Dear Mr. Zwick:

I am writing in response to the Department's request for public comments 
regarding the forthcoming regulations for implementing and administering the 
"September 11 Victim Compensation Fund." I strongly urge the Department to 
draft regulations that ensure compensation is available to all victims of the 
attack, including the committed partners and the non-biological children of 
gay and lesbian victims.

Many Americans lost their lives on September 11, each of whom left behind 
loved ones. I urge the Department to honor these bonds by treating the 
families of gay and lesbian victims as you would any other.

Victim Compensation


Dear Mr Zwick:  I have heard that the partners of gay and lesbian victims of 9/11 will not be provided equal compensation as the heterosexual victims partners.  If this is indeed true, I wish to voice my disagreement with this policy.  The gay partners are equal victims in this tragedy and diserve equal treatment.  To allow for this kind of discrimination is, it itself, a form of terrorism.  To deny these partners  compensation would be denying them their right to exhist freely in this county, as the terrrorists denied the victims of 9/11 their right to live.  Please, do not perpetuate this form of discrimenation.  

The tragic events of 9/11 have brought this county together in solidarity to defend the 'free' world.  If the gay partners of the 9/11 victims are treated any differently than the other partners, this does not represent freedom and equality, those values that American so cherish.

RE: Comments on the Rulemaking for the September 11th Victim Compensation Fund of 2001

Dear Director Zwick:

You are, thankfully, in the process of creating the September 11th Fund to provide compensation for the losses of relatives of those who died, and those who were injured. 

It is crucial for the many grieving families that the regulations that implement this program permit all deserving relatives to recover   including committed partners or non-biological children of gay and lesbians victims ofthe terror attacks. For those whose family relationships do not meet certain strict formal legal definitions, the enormity of the loss of a beloved companion or parent could be compounded by the prospect of that they will be ineligible for compensation intended for their protection. The Department of Justice should not permit this potential inequity.

I urge the Department to include amont relatives eligible for compensation those who lost their life partners or de facto parents or children, regardless of sexual orientation and marital status. A suggested method for effectuating this policy has been laid out in the Lambda Legal Defense and Education Fund's November 21, 2001 letter to you.

September 11 Victim

Hi, 

My name is
My apartment and business office located on ground 0. 
I lost my apartment, some of my furniture and personal belongings because of 
September 11 disaster.
 I also have to deal with a huge business interruption and I don't know at 
this point if my business survive it.  
I am going through enormous pressure and constant stress day in day out. This 
is probably the most difficult time in my life. 
Some of the organizations such as FEMA, RED CROOS, etc. are trying to help me 
and people like myself, but its definitely not enough. I would like to thank 
them anyway.
 We lost almost everything including our health and we are getting just 
couple grand for temporary housing and a loan under the personal guaranty 
that you have to pay back eventually. This is just not right, we see millions 
of dollars going to different organizations and than what? How much of this 
money will reach real victims?
I believe that for every person seriously effected by the WTC disaster a 
substantial grant should be given for the quick and painless recovery from 
the drastic events we survived.

murdered 9/11 victims?  Why should they be discrimnated against?  Is their

Support Equal Access to Crisis Relief Benefits for Surviving Gay and Lesbian Partners!

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars
per year might receive thousands of times as much compensation as the survivors of a dishwasher in
one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent
worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It
would be a double blow to the survivors to first lose their loved one and then watch as most of the
taxpayer money went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

    I feel compelled to write this e-mail, to express my dissapointment with the compensation amount in the federal victims fund. I would be entitled only to non-economic loss which according to the fund would be 300.000.00 munus collateral source compensation which in my case, would entitle me to receive 75,000.00 from the fund. This is no incentive to stop me from going into litigation no matter how long it would take. I feel that 300,000.00 without any deduction from callateral source, would be inadequate but considering the favorable time factor with the fund and the fact that noone wants to strain our airline industries with lawsuits, I would go with the federal fund,

September 11 Victim Compensation Fund

Dear Mr. Zwick:

I am writing in response to the Department's request
for public
comments regarding the forthcoming regulations for
implementing
and administering the "September 11 Victim
Compensation Fund." 
I strongly urge the Department to draft regulations
that ensure
compensation is available to all victims of the
attack,
including the committed partners and the
non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and
economic
losses suffered by the families of gay and lesbian
victims are
no less than that of other families.  Just as the
terrorists
drew no lines in choosing their victims, our country
must draw
no lines in compensating those who suffered the most
personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each
of whom
left behind loved ones.  I urge the Department to
honor these
bonds by treating the families of gay and lesbian
victims as you
would any other.

