family member dies. . .well let's just hope that the majority of  victims families can see beyond their own greed and realize everyone in America is pained by this loss of life, everyone in America truely wishes that this fund along with other funds, will help them bridge to their future. America does not want the victims to be forgotten a bit, and ask that they accept these funds in the spirit that they were set aside in and with the other funds in the spirit in which the givers intended, as heartfelt assistance in a time and circumstance of incredible sadness (not pity), and not as some form of deserved compensation.

Denial of Gays and Lesbians Benefits of 9/11

 



Dear Sirs, 

I read with great sadness that you will be denying the spouses and loved ones of gays and lesbians the same benefits that heterosexuals and even illegal aliens will be receiving. I nod my head and wonder if the events of September 11,2001 have taught us anything at all.                     , a hero who happens to be gay, gave his life freely to save  others and his fellow Americans from becoming part of the disaster that was 9/11. The                      of the plane that slammed into the                      died needlessly as did the fireman who died in the line of duty aving and rescuing people after the first tower collapsed...what message are we sending out to their loved ones? That their heroism and efforts were for nothing? That their lives meant nothing to those who were close and dear to them? That the heros in our community are less than everyone else? 

What you are doing and saying is just what is so wrong with this country. To say that fetuses. illegal aliens stand a better chance at benefits than say Gays and lesbians loved ones? I stand back and I take alook at this picture and i ask myself: "what is so wrong with this picture?" You are willing to bend the laws a bit to support and benefit illegal aliens family members(and you never know if one of those illegal aliens may have been the father or mother of one of the hijackers). Yet, you will deny benefits that are equal to the ones that heterosexuals are getting? I cringe that our government allows such discrimination. What happened to all people are equal under the law? Or does that only apply to those that are heterosexual? 

We, in the gay and lesbian community, have had enough! we have had enough of people telling us that our way of life is wrong and unnatural. We have had enough of hatred towards our kind and our community while the government sits back and allows it to happen. And we have had enouhg of the discrimination based on our sexual orientation. I'm sure i speak like the rest in my community when I say ENOUGH IS ENOUGH! It is time that these heros and the people that were close to them be recognized and compensated for their heroism instead of their heroism being swept under the rug like it were nothing.It meant something to us and it meant a lot to those who were loved by them. It is time for the government to end this discrimination and allow these benefits to be equal and freely given.

Relief for gay and lesbian partners


December  21, 2001

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.
I am lucky because I am heterosexual and married and I fit society's idea
of who a family is.

Benefits for Gay Americans - 911 Fund


I just read an article that both shocked and saddened me about how
same-sex partners of those lost on September 11th may not receive the
same benefits as heterosexual partners of those lost.

September 11th has shown us the ugly face of hate in a way many
Americans have never seen it. The terrorists judged Americans for who
and what we are, and elected to punish us for it. On that terrible day,
they took the lives of people that they could not have possibly judged
as good or bad people, doing right or wrong in the world. We were all
labeled Americans and targeted for it.

Who are we to judge the value of our gay Americans... the quantity or
quality of their love, their commitment to each other, and the lives
that they built together? Same-sex partners of survivors are left no
less devastated or heartbroken by the loss of their loved one. Their
lives are no less destroyed than their heterosexual counterparts.

It's time, particularly right now in the face of trying to heal our
country from the horrible scars September 11th left behind, for us to be
very aware of whom we hurt on our own soil. Heart-wrenching events such
as these call for love and compassion to heal, not laws. 

I ask you to reconsider your program's stance on providing benefits to
the loved ones of gay Americans lost on September 11th. If the purpose
of your program is to assist the loved ones of those lost; to help them
rebuild their lives, to help them to face the future without the partner
or parent they thought they'd have the opportunity to build that future
with, I urge you to make decisions on that criteria alone. 

You have the power to do what it takes to make sure that these Americans
are honored and taken care of in an equal and just way. I do not want my
children's children to read about how gay Americans were discriminated
against in the aftermath of September 11th while others, even
non-Americans, were assisted, and wonder why. And they will wonder, just
as I wondered when reading my history books why African-Americans were
discriminated against in this country.

I beg you to give this issue serious consideration, and not overlook the
fact that the love shared between any two people is as real and true as
the hate that brought us to this moment.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving
families of the tragedy on September 11th, including the children and
families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader
earning millions of dollars per year might receive thousands of times as
much compensation as the survivors of a dishwasher in one of the
restaurants destroyed.  Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum
compensation level is set to lessen the disparities. It would be a double
blow to the survivors to first lose their loved one and then watch as most
of the taxpayer money went to those who were already well off in the first
place.

