Dear Mr. Zwick:

I am writing in response to the Department's request for public comments
regarding the forthcoming regulations for implementing and administering
the "September 11 Victim Compensation Fund."  I strongly urge the
Department to draft regulations that ensure
compensation is available to all victims of the attack, including the
committed partners and the non-biological children of gay and lesbian
victims.

It is unquestionable that the devastating grief and economic losses
suffered by the families of gay and lesbian victims are no less than that
of other families.  Just as the terrorists drew no lines in choosing their
victims, our country must draw no lines in compensating those who suffered
the most personal of losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom left behind
loved ones.  I urge the Department to honor these bonds by treating the
families of gay and lesbian victims as you would any other.

victims so called right to compensation



I am in total shock at the actions of these people squabbling with each
other and wallowing in their own greed at the first smell of government
money. They have finally overshadowed any place they had in the hearts of
fellow citizens by their willingness to turn mercenary at the first sign of
compassion. Their "hurt" equals "money", and they'll gladly sue well meaning
people to get it. I am also shocked at the percentage of Americans that
equate suffering from ANY cause with immediate compense by the "Government".
The Government is you, me, and everyone else that is a citizen, and fellow
citizen, that is not what Government is about. What have we become? Why will
Americans not accept responsibility for their lives ? These people have
suffered, but in fact they were only at work that one day, just like
millions of people in this country.

911 Fund's Discrimination Agains Gays and Lesbians



I am appalled by the Kenneth Feinberg's comments on Meet the Press this past Sunday.  I am ashamed that my government would see fit to so openly discriminate against Gays and Lesbians, people who were equally devastated by the events of September 11.  I rejoice over the new found freedoms of the women of Afghanistan, but wonder how we can call other governments discriminatory when we won't even acknowledge such a large, politically active, community-oriented group in our own country.  

Is there something that tells you that gays and lesbians grieve less, sacrifice less, or in any way are less affected than other U.S. Citizens by these events?  How can you in good conscience say that you will forgive immigration violations to compensate illegal immigrants, yet ignore and marginalize a group of citizens who were legally employed?  How can you look into the faces of the loved ones of those who died - people who loved and cared for the victims as much as any spouse - and tell them that they don't count simply because of their sexual orientation?  I think the obvious answer is that you decline to look at them at all.  For that you should be ashamed, especially to wrap your discrimination in the cloak of warding off lawsuits, an incredibly specious arguement and one not worthy of consideration.  Not in this country, not in this time.  

I hope that you will reconsider your actions, take the right and moral step and compensate those who lost loved ones, regardless of their sexual orientation. I expect my government to act in a more noble manner.

Setp 11th Victims Funds

I've already sent a note regarding the Sept 11th Victims Fund, and I have 
one additional note as a resident of Battery Park City with renters 
insurance...

Having insurance has been a double-edged sword.  It's hindered (at this 
point, ceased) our ability to get assistance (FEMA and Red Cross) even 
though our "loss of use" coverage ws used up the first few weeks after the 
disaster.

Disrimination of 9/11

I just finished reading an article about the September 11 relief funds that 
made me ashamed to be in this country. It sickens me that a person of illegal 
status in the country can receive funds, but someone born and raised, who 
works each day, pays their taxes, and is a credit to the country, cannot 
receive this fund, only because of the sexual preference they have. I do 
believe that it is illegal in this country to discriminate against people 
because of ones sexuality. I know it's against the law to discriminate 
against people because of their religion, if they have HIV/AIDS, if they're 
female, or if they have a different skin color, and no one slides on those 
rules, they're set in stone. So why is this law able to bend? Why can people 
look the other way a gay man or a lesbian women is concerned? Did they not 
suffer the same? Was the pain not as real because they came home and cried 
with a person of the same sex instead of the opposite? Were their tears not 
as frequent? Their heartache not as real? Is a person of less value because 
of a choice in their life? And may I add that it is not a choice to be gay, 
it is a choice to be open about being gay. So would you rather have people 
hide their true selves from the world? To be fake and pretend to be happy 
with the wife they don't love and the kids born into a fake relationship? I 
think that would constitute much more of a problem then a few people looking 
the other way when a male couple walks down the street. This entire ordeal 
has made me sick, and more ashamed of my American blood then I ever thought 
possible to be. Isn't this the land of freedom? The land when people are free 
to be themselves, no matter what anyone else thinks of them. The land of 
opportunity. Shouldn't everyone have the opportunity to grieve? To receive 
the same treatment as every other person during a time of great sadness? If 
this is what the government calls Freedom and Opportunity then someone needs 
to hand them a dictionary. Or better yet, put them in the shoes of a gay man, 
a person infected with HIV/AIDS, an Atheist, A women, and see how well they 
hold up, see how many things are changed.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

          As you consider government relief for the victims of the attacks on our country on
September 11, please consider two things:

     1)   Aid to the families of the victims should not be based solely on the victim's last
          paycheck. We should not be giving away public funds only to the wealthy. A
          strong minimum payment for all victims' families should be established.

