Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Monday, March 18, 2002 6:58 PM On the discrimination against lesbian and gay partners of 9/11 victims I have read about the proposed inequitable treatment and compensation for gay and lesbian partners of 9/11 victims. I am outraged by this inequity. Some of the most prominent heroes of 9/11 are acknowledged by their families, partners and the media to be both gay and lesbian and oustanding men and women. To disrespect their memories by delegitimizing the rights of their partners to seek compensation is blatantly unfair. The Victim's Compensation Fund will not discriminate against heterosexual partners of the deceased, and even will not deport illegal aliens who are discovered in the process of getting benefits to the victim's families. Turning a blind eye to the legitimacy of partners of gay and lesbian victims is cruel and unfair - and flies in the face of American public sentiment that all victims' families should be treated equally. Thursday, January 31, 2002 10:10 AM Disappointing and Embarrassing! Although my comments will arrive after the deadline for public comments, I feel it is vital to weigh in on this subject. As I understand the victim's compensation fund, it is an opportunity for those who were harmed, either directly or indirectly, to be adequately compensated for this harm, in such a manner not to cause undue financial hardship. However, the alleged victims who already possess great wealth and benefits, are the very individuals who are willing to look a "gift horse in the mouth," as they say. It is beyond my realm of thinking that the so-called wealthy victims are intent on gouging their fellow Americans. Worse, the fact that any policymaker would provide these individuals with an open forum, as well as an open checkbook, is also beyond. Let us think about this dilemma in real terms. If my husband (and I am unmarried) were to die serving this country, the government is unwilling to provide me with up to one million dollars. However, if I am a wealthy financial investor who died in the world trade center, and I have a million or so dollars in a life insurance because I could afford it), and received substantial compensation from the many charitable funds for victims of 9/11, I am still permitted to request a million dollars in compensation from taxpaying Americans, who have lost loved ones in other crimes such as drive-by-shootings, murder, etc. Does anyone see the hypocrisy in this decision? If the wealthy are financially okay, then compensating them is uneccassry. This fund is not about a person's future earnings lost, or increasing personal wealth, this fund is to ensure that those who have suffered do not suffer more by becoming homeless, uneducated, and losing any future that they might have had if this incident did not occur. The only request that I make is that those wealthy enough to afford and sustain a lengthy lawsuit not tie up our court systems for what is simply an act of terrorism - a horrific crime. It is not the airline industry's fault, it is not the Clinton Administration's fault, and it is not the Bush Adminstration's fault; it was simply that of murderers committing crimes on a very large scale. That is it. Don't let these people convince the American public that they are now being victimized by the government. They do not have to sign paperwork relinquishing their right to sue. However, if they are making a choice to sue because they are not in need of any financial assistance - compensation, then that is their choice. Do not make it my choice. Tuesday, January 15, 2002 9:19 PM 9/11 victims comp fund As part of the Airline Bailout Bill, the above subject fund was created. The purpose of the fund was to equitably compensate the victims' families and deter them from suing the airlines. At a meeting I attended about a week ago the special master of the fund led us to believe that economic loss, plus a 250,000 amount for non-economic loss would be used in the calculation.Economic loss would be annual earnings over a period of the persons working life [to age 62] Our son was 38 and earning approximately 30,000. Assuming he worked until age 62 he would have earned approximately 720,000 before any earnings adjustments for increases, etc. Based on the published tables figures, including 250,000 non-economic loss, we would get approximately 411,000 before any collateral offset.That would make his earnings loss worth 161,000 for 24 years-6400 peryear. That seems to be totally absured and unfair. In addition if he had one dependent child his award would be 594,000 instead of 411,000. The difference in the award should only be the non economic amount of 50,000. Since he did not have a child he is being penalized on his economic earnings. In addition, the total of this award must be reduced by any insurance proceeds. My son had a 50,000 policy provided by his company and 50,000 from workmens compensation. Reducing the award by that amount would net approximately 310,000. Is that amount what a 38 year old persons life is worth ? This award amount is totally inadequate and unfair. In our time of grief when the government is supposed to be helping us reach a quick settlement they are doing nothing but creating more aggrevation. for us. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Tuesday, January 22, 2002 5:48 PM in support of the current plan To Whom It May Concern: While I believe that household services should be calculated into the settlement award granted to each family, I am writing in support of the current plan. Families should be expected to waive their right to sue in order to receive the money. Lawsuits would only further injure this country and economy. There seem to be a number of misconceptions held by the families (as demonstrated by the interviews done on television). The government should press upon these families that parties regularly waive their right to sue when accepting a settlement. While I am sympathetic to their tragic losses, I, as someone who donated money to these people, am now hurt by the fact that this settlement, which far exceeds the average wrongful death settlement, does not seem to be enough for these families. The entire nation pulled together to support these people. They are now turning on the very people who rallied to help them by demanding the right to sue over a tragedy that could not have even been reasonably predicted. There is no claim here. The airlines were not negligent. They followed all the security measures required at the time. Nonetheless, the cost of litigating all the claims filed would be devastating for companies struggling to stay afloat. As previously stated, lawsuits would only force companies to do more lay-offs. Hasn't there been enough suffering? The current plan is generous and fair. The deductions being made are wholly appropriate. Further, any amount received from collateral sources should also be