The second major issue has to do with recognizing the legitimacy of gay and
lesbian relationships and families. Gay and lesbian families are especially
vulnerable when one partner is killed. Because the option of marriage is
unavailable, these families may find themselves in the traumatic
predicament of having to prove that their union is legitimate. Fortunately,
both the Red Cross and the State of New York have already announced that
they will not discriminate against gay and lesbian families. The Department
of Justice should do the same.

will act on these very important issues.

Victims Fund

To whom it may concern:
    We are writing to express our utter dismay and disappointment with the 
recent announcement of the exclusion of gay and lesbian victims' family 
rights to access to the September 11 Victim Compensation Fund. This exclusion 
is clearly discriminative and shows that the U.S. still has a long way to go 
to be fully inclusive of every type of American that this country consists 
of.  It simply is not fair that relationships between gay and lesbian 
Americans are totally unrecognized, while unborn children and illegal 
immigrants are eligible for access to the fund. We truly hoped that in the 
shadow of this great tragedy, America would no longer tolerate such injustice 
and inequality. It is our sincere wish that you change the current status of 
the fund and honor the memories of the many gay and lesbian victims of 
September 11 such as             ,            , and            , as well as their surviving families and partners.

Compensation Fund

Dear Mr. Zwick:


I am writing in response to the Department's request for public comments
regarding the forthcoming regulations for implementing and administering the
"September 11 Victim Compensation Fund."  I strongly urge the Department to
draft regulations that ensure compensation is available to all victims of
the attack, including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic losses suffered
by the families of gay and lesbian victims are no less than that of other
families.  Just as the terrorists drew no lines in choosing their victims,
our country must draw no lines in compensating those who suffered the most
personal of losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom left behind
loved ones.  I urge the Department to honor these bonds by treating the
families of gay and lesbian victims as you would any other.

Dear Mr. Zwick,

I urge the Justice Department to include gay, lesbian, and heterosexual
domestic partners and life partners and their children in the regulations
regarding compensation and support for survivors of those lost in the
September 11th attacks.  To do otherwise is to divide our nation at a time
when we need unity more than ever.  It also proves to those enemies of our
nation that we are not "one nation...with liberty and justice for all".

Those lost in the tragedy our whole nation endured were not singled out for
their marital status nor for their sexual orientation nor their affectional
preferences.  They were targeted because they were Americans.  Please don't
discriminate against them now.  Many people lost loved ones in this terrible
attack-and many of them had gay, lesbian or domestic partners.  Many of them
were children of nontraditional families such as these.

Dear Mr. Zwick,
    We are writing in response to the Department's request for public comments regarding the forthcoming regulations for implementing and administering the "September 11 Victim Compensation Fund."  We strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and non-biological children of gay and lesbian victims.  
    Is there some question in your mind that the devastating grief and economic losses suffered by the families of gay and lesbian victims is less than that of other families?  How would you feel if a gay or lesbian victim was a member of your family?  Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks.
    Many Americans lost their lives on September 11, each of whom left behind loved ones.  How can you be selective about whose deaths are important?  Is this an example of our wonderful American democracy?  Gay and lesbian victims are also members of our country and the human race, and have to be treated as such.

         September 11 Victim Compensation Fund of 2001

Dear Mr. Wick:

This letter is in response to the Department of Justice's Notice of Inquiry and Advance
Notice of Rulemaking (66 Fed. Reg. 55,901 (Nov. 5, 2001)) (the "Notice"), seeking
public comment on the development and implementation of a program to provide
compensation to victims of the September 11, 2001, terrorist attacks.

            is a leader in providing accounting, assurance, and information
technology services around the globe, with 84,000 employees based in 130 countries.  Of
particular relevance to the Victim Compensation Fund,    performs accounting, internal audit, claims compliance audits, and tax services for several large class action settlement funds across the country.

Our comments are directed to the proposed claims process, eligibility requirements, and
compensation determination methodologies.

Claims Process

As outlined in the Notice, the Air Transportation Safety and System Stabilization Act (the
"Act") requires the Special Master to make a final determination on any claim within 120
days of its receipt, and, if an award is made, to authorize payment within 20 days
thereafter.

