Equal Access to

December 19, 2001

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.

As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Sincerely,

Individual Comment

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Sincerely,

September 11th Victim Compensation Fund of 2001

Kenneth L. Zwick, Director

Office of Management Programs

Civil Division

U.S. Department of Justice

Main Building, Room 3140

In Re: Public Law 107-42

Thank you for inviting public comment on the above-cited Public Law and its provitions. I wish to specifically comment on the Victims' Fund.

There has been great public discussion and no small debate over who exactly constitutes a victim for purposes of eligibility for a portion of
this Fund. I wish to express my earnest belief that a victim should herein be defined as any person with an accountable relationship to any of
those who perished in the national tragedies at the Pentagon and the World Trade Center.

I particularly wish to fully endorse the provisions contained in the Congressional letter of 16 November authored by Mr. Frank and signed by 44
Members of Congress, including Mr. Nadler, whose district includes the site of the World Trade Center.

I wish to note that Governor Pataki has already signed a compensatory program which reflects the broad and inclusive interpretation we are
asking the federal government to apply to the victims of this tragedy. I hope and pray that my nation's government is as compassionate as that of the city and state of New York.

Sincerely,

Individual Comment

September 11th Victim Compensation Fund of 2001

I have been displaced from my apartment

It is inconceivable to me that any one directly affected by the events of
9/11 would not be considered to be a victim even under what appears to be
the very narrow definition provided.

I have been displaced now for almost 2 months now and I have no date from
the landlord as to when I will be able to move back to my home. For a
number of weeks following the attack access to my apartment was extremely
limited as the whole area was designated a crime scene. Even now access to
my apartment is limited to business hours and I have to sign in before
entering.

The cost of finding alternative housing and the clean-up of the apartment
(HazMat decontamination) not to mention the emotional cost is staggering.

DISCRIMINATION AGAINST GAY AND LESBIAN VICTIMS & PARTNERS UNFAIR!!!

I am outraged that gay and lesbian partners of those
who died on September 11 are not automatically going to
receive the same benefits as heterosexual spouses.

If September 11 has taught us anything, it's that our
patriotism and love of country transcend our differences and
unite us all. We were told that September 11 was the day
that "hyphenated-Americans" were no more, and rather than
being Italian-Americans, African-Americans or gay-Americans,
we were now simply Americans, all of us together as one
American family. Apparently, that family just got a divorce.

The hyphens seem not to matter when our government wants to
use our heroism to inspire others, but when it comes time to
actually aid the families of those heroes, the hyphens come
back with a vengeance, and it seems that some American heroes
are now more equal than others.

Exclusion of Benefits to Gay & Lesbian Families of 9/11 Victims

Is it true that benefits have been denied to families
of gay and lesbian victims of the 9/11 terrorist
attacks? If so, I am writing to protest this
additional injustice against those who died that day.
How can a government pick and choose those who are
eligible for compensation--based on their sexual
orientation? Are the families of those who died any
less worthy of our help because they don't meet the
traditional definition of the American family unit? I
thought America was about INCLUSION, not EXCLUSION.

Please Guarantee Help for All Victims of 9/11

December 19, 2001
Dear Mr. Kenneth Zwick,

As you know, the United States has committed to uphold international human
rights standards, including the Universal Declaration of Human Rights and
the International Covenant on Civil and Political Rights, which prohibit
arbitrary discrimination.

Thank you for considering these concerns. I look forward to hearing from
you about your efforts to ensure that all surviving victims of the
September 11 attacks have equal access to the relief fund.

Sincerely,
Individual Comment

Support for G/L survivors and families of 9/11

I can't believe what I am reading. This fund should go down in history as an
effort that saw through narrow-minded definitions of family. Surely the
future will bring more, not less, acceptance, and this action will be judged
through that lens.

Please re-think your decision.

Non-traditional familes also need support at this time

Comments on September 11 Fund

Dear Mr. Zwick:

I am writing to ask that gay and lesbian survivors of the September 11
attacks be included in the compensation plan for the September 11 Fund. I
think you can find an equitable way to include everyone who has suffered a
loss--no matter the kind of family they have.

