Dear Mr. Zwick,

I am writing in response to the Department's request for public comments regarding the September 11 Victim Compensation Fund.  I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, Including the committed partners and non-biological children of gay and lesbian victims.

My partner and I have five children together.  We are married and all the children consider us both to be their moms,  If any thing happened to one of us the other would do what any surviving spouse would do.  Because we are both women would not make our grief and loss any less, it would not eliminate the financial responsibilities of our family.  Please do not penalize these people because they loved a person of the same sex.  Perhaps it would be helpful to, as my mother used to say, "remember the golden rule"  DO UNTO OTHERS AS YOU WOULD HAVE THEM DO UNTO YOU.    

I urge the Department not to exclude these grieving children and partners.

Benefits for All Victims

I have learnt that the partners of same-sex couples will not be eligible
for compensation for the tragedy of September 11, 2001. If this is true,
I am shocked and disappointed that an outdated prejudice, which may
indeed be unconstitutionally based on religious presuppositions, should
be allowed to exacerbate the pain which all of us already feel. Please
make sure that all benefits are applied equally to all humans.

Help all victims of terrorist attack


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11 terrorist
attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex unions.
They suffer just as grievously for their deceased loved ones as do other
survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups and
individuals who would have the Department of Justice limit compensation to
survivors of heterosexual unions.  They are interested in a political victory,
not humane assistance.

This Fund is intended for humane purposes; it is not a political statement,
Mr. Zwick.

i think that is soooo messed up that yous guys areNOT giving monatary contributions to the lifetime partners of G/L/Ts who lost thier other half on sept. 11.

Comment on Victim Compensation Program


I am writing to comment on the Victim Compensation Program. I am a visiting professor at NYU and Connell Professor at UCLA Law School; I have taught torts for 32 years.

1. I believe the term "physically injured" should include the emotional distress of those evacuated from the damaged buildings, whether or not they suffered direct physical impact. As you know, the latter requirement has been eliminated by virtually every American jurisdiction. Nor do I think there should be a requirement of physical consequences (sleep loss, changes in diet); we know that emotional distress has physical components.

2. I believe that collateral sources should be disregarded. I gather the DOJ is already inclined to disregard charitable donations. The only other significant collateral sources are those for which the victim already has given value--premiums for insurance, labor for employment benefits (including insurance).

3. I do NOT believe survivors should be compensated for the pain and suffering of decedents. The only justification for such payments after death is deterrence, which has no relevance to the federal compensation fund.

4. Obviously statistical methods will be necessary to extrapolate forward the income streams of those killed or injured and the portions that would be devoted to the benefit of dependents.

5. State law varies greatly about whether family members can recover for damage to the relationship with a victim who is killed (wrongful death) or injured (loss of consortium). No state offers a principled basis for drawing the lines it does. I believe the DOJ is free to draw its own lines; I would urge it to do so broadly to include spouses, parents, and children (including step-relationships). At the same time, I do not believe there should be individualized valuations of these relationships; the purpose is to acknowledge the loss, not to compensate it, since there can be no meaningful compensation.



I would be glad to expand on or explain any of these ideas.

How can you deny benefits on the basis of sexual orientation?  do you think 
the gay and lesbian people who died and their families were any less American 
than the heterosexual victims and their families?  When are you going to 
figure out that gay and lesbian people are PEOPLE who deserve all the 
dignity, respect, and BENEFITS others are getting.  The lesbian and gay 
family members of 9/11 victims are suffering just as much -- even more in 
light of rules like this that deprive them of their rights.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

Regulations governing dispensing of funds for victims of the 9/11/01 attack
SHOULD NOT exclude anyone.  There should be no difference whatever, between
heterosexual or homosexual persons, their families, friends, partners, etc.

Government's 9/11 Fund Exclusions


To the Bush Administration and 9/11 Fund Administrator Feinberg:

I am disgusted, angered, and disappointed by the recently announced decision 
to exclude surviving partners of lesbian and gay victims of the 9/11 
attacks.  That this exclusion is cloaked in an ostensible reliance on state 
laws is a transparent attempt to deflect responsibiltity by harking to a 
kind of "state's rights" interpretation - "if they don't recognize 'em, we 
won't."

