"In an appearance on the Sunday, March 10 broadcast of NBC's "Meet the Press," Kenneth Feinberg, the head of the September 11th Victim Compensation Fund (a fund created by Congress and run by the Department of Justice), said that gay partners of the heroes of September 11th will not necessarily be eligible for the same compensation as heterosexual family members who lost their loved ones. According to Feinberg, lots and lots of people will receive compensation under the plan, including children, babies, and even fetuses. And as an indication of how generous the fund will be, even illegal aliens, who aren't American citizens and who are in the US in violation of federal law, will receive benefits. Feinberg even says that the Attorney General has promised that if undocumented aliens come forward, they won't be kicked out of the country, and their employers won't be penalized. "The attorney general, in consultation with Immigration, etc., undocumented aliens who come forward, the families will not suffer any consequences. They are covered by this program. They will get a check. The employer, where we need the economic information about the undocumented alien, will not be penalized," Feinberg told "Meet the Press. [Gays and lesbians are] left out of my program to the extent that their own state doesn't include them. I cannot get into a position in this program, which has a one-and-a-half or two-year life start second-guessing what the state of New York or the Commonwealth of Massachusetts or the state of Virginia or New Jersey, how they treat same-sex partners, domestic live-ins, etc. I simply say this: What does your state law say about who is eligible? If your state law makes you eligible, I will honor state law. If it doesn't, I go with the state. America has already shown generosity via charitable contributions. Why should the taxpayer to help the survivors live in luxury? These people have already suffered the enormous loss of their loved ones. Now, they suffer doubly by having their relationships deemed unworthy by the very society in which they lived and in which their partners unwittingly died. Every single person who perished in this horrible attack--regardless of the texture, shape, or size of his or her part in the great American mosaic--deserves to be honored in the fullest possible way. This includes honor and respect for the ones they left behind, the ones with whom they chose to lead their lives, the ones who will remember and mourn for them long after their names have faded from your and my memories. I have studied your recent comments about the Fund and find your argumentation as to why you must discriminate morally and intellectually indefensible. On September 11, 2001, my youngest son , along with thousands of others,was killed in the terrorist attack on the World Trade Center. The pain of his loss and subsequent grief has been incredibly difficult to bear as I am certain you can understand. I am continuously haunted by the thought that he suffered a harrowing death by fire , unable to escape from the 104th floor of WTC1. I do understand the need to resolve the issue of compensation to avoid prolonged litigation which could potentially have long term economic effects on our country . I also believe that the Victim Compensation Bill addresses these issues perfectly. For it to work effectively though, I believe it must be applied equally, simply and non-discriminately. My suggestions are, as follows: 1. The amount of the Settlement should be set ? the same for every applicant, no discretionary decisions . All of us are suffering the same grief regardless of our position in life. Arbitrary decisions made on a ?case by case? basis will only require us to hire attorneys to write our appeals to insure that our cases are pleaded properly. What will happen to those who do not have the funds to afford a top lawyer? A pre-determined offer of settlement based on relationship would also eliminate need for appeal. Take it or leave it. 2. Insurance and other payments should play no role in determining amount of settlement. To do otherwise would require the submission of reams of documentation . The loss of life and subsequent pain and suffering is the same for all of us. 3. Most important, please try to keep a simple, uncomplicated process. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions of the rights of the victims" relatives to recover damages from court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. Remove arbitrary income limits. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held and where they worked-the World Trade Center, the Financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support they provided their families before their death. 2. Increase non-economic rewards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Congressman Peter King,"Å every death is tragic. A murder is particularly tragic. Sunday, March 17, 2002 4:35 PM 9/11 Fund Exclusion of Gays To Whom It May Concern, I am outraged that families of gay and lesbian victims of the 9/11 tragedy will not be automatically compensated in the same way as families of heterosexual victims. Americans have pulled together as never before as a result of this tragedy and denying equal compensation to families of gays and lesbians is to alienate queer and queer friendly Americans (and there are quite a few of us). Discriminatory policies are not new to gays and lesbians and their families, however this policy is particularly offensive. The entire country felt an extreme sense of loss on that day, one which will last for many years to come. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed.