Dear Mr. Zwick:
 
I recently read that the September 11th Victim Compensation Fund will not
provide funds to gay and lesbian partners of those who died on September
11th in the same way as heterosexual spouses.  I urge you to reconsider this
decision.  This kind of discrimination is un-American and reinforces the
kind of discriminatory thinking and inhuman belief which leads to acts such
as the September 11th terrorism.
 
The loved ones of those who died on September 11th deserve support,
regardless of their sexual orientation.  Please reconsider your decision.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should
do the same.

I write as a member of Amnesty International, a worldwide human rights

September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

about your efforts to ensure that all surviving victims of the September 11

policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

Victim Compensation Fund


I just finished reading an article in today's Seattle Times, "Victims' families to get average of $1.6 million" and after reading the article aloud in my office my fellow employees and I are in agreement that this is way overboard.    Although I have not heard one explanation for the reasoning behind why the payments have been tailored the way they are, I suspect that the primary reason is so that 3,200 families do not sue the airlines, in effect creating another need for airline industry bailout.  However, it is upsetting to me to read that this fund, or, as the paper says Kenneth Feinberg puts it, "an unprecendented expression of compassion" on the part of the American people to the victims and their families, will pay the families of single, childless victims who died in the September 11 tragedy.  What happened on that day was certainly a tragedy that touched the world.  It created emotional problems for people all over the world and especially in the United States.  Like any other death, I for one am at a loss of words to the families who lost people in the tragedy.  However, the ACTUAL "unprecedented expression of compassion on the part of the American people" was their giving, and mine, to the United Way and the Red Cross funds so that that money could go to the families of the victims.   What bothers me most is the inequity of this fund and the way it is categorizing people that were directly affected by the disaster.  Americans in every corner of the nation are violated every day or they are met with misfortune.  I know of two women that I went to highschool with who were murdered...one beaten to death with a blunt object and another found in her bathtub strangled.  These people were murdered just the same as were the people in the World Trade Center and the Pentagon.  On September 12 a friend of mine and her two sisters lost both of their parents in an airplane crash in the Yucatan in Mexico.  My own mother died when I was four years old and my sister six.  Social security paid my father about $100.00 per month for each of us until we were eighteen years old.  I have countless other examples of sad stories such as these.  Who compensates people like this for their loss, pain and suffering?  Who pays for the funeral costs?  They do.    We Americans exist in the land of opportunity.  Most of us are entirely capable of making important choices to plan for our futures and for the futures of those we love by obtaining life insurance, retirement funds, etc.  Some of us are lucky and we are able to get good educations and make good money in the careers of our choice.  Hopefully we are able to save for the future and whatever that may bring, good or bad.  But after the life insurance check comes, that's it for most people, if they even have that.  It does not make good sense to me that this fund is going to pay the survivors of a 25-year old single worker who made $25,000 annually up to $1.17 million before deductions, nor that a widower of a 40-year-old childless Pentagon worker earning $60,000 a year would receive $640,000 before deductions.  I can understand compensating a widowed spouse with children or children that are now left without parents.  I think paying someone who was disabled in the World Trade Center is the right thing to do.  I can understand helping them to get back on their feet for however long that takes.  I can understand helping all survivors who lost their jobs to make their house payments and to make ends meet.  But no amount of money will bring these people back.  And while this event was one of the most tragic things that has happened to America in its entire history, individuals and individual families are met with equal hardship every day.  What about all of the Boeing workers who have lost their jobs as a result of this tragedy?  Is the federal goverment paying them in addition to the measly amount they are paid in unemployment benefits?  Even Japanese individuals that were placed in camps so many years ago during the Japanese conflict were only paid around $20,000 in many instances.  So, this law is not equitable at all.   I am sickened by the obvious greed that is shown by statements made by people like &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp of Long Island.  I would like to know what is so ultimately different about her situation and my father's.  Yet she has the gall to call the amount of money she will be getting from the Victim Compensation Fund a sick joke.  And &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp of &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp asks why he should be penalized for planning for his future in referring to the fact that his life insurance income will be deducted from the "award" he receives.  Getting any amount of money from the Victim Compensation Fund in addition to his life insurance is not a penalty, it is a blessing for him to receive it during a very difficult time in his life.  Both of these people need to take stock of their situations, be thankful that they are still alive, and move on like every other person who endures loss must do.  Perhaps they should spend all that energy on helping to change the world instead of being angry that the average figure of $1.6 million is not enough for them to pick up their lives and live on.    I hoped that if anything positive came out of the September 11 tragedy that at least Americans might finally realize that what they have is a whole lot more than what most other people in this entire world have.  I hoped that they might finally stop pointing fingers at everyone else and take responsibility for their own actions for once.  I also hoped that people would realize that bad things happen with no explanation, and while it is always painful to someone, we must move on.  I am angry about the way this fund will work.  I am angry that despite my wishes, through the Victim Compensation Fund I will be paying for a highly paid banker or stocktrader's family to live in addition to what I have already given to charitable organizations.    I understand the purpose of the fund, but I do not agree with the manner with which you are going about the disbursement of these funds.

