Dear Mr. Ashcroft:

     We submit these comments to you on behalf of the New York State Trial Lawyers
Association (NYSTLA), in response to your request for commentary on issues related to the
promulgation of regulations under the Air Transportation Safety and System Stabilization Act
(now Public Law 107-42).  The regulations would implement the "September 11th Victim
Compensation Fund," which was established by P.L. 107-42 as an alternative to bringing a civil action against any parties (other than the international terrorists who perpetrated this horrific crime) whose negligent conduct may have resulted in the failure to prevent this crime or may have worsened the terrible harms that occurred as a result of the crime.

     The attacks on the World Trade Center and the Pentagon were attacks on all of us as
Americans.  They were assaults on a massive scale that this country has never experienced
before.  Three members of NYSTLA's staff were witnesses to the World Trade Center attack. 
Two of our staff members were so close to the towers when the attack occurred that debris fell on them.  When the towers collapsed, we opened our doors to the people who were fleeing through the streets from the black cloud of dust, shepherding them into our legal education classroom so that they could drink some water to help recover from the smoke and try to call their loved ones.  We are deeply and personally aware of the huge scale of this attack and its devastating effects, and we are reminded daily of the horror of this event because of the smell from the still smoldering site.

     Motivated by this experience, we are deeply concerned for the plight of the families
affected by this atrocity.  Our comments therefore are submitted in the spirit of hope that this program will provide the full relief contemplated by Congress and include the full range of victims of the attack or whom Congress intended to provide this relief.

     As you may already be aware, NYSTLA has been at the forefront of an unprecedented
pro bono effort to help September 11th victims and their families, having issued a statement
within days of enactment of the "September 11th Victim Compensation Fund" - a vow to
represent for free anyone intending to make a claim to the Fund for compensation.  Ever since, we have been working closely with the Association of Trial Lawyers of America (ATLA) to make sure that every claimant has the benefit of skilled, experienced, free counsel.  All attorneys volunteering for this work meet strict qualifications for experience and training and have pledged not to represent any September 11th victim for a fee either in a claim against the Fund or in any lawsuit.

     Our comments will focus on two key questions: who is covered by the Fund, and how 
compensation will be determined.

WHO IS COVERED BY THE FUND

     We believe that Congress intended that the Fund would cover all of the people who were
physically injured or killed as a result of the terrorist attack.  We therefore urge the Department of Justice to establish regulatory provisions to clarify that the statute covers the people who were injured or killed as a result of the destructive force of the plane crashes and the collapse of the towers, and also those who have been injured while carrying out the truly challenging job of rescue and recovery on the site.  

(1) Coverage of the People Injured by the Attack

     Because the towers themselves were so extraordinarily tall, and because the planes hit
with such extreme force, the impact of debris was much more widespread than one might
ordinarily assume.  For example, the two NYSTLA staff members who encountered falling
debris (but fortunately were not injured) were walking at least a block and a half away from the towers; also a large chunk of metal from a jet engine fell on lower Murray Street, which is three to four blocks away.  Clearly, the "site" of the attack was not limited only to the footprint of the buildings.

     The statute states that the Fund will cover injured persons who were "present at" the
WTC, Pentagon or Pennsylvania crash site.  We believe that Congress intended this to include all of the people who were injured by glass, metal or other harmful material from the explosive impact of the attack.  We therefore recommend that the regulations define the term "present at" to include any person who was in such proximity to the site that the person suffered physical harm.

(2) Coverage of the Rescue and Recovery Workers

     Immediately after the attack, heroic and seemingly tireless ironworkers, firefighters, and other rescue and recovery workers rushed to the site to try to recover any surviving victims or, for the peace of mind of the bereaved families, the bodies of loved ones.   This work, tragically, has taken much longer than most of us probably expected, in part because the site itself remains so hazardous.  The site is still hot and smoldering; this means that the work remains treacherous. The people who continue, with truly inspiring dedication, to perform that heart-breaking recovery work at the site must not be left without compensation for harm that they suffer while performing this hazardous yet necessary task.

     We believe that Congress intended to include the courageous and dedicated rescue and
recovery workers within the scope of the Fund.  The statute states that the Fund will cover people injured in the attack or in the "immediate aftermath".  The regulations should provide a  definition of "immediate aftermath" to include the period within which authorized persons make efforts to rescue victims or recover human remains from the site.  In other words, it should cover injuries suffered by the rescue/recovery workers.

