To Whom It May Concern:

I wanted to relay my concerns regarding the attached article and decision that has been made with regards to exclusion of benefits for gay/lesbian partners of those who died in the Sept. 11th tragedy.  This is a massive atrocity and sickens, as well as saddens me.  The article clearly identifies and hails several people as heros form this tragedy, who also were homosexual.  However, because of their sexual orientation, their partners are not given the same benefits as others.  It is especially concerning to me that the partners of gay/lesbian victims will not receive benefits stemming from the loss of their loved ones, gut that victims benefits will be given to survivors of Sept. 11th who are illegal aliens.  Not that I do not agree that they (illegal aliens) should, however it is greatly concerning to me that they are given priority and rights that citizens of our own country are not.

The article talks that they cannot go against state law and provide benefits to those that states would not normally distribute benefits to, however in this instance they will to illegal aliens.  Is this not an inconsistency in policy and decision making?  Please help me understand if I am mistaken.  I am finding it hard to stomach the lack of intolerance and fair treatment with regards to this matter , especially when since Sept. 11th we are "preaching" solidarity as Americans and support of one another - where is it shown here?

I understand that there are rules, policy and regulations, however, at times of such these things need to be examined and decisions must be made that reflect true support and fairness - what is right.  I do hope you take the time to reconsider the decisions that have been made.  We need not to be fighting ourselves.

Compensation Fund

Sir:

This fund is a scam for those people involved in the WTC terrorist attack and sets a very dangerous precedence for this nation. Already the Oklahoma Bomb Crowd are linigng at the trough for money!

We have established SSI payments for children of parents who die; we have life insurance polices for those wishing to pay for them--what is going on to protect the airlines is wrong!

First--the air lines should be protected from law suits!!! Especially in terrorists attacks, which they cannot defend against--that's what our military is for.

If you put this to a vote--the American people do not support this action with OUR tax money!!!

     In the immediate aftermath of the tragic attack of September 11th upon our nation,
Congress enacted the Victims' Compensation Fund of 2001 P.L. 107-42, to compensate
the relatives of the victims of that brutal attack.  As you know, this Fund was enacted as
part of a comprehensive package which bailed out the airline industry and imposed
restrictions on the rights of the victims' relatives to sue the airlines in court.  We implore
upon you, as our elected officials, to demand changes to the interim rules issued by
Kenneth Feinberg, the Special Master.  As it stands, Mr. Feinberg's self-imposed rules
fail to satisfy the letter or the spirit of the legislation which was enacted.

        Specifically, we request that you act on our behalf and demand the following
changes to the interim rules:
1.        The arbitrary income limits imposed by the Special Master are not only unfair
     but also inconsistent with the letter and the spirit of the law.  Those victims from
     the financial industry are specifically harmed by this limit.  They were targeted and
     murdered precisely because of the jobs they held, and where they worked - the World
     Trade Center, the Financial capital of the world, the embodiment of financial success.
     Those who achieved such success should see that reflected in their awards.  They
     personified American Business and commerce, democracy and freedom.  We ask that
     you demand that Mr. Feinberg lift the arbitrary income limits so that each family can
     be treated fairly, commensurate with the support they provided their families before
     their death.
2.   Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and
     suffering, no matter what the extent of the pain and suffering.  This is unacceptable.
     In the words of Rep. Peter King, "...every death is tragic.  A murder is particularly
     tragic.  But to have your loved one murdered in a burning building in full view of the
     world - in a scene which will be repeated in the media for decades to come - is a
     horror these families will never escape from.... The Special Master cannot take it
     upon himself to restrict the rights of the families." Therefore, we request that the
     interim rules be amended to more appropriately compensate the victims' families for
     the immeasurable pain and suffering endured by our loved ones.

       As Mayor Giuliani stated in his farewell address: "we have an obligation to the
     people who did die...  Their families need to be protected just as if they had been alive,
     financially and every other way that we can help and assist their families.... There should
     be no compromise about that ever...." We request that the interim rules be amended and
     redefined to the extent that income caps be removed when computing economic loss and
     that compensation for pain and suffering more accurately reflect that horror which was
     suffered.  Justice demands no loss.

Equal Crisis Relief Benefits

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

victim's compensation plan

Dear Mr. Feinberg,

This letter is to inform you that I am the wife of a man who died in the terrorist attack on our nation on September 11, 2001.  When I first heard about the Victim's Compensation Fund, I felt great relief.  It seemed to be a reasonable and fair way to help the families avoid litigation and protect the airlines.

Mr Feinberg, this fund will virtually exclude me and my children.  My husband and I planned for our future and took care to protect ourselves.  We bought Life Insurance and paid high premiums for that insurance.  My husband was vested and paid into a pension.  We will be penalized for careful and responsible fiscal planning by having those amounts off-set any award (strange term) that we might have received.  This would not be allowed in a court of law.  I realize that this component of the fund was voted in by congress but it is flawed.

That is just one small area of the fund that is defective.  I  refer you to the letter sent to you on 1/14/02 by my Congressman, Marty Meehan, for a full text of the inadequacies of this fund.

