As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Private sector charities are free to give money as they chose, and this must not be infringed upon by the government. If the fund docks money from a victim's family who has received private sector aid, the government is in effect negating these charitable donations, instead of those given involuntarily (by taxes). No life lost was more or less valuable in the eyes of the American public, either, and therefore equity in distribution of charity should be achieved as well. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a diswasher in one of the restaraunts destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayers money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian famillies are especially vulerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in a traumatic predicament of having to prove that their union is legitimate. Fortunaely, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." As that Act makes clear, the purpose of the Fund is to provide compensation to any persons who were physically injured in the September 11 terrorist attacks as well as to the surviving "relatives" of those who died. I strongly urge the Department to promulgate regulations ensuring that compensation is available to all surviving family members of those killed, including the committed partners and the non-biological children of gay and lesbian victims. Just as the terrorist drew no lines in killing people, our country must absolutely draw no lines in compensating those who suffered the most personal of losses from these horrific deaths. In promulgating its regulations, the Department should look not to legal formalisms that may define relatives or families for purposes of other laws, but rather to the realities of the lives of those who were killed and those who loved and were dependent on them. It is clear from the Act that this is precisely the approach the Department must take in administering the Fund. The Act specifically identifies a number of "economic" and "non- economic" losses for which compensation is to be awarded from the Fund. These include burial costs, loss of earnings, physical and emotional pain, suffering, mental anguish, and loss of society and companionship. See 402(5) and 402(7). It is unquestionable that the survivors of those killed on September 11 suffered these types of losses regardless of their sexual orientation or marital status or their formal legal relationship to the deceased. Indeed, grief and economic loss know no such boundaries. The emotional devastation and economic loss caused by the death of one's partner is not any less because that person was of the same sex as the survivor. A child's anguishing loss of a parent is not any less because there was no biologic tie. Since the purpose of the Fund is to compensate survivors precisely for the types of losses suffered by family members of those killed, the Department's regulations should not and indeed cannot properly exclude anyone who was a family member in fact. In the immediate aftermath of the September 11 tragedies, as various victim-relief funds were being established, some on the extreme radical right criticized relief agencies that had made clear their intent to make funds available to assist not only surviving married spouses of persons killed in the attacks but also the surviving partners of gay men and lesbians who had been killed. These cruel and reprehensible calls for the exclusion of gay and lesbian families from relief efforts have been accompanied by claims that the effort to provide relief to all who have suffered is somehow a push for a so-called "gay agenda." However, the determination of who was actually victimized by the September 11 attacks, of who actually suffered loss, of who actually is grieving, is not about advancing some alleged political "agenda." What is at issue here is a human tragedy of unimaginable horror and dimension, and about the fair and humane treatment of all who have personally suffered from the acts of the terrorists. Many gay and lesbian Americans lost their lives on September 11. Many of them left behind loved ones, including partners and children whose lives were intertwined with theirs and who were dependent on them for financial a well as emotional support. A number of them are known to have engaged in heroic acts that day, and they have been praised as national heroes. It would be an insult not only to those heroes, but to all who died on that tragic day, for the Department to draw artificial lines defining loss and grief. In fact, it would be unconscionable. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. Wednesday, January 30, 2002 11:16 PM My comments regarding the regulations Dear Mr. Zwick: Once again I write to you to share my thoughts and feelings regarding the Interim Final Regulations for the Victim Compensation Fund. My 36 year old husband, &nbsp&nbsp&nbsp&nbsp worked at &nbsp&nbsp&nbsp&nbsp on the &nbsp&nbsp&nbsp&nbsp floor of Tower 1. Our second son &nbsp&nbsp&nbsp&nbsp was born just six days before the attack and September 11 was our 3 year old son's first day of school. &nbsp&nbsp&nbsp&nbsp should have been home, but he was a hardworking, dedicated man and instead, he took the 5:37 AM train to work. What a mistake. Everyday &nbsp&nbsp&nbsp&nbsp asks, actually cries, for his daddy. Just yesterday we were driving in the car and &nbsp&nbsp&nbsp&nbsp said to me, " Mommy, &nbsp&nbsp&nbsp&nbsp just said da-da!". Then he turned to &nbsp&nbsp&nbsp&nbsp and said, " Silly, Daddy is in the sky." That's when it really hit me that &nbsp&nbsp&nbsp&nbsp will not learn the word da-da. Not at this age. My poor sweet &nbsp&nbsp&nbsp&nbsp never even got to know his daddy who was one of the most generous, loving and kind men you could ever meet. It is my duty to ensure that my boys get what they deserve -- what their daddy worked so hard for. I'm not even going to get into the whole ridiculous issue about deducting life insurance payments as a collateral source. Must we really accept the fact that our husbands had the intelligence and foresight to prepare for the future in the event of a disaster, yet they will be penalized for doing just that? This makes no sense, but apparently it is the law and most likely won't be changed. What nonsense. Below lists my objections to the regulations: 1) Deducting Social Security, Worker's Comp, pensions and other death benefits as collateral sources of income. I am 33 years old and could quite literally end up with close to $0 if these items are included (especially if the life insurance is deducted). 2) The methodology used to formulate the presumed income tables seems to be quite outdated and inapplicable. Many of our husbands did not receive small 5% raises each year -- they earned a lot of money because they worked their tails off. And they worked in an industry that rewarded that hard work very well. 3) The compensation table only goes up to $231,000. I understand that is because only 2% of the country earns above that amount. Well this is a different population. Our loved ones worked for the top companies in the U.S. and earned top dollar because of their hard work. Many people earned well above $231,000 and they have a right to know what their compensation level will be. Please remember that we are being asked to enter into this fund and once we do there is no turning back. Who in their right mind would sign up for something that is binding and non-appealable without knowing the end result, or at least 95% of the end result? 4) The proposed maximum award of $250,000 for non-economic damages is simply ludicrous. Does the federal government actually think that that amount of money is sufficient for the pain and suffering our husbands, wives, children have gone through? Perhaps we could put those people who support the award amount in a room and fill it with smoke, make it just 1000 degrees warm (although it was even hotter for our loved ones) and lock the doors. How would they feel after only one minute knowing that they couldn't get out -- that they were trapped and no one was going to rescue them? Our loved ones were trapped in those towers for many, many minutes. There were plenty of frightened phone calls made from the towers on September 11 telling their loved ones that they weren't going to make it. I wonder what went through my husband's mind as the smoke kept pouring in? I imagine it was the image of me and the boys, his parents, brothers and sisters that kept him hopeful. But I only think of the despair and fear that ran through his mind. I cannot believe the federal government has the audacity to propose a maximum award of $250,000 for his pain and suffering! That my sons' pain and suffering is only worth $50,000. Walk in our shoes one day. That amount of money is an insult to my husband who died for this country. A country that failed to protect its citizens. I like proposal: if the Federal government thinks they can cap the non-economic loss at $250,000, then the Federal government can cap their collateral source deductions at $250,000. Obviously you can feel my anger and frustration. We are going through hell. It has not gotten any easier with time. In fact, it's worse. The paperwork just keeps piling up and now we have to deal with the Fund's regulations. I understand the bill was put together with the right intent, it was just a bit hasty and now we are paying the price. I ask you to please think of our loved ones and those they left behind while you are revising the regulations. The victims of the September 11 attacks were true American heroes and our government needs to recognize that. These men and women did not sign up to be on the frontlines of a terrorist war. Our government should have been protecting them and they failed. Now the government is asking us, encouraging us, to sign up for the Fund in order to avoid litigation. Well, please honor our loved ones and revise these regulations so that they are fair and equitable and maybe we will sign up for the Fund. Thank you.
