September 11 Victims Relief Fund


December  19, 2001

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Dear Mr. Feinberg:

I lost my beloved husband       when he was murdered at the World 
Trade Center on September 11th.

I am writing to express serious concerns re the Department of Justice's (DOJ) 
"Interim Final Regulations Governing Payments Under the September 11th Victim 
Compensation Fund."

The "airline bailout" act gave the airlines $15 billion in cash and loan 
guarantees and capped the airlines' liability for the September 11 crashes at 
the limits of their insurance coverage. Because of this cap, the damage 
caused by the crashes greatly exceeds the private Fund available to 
compensate victims and their families. Thus, for the vast majority of victims 
and families, the cap has the effect of eliminating the right that they would 
otherwise have to sue the airlines. Congress set up the Fund to ensure that 
the airline bailout would not come at the expense of the victims' families.
The act mandates full and fair compensation to victims and their families for
their actual economic and non-economic damages.

 DOJ has apparently discarded this mandate, instead creating regulations that 
will result in compensation levels far below the losses actual suffered by 
the victims and their families. In fact, many families' total compensation 
from the Fund COMBINED with all collateral sources combined will not fully 
replace lost income as the Fund regulations now stand. In effect, these 
families will not receive ANY of the non-economic compensation required by 
the statute. After collateral sources are deducted, as required by the 
statute, some families would receive NOTHING from the Fund under the interim 
final regulations, despite news reports that would have the public believe 
otherwise.

DOJ's formula for non-economic damages of $250,000 for the person killed and 
$50,000 for the spouse and each dependent is about 1/10 of the minimum 
awarded in a variety of air crash and terrorism cases.  Further, independent economists have found serious flaws in DOJ's method of 
calculating economic damages, including use of outdated and inapplicable 
worklife and lifecycle earnings data.

Under DOJ's rules, a family's award may be increased above the "presumptive" 
award only by a showing of "extraordinary circumstances" -- beyond those 
suffered by other victims or victims' families. This high burden of proof 
puts the onus on the grieving families and creates, intentionally or not, an 
adversarial situation with families "competing" for monies.

DOJ should fulfill the act's intent by revising the rules to compensate 
victims and their families for the types of damages specified by Congress, at 
levels comparable to those provided in the tort system the Fund was designed 
to replace. 

DOJ continues to resist the victims' and families' requests for significant 
changes. If the proposed regulations are not changed meaningfully, many 
families, anticipating little relief from the Fund, will be forced into the 
legal system, suing despite the handicap of the liability limits. 

I cannot believe this is the outcome Congress intended.

 Dear Mr. Attorney General,

 We applaud the approach you are taking in soliciting wide public comment in fulfilling your legislative mandate to promulgate regulations governing the
distribution of funds voted by Congress and approved by the President for victims of the terrorist attacks of September 11.

Because it was important for us to act speedily, the legislation of necessity sets our broad guidelines and leaves to you and your department the job of
providing specificity so that these funds can be distributed fairly and expeditiously.

We write to express our view on one aspect of this important set of questions which is before you-namely, we urge that in creating the category of those who
qualify as "survivors of someone lost in the crashes", (Topic 5, Notice of Inquiry), we can best carry out the intent and spirit of the law by compensating all of
those who suffered both grievous emotional loss from these murders and significant financial loss as well.

That is, we believe that the federal government should provide such compensation as is appropriate to all of those who had a close relationship with the
murdered victim and whose own financial position will be seriously adversely affected by the death. Relevant indicia of such a relationship include a shared
residence, shared bank accounts for other financial instruments, joint membership in a health plan a significant sharing of living expenses, etc. Obviously a
wide range of different personal relationships will be covered by this, and we believe that this coverage is wholly appropriate in this instance.  We note that
this is the approach taken by Governor George Patalo of New York, where so many of the victims live.

The act we passed was not an effort by the Congress to regulate any set of personal relationships nor to encourage or discourage people from following any
particular pattern in their living arrangements. It was simply a prompt response by the Congress to the terrible murders inflicted on America on September 11,
in particular by doing what we can to come to the aid of those who were particularly victimized by the deaths of people close to them. Aiding all of this latter
category of victims seems to us the appropriate response.

I am writing this to urge you to reconsider your decision to not consider 
gay and lesbian victims of the Sept. 11 horror in the same manner as 
heterosexual victims.  Specifically, your stated decision to not provide 
benefits to the committed partners of gay and lesbian victims is horribly 
insulting and highly unjust.  All were/are victims.  Please do not send the 
message that gays and lesbians who lay their lives down for their country 
are any less worthy than any others.

