My name is &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp and I am writing to you in regard to the recent
announcement of the preliminary award figures from the September 11th Fund.
My mother &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp was one of &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp most dedicated employees.
She worked for &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp for more than 18 years.  &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp
The minimal salary she received kept us
afloat for many years as she struggled to keep her head above water.  This
woman raised me all by herself from the age of sixteen to my mid twenties.
We had a wonderful relationship and I refused to leave her all by herself
to live alone until I got married.  She was an extraordinary woman who was
admired by all who knew her, for her inner strength and sense of humor.
She taught all her children how to respect and love ourselves above all.
For we could never love others until we truly loved ourselves.  She was the
true matriarch of our family and the center of everything we planned.
So without hesitation, my eldest
sister &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp quit her six-figure job in Manhattan to take care of my
sister and her children.  &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp has three children of her own and she has
had a very difficult time dealing with this horror.  &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp and my mother
were more than just mother and daughter, they were great friends.  We all
have been scarred by this event.  I myself, witnessed the fire and collapse
right in front of my own eyes from my office building in Manhattan.  When
the buildings collapsed I dropped to my knees in front of all my co-workers
and balled my eyes out.  That image of the building collapsing is burned in
my memory and appears whenever I close my eyes.  I recall walking aimlessly
through Manhattan that day, walking downtown as thousands walked past me
going uptown.  I was scanning every face that passed me, hoping to see her
beautiful face.  But I never did and I know I will never see it again in
this life.  We still have not received any remains either.
     My sister's and I speak on almost a daily basis and try to help each
other through the sheer insanity.  On September 11th my family members were
victims to one of the most heinous crimes in the history of the world.
Then on December 20th we became victims for a second time.  This time, by
our own government that I love so much.  The mere pittance that the
government thinks my mother's life is worth, is an insult to our family and
should be, to all of the caring and thoughtful Americans who emptied their
pockets to help the victims families.  With regard to the unbelievable
outpouring of monetary support, I just want that thank the American people
from the bottom of my heart for caring so much.  But I also would like to
apologize to them, and tell them that their good wishes may not have
reached the people they intended to reach.  From what I hear in the media
approximately $1.4 billion has been collected from the public so far, my
family to date has received approximately ??$20,000.  Seems to be a little
problem with the math here huh?    Let's see?$1.4 billion, 3,500 or so
victims should be about $400,000 per family right?   Seems as if the
charities use the same mathematical calculations that the government used
in figuring out the "Victim Compensation Fund".  The presumed payouts from
the Government's Victims Compensation Fund are an utter insult and I take
major offense.  I keep hearing about the average payout being $ 1.6 million
per family.  Well let me give you the actual figures.  According to the
charts provided yesterday, our government feels that our mother's life is
worth $250,000.
      The other thing I think that needs clarification is the fact that the
government is not giving a "gift" to the victim's families.  The government
knows that the airlines were negligent.  The airlines did not provide the
proper security to prevent these animals from boarding the planes with
knives in the first place.  They did not provide a cock pit door that was
impenetrable.  Have you ever seen those cockpit doors?  I had a stronger
door on my tree house as a kid.  If they can't get in the cockpit, they
can't crash the planes into the WTC and kill 3,000 people.  It's that
simple.  It is all about profit, and the airlines did not want to eat into
their profit to provide these safety measures that would have prevented
this catastrophe.  THAT IS WHY THEY ARE NEGLIGENT AND THAT IS WHY THE
GOVERNMENT BAILED THEM OUT.  The government knew that if they didn't step
in, the airlines would go bankrupt.  The other little caveat the government
snuck in under our noses in the Airline Stabilization Act is a cap on the
liability to the airlines.  Meaning, if we choose not to accept this
"offer" and choose to sue the airlines, then the cost to the airlines would
be minimal.  This is unprecedented by the way.
      Now back to the offer by the government.  I do not argue with the
economic compensation part of the award.  Which you see many greedy people
on TV challenging.  I do not even argue the fact that my mother's portion
of that amount is only 50,000 compared to the millions that others will
collect.  I do not even argue that.  What I do find the biggest insult of
this offer, is the non-economic portion.  The government states that for
the pain and suffering this has caused all of us we are entitled to
$250,000.  Which will be reduced by the amount of my mother life insurance.
Correct me if I am wrong but when was the last time a settlement in a
negligence lawsuit was reduced by the victims insurance.  I'll tell you
NEVER!!!!   That is money that my mother paid out of her own pocket for.
The airlines didn't pay her premiums, the government didn't pay her
premiums.  The thing that gets me so upset is the fact that I personally
know people who have settled lawsuits for minor car accidents that caused
them to miss a few weeks of work for more than $250,000.  And these
settlements were purely for pain and suffering.  THESE PEOPLE ARE STILL
ALIVE.  My mother was a victim of possibly the most hideous crime in the
history of man.  And the airlines and the government were asleep at the
wheel.   How can the government possibly compare a minor car accident to
this cataclysmic event?  I personally, can not even put a figure on the
physical and emotional damage that has befallen my family.  I am not saying
that my mother should receive the same amount as others.  After all, most
of the people who perished were the sole breadwinner in their homes.  These
people need to be taken care of first and compensated at a higher level
than my family.  I know what's right and what's wrong.  When someone
contacted me from the &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp , I stated that I refused to take
any money until all the mother's with children were taken care of first.
Which is exactly what they did.  This is not a matter of greed it is a
matter of respect.  I think the American public needs to know the truth
about how this "offer" insults the families of the older people involved in
this tragedy.  I implore them to think for one second how they would feel
if it were there mother or father who was crushed to death and then had to
live with the idea that their parents remains may very well lie in a dump
right now.  It torments me to write that, but this is the reality of the
situation and we have to deal with that on a daily basis.  I need to ask
Mr. &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp (the administrator of the fund) why he feels someone his own
age is worth almost nothing dead or alive?  Would he be satisfied that his
family would receive the same compensation as someone involved in a fender
bender?
      I for one, love my country and support it every chance I get, but I
am extremely ashamed that my government insulted us this way.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

