Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. This importantly should include the partners and children of same sex unions. I am outraged by what I was reading. I don't want to take anything away from people that suffer losses on September 11, 2001. But providing money for people that are here illegally because they are not gay is simply outrageous. Gay people are a big part of the economic stability. They are the one spending money on restaurant, house and house remodeling, buying cars, traveling, buying clothing and all. Tuesday, March 12, 2002 4:26 PM Protesting the Exclusion of Domestic Partners from the 9/11 Fund As a gay American, voter, and taxpayer, I am writing to register my disgust at the exclusion of domestic partners of victims receiving compensation from the 9/11 fund. This is biased, and reinforces the message that gay people's families, which include partnerships as strong as any marriage, are less worthy of financial support than even illegal aliens' families. Obviously state and federal law have been ignored in the case of illegal aliens, but when it comes to American citizens, it is simply more politically expedient to hide behind "existing state laws." All domestic partners who can provide proof of a lasting relationship (lease, financial interdependency, assignment of wills, life insurance, and 401(k)s, etc) should be included. 9/11 affected EVERYONE, Americans of all races, colors, creeds, nationalities, religions...and gay people died along with them. DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. Our insurance company paid for 30 days additional living expense which helped immensely, but my husband's asthmatic condition is much worse when we are at home. I have lost my sister in law who supported her 75 year old Mom without a pension. What is she going to do for the rest of her life. You can never repay us for the lost of a vibrant, full of life hard working woman. Atleast, do the right thing and represent the true heroes, the victims...rightfully. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. Monday, January 07, 2002 12:05 PM Protect the rights of Domestic Partners Dear Mr. Zwick, I am writing you out of concern for the "domestic partners" of the victims of the tragic events of September 11th. Will fiancees and other domestic partners be eligible for compensation from this fund? Would it not be reasonable to follow the guidelines of international human rights organizations, such as Amnesty International? What about the eligibility requirements already set up by the New York State World Trade Center Relief Fund? Obviously, a person would have to show documentation to prove him or herself as the "domestic partner" of a victim. The documentation permitted would include documents like insurance policies, bank and credit accounts, leases and mortgages, health insurance policies, that is documents that a casual partner would not in a million years be able to produce. This is not the time to impose a political agenda or ideology on the life-styles that a particular victim had chosen. There were plenty of people living together in long-term common-law marriages that lost their life partner on that day, and it would not be right to by-pass them for the benefit of whoever the closest living relative is. To illustrate one of these cases, I would like to share my own perspective with you: on 9-11 I lost my fiance, and with him the children we were planning to raise and the life we had been planning and building for years, and which we should have been enjoying for another 50 years or so. What should have been the happiest few months of my life, as I was planning our wedding for New Year's Eve (which would have also been my fiances 35th birthday) was in an instant turned into a period of grief and anguish beyond words. The bureaucratic problems I have been running into since my fiance and myself were not married yet, are nightmarish. I should also mention that his parents are deceased and the person considered his next-of-kin is an estranged sister with whom he has not had any contact for years and whom I have never met even though me and my fiance had been living together for the last four years. I do not think it is just or fair in any way to annull the decisions that individual victims had made in regards to their own lives. It is not reasonable to expect that the victims should have had wills made out, since the majority of them were much to young to think about this type of issues. It is fair to push aside the fiancees and domestic partners of these people just because they were not yet married or because they choose to live together un-married or because of their sexual orientation. This fund should be looking to compensate the family of the victim, and I think that the person you wake up with and go to bed with every day for years, the person that you make a promise of marriage to, the person that you share the expenses of your daily life with as well as plan a future with, is more of a family than someone you share some genetic charcteristic with but not much else. I hope that you will take my perspective and thoughts on this into consideration. Even though every situation and set of circumstances is unique, I know for a fact that I am far from the only person in this type of situation. I hope that you will be able to come up with a set of reasonable eligibility requirements for this compensation that will not exclude the "domestic partners" of the victims, but rather strive to accomplish basic fairness which would take into account the individual circumstances of each "victim" remembering that every single one of them was a person with a different cultural, ethnic, religious and ideological back-ground. Tuesday, January 22, 2002 7:45 AM (no subject) To Whom It May Concern First, I wish to request any available information concerning the Victims Compensation Act and the enrollment process. My brother-in-law was killed during the WTC attack, as he was on the 95th floor of the North building. I am attempting to assist his wife in the processing of benefits that she is eligible for. My name and contact information are listed below. Next I would like to address the provisions of the Act. Some criticism has come from familles that believe that the fund is insufficient and lacking. I personally feel that the government is being more then generous in it's efforts to provide compensation to the victims. I have persuaded my sister-in-law to pursue this avenue that is available to her and to disregard the legions of plaintiffs attorneys that have been attempting to derail this process. We have been subjected to numerous attorneys encroaching upon our families grief in an effort to ingratiate their pockets. If any piece of legislation should have been passed, it should have been a law protecting victims from attorney solicitations. As early as the second day after the attack, we had attorneys calling us, attempting to allow them to represent us, and no doubt, initiate a law suit. What I would like to see is the DOJ initiate actions against these attorney's that are steering the victims to institute class action suits against the airlines and Bin Laden. I truly believe that in the end, the victims will not receive additional compensation to this fund, and will be victimized again when they see how much their attorneys will walk away with. I also wish to say that I believe that the rules set up for the disbursement of the fund are both fair and adequate. I believe that other forms of compensation that the families received should be deducted from the total sum of the payment. I also believe that the total sum should be means tested. Since this is taxpayer money, it should not be a "free for all." I believe that people are becoming greedy and should be thankful for what is being provided, instead of looking for more. I also believe that families that receive large sums of money from insurance payouts should be zeroed out, as they have been provided for. I would encourage you not to bend to those who find the fund inadequate, and proceed on your original establishment of the rules. For there to even be such a fund available, is remarkable. If any of these people had simply died by any other means, they would not have any of this money available to them.
