To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Other Victims--East African Bombings

Dear DOJ Federal Counter-parts,

    As a Federal government employee and a victim of the East African Embassy 
Bombing in Nairobi, Kenya on 8/7/1998, I would like for the Dept of Justice 
and the U.S. Government to please include the American citizens that were 
killed or seriously injured in the attacks on our Embassies.  Please note 
that the same terrorists group (Bin Laden and Al Qaeda) were responsible for 
the Embassy attacks on civilians, not armed combatants, and on American soil 
(the U.S. Embassy).  

   I believe we should be included in this compensation package also and the 
package should be renamed -- or changed to reflect a more inclusionary name 
such as the September 11, 2001 and August 7, 1998 Compensation Package.

   We too are Americans that were hurt and killed, and to date, we have 
received NO compensation.

Please tell me it's not true

I just received an email from a friend and I'm hoping it's some kind of sick joke. It said that gays and lesbians will not be compensated from the September 11 fund at the same rate as heterosexuals (or fetuses or illegal immigrants). I may not be gay, but I certainly recognize discrimination when I see it. In all the horror of 9/11, WHY would the United States use the Compensation fund to promote homophobia and discrimination? Did homosexuals not suffer as much, so therefore they do not deserve as much compensation? It is not their fault they are barred from marriage. This is not a time for our government to act in a divisive manner. I hope that the administrators of the fund will correct this error and make sure that ALL the survivors of September 11 are treated in a fair and equitable manner - no matter what their sexual orientation may be.

Re: September 11 Victim Compensation Program 

Dear Mr. Zwick: 

I am writing in response to the Department's November 5, 2001 request for public comments regarding the Department's forthcoming regulations for implementing and administering the "September 11 Victim Compensation Fund" established by the Air Transportation Safety and System Stabilization Act ("the Act"). As that Act makes clear, the purpose of the Fund is to provide compensation to any persons who were physically injured in the September 11 terrorist attacks as well as to the surviving "relatives" of those who died. 
I strongly urge the Department to promulgate regulations ensuring that compensation is available to all surviving family members of those killed, including the committed partners and the non-biological children of gay and lesbian victims. Just as the terrorists drew no lines in killing people, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific deaths. In promulgating its regulations, the Department should look not to legal formalisms that may define relatives or families for purposes of other laws, but rather to the realities of the lives of those who were killed and those who loved and were dependent on them. 
Indeed, it is clear from the Act that this is precisely the approach the Department must take in administering the Fund. The Act specifically identifies a number of "economic" and "non-economic" losses for which compensation is to be awarded from the Fund. These include burial costs, loss of earnings, physical and emotional pain, suffering, mental anguish, and loss of society and companionship. It is unquestionable that the survivors of those killed on September 11 suffered these types of losses regardless of their sexual orientation or marital status or their formal legal relationship to the deceased. Indeed, grief and economic loss know no such boundaries. The emotional devastation and economic loss caused by the death of one's partner is not any less because that person was of the same sex as the survivor. A child's anguishing loss of a parent is not any less because there was no biologic tie. Since the purpose of the Fund is to compensate survivors precisely for the types of losses suffered by family members of those killed, the Department's regulations should not and indeed cannot properly exclude anyone who was a family member in fact. 
In the immediate aftermath of the September 11 tragedies, as various victim-relief funds were being established, some on the extreme radical right criticized relief agencies that had made clear their intent to make funds available to assist not only surviving married spouses of persons killed in the attacks but also the surviving partners of gay men and lesbians who had been killed. These cruel and reprehensible calls for the exclusion of gay and lesbian families from relief efforts have been accompanied by claims that the effort to provide relief to all who have suffered is somehow a push for a so-called "gay agenda." However, the determination of who was actually victimized by the September 11 attacks, of who actually suffered loss, of who actually is grieving, is not about advancing some alleged political "agenda." What is at issue here is a human tragedy of unimaginable horror and dimension, and about the fair and humane treatment of all who have personally suffered from the acts of the terrorists. 
Many gay and lesbian Americans lost their lives on September 11. Many of them left behind loved ones, including partners and children whose lives were intertwined with theirs and who were dependent on them for financial as well as emotional support. A number of them are known to have engaged in heroic acts that day, and they have been praised as national heroes. It would be an insult not only to those heroes, but to all who died on that tragic day, for the Department to draw artificial lines defining loss and grief. In fact, it would be unconscionable. We urge that the Department's regulations reflect these concerns.