Sincerely,

Individual Comment

equal access to 9//11 relief funds

December 31, 2001

Dear Mr. Kenneth Zwick,

I urge you to administer the September 11 Victims Relief Fund without
regard to the sexual orientation of the victims. Specifically, by
including among relatives eligible for compensation those who lost their
life partners, as well as de facto parents or children, without regard to
sexual orientation or marital status. The State of New York has already
adopted such a policy, granting compensation benefits "on a showing of
mutual interdependence with the victim, in recognition that anyone who
shared with the victim living expenses, day to day activities and the
emotional bonds of family deserves help in this time of need."

In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. for all victims, regardless of sexual orientation or
marital status. As you know, the United States has committed to uphold
international human rights standards, including the Universal Declaration
of Human Rights and the International Covenant on Civil and Political
Rights, which prohibit arbitrary discrimination. My concern is that the
September 11th Victims Relief Fund be administered in accordance with this
standard.

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights

without discrimination, in support of equal access to benefits under the

orientation or marital status.

Special Master Kenneth R. Feinberg
September 11th Victim Compensation Fund
U.S. Department of Justice
950 Pennsylvania Avenue, NW
Washington, DC 20530

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th,
including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the
restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all
those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double
blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those
who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of
marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove
that their union is legitimate. Fortunately both the Red Cross and the State of New York have already
announced that they will not discriminate against gay and lesbian families. The Department of Justice should
do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very important
issues.

Sincerely,
Individual Comment
Oakdale, NY

Special Master Kenneth R. Feinberg
September 11th Victim Compensation Fund
U.S. Department of Justice
950 Pennsylvania Avenue NW
Washington, DC 20530

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families. Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

Sincerely,
Individual Comment
New York, NY

discrimination / final report

Stating the obvious, regardless of a person's race, class, gender or sexual orientation, pain and loss are suffered equally. You now have two options before you: make another mistake for posterity to learn from, or set a precedent that posterity will respect.

Let the history of discrimination be your guide.

Help all victims of terrorist attack

Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex
unions. They suffer just as grievously for their deceased loved ones
as do other survivors, and their need for assistance is just as
great.

Please do not give in to the importuning of callous homophobic groups
and individuals who would have the Department of Justice limit
compensation to survivors of heterosexual unions. They are
interested in a political victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.

Sincerely,

Individual Comment
Austin, TX

Federal Compensation

I wouldn't mind the deductions of Life Insurance etc., if you used my
husband's real salary and not have put a cap on earnings. You would think
the money was coming out of Mr. Feinberg's own pocket the way he is trying to
give the families as little as possible. The only people that make out are
those who never bought life insurance and did not plan for the future. These
people who made a lot of money contributed the most to Social Secuity, and
were taxed at high rates by the State and Federal Governments. Why should
there have to be a cap on salaries. It's bad enough he is only recommending
$250,000 for pain and suffering. With the deductions alot of people will
receive next to nothing so their only alternative will be to sue, which was
what the government was trying to avoid. But if you get nothing you really
have nothing to lose by suing. A little something is better than nothing.

Eugene,OR

studied compensation statements, tables and comments as pertaining to high
income earners and believe you have opened a can of worms--look at it from my
daughter's viewpoint. Her husband , 32 years old, high income earner, 9
years with the company, rising very fast with a 15 month old son and a good
insurance policy. According to your formula, she will get less than one-half
of 1 years compensation. Our family was thinking and discussing at length
that if she can't get 2-3 years of his latest remuneration(ex-options), the
whole fund is senseless. The changes, mental and physical to her and our
extensive family, the extreme emotion (psychologists, group therapy sessions,
disruptions to the extened family) is such that you are throwing us into the
clutches of attorneys, who up until this time we have not consulted.
Forgetting the life insurance, if the money you provide her with can't give
her a relatively adequate reasonable stream of income (albeit at a reduced
level from her former circumstances) then you are kidding yourselves and
inviting ridicule and abuse from families who have already had their share of
abuse. Getting away from the initial grief, we are all seeing things a
little clearer and realizing how culpable, lax and inadequate was the
protection afforded our son in law by our government. If his suffering, my
daughter's suffering and loss of companionship and lifestyle is not worth at
least 2 years of his net salary (after life insurance for which he is being
penalized for taking out) to her and her child, I then think you are making a
big mistake.
                 respectfully, an angry father
