Subject: Fair Distribution of September 11th Relief Funding


December  20, 2001

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, the partners of those killed have had mixed results in
obtaining equal treatment at the local level in the distribution of relief
funds by private and state agencies.  An inclusive policy on the part of
the federal government would help establish an important principle for
other such funds.  In compensating victims, real justice will be served
only when all families - and all types of families - impacted by the human
rights tragedy of September 11 are treated with dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

In response to the Public Law 107-42 - September 11th Victim Compensation
Fund of 2001, as usual, no matter how much you try to help someone, it
isn't enough. The formula being used is correct and should not be changed.
If anything the formula is much more than is needed. If a nuclear weapon
had been detonated in New York and killed thousands, maybe millions of
people, there would be no way anyone would be getting the kind of compensation
in this fund. Considering the circumstances, the victims families should
consider themselves lucky. If they persist in suing, all compensation
should be taken away. Be grateful for what is being  given. The Compensation
Fund of 2001 is Discretionary, Not mandatory. Thank you for your time.

Dear Mr. Feinberg: 

I am writing to provide comment on the interim final rules for the 
September 11th Victim Compensation Fund ("the Fund"). 

I appreciate the hard work you, your staff, and the Justice Department put 
into assembling the interim final rules. I also appreciate the fact that, 
under the interim final rules, charitable contributions to persons injured in 
the September 11th terrorists attacks or the relatives of those who lost their 
lives in this tragedy will not offset Fund awards. I had weighed in on that 
particular issue during the prior notice-and-comment period, in correspondence 
dated November 26th, 2001. 

At the same time, I strongly and respectfully request that the interim 
final rules be modified to provide truly full and fair compensation for 
economic and non-economic harm incurred by victims of the September 11th 
terrorist attacks and their loved ones. I had emphasized the moral and 
practical imperative of providing full and fair economic and non-economic 
damage awards through the Fund during our meeting of December 13th, 2001. 
Unfortunately, I do not believe the interim final rules achieve this 
objective. More importantly, those directly affected by the September 11th 
terrorist attacks consider the interim final rules to be seriously deficient 
and are -- quite understandably -- angry, hurt, and frustrated. 

A combination of unjustifiably low presumed non-economic damages awards, a 
flawed presumed economic damages formula, the collateral source offset rule, 
and an inappropriately steep evidentiary hurdle to securing modifications to 
presumed Fund awards will operate in many instances to prevent victims and 
their loved ones from receiving full and fair compensation -- and, on 
occasion, any compensation -- through the Fund. This would frustrate 
Congress's intent, deprive some families of resources critical to their 
economic security, encourage litigation, and send entirely the wrong signal to 
these families regarding our government's and society's estimation and 
appreciation of the magnitude of their loss. 

In the airline relief and airline security bills, Congress limited the 
courtroom liability of airlines, the airline industry, the World Trade Center, 
and other parties. It recognized that these liability limits -- operating 
alone -- might deprive victims of the September 11th terrorist attacks and 
their loved ones of full and fair compensation for the terrible harms they 
have suffered. Thus, Congress created a government-funded program to provide 
full and fair compensation for the economic and non-economic harm suffered by 
victims and their loved ones, minus a narrow range of collateral source 
payments. Notably, it did not subject the program to the annual 
appropriations process. Rather, it funded the program through mandatory 
spending. In other words, the manifest intent of Congress was to ensure that 
the program fully and fairly valued the economic and non-economic harm 
suffered by victims and their loved ones -- federal budgetary and cost 
considerations notwithstanding. Indeed, this would not only benefit victims 
and their loved ones but also reduce litigation arising from the September 
11th attacks. 

Along these lines, the fact that courtroom litigation may be less 
attractive to victims and their loved ones due to the liability limits imposed 
by recently enacted federal law certainly does not support valuing economic 
and non-economic damages incurred by victims or their loved ones for purposes 
of the Fund at levels significantly lower than what one would secure in a 
successful courtroom action. Those liability limits instead make it 
particularly imperative that damages estimates under the Fund be full and 
fair. Again, this is not only good policy but also the clear intent of 
Congress. 

To achieve this objective, I respectfully urge you to modify the interim 
final rules to increase presumed non-economic damage awards to amounts that 
fully reflect the damages that Congress listed as compensable, correct any and 
all methodological and statutory interpretation flaws in the setting of 
presumed economic damages, and allow increases to presumed awards based simply 
upon a showing that such awards do not accurately reflect the damages incurred 
by victims and their loved ones (as opposed to requiring a showing of 
"extraordinary circumstances" for increases to presumed awards). 

