As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I have not been able to find the complete actuarial assumptions that were used to create the proposed presumptive settlement amounts so I am limited to a few issues that were spelled out in the proposed regulation. The one of most significant assumptions in the calculation of the economic loss is the earnings level of the victim. The tables are based upon the average earnings for the years 1998-2000. This will often be representative of the victim's earnings for the middle year of that range, 1999. Since the economic loss is measured by the lost income from essentially 2002 and later, this "base" salary starting point is 2 or 3 years out of date, depending upon when you start applying the salary increase percentages. This would mean that your economic loss amounts would on average be 10-15% too low. In particular cases, the average earnings for 1998-2000 could be most unrepresentative of the victim's earnings capacity. In most situations, the best estimates of a person's current earnings capacity is their actual current earnings! I suggest that the starting point be based upon the annualized 2001 earnings. This might save you and the victim's families much time and effort in presenting and resolving disputes. A second adjustment that I would like to suggest is based upon the timing of the payment. The law provides for claims to be made up to December 22, 2003 and payments to be made within 120 days. Thus it is possible that some payments could be made almost 2 1/2 years from the date of the loss. It would be appropriate to add interest (at the rate used to discount future earnings) from approximately September 11, 2001 to the date of payment. In fact it would be improper to discount future earnings back to 2001 if the payment is to be made in 2002 or 2003 or even 2004. If further details of the calculations were made public, I might make other suggestions. If desired, I'm sure that you could call upon volunteers from the Society of Actuaries to assist in the process or review the procedures. I would like to close with a general comment. When Congress passed the law establishing the September 11th Federal Victims' Compensation Fund they also limited the ability of the victims to recover damages by alternative means. Victims must relinquish the right to bring lawsuits upon application to the Fund. These facts argue for a liberal interpretation of the law and giving the benefit of the doubt to the victims when deciding upon the assumptions for the calculations of economic and non-economic losses. I don't think Congress meant to penalize the September 11th victims versus others in other situations who have the right to pursue claims in court. At least I don't think any of them would admit to that. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." Friday, January 18, 2002 1:29 PM Interim Final Regulations Attachment 1: January 17, 2001 Dear President Bush, My Husband, &nbsp was murdered along with his &nbsp co-workers on the September 11, 2001 terrorist attacks on the World Trade Center. The interim final regulations written by the Dept. of Justice have not followed the intent of the Congress when they passed and the President signed the "September 11 Victim Compensation Fund of 2001" into law as Title IV of Public Law 107-42 ("Air Transportation Safety and System Stabilization Act"). Congress set up the fund to ensure that the airline bailout would not come at the expense of the victims families. The act mandates full and fair compensation to victims and their families for their actual economic and non-economic damages. DOJ has ignored this mandate and instead has written arbitrary regulations that will result in compensation levels far below the losses actually suffered by the victims and their families. In fact, many families total compensation from the fund and all collateral sources combined will not even fully replace lost income. In effect, these families will not receive any of the non-economic compensation required by the statute. After collateral sources are deducted, as required by the regulation, some families would receive nothing from the fund under the interim final regulations. DOJs formula allows for non-economic awards at only one-tenth the level paid in comparable cases, even though Congress explicitly enumerated a broader range on non-economic damages than could be recovered in any single jurisdiction. DOJs formula for non-economic damages is $250,000 for the person killed and $50,000 for the spouse and each dependent, In a wide variety of air crash and terrorism cases, judges, juries and mediators commonly have provided non-economic damage awards well into the seven-figure range. My children have to go through the rest of their life without the man that was helping to shape them into productive, honest citizens of this country. Hes no longer here to laugh and play with them, swim and vacation with them, be their soccer and softball coach. Is their pain only worth $50,000? The method that DOJ used to calculate economic damages has serious flaws also. Using outdated and inapplicable work life and life-cycle earnings data and data that tracks federal worker incomes and doesnt take into consideration the higher paying private sector career paths followed by the vast majority of the victims is just plain wrong. These employees were of above average intelligence and productivity and the calculations should reflect this. These points have been brought to your attention on several occasions by economists, attorneys and Howard Lutnik of Cantor Fitzgerald. These employees are part of the reason why America has enjoyed the prosperity we do and these calculations should reflect this. I implore you to rewrite these regulations in accordance with the original intent of Congress and the President. Please dont victimize us again. Wednesday, December 19, 2001 9:20 AM September 11 Victims Relief Fund December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