September 11 compensation

As taxpaying citizens, gay and lesbian Americans should have equal access to the compensation fund.  For Kenneth Feinberg to  wimp out on the survivors by invoking 'state law' is ridiculous and a specious argument.  Everyone who lost a partner, relative or spouse in the WTC destruction shares equally in the loss of their loved one(s).  So much for the ideals of the United States.  So much for democracy.  So much for "compassionate conservatism."  So much for human decency.

Mr. Feinberg, you should be ashamed.

Victims of Terrorism Tax Relief Act

My name is        and my brother-in law,        , was
killed in the World Trade Center on September 11th.

I would like to address a few key points regarding the Victims of Terrorism
Tax Relief Act:

 1)   Income Tax - Waives income tax liability for the year of death
and at least one previous year.

 2)   Estate Tax  -  Decreases estate tax under a formula that
shields the first $3 million in assets from both
       federal and state estate tax and $8.5 million in assets from
federal estate tax only for 2001.
       (this does not include state estate tax on this portion). 

 3)   Payroll Tax Relief - Refunds the two years worth of payroll
taxes of all those killed in the attacks.

Help all victims of terrorist attack


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex
unions.  They suffer just as grievously for their deceased loved ones
as do other survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups
and individuals who would have the Department of Justice limit
compensation to survivors of heterosexual unions.  They are interested
in a political victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.

dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.

Support Equal Access to Crisis Relief Benefits for Surviving
Gay and Lesbian Partners

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Victim Compensation Fund

On September 11, thousands of people lost their lives in the most tragic of
events my generation has known.  Countless people have been affected and
left to wonder what they will do now.  
I am writing to express my support of including domestic partners and
children of gay/lesbian partnerships in the plan for distributing the fund.
 Gay/lesbian relationships are no less loving, no less supporting, and no
less valid than any other relationship.  Those gay/lesbian victims of
September would want their families to be included in the Victim
Compensation Fund no less than any other victims.  Although gays and
lesbians do not have the same legal protections as other partnerships,
their families should be treated no differently.  As one nation--as one
human race--we all lost something on September 11.  Please do not exclude
the families of those gay and lesbian victims.  They have suffered as much
as anyone else.  The pain does not need to be worsened by discriminating
against or excluding these families.

paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.

9/11 Fund Exclusion of Gays

Dear Mr. Zwick:
I am saddened but not surprised to learn that some of America's fallen heroes are regarded as worth less than others, and that the loved ones and survivors of the former group of heroes are regarded as not worthy of respect and consideration in their suffering. You uphold discrimination against gay men and lesbians who are American citizens on the grounds that such is the states' law, but you are willing to bend the rules when it comes to illegal immigrants. Those who lost loved ones in the tragedy of 9/11 do not feel any less suffering or emptiness or hardship because the lost one was of the same sex. Please remember the lessons which 9/11 taught our nation, of strength and courage, of hope and renewal, of coming together as Americans beyond all differences and divisions. Don't allow bigotry and prejudice to excuse this injustice. Give the survivors and families of *all* 9/11 victims, whether gay, lesbian, or heterosexual, their rightful benefits. We have been saying, "United we stand." Let's live up to that. Thank you.

Try This ?

Greetings

The political agendas of the 'Religious Right' and the 'Liberal Left' remain in conflict, as usual, over even the 'little things' here in the U.S., even after Sept 11th when we need each other the most.

But now these agendas are drawn way out of proportion when it comes to dispersment of Sept 11 funds for victims of terror and the World Trade Center.

What I would do is simply render each surviving 'permanant member' of each affected 'Household' that lost it's primary source of income to be compensated.