First, the presumed non-economic damages awards provided under the interim 
final rules are substantially lower than those paid in comparable cases. Non- 
economic damage awards in considerable excess of $1 million are typical for 
other airline crashes and terrorism cases, but in this instance, presumed non- 
economic damages awards are limited to $250,000 per victim and $50,000 for a 
spouse and each dependent. This dramatic undervaluation of presumed non- 
economic damages runs contrary to Congress's general intent to provide full 
and fair compensation and, significantly, to the specific language of the law 
establishing the Fund, which lists an extremely broad array of non-economic 
damages for which victims and their loved ones are to be compensated 
(regardless of what may be allowable under state law). This problem bears 
considerable responsibility for the fact that many victims or their loved ones 
would reportedly be severely undercompensated or even receive no compensation 
under the Fund - potentially driving them to pursue litigation which, due to 
statutorily imposed liability limits, may shortchange them as well. The 
interim final rules can and should be fixed to increase presumed non-economic 
damages awards to amounts which properly reflect Congress's intent and are a 
more realistic assessment of the considerable pain and suffering endured by 
the victims of the September 11th terrorist attacks and their loved ones. 

Second, a number of economists or experts have pointed out flaws in the 
interim final rules' methodology for calculating presumed economic damages. 
The use of outdated and improperly aggregated federal government data and the 
underestimation of household services performed by victims and of real 
increases in earnings by administrative support and clerical workers, among 
other things, has resulted in the unjustified and unnecessary undervaluation 
of presumed economic damages. The interim final rules' cap on the level of 
income a victim may be considered to have earned per year for the purpose of 
calculating presumed economic damages awards serves to exacerbate this 
problem. I strongly urge you to provide interested parties with all 
information that is necessary and useful to further evaluate the propriety of 
the interim final rules' presumed economic damages methodology and then 
correct all flaws that would tend to undervalue such damages. 

The fact that these are merely presumed economic and non-economic damages 
amounts - purportedly subject to upward adjustment based on specific evidence 
of loss presented at hearings or through supplemental evidentiary submissions 
by victims or their loved ones - does not excuse flaws in their calculation. 
Rather, presumed awards should be based on the best available data and 
methodologies regardless of the hearing or evidentiary submission option. 
Indeed, the goal of providing accurate compensation expeditiously through the 
Fund is furthered by having properly justified presumed Fund awards, as this 
may diminish the need for hearings or supplemental evidentiary submissions in 
each and every case. It also may be overly optimistic to assume that each 
Fund claimant will be able and willing to present evidence at a hearing to 
correct inaccuracies in the presumed Fund awards in light of their individual 
circumstances. Indeed, one can reasonably expect that some victims or their 
loved ones may, upon viewing inadequate presumed Fund awards, have little 
faith in the ultimate fairness of the hearing or supplemental evidentiary 
submission process and decide to forsake the Fund altogether. 

More importantly, the misplaced requirement contained in the interim final 
rules (though not contained in the statute establishing the Fund) that a Fund 
claimant demonstrate "extraordinary circumstances" through supplemental 
evidentiary submissions or at a hearing to justify increases to presumed Fund 
awards could serve essentially to "lock in" the unfair presumed economic and 
non-economic damage awards in any given case. Whether or not the presumed 
awards are fair, upward adjustments should be possible simply upon a showing 
by a claimant that a presumed award does not accurately reflect the economic 
and non-economic damages he or she has endured. But this degree of 
flexibility is particularly essential if the presumed economic and non- 
economic damage awards would in many cases provide less than fair and full 
compensation. The "extraordinary circumstances" threshold, however, may 
prevent the accurate and individualized Fund awards intended by Congress, 
because while all victims and their loved ones have endured extraordinary 
hardships, it may be difficult for a single Fund claimant to establish that 
his or her circumstances are "extraordinary" relative to all other victims and 
their loved ones. 

The hearing or supplemental evidentiary submission opportunities for 
victims and their loved ones must certainly be structured so as to afford them 
ample time and a convenient way to make their case. But even a properly 
structured hearing or evidentiary submission process would not remedy the 
difficulties arising from the inappropriately stringent "extraordinary 
circumstances" standard. Congress did not erect or envision any such obstacle 
to the award of accurate and individualized compensation to victims and their 
loved ones. Indeed, as Congress has considered bankruptcy reform legislation 
over the past few years, it has moved away from using an "extraordinary 
circumstances" threshold for permitting deviations from a grid of allowable 
expenses for debtors in favor of a standard that more readily accounts for 
debtors' particular economic circumstances. Accordingly, the "extraordinary 
circumstances" threshold should be modified. 

