Sept. 11th victim compensation fund--

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

I am the mother of a gay son.  He and his partner have been together for 
almost 13 years.  I know the love they have for each other, and it is no 
different than my husband and I have for each other after our fifty plus 
years together.  A loss of anyone's loved one is just as tragic no matter 
who we are.  At this season I think of Tiny Tim's phrase when he said "God 
bless all, everyone"!!!  No one is excluded!!!

Dear Mr. Zwick,

I am writing in response to the request by your office for public feedback 
concerning the drafting, implementation, and administration of the 
"September 11 Victim Compensation Fund." I think it is very important for 
the language included in forthcoming regulations to include compensation for 
the widows of gay and lesbian partnerships, as well as their children, 
biological or not. Family is defined more broadly today than it ever has, 
and I think it valid that those who considered themselves the family of a 
victim or victims in this tragic event be included and compensated equally 
as those in a more traditional scenario.

Furthermore, as the supervising manager of a restaurant that proudly took 
part in the nation-wide "Windows of Hope" charity day, a day where a portion 
of our proceeds and those of hundreds of other restaurants for one evening 
went to the families of those restaurant workers that were killed in Windows 
on the World, I strongly lend my voice to the families of those victims as 
well. Many of those people who worked for Windows on the World as well as 
those that worked in the World Trade Center, were undocumented residents of 
this country. Therefore, their families, many of whom are either living 
elsewhere in the world or are also undocumented, have not recieved the kind 
of governmental aide that those who are citizens of the United States have. 
I feel that your Compensation Fund also ought to take the stance that the 
American Red Cross has by encouraging those who are victims and may be 
illegal to come forward for help without the fear of arrest and deportation. 
In this trying time, we must look past such petty laws and look into the 
lives of those that have lost so much. This a human issue, a global issue, 
and one that supercedes, for the time being, immigration law.

gay/lesbian victims compensation


I am appaled that partners of gays and lesbians may not be included in victim compensation for the Sept. 11th tragedy.  Please do not divide us on this issue...our country is in need of healing, not further division. Many of the heroes of Sept. 11th, including           , were gay or lesbian.  Honor their spirits and patriotism by including their loved ones in victims compensation...it's the right thing to do.

Dispute over Victims' Fund

I, along with hundreds of thousands other Americans was horrified at the
murderous act of the terrorists.  I personally feel there should be some
assistance given to the victims' families.  However, I am sorely
disappointed in the hoopla that has surrounded the various funds, in
that what would have any one individual family had done had their spouse
just dropped dead of a heart attack.  Just yesterday, a truck driver
died in my city, as a result of an auto/truck accident.  No one will
come forth to help his family. He was on the job, I assume, and will be
entitled to Worker's compensation.  Hopefully, he had life insurance or
some means too provide for his family.

I do not wish to diminish in any way the suffering of the families
affectved by September 11.  However, I think we all fail to forget that
EVERY DAY, many times a day, someone's loved one, spouse, breadwinner,
etc. dies unexpectedly.  I cannot for the life of me see where the
families of September 11 are any different.  What had one man gone to
work at the WTC and just dropped dead at his desk of a heart attack?
You'd never heard of it, much lest have billions of dollars raised to
provide for him or the many others just like him throughout our country.

I just think it is time we put into perspective that these families on a
one on one basis, just as if a horrible accident had just happened to
one of them.  It just was multiplied by this horrendous act.  However,
in reality, it is no different than the customer in a convenience store
that got gunned down by a robber.

These families should be greatful for the amounts of monies that have
poured in from around the country, or world, for that matter.  Many
widows/widowers have nothing when their spouse just happens to get
killed out here in the day to day scene of living. I just think we
should make every effort to give them some relief, see that worker's
compensation is paid promptly, life policies paid promptly, and then
assist then each in some way.  I don't think we owe them hundreds of
thousands of dollars for each family, but should be based on a need.

Help same sex partners of terrorist victims


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex
unions.  They suffer just as grievously for their deceased loved ones as
do other survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups and
individuals who would have the Department of Justice limit compensation to
survivors of heterosexual unions.  They are interested in a political
victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.

Protect Traditional Marriage

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation. 
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died. 
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have? Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist                , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
                accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution." 
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer. 
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

rules of the fund for Victims of September 11 in such a way that funds are 
administered to life partners of victims, and de facto parents or children,

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justi ce should do the same.

important issues.

compensation for 9-11


When I donated money for the Sept 11 Fund, I had no idea that there would be 
discrimination against gay partners of the victims of the tragedy. This needs 
to stop immediately. I cannot believe in this time when we as a nation should 
be pulling together to fight evil we allow this kind of evil to exist. And 
no, I am not gay...I believe in the rights of all Americans.......I can't 
help but wonder how              partner must feel.....he is being praised as the hero he was and yet what exactly did he die for....I would think he 
made the decision to fight the terrorist just as the others did because he 
believed in this country, in what we stand for. To think that his partner 
would be treated differently than any other bereaved spouse makes me sick. 
Shame on all of you for your decision to exclude gay partners for their 
rightful share of the money I sent. Your decision is based on fear.....the 
same fear that existed in the hearts of the terrorists. I will send no more 
money to your fund and will spread the word until I have received clear 
evidence that you have changed your policy.