let charity be charity

I can not believe what a horrible system this country
has when it comes  to giving charity. Charity that is
what it is. It does not mean give back, borrow or
repay in any given form. People give to be kind and to
help, why would you consider taking back any type of
charity from people. You should be embarrassed for
even thinking about it.
As for other life insurance policies, I can not even
imagine how that would have any type of impact on any
decision involving the airlines. Our husbands and
wives died at their jobs while making a living and
because of the negligence of proper security you
should be giving the largest sums of money possible to
people, with a smile on your face not thinking about
what they already have. The airlines owe their lives
to us.

Mr. Feinberg
                     
                I am writing you again regarding who is eligible to claim
funds from the compensation fund. I have read many of the comments that have
been posted . I have also written letters to The Attorney General of
N.Y.,the Governor of N.Y., My State Senators and I have spoken to my
attorneys. I am the fiancée/Domestic partner of a victim from the WTC
attack. Apparently  there are many other people in the same situation as I
am ,which is not knowing if we will be part of the claim process. The woman
I love was brutally attacked and murdered just as all the rest of the
victims were.    and I were as much married and dependent on one another
as anyone else who actually was married. We supported each other
emotionally,financially and spiritually!  We cared for each others families
without hesitation, We lived life for each other as soul mates . We were
inseparable except when we were at work . My pain my grief my loss is
something only the other victims families could understand. There is no way
to describe what has happened to all of us . The nightmares awakening me
with screams the visions of death the ache in your heart in an instant
perfect harmony changed into a tragedy. The loneliness the empty chair  no
one to warm your feet on a cold winters night. You can almost say you are
close to being catatonic. I am not judging the amounts to be given to the
victims families I cant imagine trying to put an amount on pain and
suffering or determining what someone may have made 10 to 15 years down the
road. All I'm saying is that documented fiancée/domestic relationships must
be eligible to receive compensation under your rules. You have told me in
the past it's the state law that dictates who is eligible. I spoke to the
attorney general and the Governor and they say the state law has nothing to
do with who is eligible for the fund its strictly up to you Mr. Feinberg.
Don't just hear the people listen to them they are crying out to you.