I do appreciate the fact that the interim final rules will not offset Fund 
awards by the amount of charitable contributions received by a victim or his 
or her loved ones. I believe the collateral source offset provision of the 
law is misguided. To the extent the final rules do offset Fund awards by 
virtue of certain collateral source payments, I strongly urge that you 
construe the collateral source offset provision of the law narrowly, 
consistent with the tenets of proper statutory interpretation. In particular, 
amounts paid by victims or their loved ones to secure certain types of 
collateral source compensation -- for example, life insurance premium payments 
-- should be deducted from any amount considered to offset a potential Fund 
award. Likewise, where collateral source payments trigger new income or 
estate tax liability, that new tax liability should be deducted from any 
amount considered to offset a potential Fund award.

To our Elected Officials:

     In the immediate aftermath of the tragic attack of September 11th upon our nation,
Congress enacted the Victims' Compensation Fund of 2001 P.L. 107-42, to compensate
the relatives of the victims of that brutal attack. As you know, this Fund was enacted as 
part of a comprehensive package which bailed out the airlines industry and imposed
restrictions on the rights of the victims' relatives to sue the airlines in court. We implore 
upon you, as our elected officials, to demand changes to the interim rules issued by
Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules
fail to satisfy the letter or the spirit of the legislation which was enacted.

          Specifically, we request that you act on our behalf and demand the following 
changes to the interim rules:
     1. The arbitrary income limits imposed by the Special Master are not only unfair
     but also inconsistent with the letter and the spirit of the law. Those victims from
     the financial industry are specifically harmed by this limit. They were targeted and 
     murdered precisely because of the jobs they held, and where they worked-the World
     Trade Center, the Financial Capital of the world, the embodiment of financial success.
     Those who achieved such success should see that reflected in their awards. They
     personified American Business and commerce, democracy and freedom. We ask that
     you demand that Mr. Feinberg lift the arbitrary income limits so that each family can 
     be treated fairly, commensurate with the support they provided their families before
     their death.
     2. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and
     suffering, no matter what the extent of the pain and suffering. This is unacceptable.
     In the words of Rep. Peter King, "...every death is tragic, A murder is particularly
     tragic. But to have your loved one murdered in a burning building in full view of the 
     world - in a scene which will be repeated in the media for decades to come-is a 
     horror these families will never escape form... The Special Master cannot take it
     upon himself to restrict the rights of the families." Therefore, we request that the 
     interim rules be amended to more appropriately compensate the victims' families for
     the immeasurable pain and suffering endured by our loved ones.
              As Mayor Giuliani stated in his farewell address: "we have an obligation to the 
     people who did die... Their families need to be protected just as if they had been alive,
     financially and every other way that we can help and assist their families...There should
     be no compromise account that ever..."We request that the interim rules be amended and 
     redefined to the extent that income caps be removed when computing economic loss and 
     that compensation for pain and suffering more accurately reflect that horror which was 
     suffered. Justice demands no less.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

important issues.

Dear Director Zwick:



On behalf of the Association of Flight Attendants (AFA), representing 50,000 flight attendants at
26 airlines, we are writing to comment on the Department of Justice's November 5 Notice of Inquiry
and Advanced Notice of Rulemaking regarding the September 11th Victim Compensation Fund of
2001.  AFA represents some of the flight attendants lost onboard aircraft during the attacks of
September 11th.



The purpose of the notice is to ask for public comment in the development of any rules established under
the program "including, but not limited to, potential beneficiaries of the program, their employers, the
legal community, and all those who have come forward to help those impacted."



The September 11th Victim Compensation Fund is an important program in helping victims and their
families recover from the attacks.  However, we have concerns that the current proposed statute does not
clearly identify that domestic partners in same-sex relationships or non-biological children are eligible to
receive compensation from the Fund.  We believe that when Congress approved the Fund it was for the
purpose of helping all families to recover their economic security and ease the economic difficulties of
all survivors.  Compensation delivered through the fund must assist all individuals adversely affected by
the September 11th attacks without regard to sexual orientation or biological relationship.



At some carriers represented by AFA, domestic partners are included in benefit and survivor packages. 
Clearly, companies have recognized the reality of family structures and relationships in today's society. 
It is important that when implementing the Fund, the Department must also recognize these relationships
and provide compensation to individuals that were economically and emotionally dependent on the
victim.



In conclusion, while we support the September 11th Victim Compensation Fund, we believe it is crucial
that all surviving family members, including same-sex partners and non-biological children of those who 
lost their lives, have access to compensation from the Fund.

