Equal Access Now!

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

The following comments are submitted pursuant to the Notice of Inquiry and Advance Notice of Rulemaking with respect to regulations implementing Public Law 107-42 establishing the September 11th Victim Compensation Fund of 20001.

INTRODUCTION

The basic thrust of my comments are to call attention to the work of the Presidential Commission on Catastrophic Nuclear Accidents, and to its Report to Congress, volumes 1 and 2, dated August, 1990.

While this report submitted pursuant to the 1988 amendments of the Price-Anderson Act, (Public Law 100-408) was a comprehensive study of the appropriate means of fully compensating victims of catastrophic nuclear accidents (greater than approximately $7.3 billion) many of the issues addressed in the rulemaking to implement the September 11th Fund were considered in detail in this report from both a legal and public policy aspect.  Specifically, with respect to one of the most important issues, the Presidential Commission considered the degree to which payments from collateral sources should be used to offset recovery through a judicial process containing administrative features designed to speed the resolution of cases.  The administrative process set forth in the September 11th Fund legislation follows very closely the system set forth in the Presidential Commission report.

COLLATERAL SOURCES

On pages 93 to 95 of its August, 1990 report the Presidential Commission on Catastrophic Nuclear Accidents recommends that payments from collateral sources should not be used to offset recovery except when a claimant has demanded plenary adjudication (i.e. trial rather than than the proposed administrative claim resolution process).  Further, the Presidential Commission recommended that in no case should proceeds from life insurance policies be used to offset recovery.

I recognize that the September 11th Fund legislation in Section 405 (b)(6) provides that the Special Master shall reduce the amount of compensation ... by the amount of collateral source compensation the claimant has received or is entitled to receive as a result of the terrorist attacks. While the definition of collateral source means all collateral sources including life insurance, pension funds, death benefit programs and payments by Federal, State or local governments, an open question is whether collateral source compensation includes receipts from charitable donations.  In this regard, the consideration of the pros and cons of subtraction of collateral sources in general discussed by the Presidential Commission on pages 93 to 95 of its report, are germane.

The Presidential Commission noted that the collateral source rule usually bars a defendant from introducing evidence that a claimant had received compensation from collateral sources such as insurers or governmental benefit programs.  The rationale seemed to be that the defendant (called the tortfeasor in the report) should be required to pay the full extent of the damages his conduct had caused, and should not benefit through a reduced award as a result of any compensatory payments received by the plaintiff from third parties.  The Presidential Commission noted that "although double recovery arguably produces a windfall for the plaintiff, the rule reflects the value judgement that it is preferable to overcompensate a victim than to inadequately penalize a wrongdoer."

The Presidential Commission noted that with tort reform, the collateral source rule has  increasingly been subject to debate. At the time of the 1990 report it was noted that 25 states and two federal statutes had restricted or abolished the application of the rule.  The Presidential Commission felt that the collateral source rule should have little force under the special scheme of the Price-Anderson Act because compensation, rather than deterrence, is the principal goal of the Act. Further, the retributive function of the collateral source rule is also not relevant in the Price-Anderson context because losses are borne by the entire nulear industry and its ratepayers rather than by the tortfeasor.  

Nevertheless,reducing awards by the full amount of collateral recovery was viewed by the Presidential Commission as possibly raising substantial considerations of fairness. Where collateral protection has been obtained through the payment of premiums for insurance, for example, reducing awards by the full collateral recovery would result in net economic loss to the claimants.

While the Presidential Commission did not consider charitable contributions in its analysis (a non-issue with respect to nuclear accidents) the fairness argument would seem to apply to charitable gifts.  The charitable contributions were made by individuals and organizations irrespective of what other compensation, whether through the September 11th Fund system or through lawsuit, the plaintiffs might receive.  An after-the-fact use of these funds to reduce taxpayer burden was probably not one that was contemplated by the charity contributers and in at least with respect to this collateral source, the possible "evils" of so-called overcompensation (if such a concept could even exist in the case of these horrendous deaths) must yield to basic fairness for the plaintiffs.

OMBUDSMAN


While not considered in the Presidential Commission report, the regulations under the September 11th Fund legislation should acknowledge that the use of the fund will entail questions of sensitivity and tact that may be overlooked in the legally-driven compensation scheme with a 120 day deadline for awards.  For this reason, I recommend that the rules establish at the ouset an Office of Ombudsman, not as another source of special pleading, but as an assistant to claimants and others through the bureaurocratic maze.

PART-TIME AND VOLUNTEER ASSISTANCE

These are new and untried approaches both for the plaintiffs and judicial and executive governmental bodies involved.  The special master and others involved in carrying out the provisions of the statute should look to experienced persons  who have been involved in consideration of the pertinent issues in these and other compensation schemes to assist on a part-time compensated or volunteer basis.