To comply with the time frame established in the Act, the Special Master may want to 
establish a process that expedites claims adjudication, allowing, in certain cases, for
claims to be decided on the basis of a paper record (the claim form and other written
evidence), without the need for a hearing.  If this is the case, claims forms must be
designed to provide all of the information that is needed to adjudicate the claim and to
determine an award.  At the same time, it must be easy for the claimant to understand and
follow.  To accomplish this, the individuals designing the claims process must coordinate
with those designing the forms from day one.  It has been our experience that such an
integrated approach, in which process and form designers work in tandem, accelerates
implementation and avoids potentially confusing, misleading and disjointed claims
procedures and forms.

Eligibility Requirements

Given the large sums of money to be disbursed by the federal government as a result of
the Act, there exists a high likelihood of individuals claiming rewards based on false or
fraudulent information.  One's presence at the World Trade Center, the Pentagon, or
Shanksville, PA "at the time, or in the immediate aftermath" of the terrorist attacks may
be very difficult to prove or disprove.

Additionally, any regulations should clearly define terms such as "physical harm," "at the
World Trade Center," and "in the immediate aftermath," to name a few.  To deter bad
actors, the claims forms should clearly communicate that the Justice Department will
prosecute individuals who submit fraudulent claims, and require a statement, signed by
the claimant or his representative, stating that all of the information being submitted is
factual to the best of his or her belief and knowledge.

Furthermore, provisions should be made, under the supervision of the Special Master, to
verify information contained on the forms.  Procedures should be designed that are both
comprehensive and sensitive to the claimant, and allow for random auditing of claims,
with special emphasis placed on exceptionally large awards.  Finally, potential claimants
should be advised that their forms might be selected for audit.

Nature and Amount of Compensation

Section 405(b) of the Act indicates that the Special Master shall determine the amount of
compensation based on "the harm to the claimant, the facts of the claim, and the
individual circumstances of the claimant."  As the Notice suggests, this will be difficult to accomplish in a detailed, consistent fashion given the potentially large number of
claimants and the short 120-day period in which determinations must be made.

We believe that a fair and consistent methodology for determining compensation can be
developed using statistical and actuarial techniques.  Matrices set up to determine
compensation based on the information provided in the claims forms would serve many
purposes, including:  treating each claimant consistently within the guidelines as 
determined by the Special Master, reducing the emotional subjectivity that could arise by
providing a framework for fairness, and expediting the process in light of the time
constraints established by Congress. 

Several large class action suits have used this methodology very successfully in determining
claimant awards.  Publication of such matrices would further assist potential claimants in
determining whether to apply for compensation from the Fund. 

Use of a matrix system for determining compensation would not unduly limit the Special
Master's flexibility.   Even with such matrices, hearing officers would need to weigh
individual factors when making a compensation determination.  Moreover, after notifying
a claimant of an initial determination, a claimant could request a hearing to present
additional information.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Dear Mr. Zwick,

     As parents who tragically lost two sons on September 11th, we would appreciate
the Dept. of Justice to consider our comments in order that we as a family be treated with
honesty and fairness relative to the intent of Congress to compensate the families for the their
loss.

My recommendations are threefold:

     1.) Utilize the methodology established but eliminate the cap, i.e. using the 98th 
          percentile. On December 17th before some 1200 victims' families, the Special
                       Master indicated with clarity and emphasis that there would be "no cap." A few
                       days later the Interim Final Rule was issued that
                         a) clearly indicated a "defacto" cap by adopting a 98 percentile ceiling. This
                                        is totally inappropriate because out of approximately 3000 victims there
                                       will be some 300-400 victims who earned six figures and dozens who
                                       earned a seven figure salary. Note well that while money is being
                                       expended from public funds, these same individuals have been paying
                                       significant income taxes over the years and have been creating jobs
                                       because of their production as well as buying goods and services
                                       providing for additional jobs. A jury in a court of Law would reward the
                                       families substantial awards because of such earning capacity. What is
                                       most disturbing is the Special Master's comments that an award of over
                                      $3,000,000 would be extraordinary. This gives the families an impression
                                      that is a contradiction. Congress had imposed no caps or stated that any
or
                                      all awards would be extraordinary or rare.

     2.) Allow the claimants a choice of using 1999-2001 earning period vs. 1998-2000.
          This would give those families' loved ones who just started their careers in the 
                       work force a more fair compensation methodology. It is also contemporary and
                       meaningful to utilize 2001 for both new and experienced employees.

     3.) Non-Economic losses should included an award of a minimum of $1,000,000 per
          family with additional payments of $100,000 for each dependent or for families
          who had multiple losses.

Finally, we endorse all those comments and recommendations that will be proposed by
