To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

DiscrimiNATION

To Whom It May Concern.

I am a heterosexual.

I am outraged by the hypocrisy of the UNITED states government's decision 
not to compensate the families of ALL Americans who need relief after 9/11.

How is it okay to fight for or even die for your country if you are 
homosexual, as did occur on 9/11, but it is somehow against the law to honor 
these individuals when the time to do so presents itself?

I can't imagine the grief of the survivors, a grief that trancsends race and 
creed, and even transends our stated policies on illegal aliens in an 
attempt to help.

Homosexuals ARE NOT ILLEGAL.  They ARE NOT ALIENS.  How can we turn our 
backs on ANYONE'S loved ones who did such courageous things for AMERICA?

HOMO-AMERICANS are just Americans.  They love, just like anyone else.  They 
proved thier love for this country.  Denying relief to the PEOPLE that they 
loved, and who loved them, is like a slap in the face.

People are what makes our nation great.  ALL kinds of people, each with 
different talents and gifts to give.

I sincerely hope a reconsideration takes place.  HOMO-victims are still 
victims, just like the rest.  They cry the same tears, and feel the same 
hurt and loss.  To deny this not only minimizes their status as Americans, 
it minimizes their status as HUMAN BEINGS.  I'm ashamed that my country 
would turn its back on ANYONE who gave so unselfishly.

I find it adds insult to injury to allow fetuses and illegal aliens latitude 
with victim compensation, while completely ignoring the fact that, 
statistically, 1 in 10 of those who are gone now happened to not be 
heterosexual.  How can you dis-count the value of those lives?

Having served in the armed forces, I KNOW that you allow men and women to do 
everything up to and including DYING for the U.S.,  but those who reside in 
the HOME OF THE BRAVE are NOT allowed the luxury to live in the LAND OF THE 
FREE.  Let freedom ring; do the right thing.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Expressing My Outrage!

How dare you people judge the way that you do.  How dare you insinuate that gays and lesbians are any less of an American citizen than everyone else in this country.  This nation is known for its diversity and it seems that you people don't realize that.  We suffered the same hurt, the same feelings and the same sorrow as everyone else did on 9.11. September 11 Victim Compensation Fund


Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Crisis Relief Benefits

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp, who "fears" she'll get nothing from the government because he 
husband had more than $1 million in life insurance, needs to look around.  
Probably the majority of people in the US has little if no life insurance.  
The fund should help those people and not contribute to million dollar 
policies!

Pursuant to the directive on the Department of Justice website, we are forwarding these
comments on the interim final rule implementing Public Law 107-42.  We currently represent one
of the decedents who perished on American Airlines flight 11 on September 11, 2001.

Initially, we commend the expeditious passage of the law and the prompt promulgation of the
regulations and rules.  The process involves a detailed analysis of the applicable laws and
statutes, and provides the foundation for expediting recovery on behalf of many of the victims
and their families.  

In reviewing the "interim final rule," we did note several subject areas that warranted comment
and/or question in order to assist the practical implementation of the provisions of the Act:

         There appears to be some ambiguity in specifying when a hearing can be
          requested before the Special Master.  In some sections, it appears that there is a
          presumptive right to a hearing, whereas others state that there may be a hearing, if
          requested.  Please verify at what stages the hearing process shall take place.

         Based on the current rules, it appears that the filing of a claim constitutes a waiver
          of the right to bring a civil action.  For the benefit of the Special Masters and the
          victims, it would be helpful to provide a preliminary screening hearing for the
          victim or a personal representative.  This will enable them to properly evaluate the
          viability of their claim under the Act prior to waiving the opportunity for a third party
          action.

         The collateral source rule has come under serious scrutiny.  Collateral sources
          now include life insurance, pension funds, death benefit programs and other
          government payments.  Based on the financial circumstances of many victims and
          their families, this provision will substantially reduce and/or eliminate their
          eligibility for any recovery under the Act.  We suggest that the collateral source
          rule be amended so as to provide that the first $1 million recovered from a collateral source
          by a victim or his/her family be immune from deduction from the overall award. 
          Only those amounts which exceed $1 million in funds from collateral sources
          shall offset the award.

         The subject of federal and/or estate tax is not covered under the rule.  The rules
          do state that, similar to personal injury recoveries, amounts recovered under the
          Act will not be subject to IRS income tax provisions.  However, in order to
          determine the viability of filing a claim, applicants need to know whether the
          award they receive shall be subject to estate tax or shall be provided directly to the
          appropriate beneficiaries. 

         Numerous tables were prepared with the proposed rules, including the amount of
          recovery for individuals who are married, with or without dependents, etc.  These
          estimates were provided in 5-year intervals and larger intervals for annual income. 
          There needs to be a clarification as to the treatment for those whose age falls
          between the 5-year intervals and income is between the included intervals.

Hopefully, these comments, questions and answers shall be useful, not only for us, but for your
department in amending, where appropriate, the current rules prior to commencing the filing of
claims.

The airline bailout act gave the airlines $15 billion
in cash and loan guarantees and capped the airlines'
liability for the September 11 crashes at the limits
of their insurance coverage. Because of this cap, the
damage caused by the crashes greatly exceeds the
private fund available to compensate victims and their
families. Thus for the vast majority of victims and
families, the cap has the effect of eliminating the
right that they would otherwise have to sue
the airlines. 