Against anti-gay compensation policy



Dear Sir or Madam,

I have recently received the disturbing news that the September 11th fund is 
refusing to compensate same-sex partners of victims of the September 11th 
attacks.  While I understand that the absence of legal marriages makes this 
situation a bit more complex, the events of September 11th demand that we 
negotiate with complex situations and triumph over them.  Please consider 
revision of your current policy to allow for compensation to ALL of the victims 
of September 11th.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New

Relief Fund finds no Relief

My husband was killed on 9/11 leaving behind a 4 year old son, a 2 year old daughter and a seven week old daughter whom he never had the chance to meet.  I am writing because I am very angry with the way the government has set up the 9/11 relief fund for families.  My husband and I had made a conscious decision to purchase life insurance.  I do not feel that we should now be penalized for having been forward thinking.  If I felt as though I could sue American Airlines (m my husband was on flight 11) I would not be so angry.  I feel that the government took away my option to do so when it capped each plane at $1.5 billion.

To our Elected Officials:

     In the immediate aftermath of the tragic attack of September 11th upon our nation,
Congress enacted the Victims' Compensation Fund of 2001 P.L. 107-42, to compensate
the relatives of the victims of that brutal attack. As you know, this Fund was enacted as 
part of a comprehensive package which bailed out the airlines industry and imposed
restrictions on the rights of the victims' relatives to sue the airlines in court. We implore 
upon you, as our elected officials, to demand changes to the interim rules issued by
Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules
fail to satisfy the letter or the spirit of the legislation which was enacted.

          Specifically, we request that you act on our behalf and demand the following 
changes to the interim rules:
     1. The arbitrary income limits imposed by the Special Master are not only unfair
     but also inconsistent with the letter and the spirit of the law. Those victims from
     the financial industry are specifically harmed by this limit. They were targeted and 
     murdered precisely because of the jobs they held, and where they worked-the World
     Trade Center, the Financial Capital of the world, the embodiment of financial success.
     Those who achieved such success should see that reflected in their awards. They
     personified American Business and commerce, democracy and freedom. We ask that
     you demand that Mr. Feinberg lift the arbitrary income limits so that each family can 
     be treated fairly, commensurate with the support they provided their families before
     their death.
     2. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and
     suffering, no matter what the extent of the pain and suffering. This is unacceptable.
     In the words of Rep. Peter King, "...every death is tragic, A murder is particularly
     tragic. But to have your loved one murdered in a burning building in full view of the 
     world - in a scene which will be repeated in the media for decades to come-is a 
     horror these families will never escape form... The Special Master cannot take it
     upon himself to restrict the rights of the families." Therefore, we request that the 
     interim rules be amended to more appropriately compensate the victims' families for
     the immeasurable pain and suffering endured by our loved ones.
              As Mayor Giuliani stated in his farewell address: "we have an obligation to the 
     people who did die... Their families need to be protected just as if they had been alive,
     financially and every other way that we can help and assist their families...There should
     be no compromise account that ever..."We request that the interim rules be amended and 
     redefined to the extent that income caps be removed when computing economic loss and 
     that compensation for pain and suffering more accurately reflect that horror which was 
     suffered. Justice demands no less.

Equal Access to Benefits under the September 11 Victims Relief
Fund

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Compensation for Sept 11

To the extent that the Federal or any other Government agency provides 
money, credits, or anyother remuneration to surviving families, spouses, and children, then the same criteria that applies to a spouse should apply to a partner regardless of sex.

The criteria and funds should also apply to any foreign person killed at the WTC, the Pentagon, or any of the three airplanes.

Thank you.  We must use this tragedy to build bridges and to reduce the 
segregation, labelling, and discrimination that too often leads to the 
hatred and anger best exemplified by the terrorist.  In this regard, the US must set the example for the world.  If we can we should work with our coalition partners to further this objective.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

Dear Mr. Zwick:

I am a retired age 58 citizen/taxpayer and have the following comments
(due January 21, 2002) concerning the December 21, 2001 final interim rule and
proposed policy stated below relating to the distribution of monies to victim of
the September 11th tragedy.

It is our view that, absent extraordinary circumstances, awards in excess of $3 million,
tax-free, will rarely be appropriate in light of individual needs and resource. At the same
time, we want to ensure that victim's families are receiving at least a minimum level of 
resources to help meet their needs and rebuild their lives. Thus. We have concluded that
the families of deceased victims should receive a combined total of at least $500,000
from this program, other state and federal programs, life insurance policies and other
sources of compensation. Similarly, the baseline for single decedents should be $300,000.
This ensures that every needy claimant's total compensation from this program and other
sources will be at least equal to these threshold amounts.

For those victims who died as a result of the September 11 aircraft crashes, the presumed
noneconomic losses will be $250,000 , plus an additional $50,000 for the spouse and each dependent of the deceased victim. That $250,000 figure is roughly equivalent to the
amounts received under existing federal programs by public safety officers who are killed
while on duty, or members of our military who are killed in the line of duty while serving
our nation. See 38 U.S.C. 1967 (military personnel); 42 U.S.C. 3796 (Public Safety
Officers Benefit Program). The latter figures--$50,000 for the spouse and each
dependent-include a noneconomic component of "replacement services loss."