Perhaps I am not fully understanding the purpose of the fund.  My husband suffered a wrongful death, most likely in hand-to-hand combat with terrorists who                   .                    , I cannot even imagine the horror of that situation.  I do not know when I will be able to step on an aircraft                    again knowing that to be the place where my good husband was murdered.  He will not finish his last 10 years of employment with                    so there is still a loss of income and his pension was reduced by half of what it would have accrued.  Because of these events, I cannot return to my job as a                    for                    for quite some time.  Because of the way this fund is set up, I will receive basically the same benefits I would have received if my husband had died in a car crash.  However, his death was certainly very different than a car crash.  Those facts simply address some of the financial aspects of my life and do not even touch on the personal loss of my family.

My husband,                   , was a victim of terrorism.  I decided early on that I would stand proud as an American and not allow those heinous deeds to make me a victim also.  The terrorists could not do that to me.  Please do not allow my own government and the DOJ to succeed where the terrorists failed.  The rules of the Victim's Compensation Fund need serious adjustment in order to fulfill the intent of Congress.

Sept. 11 Funds

It is an absolute outrage that homosexual victims are not being treated 
equally in the aftermath of the worst terrorist attacks in human history. 
It's un-American and subhuman to demonize a group of individuals who just 
happen to be attracted to the same sex AND who ARE AMERICANS! What's worse is 
that fetus' and illegal aliens are treated with more respect and equality!!

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, 
including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the
restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all
those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double
blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those
who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of
marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove
that their union is legitimate. Fortunately both the Red Cross and the State of New York have already 
announced that they will not discriminate against gay and lesbian families. The Department of Justice should
do the same.

September 11 Victim Compensation Fund

 Dear Mr. Zwick:
 
 I am writing in response to the Department's request for public comments
 
 regarding the forthcoming regulations for implementing and administering
 the  "September 11 Victim Compensation Fund." I strongly urge the Department
 to draft regulations that ensure compensation is available to all victims
 of the attack, including the committed partners and the non-biological 
children
 of gay and lesbian victims.
 
 It is unquestionable that the devastating grief and economic losses
 suffered by the families of gay and lesbian victims are no less than that of
 other families. Just as the terrorists drew no lines in choosing their
 victims, our country must draw no lines in compensating those who suffered 
the most
 personal of losses from these horrific attacks.
 
 Many Americans lost their lives on September 11, each of whom left
 behind loved ones. I urge the Department to honor these bonds by treating the
 families of gay and lesbian victims as you would any other.

Please support equal benefits for surviving gay and lesbian partners

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Collateral Offsets


It is a shame that the comments area has been "hijacked" by mass email
spammers seeking to advance political agendas (however worthy they may
be)  instead of allowing for open discussion of the merits of the
program by those directly affected, namely families of victims like my
sister in law, who lost her husband.  I trust by now you have heard from
practically every outlet that reducing awards by "collateral offset"
will be a certain deal-breaker for many families, as it uses the
benefits that people had earned in their own right, or paid for out of
their own pockets, as an excuse to deny compensatory damages for what I
expect any court of law or sensible jury would find to be inexcusable
lapses in security, preparation and judgment on the part of the many
organizations involved (the airlines, the airports, the security
companies, the WTC building management, etc.).  

I am hoping that the great public outcry against these conditions will
be taken into account prior to the finalization of the settlement terms.
When many potential settlements are being reduced to almost zero due to
these conditions, many families will have no choice but to opt for
litigation, as painful and drawn out as it will certainly be for all
involved.

NOTE:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing 
and administering the "September 11 Victim Compensation Fund." 
I strongly urge the Department to draft regulations that ensure 
compensation is available to all victims of the attack, 
including the committed partners and the non-biological children 
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic 
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of 
losses from these horrific attacks.

Many gay and lesbian Americans lost their lives on September 11, each 
of whom left behind loved ones. I urge the Department to honor these 
bonds by treating the families of gay and lesbian victims as you
would any other.

Public opinion

Why should the government have to pay for any of this?  Public donations of 
$500 million have already been set aside for the September 11 fund.  The Red 
Cross announced that they are no longer soliciting money for this fund  
because it is now funded adequately.  So, why the need for this government 
fund?   The government should help these people if they are stuggling 
financially because of lost wages, but not pay for any pain and suffering.   
To do so would be somehow admitting guilt or negligence for the attacks.   

Example:  A father should not receive any payment for the loss of a daughter 
who he is not financially dependent on, but a daughter should receive payment 
for the loss of a father who she is financially dependent only.

The government should pay for pain and suffering only if the pain prevents 
someone from being gainfully employed,  which essentially falls under the 
"lost wages" category.    Any amounts received from other sources (charities, 
insurance, etc.)  should be deducted from any amount the government might 
award.

Thank you for inviting public comments on how the September 11 Victim Compensation Fund should be distributed.

I believe that justice will only be served when all types of families impacted by the September 11th terrorist attacks are treated with equality.

Therefore, I am asking that those who lost their life partners or de facto parents or children, regardless of their sexual orientation or marital status, be included among relatives eligible for compensation.

I strongly urge you to follow the example of New York Governor Pataki in granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day-to-day activities and the emotional bonds of family deserves help in this time of need."

I hope you will seriously consider this matter when participating in the decision making process that will help determine how the money of this fund will be spent.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a diswasher in one of the restaraunts destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayers money went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian famillies are especially vulerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in a traumatic predicament of having to prove that their union is legitimate. Fortunaely, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should 
do the same.
