The money you are about to dispense was not donated under the expectation that it would only be distributed among heterosexual couples, it was given out of the goodness of people's hearts and souls for ANYONE who suffered a loss (or losses) due to this national event. I know that's where my money went. To deny men and women the monetary acknowledgement that others are receiving simnply because they may not have a piece of paper showing that the state calls them "married" is full of the same bias and prejudice which fostered the crisis in the first place. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. It is disheartening to see that your fund, which includes all heterosexual partners and children of victims (including fetuses and illegal aliens), has decided to exclude same-sex partners on the basis of a flimsy excuse of not wanting to get sued for giving benefits to people in States where they aren't required. It is obviously a transparent attempt to discriminate against gay men and lesbians, since illegal aliens, which are not entitled to financial benefits (and are in fact supposed to be deported) are being given full benefits and universal immunity if they come forward. The following comments reflect our dissatisfaction with the Fund as it stands in January, 2002 and the hope that our thoughts would be incorporated into the final proposal. a. Including pensions of the deceased victims as "collateral sources" against the settlement offered would leave most civil servants' families with little or no wrongful death compensation. Civil servants are typically on lower wage scales than those in private industry, but take pride in fulfilling vital services to their communities. As part of their overall compensation packages, they work for their pensions during their active duty so that they can rest assured that they and / or their families will be adequately provided for when their active duty ends. As families / friends of civil servants we view the inclusion of pension benefits as collateral sources as clear discrimination against blue-collar workers. b. Including life insurance policies as "collateral sources" discriminates against those who thoughtfully and responsibly provided for their families. c. Valuing the lives of our loved ones on a demographic chart is an insult to the dead. All human lives are precious and none are worth more than others, no matter how long the deceased lived or what his/her arbitrarily determined "earning potential" was. d. Capping emotional pain and suffering at $250,000 is ridiculously low particularly in comparison to court-determined awards in similar cases. We are not seeking funds to replace the lives of our loved ones. We instead wish the federal government and the airlines to admit their careless roles in the wrongful death of Americans. We note that our U.S. Constitution has been violated in numerous ways, most importantly by the fact that our Congress passed a law reducing the airlines' liabilities after (ex post facto) the events of September 11, 2001, thus limiting our potential to gain suitable settlements in traditional court proceedings, Further, we are discouraged to know that an unelected and unaccountable official will determine our compensation. We note that Mr. Feinberg has an unsuitable historical record in similar proceedings such as the "Agent Orange" cases in which he neglected to fairly compensate Vietnam War veterans. In this horrible time of grief and despair, our government has further victimized our families by infringing upon our civil rights. The government and media point to charity to compensate our families, yet fail to realize that such "awards" are often unequitable, poorly administered, and were not intended to take the place of negligent or punitive damages. We understand the long, uphill battle involved in changing a law and do not shy away from it. However, such proceedings would cause additional and prolonged pain to our traumatized families. Friday, March 15, 2002 10:54 AM September 11 Fund First, let me start by saying that, as a naturalized citizen and a self-proclaimed New Yorker, September 11 was one of the worst days of my life. I was two miles from ground zero, but watching the towers crumble is a sight I will never forget. And I grew up in a country racked by bombings (London in the 1970s was not a quiet and peaceful place). Secondly, I was horrified when I visited my brother, who lives in Bali (a Hindhu island, albeit in the largest Muslim country in the world) to hear the "well, you had it coming" attitude from Brits, Australians, New Zealanders alike; they felt that this government's arrogance and general discounting of the rest of the world contributed to the attack. Nonetheless... I happen to be heterosexual. I can't help it: I was born that way. There are thousansd of agencies in this country that are indivdiually owned, and many are staffed by individuals who work on commission alone. After the 9/11 events, these individual companies have been financially devastated by this diaster, and to date no one has addressed the financial losses these companies and organizations have suffered. Such as; travel agencies and tour operators. I, am such and individual who is working for a self employed owner of an agency. I have lost my position due to the decline in business since 9/11. I am facing being homeless, having my automobile repossessed and have no food in my home. There has been no assistance provided to those individuals who operate such agencies, why is this? Yet there are millions designated to bail out the airlines. The airlines have suffered yes, as well their employees, however, individual travel agents who are paid on comission and operate on commission can not file for unemployment or have furlough pay as such with the airline employees. The airlines do not compromise the totality of the travel industy. The travel industry is comprised of many other types of individuals, yet these professionals have not once been mentioned or offered any assistance and some are facing bankruptcy. Why is this? Also, on another note. There was never any thanks to Nova Scotia for all their assistance during this crisis. I, was one of those stranded passengers, along with another 10,000 people who were stranded in this Province. Yet no one has offered a thank you or even mentioned what happened to all those stranded people. Doesn't anyone realize that we were stranded for an additional five to six nights, that we were not prepared for finanically? Why aren't these individuals being focused on and offered some, if minimal assistance or at the very least recognition for being stranded and the trauma involved being stranded in a foreign country and feeling displaced and almost orphaned. Yes, those lives lost and their families, friends and associates will never recover from this loss. But no one has yet to ask what it was like being in a foreign country and seeing a plane fly into the towers, as an American and how that has affected us. Some of us returned to no jobs, or decreased salaries, as in the travel industry and yet these issuses and people have been totally ignored. I think we deserve to be recognized at the very least for what we have also lost. My friend, who owns her agency is barely hanging-on, and she is the sole support of her family. The consolidators and tour operators that we deal with have had to alternate their staffing because they can not afford to pay their personal for a full 40 hours. This is still happening, again, why is there no focus on this? Yet we are encouraged to travel, however, how can the media encourage people to travel when there is no support of the travel industry or any kind of bail-out funds for the travel industry. Were is the Americanism in this, in the total disregard and ignoring the importance of this industry? Who is the first person a traveler calls when they are stranded? Not the airline, but the agent who sold them the ticket and/or the tour or vacation package and where would we be if there was not travel agent to call and assist that stranded passenger or solve that all important vacation problem when you are in a country that has English as a second language, who does this person call? As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks.