deducted. This is standard in determining tort damages. This case should be no different. Aside for my concerns about the estimated amount for household services, I feel it should be implemented in its current form. Thousands of people die unexpectedly and tragically in the country every year, and their families receive no compensation. We are being incredibly generous to these families. Shame on those who seek to take advantage of our generosity. People should not be penalized because they had to foresight to plan for the future with life insurance and any other financial plans or employment selection. Why don't we calculate a dollar amount by using the victims age and earnings to project what he/she and their family would have if he/she did not die? Then set a standard value for the "pain and suffering" cost. This plan penalizes those who set aside money for the future, life insurance or by choosing a career in public service that has a retirement system. It should not be the government's concern as the dollar worth of a family it this situation. How can you tell a firefighter or police family that because they elected to pursue a career in the public sector (often the major benefit is the retirement plan and not the salary or work schedule) that their award will be reduced by the amount of money they receive from other sources? Lets be fair about this and not attempt to buy off the potential law suits by this initial $ 50,000 payment. Consider this: Take all the money in the fund and deposit it somewhere in an account and mail payments monthly to the victim's spouse/family in the amount that they would have been paid had they not died, continue this until the victim would have reached retirement age. Lets make this money tax free so they can purchase health and dental insurance etc., benefits that are lost without a job. This method would insure a continuing income and hopefully interest earned on the money deposited will offset some of the cost. All I ask is that the government do the RIGHT THING for these people. I went to the White House Reception for Family Members of Flight , and the Chief of Staff told us so behalf of the entire White House staff, who thanked us all individually as we left for the heroism of the passengers on that flight, which potentially saved their lives. I am dismayed by the interim rule for three reasons: (1) Obviously, I believe that the passengers on Flight were special. They took a vote to save the lives of their countrymen. They deserve some recognition of their heroism. To date, they and their families have received a quite nice reception at the White House, but little else. (2) Beyond the special circumstances of Flight as opposed to the passengers of the other flights, ALL passengers on ALL the flights of September 11th entered into a situation in which the airlines AND the governments, by extension and agreements with the airlines vis-a-vis airport security, were responsible specifically for their safety. The passengers on all of the flights should be compensated at a higher rate than those who were on the ground because of the inevitability of their fate once they were on the planes in comparison to the chance presence of victims on the ground at the sites where the planes went down. The airlines and the government (again by extension) were specifically responsible for my daughter and the rest of the passengers of Flight and the other planes. (Theoretically, the government is also responsible for the presence (and by extension the safety) of the staff personnel who were victims at the Pentagon.) (3) The interim rule proposes on the first page to avoid making calculations by income levels, etc., yet apparently on the following pages it outlines plans to do just exactly that. Such calculations do not address the loss to me and my daughter's mother of the POTENTIAL FOR JOY IN LIFE, watching our daughter complete her college course and enter into a productive life helping others as . My daughter's age and occupation as a student place her in a category which is addressed by "individual circumstances", without explaining what those individual circumstances are. I have described some of the individual circumstances which I think affect the "calculation" of loss caused by the death of my daughter as a passenger, as a hero, and as a potential source of joy in life which has been taken form me as a result of the poor security systems in place at Newark Airport. I expect that the interim rule will have to be amended in order to more adequately address the individual circumstances I have described. I am reluctant to accept the current form of this document as a model for the final compensation system. I understand the difficulty of developing this rule, and I hope to be able to see an improved final version and to be able to accept it. In my previous e-mail of January 21st, I outlined three reasons why I disagree with the interim rules as it applies to my daughter's case. The following comments are amplifications of those items which I felt compelled to add after the meeting we had on February 10th. First, as a member of Flight 's heroic struggle, may daughter is a member of a class of people deserving recognition for having given their lives for their country in a special circumstance, including the consideration that the government was prepared, according to public statements, to sacrifice their lives by shooting their plane down if it had reached Washington or any other significant target. Second, my daughter and ALL passengers on ALL the planes involved were member of a class of people who entered into a specific agreement, by purchasing a ticket, to be given service and protection by the airlines. The airlines, through negligence in maintaining adequate security, were responsible for the conditions which allowed the terrorist to board the airplanes, attack the pilots, fly the planes, and ultimately kill those on board. In terms of measures taken or not taken to adequately provide security for the passengers on the plane, the U.S. government has long been - and still is - in close collaboration with the airlines in instituting or not instituting measures which are designed not so much to protect the passengers being served by the airlines, but rather designed to protect the airline form suits by parties related to the victims of September 11th is, in this way, very similar to the role the government has played in the past in reducing the requirement s for expenditures by the airline related to providing security both on and of the airplanes they operate. Third, the interim rule proposes to distinguish between rich people and poor people, between people who are worth more financially and economically and people who are financially and economically less able to provide for themselves and to seek adequate legal counsel, should they decide to press for legal redress outside of the compensation system proposed in the rule.