Since the government is planning to step in and assume legal liability for victim
damages due to the September 11th, terrorist attack why not limit award
settlement amounts to more reasonable $ 500,000 (families) and $ 300,000
(individuals) amounts to better utilize taxpayer monies. A settlement of this
nature appears to be more than comparable to a customary Term life Insurance
benefit available to the average U S Citizen.

A maximum award for families of $ 500,000 and individuals of $ 300,000 would appear to be more fair and equal and would not consider a victims past employments and future earning potential.  Why should any family receive n excessive benefit of $ 3 million at taxpayers expense?  An award based upon an individuals future income potential appears excessive and arbitrary and discriminatory in favor of current and temporary high wage individuals.

The governments liability should also be funded as much as possible by terrorist frozen bank account funds.

maximum awards to Sept 11th victims not only should be reasonable and fair to all victims but also comparable to customary private and public awards and benefits available to the average United States Citizen.

The Average U S Citizen would be more than happy to be covered with a Term
Life Insurance benefit of $ 500,000 or $ 300,000. Also, the customary Social
Security Death Benefit of $ 255 appears much too low in comparison.

Again, my main comment is that victim awards should be limited to a maximum
of $ 300,000 for individuals and $ 500.000 for families in the name of fiscal
responsibility and fairness to all U S Citizens.

Government funds are considered limited and available excess funds can be
more prudently spent on social and health care programs benefiting needy and
uninsured U.S. Citizens. Also, the customary Social Security death benefit of
$ 255 for all citizens should be increased to at least $ 1000 to cover burial costs
for all Americans.

Dear Mr. Zwick:

I am outraged to hear that lesbians and gay men are not being compensated
from the Victim Compensation Fund.  This is un-American.  How much more is
this country going to discriminate?  I am certain you can find a way to
determine through questionnaires how to find out who had lesbian and gay
partners.  You do realize it's not easy to be 'out' in America?

Those that are willing to answer yes to a questionnaire about having a
partner are probably being truthful.  

Yes, there will be those that take advantage of the system, but to
completely ignore a whole sector of the community for this purpose is
preposterous!

Please give this issue some thought!  Do you think             gave his lifetime of service as well as his life, so that he could be treated
this way??

Discrimination is un-American.  you can do better than this!

Please find a way to compensate these people.  Thank you for your time.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

Federal Victims Compensation Program

To start off, I think it is tremendously unfair that the parents of our 
hero's are being insulted.                     were nothing short of being 
the best parents they could be. They raised                    to have morals and values 
and they taught him to do what he believed in.  On September 11, 2001 - 
                   put these teachings into effect. On that morning,                    did the one 
thing he believed in, he put his life second to save the life of another 
human being.  The two people who are to be thanked for raising a dignified 
young man are                   , his parents.  Don't take away the honor 
that they deserve.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

discrimination in the fund


To whom it may concern.
My name is           
 and i would like to voice my objection at the way you 
have handled the distribution of funds to gay and lesbian partners of those 
who died in the tragedy of September 11. through various news reports i have 
come to learn that on Sunday's "meet the press", Kenneth Feinberg announced 
that the money that will be given to the partners of those who had loved ones 
pass on September 11 will only be distributed according to state law, without 
federal interference in the same press conference he also announced that the 
fund would be open to those who are not American citizens and that the 
federal law would be overlooked in an effort to be more compassionate to 
those who lost families in the tardy but for whatever reason are not us 
citizens. 

These two conflicting points are not my only concern but only the beginning 
my main issue is that the federal government has chosen to overlook the many 
gay and lesbian citizens in the united states and in the process also make a 
very strong statement indicating that even non-us citizens are more welcomed 
in this nation than they are. it is a sad day when discrimination is so 
blatant and accepted that even in a tragedy an entire group of people can be 
treated like second-class citizens or better not a citizen at all. i am 
deeply disturbed by this lack of compassion and the inequality that has 
happened in the wake of what should been a unified time. i am for very good 
reason, ashamed to be an American in the presence of such discrimination, and 
i hope that this point is reconsidered and changed. if not, all that we love 
and cherish about the idea of freedom and equality is lost at the time in 
which we need it the most. gay and lesbian partners might not equate to the 
same thing as wives and husbands in the eyes of the law (at least not yet) 
but their loss and pain is equal, and should be treated as such. to do 
anything less would be a disgrace to all who died on that day (many of whom 
were gay) and a disgrace to all we hold dear, especially the idea of 
"equality". i sincerely hope you rethink this position and do the only thing 
worth doing, the right thing.

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the

As you consider rules for administering the relief fund, I ask that you

Dear whomever is in charge -

America has been brutalized.  America  is in need of heroes.  America is in 
need of time to heal.

The decision NOT to extend survivor benefits to the gay &amp; lesbian partners

were flying those planes on 9/11 yourself.  How dare you use this time to 
further hurt American's and the American spirit.  So many people of so many 
different backrounds have given their lives in service to this country - and 
yet you choose to ignore those contributions and foster hatred and spite.

I am proud to be an American, and I hope that you are proud as well.  Show 
that pride by showing America stands united with ALL OF IT'S PEOPLE.  Not 
just those you agree with.