brief comment

I along with most remember the surealistic images on tv @ work the morning of 
9/11 ! I can not imagine seeing and/or remembering that image knowing that 
anyone from my family was in the building or close. How soon some forget!
We all state without considering the concept that you can not put a price on 
life!
Why would anyone anywhere ever use the word greed to describe family members 
of thousands of people who were the victims of THE WORST ATTROCITY ever to 
happen in these United States in most of our life times???
Lay out the whole national budget (foreign &amp; domestic) inclusive of the many 
ludicrous "pork barrel" projects and then tell the child not yet born on 9.11 
that his/her family was greedy and got over compensated as a result of their 
loved one getting murdered while doing little more than living!
How could anyone thow such a "stone"?  The cliches short sighted and small 
minded come to mind. 
Let us not forget the endless embarassing gov beaurocratic paperwork that 
necessitates that surviving families still grieving very personal and private 
losses provide many very personal family financial details in a somewhat 
public forum! 
Shame on all who attach the word greed to describe anyone so very personally 
affected by the attrocious murder of a loved one as they access monies 
available from us the tax paying public! Indeed tax dollars paid by people 
who lost their lives and from companies destroyed or decimated by the attack 
are also included!
In addition, I feel that a separate fund with much more flexibility be set up 
to assist those who have lost incomes but not loved ones! So what if a person 
only worked a few weeks - LET SIMPLE LOGIC &amp; COMMON SENSE PREVAIL when 
determining if loss of income was/is do to this ATTACK, NOT standard 
beaurocratic regulations governing laws like wagner-pyser, and WIA dislocated 
worker rules! Why should anyone who lost their ability to be self-sufficient 
do to an attack on the Sovereignty of this great country be put in the 
position of a beggar and called greedy??

September 11th Compensation fund

I am writing today to ask you to consider a policy for distribution of funds that will not discriminate on grounds of sexual orientation.

I am asking the Justice Department to include among relatives eligible for compensation those who lost their life partners as well as de facto parents
or children, without regard to sexual orientation or marital status.

I am asking you to follow the example already set by New York Governor Pataki in granting compensation benefits "on a showing of mutual interdependence
with the victim, in recognition that anyone who shared with the victim living expenses, day-to-day activities and the emotional bonds of family deserves
help in this time of need."

From the brave young gay man who lost his life on the plane attempting to save the lives of innocent people... to the gay priest who lost his life
while ministering at Ground Zero... to the many lesbian and gay employees working in the World Trade Center... it is vitally important that we demand that our government treat all of our families with dignity and respect and equality.

Within our own Metropolitan Community Churches, our lives have forever been touched by the death of           , a member of MCC New York, and the horrific loss experienced by her life partner and their teenage son.