HOW THE SPECIAL MASTER WILL DETERMINE COMPENSATION AND THE
SCOPE OF HARMS TO BE ADDRESSED

     Your request for commentary included several questions regarding how compensation
will be calculated.  We hope that the following comments will be helpful in your determination on those questions.

(1) Charitable gifts

     Congress listed very specifically, within the statute itself, what sources would be
considered collateral sources for the purposes of the Fund.  At the time that they established this Fund, the members of Congress were well aware that people throughout the country were making substantial charitable contributions to help the families affected by the September 11th attack.  If Congress had intended to include charities as a collateral source, it most certainly would have done so.

     As a policy matter, reducing the Fund's compensation by the amount of charitable gifts
that a family received does not make sense.  The people who were most directly harmed by the
September 11th attack experienced a double injury, both the physical injury or emotional loss from the physical impact of the attack itself and the terrorizing impact of being the direct victims of an act of intense hatred.  Their injury is far greater than the amount of compensation that they could obtain either in court or from this Fund, so there is no issue of unfair "enrichment" in this case.  These people have suffered a loss that no one else who has not been the innocent victim of such a colossal act of hatred can ever fully understand.  Also, the public-spirited Americans across the country who gave to these families did so not only out of compassion for the people who were injured but out of anger at the perpetrators and out of a need to communicate solidarity with the victims, who were the brunt of an attack that actually was directed against all Americans.  Congress clearly did not want to interfere with the intent of the donors making these gifts.

     We therefore urge that the Department of Justice adopt regulations consistent with the
plain legislative intent of Congress not to subtract charitable gifts from the compensation
provided under this Fund.

(2) Treatment of Other Collateral Sources

     The regulations should make it clear that any source of funds for which there is a right of subrogation - such as Workers Compensation - should not be subtracted from the damages award.  Otherwise there is a danger that families could, in effect, lose that money twice - once when the Special Master subtracts it from the award and again when the compensation carrier exercises the right of subrogation to "recover" the amount from the victim or victim's family.

     Only collateral sources that correspond to a particular item of damages recoverable under the Fund should be deducted, and only future collateral sources to which the victim or personal representative has an enforceable vested or contractual right should be considered for deduction. These are general principles of common law that have been the subject of a well-developed body of case law in New York.  If the Fund treats collateral sources in a way that runs counter to this principle, it will fail to carry out the intent of Congress that the Fund be a viable and attractive alternative to bringing civil actions.

     We further note, that life insurance, while included as a collateral source under the
statute, is a privately contracted benefit for which the person may have paid many years of
premiums.  Those premium payments should be deducted from the total insurance award to
reflect the actual net benefit that the victim's family received in order to determine the true amount of the insurance benefit before it is deducted from the compensation award. 

(3) Determination of Compensation

     Congress clearly intended this Fund to be a positive choice for claimants as an alternative to bringing a civil action.  We therefore note that the regulations should not establish any  "one-size-fits-all" list of damages.  Each claimant should be treated as an individual, just as he or she would be in court.  If the families affected by this attack on our country are giving up their right to access America's judicial system to hold accountable those who failed to take reasonable (and indeed, in many instances, quite obvious) measures to help prevent those attacks, they should not be asked to give up the right to be treated as individuals in determining how they were harmed by this horrible event.

(4) Issue of Long-term Injuries

     At this point, we have no idea what the long-term consequences will be for people who
were affected by the September 11th attack.  Physical injuries that have already surfaced may develop unforseen complications.  Also, people may have been exposed to harmful levels of toxic chemicals and may suffer health consequences from that exposure decades from now. 

     Unless special provision is made in the regulations for such delayed impacts, people will be limited by the very short two-year deadline for submitting claims to the Fund.  This is a full year shorter than the statute of limitations for most injury claims in New York State, and does not take into account New York's date of discovery rule for toxic-substance-related injuries.

     Since the goal of this statute clearly is to create a sufficient alternative to civil actions that people will choose to access the Fund rather than pursue a court action, it would be consistent with and in furtherance of Congress's intent to establish a "reopener" to address long-term harms that have not yet become manifest and therefore, through no fault of the person bringing the claim, could not have been raised during the two years after the attack.