RE: September 11th Victim Compensation Fund of 2001


Sir:

     I am writing this letter in protest over the regulations set forth by Special Master Kenneth
Feinberg.  As I understand this law, it is intended to provide FULL ECONOMIC and NON-
ECONOMIC COMPENSATION TO ALL THE FAMILIES of those killed September 11th,
2001.  The statute requires the Special Master to make an award based upon the individual
circumstances of each claimant.  I also understand that Mr. Feinberg arbitrarily established a system
of guidelines that would determine the award each family would receive under the Fund without
listening to any evidence and/or hearing how the tragic events of September 11th have affected
individual families.  He has already determined how much each family will receive by placing a 
salary cap and reducing the award if the family receives monies from collateral sources.  Those
families, who were well provided for, like my brother         family, will receive nothing.
     I think it outrageous.  Our government was grossly negligent in its duty to protect its citizens
and now wants to add insult to injury by placing caps and restrictions on the monies awarded to the
victims' families.  This tragedy could have been avoided had the CIA, FBI, FAA and the airlines
been more diligent in their duties.  I am very angry that ALL the victims' families will not be treated
on an individual basis as per the statute.
     As an American taxpayer and conscientious voter, I expect our government to put the
citizens of the United States FIRST before pouring millions of dollars into Afghanistan (or any other
country); to take the time, however long, to compensate these families according to the law.
     I urge you to remove Mr. Feinberg's guidelines, to provide hearings with an
independent non-political, unbiased hearing officer and to compensate each family fairly by
removing the salary caps and reductions from all collateral sources.  I cannot help but think what
a disgrace it would be to the families and a dishonor it would be to all those who died, especially to
those who sacrificed their lives (in the air and on the ground) to save others.  Please change these
regulations.  It's the right thing to do.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

equal treatment




It is my understanding that those in charge of the 9/11 funds are going to 
exclude some people while including others.  In both cases, the law is being 
used to justify these actions.



In WWII black men fought for our country and were treated as though they had 
done nothing when they returned to their homes in the United States.  We now 
see the travisty in our bigoted response to these men.



Are we now behaving so differently when we allow our government to treat gay 
and lesbian families different than any other family members who died in the 
9/11 events?



Let us NOT repeat the mistakes of our bigoted past.  The US is about 
equality.  As a voting citizen of this country, I demand our government 
stand up against bigotry and treat all people as equal.  Yes, this includes 
people who make alternative life style choices.

Dear Mr. Zwick:  Please carefully cosider the following comment:

September 11 Victim Compensation Act Collateral Source Rule
Shouldn't Penalizes Diligence


The VCA collateral source rule requires that any award under the Act must
be
reduced by the amount of any "collateral source compensation" that "the
claimant has received or is entitled to".  VCA Section 405(b)(6).

The Act does not state that amounts received by VCF claimants from charities
constitute "compensation", nor that a VCF claimant shall deemed "entitled
to" any such amoumt, both within the meaning of VCA Section 405(b)(6).
Therefore the Special Master should not reduce any compensation awarded
under the Act, by the amount of any charity payment received by a VCF
claimant regardless of whether or not actually received before application
for or award under the Act.

There are also practical reasons for the Special Master not to treat charity
receipts as collateral source compensation to be deducted from awards under
the Act.  Despite the best intentions, anyone who has diligently applied to
any 9/11 charity for help well knows the uncertainty of many charities'
criteria for making grants; seeming inconsistency in grant amounts among
comparably situated applicants; and vast discrepancies between published
grant criteria and the amounts of charity awards.  In this enviroment, how
can the Special Master possibly determine the amount of
charitable awards to which a VCA claimant is "entitled" but which the
claimant has not received or for which the claimant has not even applied at
the time of filing a VCA claim or determination under the Act?  Such a
deduction would penalize the claimant who diligently applies for and
receives charitable grants before filiing a VCA claim, as compared to a
claimant who perhaps intentionally
delays applying to any charity until after receiving payment from the
Special Master.

If a major purpose of the Act is to encourage 9/11 victims to eschew the
court system and rely upon the Special Master fairly to determine the amount
of VCA compensation that a VCA claimant should receive, the amount of any
charity receipt should be ignored in determining the compensation to which a
VCA claimant is entitled.


For all these reasons, charity receipts should not be considered "collateral
source compensation" under the VCA.

To Our Elected Officials:
 

In the immediate aftermath of the tragic attack of The United States, on 
September 11, Congress enacted the Victims' Compensation Fund of 2001 P.L. 107-42, to compensate the relatives of the victims of that brutal attack.  As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions of the rights of the victims' relatives to recover damages from court.  We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master.  As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. 

Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 

1. Remove arbitrary income limits 
The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law.  Those victims from the financial industry are specifically harmed by this limit.  They were targeted and murdered precisely because of the jobs they held and where they worked - the World Trade Center, the Financial capital of the world, the embodiment of financial success.  Those who achieved such success should see that reflected in their awards.  They personified American Business and commerce, democracy and freedom.  We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support they provided their families before their death.

2. Increase non-economic rewards.
Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering.  This is unacceptable.  In the words of Congressman       ,"...every death is tragic.  A murder is particularly tragic.  But to have your loved one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come is a horror these families will never escape from... The Special Master cannot take it upon himself to restrict the rights of the families."  Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families' for the immeasurable pain and suffering endured by our loved ones.  As Mayor Giuliani stated in his farewell address:  "we have an obligation to the people who did die...Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families...There should be no compromise about that ever..."  We request that the interim rules be amended and that compensation for pain and suffering more accurately reflect that horror which was suffered.  Justice demands no less.

Act Now To Help ALL Victims Of Sept. 11


Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund." 
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has committed
to uphold international human rights standards, including the Universal
Declaration of Human Rights and the International Covenant on Civil and
Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families--and all types of
families--impacted by the human rights tragedy of September 11 are treated
with dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

9/11 Fund To Discriminate Against Gays?

 
Mr.. Feinberg, 

It is a sad day when gay AMERICANS are provided less than would be for an illegal alien. Why can't you follow the example that ALL of the heroes from Sep. 11 have shown us and rise above the old discriminations. 

You should  not to be recognized or congratulated for your "work" in chairing this fund, for you have not learned anything of what real Americans are about; and we will not move forward as a nation with people like you who feel they can decide who is worthy of charity donated by American for Americans. 

Don't be afraid Mr. Feinberg of doing what is right. Those brave men and women on Flt 93, in New York, as well as my colleagues in the Pentagon,  gave their lives for you and ALL Americans. What are doing in return?

Protect Traditional Marriage

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation. 
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died. 
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have? Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist, writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
 accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution." 
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer. 
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

Comments on 9/11 Victims Compensation

Dear Mr. Zwick:

   We are writing in response to the Department's request for public
   comments regarding the forthcoming regulations for implementing
   and administering the "September 11 Victim Compensation Fund."
   We very strongly urge the Department to draft regulations that
   ensure compensation is available to all victims of the attack,
   including the committed partners and the non-biological children
   of gay and lesbian victims.

   It is unquestionable that the devastating grief and economic
   losses suffered by the families of gay and lesbian victims are
   no less than that of other families.  Just as the terrorists
   drew no lines in choosing their victims, our country must draw
   no lines in compensating those who suffered the most personal
   of losses from these horrific attacks.

   Many Americans lost their lives on September 11, each of whom
   left behind loved ones.  We vehemently urge the Department to
   honor these    bonds by treating the families of gay and lesbian
   victims as you would any other.

Dear Sirs,
I am appalled at the comments by some of the Sept 11 victims' families that was the result of the governments plans for compensation being released.  I was also surprised that some of the packages could be in the millions of dollars for some of the families.  I think that as a society we are in the habit of continually bargaining to relieve the grief of surviving members.  Loss is part of life and perhaps the government should not be so willing to hand out absorbent amounts of money to some of the families.

rumors are sufficing that as part of the settlement you are going to subtract 
the life insurance proceeds. And in my opinion we wouldn't be collecting them 
if the government had protected us. And  also that there is not enough money 
in the world that could ever replace what my children and I have lost. The 
awards should be made out right with the realization that we have to live the 
rest of our lives without the hub of our world. and I would also like to know 
that if we sue Bin Laden can we still participate in the Victims Compensation 
Fund? Among this time of all the paperwork and mourning and trying to get 
things in order (which will never be in order again without my husband) this 
law stuff is very confusing and you know that they say that you should not 
make any major decisions for the first year you are putting a lot of pressure 
with this 30 deciding period if I read that right. Please answer my

To whom it may concern,

We are quite surprised to read and hear that some of the victims of 9-11 
will be treated differently than others, more specifically that, as a group, 
the survivors of gay and lesbian relationships will not be seen as "real" 
spouses.  We hope that what we have read is not true.

How can people in a gay relationship be expected to show "evidence" of their 
committed relationship when almost every state does not allow for legalized 
recognition of same-gender relationships.  Thankfully we are citizens of 
California where we have registered as domestic partners.  We wonder if that 
"legal" recognition would be enough to show your agency that we are indeed 
as "married" as possible at this time in American history?

Please reconsider your (possible) actions and consider on possibly a 
case-by-case basis the relationships of the victims who were/are in the gay 
community.