Mr. Feinberg in a television appearance stressed that with a short life to 
the fund - 1 1/2 to 2 years - he is not able to follow any path BUT these 
particular state laws (though the same is not true of other laws and 
regulations, for example those dealing with immigrants).  I would suggest 
that it is _exactly_ the limited nature of this fund's life and of his 
mandate that creates a perfect case for NOT discriminating among victims - 
to determine whose life is, in the case of this fund, literally worth more 
to the survivors.  There can be little rational complaint about "social 
engineering" or charges of an effort to change state laws when the focus of 
this fund and its time frame are so limited.

In addition, treating the survivors of _all_ victims the same would allow 
the Bush administration to act upon its rhetoric of U.S. unity and to model 
equality in the wake of these attacks.  Because, make no mistake, I am not 
suggesting that anyone Mr. Feinberg has already "defined in" be excluded; 
rather, I want you to treat all survivors the same and bring in those he 
chose to leave out.

As I understand it, that would be the American Way.

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing 
and administering the "September 11 Victim Compensation Fund." 
I strongly urge the Department to draft regulations that ensure 
compensation is available to all victims of the attack, 
including the committed partners and  the non-biological children 
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic 
losses suffered by the families of gay and lesbian victims are 
no less than that of other families.  Just as the terrorists 
drew no lines in choosing their victims, our country must draw 
no lines in compensating those who suffered the most personal of 
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom 
left behind loved ones. I urge the Department to honor these 
bonds by treating the families of gay and lesbian victims as you 
would any other.

Dear Attorney General Ashcroft:

     We are writing to draw your attention to unmet crime victim service needs of family
members, friends, and colleagues of Massachusetts victims of the terrorist attacks at the World
Trade Center (WTC) and the Pentagon on September 11, 2001.

     Over 70 residents of Massachusetts were aboard the two flights that crashed into the 
WTC. Massachusetts, through its proximity to New York City, is home to many family members
of victims who worked in the WTC. In addition, several of the companies that had office space in
the WTC were Boston-based companies. As a result, Massachusetts organizations and agencies
that provide service to victims of crime are providing needed assistance to hundreds of family
members, friends, and colleagues of victims of the September 11 attacks.

     As you know, the Office for Victims of Crime (OVC) was established by the 1984 
Victims of Crime Act and provides substantial funding to state victim assistance and
compensation programs. We urge you to consider allocating some funds from the $40 billion 
emergency supplemental bill that Congress passed to respond to the terrorist attacks to OVC to
support critical victim services. OVC funds two major formula grant programs -- Victim 
Compensation and Victim Assistance. Through these initiatives, it directs funding to victim
services programs on the front lines that provide specialized homicide bereavement, crisis
response, and hate crime victim services to the many families across the country who need and
will be needing services as a result of the attacks on September 11.

     In Massachusetts, victim services programs were already stretched beyond their capacity 
with the general crime victim population before September 11, but the demands being made on
these organizations since then are enormous. Without the assurance of additional federal or state
funding, Massachusetts crime victim service agencies have stepped up to meet the needs of the
families of the over 70 victims from our state on the two doomed flights that originated from
Boston's Logan Airport and the Massachusetts residents and companies in the WTC. Counselors 
have logged tremendous hours of overtime working directly with families of victims; one agency
has established a Terrorist Attack Support Group; another has dispatched bilingual counselors to
schools to calm the special fears of immigrant children.

     To meet the overwhelming and continuing demand for victim services in the wake of the 
terrorist acts, agencies in Massachusetts and nationwide are in need of emergency funding. It is
our sincere hope that additional funding will be allocated to OVC for these purposes. We
appreciate your attention to this matter.