(5) Structure of the Decision-making Process

     As a final point, we urge that the Department of Justice establish regulations that provide the Special Master with the practical and necessary authority to supervise properly the implementation of the Fund.  In particular: (1) decisions of the hearing officers should be subject to review by the Special Master on request by the victim or the victim's personal representative; (2) the hearing officers should be former judges with long-term experience adjudicating trials in the civil justice system; (3) the decisions themselves should be set forth in writing, providing a reasoned elaboration of the decision that also provides a detailed explanation of the specific items included with the award and any collateral source deductions.  This is the only way to ensure accountability and consistency in the interpretation of the provisions of the statute.

Equal Access to Benefits

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund." 
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

The airline bailout act gave the airlines $15 billion
in cash and loan guarantees and capped the airlines'
liability for the September 11 crashes at the limits
of their insurance coverage. Because of this cap, the
damage caused by the crashes greatly exceeds the
private fund available to compensate victims and their
families. Thus for the vast majority of victims and
families, the cap has the effect of eliminating the
right that they would otherwise have to sue
the airlines.

Congress set up the fund to ensure that the airline
bailout would not come at the expense of the victims'
families. The act mandates full and fair compensation
to victims and their families for their actual
economic and non-economic damages. DOJ has ignored
this mandate and instead has written arbitrary
regulations that will result in compensation levels
far below the losses actual suffered by the victims
and their families. In fact, many families' total
compensation from the fund and all collateral sources
combined will not even fully replace lost income. In
effect, these families will not receive any of the
non-economic compensation required by the statute.
After collateral sources are deducted, as required by
the statute, some families would receive nothing from
the fund under the interim final regulations.

DOJ's formula allows for non-economic awards at only
one-tenth the level paid incomparable cases, even
though Congress explicitly enumerated a broader range
of non-economic damages than could be recovered in any
single jurisdiction. DOJ's formula for non-economic
damages is $250,000 for the person killed and $50,000
for the spouse and each dependent. In a wide variety
of air crash and terrorism cases, however, judges,
juries, and mediators commonly have provided
non-economic damage awards well into the seven-figure
range.

Independent economists have found serious flaws in
DOJ's method of calculating economic damages,
including use of outdated and inapplicable work life
and life-cycle earnings data. DOJ greatly
underestimates promotions and other increases in
earnings for victims. It relies on civil service and
military retirement system actuarial data that track
federal worker incomes and pension requirements, not
the higher-paying private sector career paths followed
by the vast majority of the victims. The interim final
regulations also arbitrarily cap a victim's
income at $231,000 a year. Combined with the faulty
methodology described above, the income cap would
result in some families receiving compensation for
less than 25% of their actual economic losses. Under
DOJ's rules, a family's award may be increased above
the "presumptive" award only by a showing of
"extraordinary
circumstances" -- beyond those suffered by other
victims or victims' families. This high burden of
proof makes a charade of the right to a hearing
provided by the statute. DOJ should fulfill the act's
intent by revising the rules to compensate victims and
their families for the types of damages specified by
Congress, at levels comparable to those provided in
the tort system the fund was designed to replace.

While DOJ has shown flexibility on some aspects of the
rules, it is resisting the victims' and families'
requests for significant changes. If the proposed
regulations are not changed significantly, victims'
widows will have to sell their homes, deplete their
children's college funds, and give up their plans of
being full-time parents while their children are
young. Many families, anticipating little relief from
the fund, will decide to sue the airlines and others,
despite the handicap of the liability limits. We do
not believe these are the outcomes Congress intended.

Compensation for all the victims' familie and loved oness, not
just tradtional families

Dear Mr. Zwick:

I want all people who lost loved ones to be represented in forthcoming
regulations for implementing and administering the "September 11 Victim
Compensation Fund."

I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  So our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other. this is not a time to discriminate against Gays and
Lesbians.

Justice Help all terrorist victims


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex
unions.  They suffer just as grievously for their deceased loved ones
as do other survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups
and individuals who would have the Department of Justice limit
compensation to survivors of heterosexual unions.  They are interested
in a political victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Regarding the "September 11 Victim Compensation Fund,"
we urge the government to ensure that the regulations governing
compensation is available to all surviving families of those
killed, INCLUDING the committed partners and non-biological
children of gay and lesbian victims. 

