Friday, January 18, 2002 2:01 PM Fiancee's concern I lost my fiance in tower 2 of the WTC on September 11th. We were in a commited relationship for almost 6 years and living together for 2 years. We shared an apartment in Hoboken, NJ for one year before making the move to NYC. We lived in NY for a little over a year and this is where we planned on buliding our future toghether. Our Wedding was planned for June 8, 2002 In agreement with a comment sent in by another fiance I feel that all of a sudden my role in my fiances life seems less significant than that if we were married. Is spending almost 6 years with someone ,livng together for 2 years and planning a wedding less significant than a married couple who knew each other for one year engaged for a year and then married for a year before this horrible tragedy happened? Why becuase a piece of paper says it is legal?. In my mind and in my fiance's mind we were already married and anyone who knew us thought the same. We did not need a piece of paper formalizing our commitment to one another and now in the wake of tragedy who is to say that this is what is right and that I should not be acknowledged as a Spouse? Tuesday, January 22, 2002 3:33 PM Compensation I would just like to comment that if what I read is correct I think it is terrible, almost as bad as the tobacco settlement which was one of the most asinine settlements ever made. I am truly sorry that lives were lost in this disaster and am sure that lives have been changed forever because of it. However, as I understand it, victims are receiving in excess of 1 million dollars each. This is astronomical. 99% of the citizens don't carry anywhere near that amount of insurance but yet they are complaining that they are not receiving enough. With so many needy people in the United States alone, surely some of this money could be distributed to other causes. How about the servicemen and women who are being killed; how much are they receiving? Don't they deserve it every bit as much as anyone else? This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. Tuesday, December 25, 2001 8:28 PM Equal Access for Surviving Gay Partners December 25, 2001 Dear Mr. Kenneth Zwick, I am writing to you as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I believe all vicitms from Sept 11 should be treated equally by the govt. Rumor has it (although perhaps incorrectly) that the airlines victims are receiving $2million for their pain and suffering, whereas the WTC victims would be receivng $250m I do not think the families of victims who were financially responsible should receive less from the govt. Specifically, life insurance proceeds , for which victims had to pay premiums, should not be deducted. In some cases, the life insurance deduction would result in virtually a $0 payment. Likewise, 401k funds should not be deducted. This was the victims own money! I have heard Mr. Feinberg speak that he cannot play Solomon. So I believe if you take a victims earnings potential and proceed on an actuarial basis, and account for dependents. it will be fair. While &nbsp&nbsp&nbsp&nbsp did not have dependents, I believe that her beneficiaries should be compensated for the loss....in this case of their only child. Thank you. Sunday, March 17, 2002 11:58 PM Support Compensation for Gay/Lesbian Partners of Victims I urge you to support equal compensation to the partners of gay and lesbian victims of September 11th. One gay man, , helped bring down the plane that might have otherwise crash-bombed into the Capitol. Hundreds more died; their lives are just as valuable as the other victims. These were mostly American citizens; we must treat their surviving partners with equal consideration of legally-wed spouses. So if you're putting a dollar amount on one's husband, father, son, daughter, mother, wife, etc. how can one person's love one's life be worth more or less than another. How can someone be penalized for having a pension (which they had to pay for) or life insurance (which they had to pay for). Will the payments they made to their pension and/or life insurance premiums be deducted from this award. Charaties are on a needs basis, this fund should not be on a needs basis, it should be equal for all. The best way to distribute these monies is on a lost wages formula. That's how it would be determined if one was to sue. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. For example, Northwestern Mutual Life indicated on their web site that they have paid out around $125,000,000 in death claims to date to about 120 policyholders. This averages out to over $1,000,000 in death benefits from their life insurance. If this is the case I suggest that further financial information be obtained from the claimants to see if they really need the money. It seems the funds donated could be put to better use by being sure those who did not have any life insurance on themselves have benefits available to help the truly needy.
