Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Of course this has significant implications for same-sex partners, but it is not limited to them. As you contemplate the final regulations, I have both a question and a comment My question is, under the interim regulations, how do you interpret the position of the same-sex partner in a committed couple who applies for compensation for a victim who died intestate, having lost the person to whom he or she was emotionally committed, and with whom he or she shared a residence and whose finances were intermingled? In fact, the questions has two parts: A. What is the legal situation of such an individual if no blood relative of the deceased objects the claim made by the made by the surviving domestic partner? B. What is the status of the surviving claimant if a blood relative does object? I note that the interim regulations, you say this to be governed by state law. I repeat what I have said to you previously, namely that I do not find anything in the governing, legislation which mandates such a decision. That is, Congress clearly did not require you to follow state law, and we are dealing with a federal statute, under the usual workings of the supremacy clause of the U.S. Constitution. Beyond that, while I do not believe that state law should be binding in this regard, if you persist in this position, a question does then arise as to how you interpret state law. It does not seem to me that there would be state laws exactly in point. That is, we are dealing here not with the ordinary rules of inheritance, etc., but with a specific act providing compensation for the survivors of those murdered in this way. Thus, it does seem to me that if you are determined to look to state law as governing in this manner, it should be state law very broadly conceived. Indeed, perhaps a more appropriate phase would be "state public policy". As you know, Governor Pataki of New York has decided under his authority, pursuant to the New York State Constitution and state laws, that the New York State victims compensation fund will be administered in a way that recognizes the claims of domestic partners to compensate the victims of September 11. Is this not the best possible analog to the situation addressed by the federal law, and if it is, should not the federal law then be administered in a way that is fully compliant with Governor Pataki's Executive Order? Thus, to summarize my view, I continue to believe that there is no requirement that state law be followed, but if in fact you are determined to follow such a policy, state law ought to be broadly conceived, and certainly in those states where the legitimate claims of domestic partners are recognized in similar circumstances, the federal government should follow suit. Obviously this would apply even in those cases where other relatives might to seek to interpose objections, because the state policy clearly supports the claim of the surviving partner. Let's not compound the tragedy of the day by discriminating against some victims and their families. I sent in money shortly after the horrible events of that day, and I want all spouses to benefit. Wednesday, November 07, 2001 2:27 PM The 9/11 attack and evacuation of residents To Whom it may concern: On August 1st, 2001 I moved to 41 River Terrace along the esplanade, at the end of Chambers St. It is a building in what is called North Battery Park City. On the morning of 9/11/01 I was standing on the corner of West Side Highway waiting to get a taxi at 8:50 A.M. I witnessed the terrible attack on the World Trade Center. By the time the second plane hit, I along with hundreds of others ran for our lives. I escaped down a subway stairway. I am not alone in this but I feel that I will never be quite the same again. I still jump at any loud noise. For weeks after the attack, I had visions of the attack running in my mind. I went to friends uptown in the city and stayed there while I tried desperately to find out what was happening to the building where I lived. I tried countless times for information, walked miles every day to see if there was any news as to when or if I could get any of my belongings or important papers or medication. There was NOTHING on TV about any of the evacuees. NOTHING. Days later, I finally made it through the checkpoints begging, and got 15 minutes to gather everything I thought was important in my life. I was timed by a park employee along with others to be sure that I got back down into the lobby after 15 minutes. The treatment of the residents in this area by all authority and the Mayor's office and the OEM was deplorable. Two weeks after the event, we were told we could move back in but never given assurance to the quality of air, the safety of our environment. We then suffered thru weeks of checkpoints where we were never given proper ID's by the city or by our landlords (who were completely unavailable to the residents of these buildings). In short, we were evacuated or ran for our lives and then left to fend for ourselves until we returned home where we were treated like criminals by a myriad of "authority" and uniforms...one not knowing what the other was doing or "who" was truly in charge. I have been a resident of NYC for over 20 years, and I have never seen such poor organization and communication but I am beginning to understand it was poor all along it just showed up more in this crisis. While our Mayor was busy taking care of press meetings, going on the Oprah and Saturday Night live shows, 10,000 citizens were completely forgotten about, including by our Federal Government. Although one can understand the reasons why the event and loss of life for so many people would take precedent, there was no reason that the residents that were in such turmoil had to fend for themselves. We had no transportation....a resident had to get her way into the Command Center to represent us and plead to have a bus or shuttle come in to help us get around. There was no one to help the disabled. I saw an elderly woman with a walker, trying to get down the streets to a doctor and not one Police officer tried to find a way to get her help. We could have had the Red Cross get golf carts or something to help out those situations. People were struggling with their children's schools being taken over and not knowing how to deal with getting them to