September 11th Victim's Compensation

Dear Mr. Zwick:

I am writing in response to the Department's request
for public comments regarding the forthcoming
regulations for implementing and administering the
"September 11 Victim Compensation Fund." 
I strongly urge the Department to draft regulations
that ensure compensation is available to all victims
of the attack, including the committed partners and
the non-biological children of gay and lesbian
victims.

It is unquestionable that the devastating grief and
economic losses suffered by the families of gay and
lesbian victims are no less than that of other
families. Just as the terrorists drew no lines in
choosing their victims, our country must draw no lines
in compensating those who suffered the most personal
of losses from these horrific attacks.

Many Americans lost their lives on September 11, and each
of them left behind loved ones. I urge the Department
to honor these bonds by treating the families of gay
and lesbian victims as you would any other.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

Hello, 

My name is                      and I have become aware recently of the inequity of
financial help available to families of victims of the September 11th
terrorist attacks. I am deeply saddened and outraged at the recent statement
made by Kenneth Feinberg on Meet the Press that he will defer to state
governments in terms of whether domestic partners of gay and lesbian victims
of the 9/11 tragedy will receive any kind of compensation.  As you know,
there is no federal law protecting domestic partners although they pay the
same taxes as heterosexuals, contribute to society, and even were recognized
as playing an instrumental part in the 9/11 events (                    , NY Fire
Department                     ).  It is an injustice, on top of
such suffering, to deny compensation or benefits of any kind to domestic
partners of gay and lesbian victims, who are not eligible for social
security benefits, survivor's insurance and other compensations allowed to
heterosexual couples.  I ask you to direct Mr. Feinberg to make an exception
for domestic partners in the same way the 9/11 fund made an exception for
families of undocumented persons.  Please do not contribute to further
victimization by leaving these families more vulnerable after the tragic
loss of their loved ones.

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

9/11 victim compensation

I am writing this email to express my confusion and concern regarding unequal distribution of benefits to homosexual partners of September 11 victims.  Discrimination in any form is un-American and it is simply not acceptable to extend compensation to heterosexual partners, fetuses, and undocumented residents and yet exclude the partners of homosexual victims.  Let's not compound the grief of the loved ones of the victims by discriminating on sexual orientation.  All should be treated equally.

To our Elected Officials:

     In the immediate aftermath of the tragic attack of September 11th upon our nation,
Congress enacted the Victims' Compensation Fund of 2001 P.L. 107-42, to compensate
the relatives of the victims of that brutal attack. As you know, this Fund was enacted as 
part of a comprehensive package which bailed out the airlines industry and imposed
restrictions on the rights of the victims' relatives to sue the airlines in court. We implore 
upon you, as our elected officials, to demand changes to the interim rules issued by
Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules
fail to satisfy the letter or the spirit of the legislation which was enacted.

          Specifically, we request that you act on our behalf and demand the following 
changes to the interim rules:
     1. The arbitrary income limits imposed by the Special Master are not only unfair
     but also inconsistent with the letter and the spirit of the law. Those victims from
     the financial industry are specifically harmed by this limit. They were targeted and 
     murdered precisely because of the jobs they held, and where they worked-the World
     Trade Center, the Financial Capital of the world, the embodiment of financial success.
     Those who achieved such success should see that reflected in their awards. They
     personified American Business and commerce, democracy and freedom. We ask that
     you demand that Mr. Feinberg lift the arbitrary income limits so that each family can 
     be treated fairly, commensurate with the support they provided their families before
     their death.
     2. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and
     suffering, no matter what the extent of the pain and suffering. This is unacceptable.
     In the words of Rep. Peter King, "...every death is tragic, A murder is particularly
     tragic. But to have your loved one murdered in a burning building in full view of the 
     world - in a scene which will be repeated in the media for decades to come-is a 
     horror these families will never escape from... The Special Master cannot take it
     upon himself to restrict the rights of the families." Therefore, we request that the 
     interim rules be amended to more appropriately compensate the victims' families for
     the immeasurable pain and suffering endured by our loved ones.
              As Mayor Giuliani stated in his farewell address: "we have an obligation to the 
     people who did die... Their families need to be protected just as if they had been alive,
     financially and every other way that we can help and assist their families...There should
     be no compromise about that ever..."We request that the interim rules be amended and 
     redefined to the extent that income caps be removed when computing economic loss and 
     that compensation for pain and suffering more accurately reflect that horror which was 
     suffered. Justice demands no less.

I am outraged

i am outraged that you are not giving our Gay-Americans the same compensations are all other Americans of the Sept. 11th.  They are still Americans and they are still Heroes. They bleed the same blood and cry the same tears. We as Americans all over the USA moored the loss of everyone that has lost there lives. So if one family is entitled to compensation so is the rest they are still families in every sense of the word. Please look after all and not some of the people who hearts have been broken.

Equal rights for gays and lesbians

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Letter to Mr. Kenneth Zwick

.Dear Mr. Zwick:

.I am writing in response to the Department's request for public
omments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund." 
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.


Efforts by right wing bigots to deny victims relief to survivors and dependents  of single sex marriages is unconscionable, unAmerican, and sick..  The Department of Justice is already in danger of becoming thoroughly discredited--don't add this insult to the great injury that is being done to the constitution under the cover of anti-terrorism investigations.

Dear Director Zwick:

The Log Cabin Republicans ("LCR") and The National Stonewall Democrats
("NSD") welcome the opportunity to offer joint comment in response to
the request for public comment by the Department of Justice ("DOJ") on
regulations and procedures relating to compensation of survivors of
persons killed in terrorist attacks on September 11, 2001.  We at LCR
and NSD are united in seeking to do all we can to console and assist
those whose lives were forever changed by the losses suffered during the September 11th attack on our nation.