     2)   New York State and the American Red Cross have stated that families of gay and
          lesbian victims will be compensated the same as others. I urge your office to 
          certify this policy as well. Those families are just as much in need as any others.

administration of funds for compensation of families of tragedy

    I hope that the funds will be equally distributed among ALL the families of the victims of Sept. 11th. Discrimination would be another tragedy. Gay life partners and unmarried heterosexual partners have had the same emotional and financial devastation as the "traditional families". As a stay at home lesbian mom I know  the loss of my partner in such a sudden and sensless way would  be emotionally devastating, but the loss of income and benifits would make it more than I could cope with. It would compound the tremendous impact on the children.  They would then have to deal with the added burden of no income, and immediate life style changes as I would have had to get a job and leave them a soon as possible, on  top of the loss of a parent  . Regardless of someones religious or moral beliefs,  this country is based of equality  for all. That is what separation of church and state is all about. Please remember these unfortunate victims when deciding on the
rules for the fund. A victim is a victim. And there has been more than
enough sensless  tragedy in this country.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, 
including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars
per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the
restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all
those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double
blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to
those
who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of
marriage is unavailable, these families may find themselves in the traumatic predicament of having to
prove
that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already 
announced that they will not discriminate against gay and lesbian families. The Department of Justice
should
do the same.

If we are going to give people an average of $1.6 million tax free, with reasonable municipal bond investment earnings of $96,000 per year tax free(6% of $1.6 million), then let's Oklahoma City victims, the victims of the embassy bombings in Africa as well as terrorist attacks on any and all American civilians anywhere in this world.  Fair is fair.  Why should some benefit while others in the same situation do not?

Excessive growth assumptions favor rich at expense of poor

Dear Mr. Feinberg

As a forensic economist who has often testified on the economic consequences
of wrongful death, I applaud your efforts to find a distribution formula
that is both fast and fair. Unfortunately these two noble objectives are on
a collision course.

Your distribution formula is badly flawed because your assumed rates of
compensation growth are much too high. The effect of this mistake is
twofold. First, of the funds available for distribution, too much is
allocated to economic loss and too little to non-economic loss. Second,
although the faulty formula proportionately "overcompensates" everyone for
economic loss, more of the actual dollar amount is allocated to the highly
compensated, at the expense of the less highly compensated. Both of these
consequences tend to favor the rich at the expense of the poor. This is true
despite your passionately and eloquently stated reluctance to play the role
of King Solomon by  deciding that some lives are worth more than others.

The appended chart documents my argument using one hypothetical worker, age
25, who earns $18,000 a year, and a counterpart earning ten times that
amount. The excessive compensation growth assumptions in this admittedly
extreme case result in a misallocation to the more highly paid individual of
$1,538,723.

At the very least, I urge you to revise your growth assumptions so that they
are in better accord with economic reality, and with customary courtroom
practice. In today¹s environment, a generalized growth rate of 3.5% is
probably appropriate, rather than the rates of up to 6.6% in your current
formula.

It would be better still, I think, to de-emphasize compensation for economic
loss, and to correspondingly increase your allocation for "pain and
suffering," hewing to your established principle of compensating everyone,
rich or poor alike, by an equal but now presumably much higher amount.

I note that you are performing this service to your country without
compensation, and if I can be helpful to you, I will gladly contribute my
services as well.

justice for all victims

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

9-11 Attack

Dear Mr. Zwick:

I understand that you will most likely be receiving many, many letters just
exactly like mine as it is a template of a letter drafted by the PFAW. This
in no way, however, ameliorates my real concern about this issue.

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Justice help all terrorist victims


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex
unions.  They suffer just as grievously for their deceased loved ones as
do other survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups
and individuals who would have the Department of Justice limit
compensation to survivors of heterosexual unions.  They are interested
in a political victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already  announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.