another school and then trying to get themselves to work with no transportation. I myself had go see the CFO of Mercantile Exchange to get some help on using their leased ferry for the residents of Battery Park City. Someone tell me why we as residents have had to do all this for ourselves. Where was our city government?? Busy taking tour guides of celebrities thru Ground Zero. At least that is what we saw each night on the TV.....not how or where were the residents that had to flee to parts unknown or any hotels they could find. Almost seven weeks later they still are not all back in their homes. And still no one has helped us from any city office. They apparently left it up to the Red Cross and FEMA to take care of us...but that is another story. I feel this city government committed terrible injustices to the residents surrounding the WTC. I have lost my job on top of this nightmare and am dealing with a rent strike because the owners will not offer a proper reduction on market value of what we signed leases against. Not one city official has stepped up to be involved in any of these issues involving property value or suffering. If it at all possible I want to sue this city for what took place here after 9/11. No one could have been completely prepared for this awful event but what went wrong with the evacuation of residents and what followed afterward, should not ever happen again to any American Citizen. I want it known that there was a second tragedy that took place within blocks of WTC and it was the neglect and complete avoidance of all the residents in this area. We are now facing major issues about our health. I want to know WHO allowed the residents to come back here to live if it was not testing safe...I understand it was the OEM. They should be brought up on charges. Today, outside my window, I now look at barges and cranes that remove the debris from the WTC on a 24 hour basis, no one in the building is getting any sleep and no one in the city offices cares. They had no regard for life when they put that crane where they did, their only concern was how fast could they get the debris out. When they took over the highschool and the middle school to use as a staging area for the rescue squads and the OEM, they had no regard for life.....there were other buildings near the area that could have been used. I intend to use every ounce of energy and focus I have left to make sure that the people who were responsible for making such inept decisions in regard to where people were living will be held accountable. Do I feel that I am entitled to compensation as a victim in this tragedy...YES. I do not want to see any funds denied to the families that lost loved ones but as I look out at the cranes and barges for the Weeks Marina company I see plenty of money going into the hands of a commercial company who had no suffering in this tragedy.....they are getting plenty of overtime and a lot of money from the Federal funds being given to NYC for this attack. The residents of this area should be compensated for the fact that they became victims in this tragedy along with the Small Business people and the families of those who died but not just because we were so dramatically effected, but also for all the injustices this city brought upon us as residents with their lack of concern or regard for our lives. Tuesday, November 20, 2001 12:56 PM September 11 Victim Compensation Fund of 2001 The purpose of this email is to provide comment and input into rulemaking on this important matter. Two choices exist for providing funds to victims: Lump sum payments or periodic payments that extend for life. You're likely aware of the studies that show that lump sum recipients dissipate their awards in five years or less. Usually, these recipients are poor money managers and/or have relatives or other influence peddlers who assist in this dissipation. So, the good intentions of the government to provide financial assistance are thwarted. These recipients will return to their current status in a very short time, and it is likely many will have to be supported by governmental welfare programs. Contrast this with periodic payment plans (often called structured settlements). Such plans, funded through life insurance companies, offer regular, life-long payments to the claimant. These payments, usually paid monthly, can be adjusted to accommodate changes in need (eg, when dependent children reach age of majority and/or graduate from college), or to reflect anticipated inflation (annual fixed adjustments). I strongly encourage the government to offer this solution and to fund it through existing life insurance companies. Benefits of this approach include: 1. Financial strengthening of life insurance companies. 2. Infrastructure is in place to process claims and make payments. 3. The industry has hundreds of qualified consultants who might assist in the analysis and processing of claims, including the need to create structures that reflect each claimant's needs. 4. It will eliminate the need for the government to create a large organization to handle claims. To facilitate the process, the government can solicit the current providers of structured settlements to join a pool for the purpose of speedy implementation. This group would agree on a common earnings rate that would fund the monthly payments. This would allow all major life companies (rated "A" or "A+" by AM Best, numbering approximately 20 such companies) to participate in an equal manner, and could be concluded in very short order with a minimum of time/resource investment. Current laws and IRS code exist to make all payments from this process tax free. That makes the payments of more value, and potentially lowers the total cost. Finally, this industry has norms and experience to assist in establishing the value of claims, especially if supported by industry experts who would create formulas for establishing amounts based on facts for each claimant. This group is in the field, in place and is funded through the life companies who would participate in the pool. In summary, this approach would: 1. Assure lifetime payments to claimants. 2. Provide payment flexibility to meet each claimant's needs. 3. Pour needed money into the life companies, stimulating investment and improved financial health. 4. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner."
