Equal Rights for All

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

exclusions of gays and lesbian partners is simply wrong

If the government can decide to overlook immigration laws, which I believe
is the right and honorable thing to to do, than the government should be
able to overlook states' laws that discriminate against same-sex families.
Every partner and dependent of a victim of 9/11 should receive funding to
help them through their financially difficult times.

As a taxpayer, I want my taxes to help ALL families who suffered such
tremendous loss.

I am deeply saddened that you don't feel the same.

Equal Crisis Relief Benefits

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Protect Traditional Marriage

Dear Mr. Zwick:

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation.
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died.
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have?Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution." 
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

discrimination of the 9-11 fund

To Whom it May Concern:

I have to express the outrage i feel towards the 9-11
fund regarding the non-eligible distribution of funds
to gay and lesbian families and loved ones.

How dare you pick and chose who may and may not be
eligible based on someones sexual orientation? Why not
base it on someones's religion or perhaps their
ethnicity or even their gender???? Simply because you
realize how ignorant and outrageous that would be not
to mention totally unacceptable.
Basing distribution based on ones sexual orientation
is also ignorant, outrageous and totally unacceptable.
As an America i am continually amazed at how our
government can no doubt take something and turn it
into chaos with no basis except for bias and
ignorance.
how stale is that?

THESE PEOPLE ARE U.S CITIZENS!

I do not believe the people who contributed to ANY
effort regarding 9-11 included in their distribution
their preference of who was to receive that money.
What is just as sad as the 9-11 attacks is the remorse
some people have over contributing their money to the
hands of mismanagement.

I wonder if next time i pay my taxes i may elect
specifically where my tax money is to go and depend on
the government to distribute accordingly.

September 11 Victims Compensation Fund Feedback

Hello,
I am providing feedback on the September 11 Victims Compensation Fund
I would like to ask that eligibility to receive compensation be inclusive of
ALL Americans impacted by this tragedy. This includes those who lost their
life partners as well as de facto parents of children, without regard to
sexual orientation or marital status.
I believe, the example of Governor Pataki of New York should be followed.
New York is granting compensation benefits 'on a showing of mutual
interdependence with the victim, in recognition that anyone who shared with
the victim living expenses, day-to-day activities and the emotional bonds of
family deserves help in this time of need'.

Comment concerning interim final rules

Dear Mr.  Zwick:

The New York Committee for Occupational Safety and Health is a
non-profit provider of health-and-safety-related training,
information and advocacy, serving workers throughout the New York
metropolitan area, with a membership consisting of over 250 union
organizations and 400 individuals -- union members, health and
safety activists, injured workers, healthcare workers, attorneys,
public health advocates, environmentalists and concerned citizens.

On behalf of the members of NYCOSH, I submit the following comment
on the Interim Final Rules:

Anyone who sustained a disabling injury as a result of the
September 11 attack ought to be eligible for federal compensation.

It is completely unreasonable to deny such compensation to anyone
who sustained a disabling injury, but did not obtain medical
services within 24 hours of being injured.

It is likely that many people received injuries that were serious
enough to require medical attention, but not serious enough to
visit an emergency room.  If an injured person chose to seek
treatment for the injury from their regular physician by making an
appointment for treatment on the day after the attack, such a
person would not be eligible under the interim rules? 24-hour time
limit.

It is very possible that some people who were injured in the
attack were in such a state of psychological shock that they did
not obtain medical treatment for days after the attack.  It is
reasonable to limit compensation to people who were injured as a
result of the attack, but there is no reasonable basis for
excluding anyone who, for whatever reason, delayed obtaining
medical services for their injury.

Dear 9/11 Victims Fund,

I was very shocked and then saddened to hear that Kenneth Feinberg, the Fund
administrator, recently said on NBC's "Meet the Press" that gay and lesbian
victims would not be eligible to receive compensation.

If this is indeed true, I can only pray that this decision is reversed.  The
loss of these victims is just as great and tragic as any other victim.  How
could such a mean-spirited and intolerant decision as this, be made?

Please say it isn't so.