Lets not balk at elephants and strain at gnats here.

Let the hypocrites do that.

Nobody cared, nationwide, who was gay and liberal and who was straight and conservative when Americans and foreign 'nationals' were working or just visiting the World Trade Center when this evil befell us all on Sept. 11th.

Why should we care now ? It's done and we have lost them. They were Americans, every one of them...somebody loved and cared about them.

Whats left is cleaning up the mess, rebuilding and going after the enemies of the United States who caused all this.

I'm fed up with these petty squablings and agendas of these two politically extreme antagonist. They need to go get a life and keep their noses out of other people's affairs. It's hypocrisy. We have bigger fish to fry which is the war on terrorism and unemployment/economy issues and learning how to protect ourselves against terrorism here at home.

"Terrorism does not discriminate".

"Our plates are full with this, in and of itself".

It is both secular and religious hypocrisy to exclude 'Permanant Household' survivors along religious lines and also, secular incriminating lines. 

We can't do that...at least not with something like 'this'.

So just find the surviving 'Heads of Households' and get the lists of ALL who were and remain permanant members of that 'household' who lost their primary wage/salary/ earner(s) and disperse the Sept. 11th funds accordingly.

Let the religious right extremist 'howl' over it because, besides, who else but George Bush and the Republican members in the House of Reps can they turn to push their agendas ? George W retains a high approval rateing...they'll get over it. 

Lets be fair about this. This isn't just a 'for families and kids only' type of event. This is for those who were permanantly dependant upon one or more of the victims lost at the WTC...period...it should go no further than that.

The stigma of 'morality' concerning the WTC victims of terror were not questioned before Sept 11th. Why should we do this now when we all need to be united against the enemies of freedom ? 

We have more important things to do besides putting up with the petty bickering.

We have a long term war to fight and win.

We have an economy to save.

We have the job of bringing world terror to justice.

We have the task of protecting Americans here at home.

We don't have time to put up with the 'extreme Left's agendas' and we don't have time to put up with the 'extreme Right's agendas'. It will take all our time, the government's and private business and plain 'folk' to just deal with what we have at hand.

So lets just DO it, get it done and go on ?

Protect Traditional Marriage

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation. 
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died. 
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have? Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist               , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
            accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution." 
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer. 
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should
do the same.

Dear Mr. Feinberg:

I am writing to ask you to carefully consider the way in which you
choose to administer the compensation to the families of all those who
died on September 11.
     If you compensate based on lost wages, then the survivors of the
bond traders will receive millions, while the survivors of the janitors
will receive very little. But whose salary will be more sorely missed?
The bond trader probably had both the funds and the forethought to
insure him- or herself, while the janitor's family was probably living
paycheck to paycheck. I think it would be more fair to at least set a
minimum compensation level across the board, so that these glaring
inequities don't happen.
     I also urge you to take into consideration that there will be
nontraditional families without a marriage license who nonetheless
deserve compensation for their loss. These include gay and lesbian
families who don't have the option of marriage, plus those who chose not
to formalize their relationships by legal means. The Red Cross and the
State of New York have chosen not to discriminate against these
families; I urge you at the Department of Justice to follow suit.

handling this formidable responsibility.

Dear Mr. Zwick:

I am writing in response to the Department's request for public comments 
regarding regulations for implementing and administering the "September 11 
Victim Compensation Fund."  I strongly urge the Department to draft 
regulations that ensure that compensation is available to ALL victims of the 
attack, including the committed partners and the non-biological children of 
gay and lesbian victims.

It is unquestionable that the devastating grief and economic losses suffered 
by the    families of unmarried and gay and lesbian victims are no less than 
that of other families.   Just as the terrorists drew no lines in choosing 
their victims, our country must draw
no lines in compensating those who suffered the most personal of losses from 
these horrific attacks.

Many Americans lost their lives on September 11, each of whom left behind 
loved ones.  I urge the Department to honor these bonds by treating the 
families of gay and lesbian victims as you would any other.