This comment focuses on the subject of claimant eligibility and
compensation addressed in Topics 5 and 6 of the Notice of Inquiry,
pertaining to sections 405(c)(2)(c) and 405(b), respectively, of the Air Transportation Safety and System Stabilization Act that establishes the September 11th Victim Compensation Fund of 2001.  These provisions on claimant eligibility and nature and amount of compensation raise a
multitude of issues, five of which we address in this comment.  First,
the DOJ asks whether the Special Master should require "survivors" of a
deceased victim of the tragedy to be notified of their potential
eligibility for compensation by the lost person's "personal
representative."  Second, the DOJ asks whether the Special Master may
determine who is the "personal representative" of a deceased victim
among a pool of claimants and other persons.  Third, the DOJ requests
comment on whether the Special Master, in a situation where there is a
dispute about the identity of the victim's personal representative,
should require adjudication and resolution of this question by an
appropriate state court or authority.  Fourth, the DOJ asks whether
compensation for a victim's claimants be placed into escrow pending
resolution of adjudication as to the personal representative of a
deceased victim.  Fifth, the DOJ asks for guidance on regulations to be
promulgated to determine the nature and amount of compensation to a
victim's claimants.

As a threshold matter, we believe that the DOJ, working through the
Special Master, should determine the identity of the personal
representative of a deceased victim and all eligible survivor-claimants
of a victim in a fair and equitable manner.  Accordingly, we believe
that the Special Master should be vested with the responsibility to
determine the appropriate personal representative of a lost victim and
the eligible claimants of such a victim.


PERSONAL REPRESENTATIVES

Criteria for identifying personal representatives should be
fundamentally fair, equitable, and consistent, and should consider all
of the individuals who had a close relationship with the deceased
through an analysis of relevant indicia of such relationship.  These
indicia would include, among others, shared residence, formation of a
civil union, registration of domestic partnership with a state or other
jurisdiction, shared bank accounts, joint membership in a health plan,
joint membership in a place of worship, joint enrollment in a club or
association, or evidence of a significant sharing of living expenses.

If there is a dispute about the identity of a personal representative of a deceased victim, an escrow procedure for compensating eligible
claimants should be established.  In such a case, the Special Master
should be required to have such disputes resolved in a state court of
competent jurisdiction where the relevant state's laws reflect
substantially the same indicia, as listed above, for determining the
appropriate personal representative.  However, if relevant state law is
substantially different and does not account for consideration of broad
criteria for evaluating relationships in a fair and equitable manner,
the Special Master should be provided with the authority and be required to exercise appropriate discretion to resolve such disputes using the types of relationship indicia discussed in this comment.


CLAIMANT ELIGIBILITY &amp; COMPENSATION

Further, regardless of the procedures for determining personal
representatives, the Special Master should be required to evaluate the
eligibility of claimants in an appropriate manner.  Fortunately, a fair
and equitable September 11th compensation system model already exists
for the DOJ's examination and consideration, and we urge the DOJ to
study and emulate the fundamental aspects of this model.  On October 11, 2001, New York Governor George Pataki signed Executive Order 113.3,
directing the state to consider all appropriate factors in determining
an eligible dependent for purposes of compensation.   The New York
executive order reads in relevant part as follows:

        "Such a dependent person shall be eligible for awards upon a
showing of unilateral dependence or mutual interdependence upon such a
victim, which may be evidenced by a nexus of factors, including but not
limited to common ownership of property, common householding, shared
budgeting and the length of the relationship between such person and the victim."

With respect to the Special Master's determinations of the nature and
amount of compensation, we strongly urge the DOJ to fairly and equitably take into consideration economic and non-economic losses suffered by a victim's eligible claimants.  For example, those sanctioned under New York City and New York State laws as domestic partners should continue to receive equitable treatment and consideration for economic and non-economic losses that are determined to exist by the Special Master.

Lastly, we suggest that the DOJ consider the bipartisan action of 45
members of the United States House of Representatives who, in a letter
to the United States Attorney General dated November 15, 2001, urged the
DOJ to consider the type of indicia mentioned above in promulgating
regulations for the operations of the compensation fund.

We submit this comment and respectfully ask for full consideration of
its contents.  Please do not hesitate to contact us if we can be of

Support Equal Access to Disaster Relief!

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

important issues.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Gay and Lesbian families suffer just as much in the the 9-11 tragedy.  It is inhuman not to compensate them because of existing protocols.  If protocols are inhibiting us from being fair, have we learned anything?

Ensure fair treatment for all surviving families

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving 
families of the tragedy on September 11th, including the children and 
families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond 
trader earning millions of dollars per year might receive thousands 
of times as much compensation as the survivors of a dishwasher in one 
of the restaurants destroyed.  Justice requires looking far beyond 
the last paycheck to the inherent worth of all those killed, so that 
a high minimum compensation level is set to lessen the disparities. 
It would be a double blow to the survivors to first lose their loved 
one and then watch as most of the taxpayer money went to those who 
were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of 
gay and lesbian relationships and families. Gay and lesbian families 
are especially vulnerable when one partner is killed. Because the 
option of marriage is unavailable, these families may find themselves 
in the traumatic predicament of having to prove that their union is 
legitimate. Fortunately, both the Red Cross and the State of New York 
have already announced that they will not discriminate against gay 
and lesbian families. The Department of Justice should do the same.