Comments Regarding September 11 Compensation Program

Dear Mr. Zwick:



We are acting for the surviving spouses of two victims of the terrorist attacks which took place on September 11, 2001.  Both men were residents of Toronto, Ontario, Canada and were in the World Trade Center on business when the attacks took place.  Death certificates have already been issued by the City of New York to each of our clients in respect of their husband's deaths.



We became aware late today that the opportunity was being given to the public to submit comments regarding the substantive and procedural rules relating to the program being established by Congress to compensate the September 11th victims (the "Program").  



On behalf of our clients, we wish to make two brief submissions regarding the Program:  



1.  Our clients' husbands were not American citizens or American residents but their deaths at the World Trade Center in New York were no less tragic than those of the many Americans who died on September 11th.  Their surviving families suffer the same losses as their American counterparts.  We hope that the compensation which will be offered under the Program will be extended to the families of all victims, regardless of citizenship or residency.



2.  The Press Release indicates that compensation under the Program will be payable to the personal representatives of deceased victims.  In the case of our clients, both of their respective husbands died "intestate" or without a will.  In both cases, it has not been necessary for our clients to apply to the Court  to be appointed personal representative of the estate as most of the deceased victim's assets were held jointly with the spouse with right of survivorship or the surviving spouse was designated as beneficiary of assets such as life insurance and retirement savings plans.  The surviving spouse was automatically entitled to the joint assets and insurance proceeds were payable to the spouse directly rather than to the deceased's estate. There are little or no assets in either of the deceased victims' estates.



If the compensation under the Program is only payable to the personal representative of the deceased victim's estate, it will be necessary for our clients to apply to the Court to be appointed personal representative.  This will potentially delay the payment of compensation and will result in the compensation payable to our clients being subject to Ontario Estate Administration Tax.  



We hope that consideration will be given to the payment of compensation directly to surviving spouses who are the sole beneficiaries of the deceased victim's estate under the applicable laws of intestate succession rather than just to the personal representative of the estate.  Under Ontario law, the surviving spouse would be the sole beneficiary of the estate if the deceased was survivived by a legally married spouse but no children.  



Under Ontario law, if the deceased was survived by a child as well as a spouse, the child would only be entitled to share in the portion of the net estate which exceeded $200,000.00 (Cdn). Depending upon the value of the deceased victim's net estate, the surviving spouse might still be entitled to receive all of the compensation payable under the Program.  In the event that a portion was payable to a minor child, however, the child's entitlement could be paid to the spouse to administer for the child if the spouse had been appointed as guardian of the child's property.

Compensation

It's outrageous that you are not going to compensate the partners of Gay and 
Lesbians who died on 9/11. They loved their partners as much as any 
heterosexual relationship and their loved one died just like the others, in 
some cases in a heroic fashion. You should be ashamed of yourselves.

Equal Access to Relief Benefits

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.

Please don't discriminat against victim's families

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Fund Exclusion of Gays

To Whom it may concern:

I was recently informed as to the policy of
not including gays in funding from the Sept.
11th tragedy.  This is outrageous and a
complete disregard of human rights.  It is
unimaginable that in this day and age the
government can legally discriminate based on
sexual orientation.  These people were just
as valuable and loved as the others, were
just as patriotic and heroic.  How could the
US government get away with this violation of
civil rights?

I as an American citizen am outraged at this
travesty of justice.  Aren't we "one nation"?
"Indivisible"?  This is wrong and the policy
must be changed!!

Victim Assistance

I feel this would be a bad precedent.  The Oklahoma City families were not
given this assistance.  The family members of the victims of the Cole did
not receive this.  I sympathize with the families, but they are already
receiving benefits that they are entitled to along with help from all the
charities started for the victims of September 11.  They will also be
receiving tax benefits.  If this country goes ahead with this plan, the
victims of another incident, here or abroad, will expect the same.  Is there
a surplus of funds available for this?  Or, will our taxes go up to cover
this expense?  There are other families in this country who have been
victims of terrible crimes, have lost family members and they are coping.  I
say, it is time for these families to pull themselves together, get on with
life and stop depending on government to help them through the rest of their
lives.