It is great to be able to read comments and suggestions offered by affected families, but the myriad of form letters submitted for alternative lifestyle situations makes that virtually impossible. To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of
the tragedy on September 11th, including the children and families of low-wage
workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader
earning millions of dollars per year might receive thousands of times as much
compensation as the survivors of a dishwasher in one of the restaurants
destroyed.  Justice requires looking far beyond the last paycheck to the
inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to
first lose their loved one and then watch as most of the taxpayer money went to
those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and
lesbian relationships and families. Gay and lesbian families are especially
vulnerable when one partner is killed. Because the option of marriage is
unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross
and the State of New York have already announced that they will not discriminate
against gay and lesbian families. The Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will
act on these very important issues.

compensation for gays and lesbians


Dear Director Zwick:

I am writing to support the position of the National Gay and Lesbian Task
Force in their letter to you dated November 21, 2001 regarding disbursement
of monies from the September 11 Fund.  I agree with the need for the
Department of Justice to Department to "include among relatives eligible for
compensation those who lost their life partners or de facto parents or
children, regardless of sexual orientation and marital status."  

The horrific loss of loved ones to a random terrorist act should not be
compounded by our own government denying survivors whatever benefits may be
available simply because we fail to have laws to protect all of our
citizens. Although I am not a lesbian, I truly believe everyone should be
treated equally.

9/11 Fund to Discriminate Against Gays


I am writing in response to a commentary by            on About.com
regarding Kenneth Feinberg's comments on the 3/10 broadcast of "Meet The
Press". 

After reading this article, I have to say that I am angry, disgusted, and
(worse of all) sadly unsurprised by these comments.

In a brief, I will no longer donate to any federal program related to the
9/11 attacks and will instead donate the these funds to worthy organizations
such as PFLAG and HRC, who work very hard to fight discrimination and
bigotry exemplified by Mr. Feinberg.  In addition, I am forwarding a copy of
the article to my mailing list and ask my family, friends and associates to
do the same.

Relief for all of America's families


December  19, 2001

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

It is time to recognize gay couples as valid


I am outraged at the news that illegal aliens and fetuses will be covered 
by the federal 9/11 fund but domestic partners will not.  It is time to 
stop pushing your hypocritical, haughty, "Christian" ideals that two members of 
the same sex aren't deserving of the same rights as heterosexual couples.  
Even if you're right, and it's not the way God would have wanted it, it is not 
for you to judge that.  Let go of your ignorance and treat everyone 
equally.

Collateral offsets

It was startling to read the current issue of Time magazine and see it
reported that many of the 9/11 victims could end up receiving no
compensation after deductions for life insurance, social security and
workers compensation are made.  Then it hit me, Time's calculations
assume that the collateral source payments will offset the non
economic damage portion of the award as well as the economic award.
That is not the law of collateral source deductions in the states I'm
aware of, including New York.  Under existing law, collateral payments
received, including life insurance, social security and workers
compensation, can only offset the economic portion of the award.
Therefore, if the collateral source payments exceed the economic
portion of the award, the victim would receive nothing for economic
loss, but would nevertheless receive the full award for non economic
loss at a minimum.

 I remember nothing in the statute adopted by Congress that said that
these collateral payments should be treated any different than in the
typical tort case.

I hope Time was in error in its assumption.  Hopefully this can be
clarified so that the anguish experienced by those injured and the
families who lost loved ones will not be unnecessarily exacerbated.

Operation of fund

Just wanted to briefly state my opinion on the matter:

I understand the dilemma you must be in: on the one
hand, you don't want to discourage charitable giving
by reducing fund disbursements should victims or their
families be compensated by other sources, but on the
other hand taxpayers should be protected from double
dipping. 

My personal opinion tends to the later. The idea is to
compensate people; not enrich them. Perhaps some sort
of compromise is possible: a contribution ceiling for
each family can be determined based on factors such as
the age of the victim, number of children he/she had,
the victim's total worth, prior earnings, etc.  If a
private charity conferred enough funds to meet that
family's ceiling, then the government need not
allocate any additional monies to that family. If not,
the government can step in and fill in the difference.