Equal Rights For All

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Interim Final Rule/Economic loss calculation

Dear Mr. Feinberg:

 I believe there may be at least one significant inconsistency
between the provisions of the economic loss calculations as set forth in
section II(A) (1) and the precise language of the enabling statute.  The
guidelines apparently utilized by the Justice Department to calculate
economic loss in Step One of the section referred to above state "This
projected future income is adjusted to account for taxes that would have
been paid.  This calculation uses the effective state, federal and local
income tax rates currently applicable in the state of the victim's domicile
for tax purposes."  Having evaluated, negotiated and litigated several
thousand wrongful death cases in New York and many other jurisdictions over
the last thirty years, I am aware that there are several jurisdictions that
do not allow for the deduction of federal, state and local taxes from gross
income in computing the net economic loss.  New York, the last time I
looked, is one such state.  (See Woodling v. The Garrett Corporation,  et.
al.,  813 F. 2d 543 (2nd Cir., 1987))

 The legislation in question directs the Special Master to determine
"economic loss" ...to the extent such loss is allowed under applicable law."
Decided case law clearly indicates that "applicable law" is applicable state
law, not federal law.  If that latter phrase is interpreted to apply to the
entirety of that paragraph, and the Congress could have been more specific
if it were not to apply to the whole paragraph, then the statute requires
that taxes not be deducted from gross earnings in determining net pecuniary
loss in most of the cases in question.  For a 30 year-old decedent, this tax
deduction greatly reduces the available award.

New York monetary fund

Apparently, September 11 has not caused us to transcend our differences.  To even suggest that gay/lesbian partners will not receive equal compensation to heterosexual couples is nothing short of disgusting.  We are truly a nation of hypocrites to discriminate in such a way.  We have truly reached a new level of bad behavior.

I urge those of you with the power to make these decisions to rethink your attitude.  Every loss is the same.  It has nothing to do with lifestyle.

Mother Theresa once said, "If we judge people, we have no time to love them."

Have we become a nation without love?  It appears so.  How sad.  How very, very sad!

gay and lesbian victims should be compensated also!

Dear Mr. Zwick:

I am writing in response to the Departments request for public comments regarding the forthcoming regulations for implementing and administering the "September 11 Victim Compensation Fund." I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims.

It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Protect Traditional Marriage

Dear Mr. Zwick:
 
I want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation. 
Funds disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died. 
To provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have? 
Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist             , writing in Out magazine has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If the DOJ provides funds to "domestic partners," it will be helping
             accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." 
We also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer. 
The money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

Victim Compensation Comments

Dear Mr. Zwick:

I am writing in response to the Department's request for public comments
regarding the forthcoming regulations for implementing and administering the
"September 11 Victim Compensation Fund."  I strongly urge the Department to
draft regulations that ensure that compensation is available to all victims
of the attack, including the committed partners and the non-biological
children of gay and lesbian victims.

It is unquestionable that the devastating grief and economic losses suffered
by the families of gay and lesbian victims are no different and no less than
are suffered by other families.  It is unthinkable that some people in the
Department of Justice (!) should even hope to have the power to deprive
these families of compensations given without question to more conventional
families, of whose structure and makeup they approve.  The terrorists drew
no lines in choosing their victims, and our country must draw no lines in
compensating those who suffered the most personal of losses from these
horrific attacks.

Many Americans lost their lives on September 11, each of whom left behind
loved ones.  It is easily imaginable that the marriages of at least some of
the widows and widowers created on that day were not as happy or love-filled
as at least some of the domestic partners who are left bereft.  Who is to
judge that any one is suffering more than anyone else, and therefore more
deserving of compensation?  Or is the motive for wishing to withhold funds
from gay and lesbian commited partners simply punitive, a desire to punish
them for lifestyles of which some Americans disapprove?  I urge the
Department to treat the families of gay and lesbian victims no diffeerently
from any other.