Congress set up the fund to ensure that the airline
bailout would not come at the expense of the victims'
families. The act mandates full and fair compensation
to victims and their families for their actual
economic and non-economic damages. DOJ has ignored
this mandate and instead has written arbitrary
regulations that will result in compensation levels
far below the losses actual suffered by the victims
and their families. In fact, many families' total
compensation from the fund and all collateral sources
combined will not even fully replace lost income. In
effect, these families will not receive any of the
non-economic compensation required by the statute.
After collateral sources are deducted, as required by
the statute, some families would receive nothing from
the fund under the interim final regulations.

DOJ's formula allows for non-economic awards at only
one-tenth the level paid in comparable cases, even
though Congress explicitly enumerated a broader range
of non-economic damages than could be recovered in any
single jurisdiction. DOJ's formula for non-economic
damages is $250,000 for the person killed and $50,000
for the spouse and each dependent. In a wide variety
of air crash and terrorism cases, however, judges,
juries, and mediators commonly have provided
non-economic damage awards well into the seven-figure
range. 

Independent economists have found serious flaws in
DOJ's method of calculating economic damages,
including use of outdated and inapplicable work life
and life-cycle earnings data. DOJ greatly
underestimates promotions and other increases in
earnings for victims. It relies on civil service and
military retirement system actuarial data that track
federal worker incomes and pension requirements, not
the higher-paying private sector career paths followed
by the vast majority of the victims. The interim final
regulations also arbitrarily cap a victim's
income at $231,000 a year. Combined with the faulty
methodology described above, the income cap would
result in some families receiving compensation for
less than 25% of their actual economic losses. Under
DOJ's rules, a family's award may be increased above
the "presumptive" award only by a showing of
"extraordinary circumstances" -- beyond those suffered by other
victims or victims' families. This high burden of
proof makes a charade of the right to a hearing
provided by the statute. DOJ should fulfill the act's
intent by revising the rules to compensate victims and
their families for the types of damages specified by
Congress, at levels comparable to those provided in
the tort system the fund was designed to replace.

While DOJ has shown flexibility on some aspects of the
rules, it is resisting the victims' and families'
requests for significant changes. If the proposed
regulations are not changed significantly, victims'
widows will have to sell their homes, deplete their
children's college funds, and give up their plans of
being full-time parents while their children are
young. Many families, anticipating little relief from
the fund, will decide to sue the airlines and others,
despite the handicap of the liability limits. We do
not believe these are the outcomes Congress intended.

To Whom It May Concern:
      a)  We believe there should be no age cap on the earnings potential of 
the victims of this terrible tragedy. Why should they have a cap if the rest 
of us are looking at retirement now starting at age 70.
      b) There should be no deductions for any charity received by the 
victim's dependants. They are ENTITLED to their share REGARDLESS of any gifts they may have received.
      c) Life insurance was PAID for by the Victim and should not have any bearing on what the family has a right to.
      d) The right to appeal should not be denied to those who are suffering due to the tragic losses inflicted on them by this horrific event.

I find it absolutely UNAMERICAN.....


I recently heard the comments on Meet the Press in regards to family 
compensations and find it to be beyond reprehensible.The fact that your 
agency is not only giving illegal aliens a get out of jail free card for 
unlawful entry but also rewarded that fact by inclusion in compensation is 
against all reason. To then further deny American family members and partners 
to these same compensation is not only disgraceful but completely 
unforgivable. I hope to hear in the very near future that this was a mistake 
on your part and that you will begin to help family members, partners and 
Americans heal from this terrible tragedy. If not I hope that your agency is 
disbanded and no money will be given until such time that it may be given to 
the people it was intended for. Please follow the correct path to fixing this 
oversight on your part.

Equal benefits

I am writing to implore you to provide equal
compensation for partners of homosexual victims of the
Sept. 11th attacks on America. The level heartache
suffered by families and loved ones of the victims
does not discriminate, why should the compensation?

we are all equal

the 14th amendment: All persons born or naturalized in the United
States, and subject to the jurisdiction thereof, are citizens of the
United States and of the State wherein they reside. 

the 15th amendment: The right of citizens of the United States to vote
shall not be denied or abridged by the United States or by any State on
account of race, color, or previous condition of servitude.

the 19th amendment: The right of citizens of the United States to vote
shall not be denied or abridged by the United States or by any State on
account of sex.

 Maybe it's just me, but i think that gays and lesbians and bisexuals
all fall into those categories, they have those rights. But, illegal
aliens and fetuses? You are saying that a person that is illegally
living in America and costing us our tax dollars and such is entitled
to any money at all, much less that they are entitled to money that a
legal US citizen is not entitled to? You are telling us that an unborn
child is being given money that a very much born person is not entitled
to. This discrimination is against all that America is supposed to
stand for---Catholics, Puritans, Jews and others all came for religious
freedom, Irish and English and others came here for freedom from
oppressive rule, the Civil War and Wounded Knee were fought for equal
treatment of minorities, and so many people today think we as a country
have grown past this sort of despicable discrimination and we tell our
children that at the same time as we tell gays and lesbians that their
love for each other means less than a heterosexual couple's love for
each other. This is not only hypocrisy, it is destructive.
