Final Interim Rule Comments

Dear Mr. Feinberg,

I recently attended a meeting with you and families and survivors of the WTC tragedy. I commend you on the time you are taking to personally meet with families in each state to provide information and answer questions about the Victim Compensation Fund.

You mentioned that in cases in which the victim died intestate, you would rely on the laws of the state in which the decedent resided for distribution of funds. In California, this would preclude heterosexual or homosexual domestic partners from collecting any funds because California does not recognize common law marriages or gay marriages. 

While defaulting to State law is the easiest way to administer the distribution of funds, it doesn't always reflect the reality of the way a person lived or what that person would have wanted (which can be ascertained by other documents besides a will or marriage certificate). It also doesn't take into consideration the fact that a person who has an "estate" of say $25,000 makes different decisions from someone who has an "estate" of the magnitude proposed under the Special Fund.

My fiance             who died on UA Flight             and I lived together for 11 years and were planning to marry on July 4, 2002. At the time of his death, his "estate" was substantially less than $100,000 (therefore would not go into probate) so he didn't feel the need to do a will. He died believing that I would be provided for to the best his abilities at the time by naming me as sole beneficiary of his life insurance and pension plans. At the time of his death, this special fund did not exist, therefore he made no provision for it.

I believe that the reason why so many people who died in the WTC tragedy were intestate is because they, like            , did not have the substantial estates that the US Government is now granting them. If people had known the sums of money involved, most would have designated how the money should be distributed.

Given the unique, unforeseeable circumstances regarding the creation of these funds, I think we should apply common sense to how the funds should be distributed. If an adult person was in a long-term committed relationship and had designated their partner as the sole beneficiary of their life insurance and pension benefits, it seems pretty obvious what that person would have wanted to do with these funds, had he known about them at the time of his death.

The simple reliance on state law for a situation that the decedent could not have anticipated and which would have affected his decisions, is a cruel game of "gotcha" for those of us who either didn't make it to the altar in time or who, because of antiquated marriage laws, weren't allowed to go to the altar to begin with.

A possible way to distribute the economic loss portion of Victim Compensation Funds is to do it in the same ratio that funds from other sources were distributed to the decedent's heirs. Since pain and suffering can not be measured, those funds should be distributed evenly amongst the heirs. 

For example, let's say the Fund calculates a total net economic loss benefit of $100,000 and a pain and suffering loss of $90,000. 

The family already received $10,000 as follows:
$5,000 life insurance proceeds to A
$2,500 remainder assets to B
$2,500 remainder assets to C

The fund would pay out the $100,000 as follows:
$80,000 to A
$55,000 to B
$55,000 to C

You stated that you wanted to distribute funds in a way that was fair. If that is the case, then it is only fair to consider the reality of the way in which U.S. citizens choose to live their lives. We are not a perfect people, nor are we cookie cutter images of one another. What constitutes "family" is different for each of us. All we can do is look at the way a person lived his life, recognize what was important to him, and not penalize him or his loved ones for things beyond his control.

WTC Attack Compensation

Mr. Zwick,

                  After reading all of the materials regarding the compensation
to families of the victims of the WTC attack, including the Air
Transportation Safety and System Stabilization Act, I find the Dept. of
Justice's interim final regulations highly inadequate, and showing
practically nothing of the intent that Congress had laid out.

                  My brother,                   , was a victim of the attack and
losing him has left a hole in this family that really can't be replaced.
And although he didn't leave any economic dependents, because he was
single with no children, the emotional and mental anguish left us, his
siblings and father, was devastating. And with these interim regulations
others, especially those widows with children, are left high and dry by
the DOJ because of their undervaluation of economic and non economic
rewards. Others in comparable cases have received so much more. If this
government can find 15 billion dollars to bail out the airlines, surely
they can find enough to justly compensate the families of that horrific
day.

                  Please, we implore the DOJ to do what is right and fair
concerning this. Don't let this drag out into long and arduous court
battles that would put these families through so much more anguish. Let
the intent of Congress come to fruition for the families of the victims,
who are all heroes.

Help all victims of terrorist attack


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11 terrorist
attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex unions.
They suffer just as grievously for their deceased loved ones as do other
survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups and
individuals who would have the Department of Justice limit compensation to
survivors of heterosexual unions.  They are interested in a political victory,
not humane assistance.

This Fund is intended for humane purposes; it is not a political statement,
Mr. Zwick.

September 11 Fund Distribution


How incredible that those who made the decisions regarding how the September 11 Fund would be administered to the survivors of victims of the terrorists should determine to allow discrimination in who receives benefits.  