Lest you be inclined toview this communication as perhaps coming from
someone with a vested interest in any part of the 9/11 Victim Compensation
Fund, I would like you to know that I am heterosexual, the biological mother
of four children all of whom have the same father--to whom I was married for
28 years--that I live in California and personally know no one who was in
any way directly involved in the September 11 attacks.

11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

no bigoted policies please

Dear Mr. Zwick:
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Comments regarding September 11th Victim Compensation Fund



I lost my brother,       , 36, on 11 September 2001.  There 
was so much pain, and still is, during the 11th as I first listened on the 
radio, on my way home from work, as it was reported that the building that my 
brother worked in collapsed, and later, as I sat with my parents and watched 
in horror the events that unfolded on television.  My brother has a wife and 
two children, that were less than three years old in September.  They must be 
taken care of.  However, my parents raised my brother, cared for him as a 
child, relished in his victories of later years, encouraged him through his 
defeats.  As a sister, we shared, family vacations, cheering for each other 
during sporting events, encouraging each other towards success, double 
dating, and discussing everything from relationship of the moment, which skis 
were the coolest, how far we would run tonight, where to go out that evening 
and what time we would meet, and how to select a school for our children.



Because of all of this, although there is an expediency issue in dealing with 
multiple representatives of any family, I believe that it is important for 
the Department to consider the significance of the loss of a husband, wife, 
father, mother.  However, the Department should not ignore the significance 
of the loss to a mother, father, brother, or, in my case, sister.



I understand that there must be a systematic manner in which to administer 
this fund.  However, in choosing to deal with a single representative of a 
victim, it is evident that the Department has already foreseen the potential 
for conflict.  This has been an emotional time for every survivor.  Why not 
avoid further distress, keep all survivors involved in the process, not just 
a single family representative.  Although this event has worked to make many 
families pull together, supporting each other.  The potential of a single 
family representative may push many families apart.



As to drawing distinctions regarding the location of the death, I do not 
understand the significance.  My brother was located on the        floor of 
wtc tower 2.  He worked for       .  Although I try not to imagine 
what happened to him following the impact of the United Airline flight, it is 
impossible for me not to try to imagine.  It is probably better for there to 
be no distinction, preventing those survivors from further imagining the 
circumstances of death.  And does it really matter, dead is dead.  As to 
where the location of the death occurred, is that really important.



Collateral sources should have no direct impact on the amount of compensation 
received.  My brother worked very hard in life.  In his death, should his 
survivors be penalized.  Do you think that people made contributions to his 
family, knowing that this may reduce the amount of compensation that his 
family may eventually receive.



I know that this document has been moved forward quickly in order to help the 
survivors of this terrible, tragic event.  I hope that in continuing to move 
this process forward, the Department will continue to be diligent in your 
efforts.  However, I also hope that the Department will be cognizant of the 
need to be sensitive to the families of the victims, limiting the amount of 
stress that they must continue to undergo throughout the duration of this 
process.

$1000 per head - fair compensation?

Dear Ken (aka Santa Claus)


I just heard on the radio the U.S Government is providing $1000 per family
to compensate for innocent civilians accidentally  killed by U.S bombs and
soldiers   last week.

$1000 per victim in Afghanistan - if that's good enough in Afghanistan that
should be 
good enough in N.Y - Let's be generous and pay them all $2000.

SEPT. 11 COMPENSATION

I am outraged to learn that domestic partners of Gay and Lesbian people
will not receive compensation for the loss of their loved ones in this
terrible tragedy.
Hasn't there been enough proof that the majority of Gays are fine,
upstanding citizens who are patriotic and have a love for their country?
How dare they be discriminated against in such an arbitrary manner
simply because of their sexual orientation?
I am an 81 year old straight, senior citizen who has been involved with
helping the Gay and Lesbian Community for more than 20 years.  My life
has been enriched and enhanced through my contacts with these highly
intelligent, talented, caring and compassionate people. They do not