The government MUST show leadership and take a fair stance for ALL citizens. 
If heterosexual non-married partners and children are compensated, so must 
those of gay,lesbian, bi-sexual or transgendered partners.  We all suffer the 
same way, PLEASE do not add to the suffering.

Justice help all terrorist victims


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.

This importantly should include the partners and children of same
sex unions.  They suffer just as grievously for their deceased
loved ones as do other survivors, and their need for assistance
is just as great.

Please do not give in to the importuning of callous homophobic
groups and individuals who would have the Department of Justice
limit compensation to survivors of heterosexual unions.  They are
interested in a political victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Don't screw the gay people

I took a look at the comments to your "Final Rule" and I am struck by how
many people have voiced extreme displeasure at you plan to compensate
everyone who lost a loved one - even illegal aliens - but not gay people.
Given the vast number of comments in favor of giving gay survivors
compensation (not dependent on state law), I hope you don't hide behind "we
got lots of comments on both sides" in disenfranchising a group of Americans
who pay taxes and who lost the central figures in their lives.

 It is pretty apparent where the sentiments of the American people lie on
this issue - one need only browse the public comments on the DOJ's website
to see that 99% of the commentors DO NOT WANT YOU TO DISCRIMINATE AGAINST
ANYONE, even the dreaded homosexual.  I hope you reconsider your hateful
position.

compensation comment...


Dear Mr. Kenneth Zwick,

I am concerned by the attitude of the US Government and the victims of the
9/11 attacks.  Additionally, I would like to protest the fact that my tax
dollars are being spent in this manner.  As terrible as the loss was for the
families of the victims, they are not ?entitled? to money from the US
taxpayers.  I agree they should be helped in their time of need.  That is
exactly the reason I have given money to charities and blood to the Red
Cross.   However, I do not believe it is ?deserved? as many outspoken
representative claim.  Nor do I believe I should be forced, de facto, to
give more of my money.  It is simply contrary to what this country stands
for?individual responsibility.

&gt;I am writing to voice my concern over the exclusion of same-sex partners from
&gt;the 9/11 Victims' Compensation Fund.  This horrible tragedy was unprecedented
&gt;and affected people from all walks of American society.  All the affected
&gt;deserve our help.  Your administration has recognized that a compassionate and
&gt;effective response will entail making certain exceptions to general U.S.
&gt;policy on eligibility for public benefits, such as making compensation
&gt;available to undocumented aliens (and protecting their employers from
&gt;prosecution should such individuals come forward).  Please make sure that ALL
&gt;affected families and households receive the assistance they need to cope with
&gt;this terrorist attack, whether the household was counting on the income of a
&gt;brother or sister, an opposite-sex but unmarried partner, a same-sex partner,
&gt;or a friend.  Fair rules can be devised for assisting all families and

As I recall Mr. Feinberg's comments on PBS he
indicated that he wanted the beneficiary to know, with
a fair degree of accuracy, the benefits they would
receive under the program.  To this end he mentioned
that there would be a right to come into his office
and discuss the matter before submission of the actual
claim form.
The proposed regulations do not make provision for a
pre-submission conference. A pre-submission conference
is extremely important to my client as they have
special circumstances that would not normally be
addressed in a typical application and the proposed 21
days to file supplemental information may not be
sufficient time to develop the data.  If a
pre-submission conference were held it would be
possible to submit data appropriate from the Master's
viewpoint in the original claim.  Specifically, my
client has a child that is severely mentally impaired
but not legally incompetent.  Guidance from the Master
regarding what would help him understand our position
may not be possible to obtain in the 21 days allowed
by the current regulations to file supplementary
information.

  I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on Sept. 11,
including the children and families of low-wage workers and gay and lesbian families.
  
  Please  set a high minimum compensation level for all families of victims, instead of following traditional 
lost wage rules. It would be horribly unfair for families of  low wage workers who were already
struggling financially to watch most of the tax payer money to go to families of  wealthier workers. The
Red Cross &amp; the State of New York have announced that they will not discriminate against gay &amp;
lesbian families. Please do the same.

along with their pregnant mothers as a result of the September 11 terrorist
attacks as "eligible victims." 



There is no reason for a child not to be considered - these women did not