Dear Mr. Zwick:

I am writing in response to the Department's request for public comments
regarding the forthcoming regulations for implementing and administering the
"September 11 Victim Compensation Fund." I strongly urge the Department to draft
regulations that ensure compensation is available to all victims of the attack,
including the committed partners and the non-biological children of gay and lesbian
victims.

It is unquestionable that the devastating grief and economic losses suffered by the
families of gay and lesbian victims are no less than that of other families.  Just as the 
terrorists drew no lines in choosing their victims, our country must draw no lines in
compensating those who suffered the most personal of losses from these horrific
attacks.

Many Americans lost their lives on September 11, each of whom left behind loved
ones. I urge the Department to honor these bonds by treating the families of gay 
and lesbian victims as you would any other.

Protect Traditional Marriage

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation. 
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died. 
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have? Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist                 , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
                 accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution." 
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer. 
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

Equality for all the families

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

     As a friend of a victum of the September 11th
terrorist attacks,  I trust that the regulations for
the Victims Compensation fund("the  Fund") can be
fashioned in such a manner to bring equity and 
closure this most awful chapter in American history.
Towards that end, the Fund must be structured to
encourage victims' families to surrender their 
rights to sue because they believe they will be
treated fairly and promptly. To send  such a
compelling message I respectfully submit that the 
regulations must contain following elements:

 

 1.   Do not reduce the award from any collateral
source funds collected, including insurance, pension
benefits, death benefits, and governmental
payments (which we understand are being considered
as offsets).   Such offsets should be disallowed for,
among other reasons, the same reason the 
IRS exempts life insurance proceeds from taxation
(i.e., to encourage citizens to plan for their heirs).
 Such offsets would penalize those 
victims who sacrificed and saved for their families'
futures and unjustly  transfer these assets, thereby
representing a lifetime of work, to insurance 
companies and other corporate entities that may
share the blame for the consequences that resulted
from the tragic events of 9/11.



In a nutshell, these assets have nothing to do with
the damages that flowed from 9/11, and therefore there
should be no offset to damages based on the  net worth
of the victims' families.  It would also result in
awarding more in damages to those who did not
sacrifice and save for their families' futures, which
would be an inequitable result.



 2.   Provide the victims' families with the right to
appeal the award, as doing so would undoubtedly
increase participation in the Fund.



 3.   Should the Department of Justice decline to
offer victims' families the right to appeal, then at a
minimum they should have input regarding the election
of the mediator who would decide the award.  The
government should  provide a list of potential
mediators with their background (e.g.,educational,
work experience, prior award history, etc.), which
would allow victims' families to make an informed
choice.



 4.   There should be set parameters for calculating
damages (i.e., mathematical formula factoring lost
future earnings, pension benefits, number of children,
and other pecuniary benefits that would have been
earned taking into consideration life expectancy
tables), that would provide a floor for calculating
damages and provide assurance to victims'  families as
to what they could expect to receive, at a minimum, if
they elected to opt into the Fund.  I believe this has
been referred to in the  press as the development of a
"grid."  In short, the victims' families  should be
able to calculate, with some certainty, the minimum
amount of money they could expect to be awarded prior
to participating in the hearing. That should serve as
a powerful inducement to opt into the Fund.



 5.   Determine pain and suffering at the hearing. 



 6.   If the mediator deviates for the guidelines the
victims' families should be able to appeal the
decision.



 7.   The regulations should include a scheme that
would afford the victims' families one that is similar
to the one they would enjoy in a wrongful death case. 
The amount awarded as damages should include all
funeral, burial, and estate administration expenses
incurred. Importantly, the amount should compensate
the victims' family for contributions they would have
received between the time of his death and the end of
this life expectancy, such as future lost wages.  His
gross earnings, including all fringe benefits  between
the date of his death and his life expectancy, must be
factored in.  Additionally, all monies the victim
would have spent for or given to his family for such
items as shelter, food, clothing, medical, car,
education, entertainment, gifts and recreation, taking
into account his salary and age, must also be
considered.  The amount awarded should also consider
the comfort and friendship that he would have given to
his family had he lived and such other elements as
work around the home and provision of society and 
comfort.



 8.   Since the amount awarded would be intended to
restore the victim's family's loss, it should not be
considered as "income."  Therefore, it should not be
taxable by the federal or state taxing authorities.



    In  closing,  I  understand that the DOJ is
suggesting that the victims' families  surrender 
their  right to sue without advising them what they
can anticipate  by  way of award and without the
ability to appeal such award.  This is, to be kind,
unacceptable.  The above suggestions would encourage
attorneys  and  families  alike to opt into the Fund,
thereby forgoing their  right  to sue.  This would
bring closure to an American Tragedy and reassure
victims' families that our government has their best  
interests at  heart.  We only want to place them in
the financial position  they  would  have  been in had
their loved ones not been taken away  in  the worst
terrorist attacks in American history.  Thank you.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Public Comments re: 9-11 Victim Compensation Fund

Dear Mr. Zwick:

I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.  

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.