And the discrimination is so blatant.  This is what I understand: The Attorney General has announced he will overlook US Immigration law as the fund will compensate the surviving partners, spouses and families of illegal aliens (in this country against US law), will not deport those coming forward, and (get this), if economic information about the undocumented alien is needed, will not penalize the employers of these people .  

My question is if an agreement from the US Attorney General that US law would not inhibit distributing funds to non-American citizens, in this country illegally, could be obtained, why did were the Attorney Generals of the 50 states not solicited and a similar agreement obtained that state law would not inhibit distribution?  

Are not all Americans who died that day equal?

Who gets compensated?

To All Concerned

Sunday morning's "Meet the Press," Kenneth Feinberg, the head of the
September 11 
Victim's Compensation Fund (a program of the US Dept. of Justice), is
planning
on limiting what kind of compensation goes to gay and lesbian victims of the
September 11 terrorist attacks.  And the way the rules read, gays and
lesbians
will probably get nothing.  Forget that           
, a gay man, was one of
the heroes who brought United Flight 93 down in a field in Pennsylvania
instead of on top of the US Congress, where it was supposedly headed.  And
forget that NY Fire Department           
 was gay, as was
the           
.  No, according to John
Ashcroft's Justice Department, apparently some heroes are more equal than
others.
I just cannot express the depth of my anger.  It's as though Ashcroft and
the Fund are suggesting that gay Americans did not suffer as much as
everybody else on September 11.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Provide Compensation to ALL Victims

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund." 
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Aid for survivors

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

As a citizen of the U.S.A. I urge you to act as quickly 
as possible to compensate those who lost loved ones
on Sept.11th,2001.

This was a horrendous tragedy to our country and we 
should be helping those who are grieving and in NEED.

It has been over two months since this devestating act 
and many are in desperate need of compensation to feed 
their families, and pay the bills that so quickly mount

Dear Mr. Zwick-

I am appalled at the thought that the FAMILIES of the homosexual victums of 
911 may not be eligable for benefits of government funding.  I capitalize the 
word FAMILIES because that's what they are.  They are the loved ones and, in 
some cases, dependents of those hard working people who were in the wrong 
place at the wrong time.  And they happen had partners of the same 
sex.....BIG DEAL!  Does that mean that they are suffering any less?  Why make 
life harder for those who have been through enough, in these recent events?

Now, more than ever, people need to be proud of who they are and feel 
empowered to carry on with their daily demands as well as their long term 
dreams.  How about if we responded with equal rights and justice?  What if 
they could feel support from their government to assist them in the same way 
that conventional, heterosexual families will be assisted?  Anything less is 
injustice.  After all, ALL of the families affected by this tragedy were 
targeted equally, by extreme animosity toward our government.  Shouldn't we 
show the world that what our government and this country stands for is 
freedom and equality?  Or is all of this "Land of the Free" stuff just a 
bunch of talk?

This is appalling!


"[Gays and lesbians are] left out of my program to the extent that their own
state doesn't include them. I cannot get into a position in this program,
which has a one-and-a-half or two-year life start second-guessing what the
state of New York or the Commonwealth of Massachusetts or the state of
Virginia or New Jersey, how they treat same-sex partners, domestic live-ins,
etc. I simply say this: What does your state law say about who is eligible?
If your state law makes you eligible, I will honor state law. If it doesn't,
I go with the state. Otherwise, Tim, I would find myself getting sued in
every state by people claiming that I'm not following how the state
distributes money. I can't get into that local battle. I've got to rely on

gay 9/11 relief

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status.  As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

important issues.

Help same sex partners of terrorist victims


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.

This importantly should include the partners and children of same
sex unions.  They suffer just as grievously for their deceased
loved ones as do other survivors, and their need for assistance is
just as great.

Please do not give in to the importuning of callous homophobic
groups and individuals who would have the Department of Justice
limit compensation to survivors of heterosexual unions.  They are
interested in a political victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.

We are all Americans

Dear sirs/madams:

Homosexuals are Americans, as are you and I.  If you feel pride for your country and thankfulness for those who gave the ultimate sacrifice, do not turn a cold heart to those who gave all, regardless of their sexuality.  They gave as Americans.  Now it is time for us to give back in gratitude.  Show that you are American.  You and I will likely never be in the position to give our lives for the sake of strangers, who just happen to be our fellow countrymen.  We are in a position to show the loved ones of those who did give all that we acknowledge them.

Is it true that you are going to award benefits to illegal aliens, who are 
not citizens, and deny them to domestic partners, who are citizens?  That's

Protect Traditional Marriage

Dear Mr. Zwick:

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation.
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died.
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have?Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution." 
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."