Exlclusion of Partners of Gay/Lesbian Americans to benefits

On the 11th of September, 2001, our country was changed forever when a vicious attack was perpetrated against our country, and I am afraid that some of my fellow citizens will be victimized again by the people that represent me in the Executive Branch.  I realize the term "victimized" is a strong word to use, but I could not think of a more discreet and oblique word to use.
I was outraged to find out that the partners of Gay/Lesbian Americans who died on 09/11 may be excluded from making a claim to the 09/11 Fund.  I fail to see why.  If all unborn children and even illegal aliens are covered and can make a claim, why can't the partners of Gay/Lesbian full American citizens?  If it is the reason that these people were not legally married, I would counter that most of these people would have been legally married if they had been allowed.
I think of  Mr.           , who heroically helped bring down the hijacked plane in Pennsylvania possibly sparing the lives of more people that would have been lost.  I think of           , a New York Fire Department       , who was giving last rites as one of the towers of the World Trade Center came crashing down on him.  These are just two of the many Gay/Lesbian Americans who lost their lives.  The ones who left partners have suffered just as much as the husbands/wives/children who lost their loved ones.  
I firmly believe that if this exclusion is made, then the bravery of           ,           , and all of the others will have been in vain, due to simple prejudice and discrimination.  Period.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of
the tragedy on September 11th, including the children and families of low-wage
workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader
earning millions of dollars per year might receive thousands of times as much
compensation as the survivors of a dishwasher in one of the restaurants
destroyed.  Justice requires looking far beyond the last paycheck to the
inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to
first lose their loved one and then watch as most of the taxpayer money went to
those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and
lesbian relationships and families. Gay and lesbian families are especially
vulnerable when one partner is killed. Because the option of marriage is
unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross
and the State of New York have already announced that they will not discriminate
against gay and lesbian families. The Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will
act on these very important issues.

Dear Mr. Zwick:

I am writing in response to the Department's request
for public comments regarding the forthcoming
regulations for implementing and administering the
"September 11 Victim Compensation Fund." I strongly
urge the Department to draft regulations that ensure
compensation is available to all victims of the
attack, including the committed partners and the
non-biological children of gay and lesbian victims.

It is unquestionable that the devastating grief and
economic losses suffered by the families of gay and
lesbian victims are no less than that of other
families.  Just as the terrorists drew no lines in
choosing their victims, our country must draw no lines
in compensating those who suffered the most personal
of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each
of whom left behind loved ones.  I urge the Department
to honor these bonds by treating the families of gay
and lesbian victims as you would any other.

Is charity or gov't aid intended to solve the lifelong problems of those victimized by the tragic events of Sept. 11th?

**********To keep charities honest and responsible every penny should be specifically accounted for (that probably includes taking ID from those being assisted.)  And those monies deducted from the total.  The consequences of not doing so are appalling in the long run.  Look at history.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

 Benefits for Gays and Lesbians


I have heard that gays and lesbians who were victims of 9/11 are not receiving benefits when straight people who were victims are.  I would like to express my outrage at this injustice.  A persons sexual orientation has nothing to do with his/her need for support or help, and also has nothing to do with the amount of suffering he/she may have experienced as a result of the tragic events of 9/11.  Gays and lesbians should receive the same assistance that straight people receive.

whole. 

The governmental aid package was surely passed on the same theory.

If victims are, indeed, receiving the aid they need from the government, 
those charitable contributions are being duplicated. If they are receiving 
aid from charity, the governmental contributions are being duplicated.

Therefore, please establish a threshhold of charitable aid that must be

Sept. 11th Victims Fund

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund." 
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Comments on 9-11 Victims' Compensation Fund


What happened on September 11 was unbelievably tragic.  However, there have been countless other tragedies this past year.  Consider these:


* In October, the 28-year-old daughter of a friend died from breast cancer.  She left a husband and two children under the age of 3. 
 

* Just before Christmas last year, the husband of a friend died very suddenly from heart failure.  He left a wife (who is suffering from a debilitating disease) and two children.


* In November, the daughter of another friend committed suicide after a long battle with depression.  While she was unmarried and had no children, her loss devastated her parents.


I am certain that, if you asked the families of these people who died, they would tell you that their loss was no less than that of the families who lost loved ones on September 11.  However, none of these people can look to the government for payments of $1+ million.
  

I have first-hand experience at this as well.  I lost my husband very suddenly when I was only 31 years old.  At that time, I had a year-old baby.  What did the government do for me at that time?  I received the Social Security death benefit of $255 and Social Security for my daughter.  But there was no payout of millions of dollars to compensate me for my loss, and I can assure you that the loss that I suffered -- and the losses of my friends noted above -- was nothing short of horrible.


I am outraged to hear the 9-11 victims' families whine about deducting life insurance, pensions, 401Ks and other sources of income from their victims' compensation fund payouts.  While I don't deny that they have suffered a loss, what makes them think that they are now ENTITLED to become millionaires because of that loss?  What about all of the other "victims" this year who left families who are not receiving a single penny?

I write as a member of Amnesty International, a worldwide human rights

York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
