Subject: Equal rights deserved by all citizens, your attention please

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Comment on Victim Compensation Fund

After reading many of the comments on this site, it is sad to see the
idealistic virtues of those who died for others in diminished by those who,
like flies to a carcass, seek to feed off of the tradedy of others.

I was somewhat concerned that the September 11th fund, while gracious and
considerate, went beyond the legitimate mandate of government to provide for
the general, rather than individual, welfare.  I had no expectation of
anything but gratitude for this exceptional effort by government to offer
charity to individuals not associated with official government activities.
I found it disheartening to see those same individuals biting the very hand
that had never offered such financial benefits to other victims of disasters
beyond immediate survival assistance and, in some case, low interest loans
to help them get back on their feet.

I find the whole September 11th fund both bad and improper precident to be
taking.  The sense of entitlement from the *government* by those who are
already the beneficiaries of hundreds of millions of dollars already
collected by the private sector for their welfare is a grotesque reaction to
the bounty offered, even if improperly, of the people of the United States
through their elected representatives.

It is not the purpose of government to maintain the "lifestyle," rich or
less so, to which people are accustomed.  It is a perversion of the
principles of democratic government to ignore the truly poor and listen to
the ugly whining of those who, through extremely unfortunate circumstances
to be sure, want to maintain their large houses or profligate lifestyles (as
so many who sadly died in the World Trade Towers  were capable of providing,
and to whom I begrudge nothing).

Millions of people yearly go through the same heartbreaking death or
poverty-through-illness (myself included) without so much as a peep that the
government somehow required to provide us with our former level of
lifestyle.  I, in fact, wrote my representative when the issue of disability
payments possibly being reduced many years ago by the government asking her
to vote in favor (despite the fact that I had paid the government enforced
premiums for the insurance that could have been better spent in the private
sector insurance market).

And my pain and suffering continue in a very real and physical sense, never
mind the pain and suffering from being completely isolated from the world of
accomplishment I used to know.  Evidently the decade of greed declared to
have occurred in the 1980's is really only now beginning to accumulate real
momentum.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

important issues.

Compensation for Sept. 11 victims

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

gay americans have rights too. SEPT 11th fund

This is totally an outrage. We are all AMERICANS. The gay partners of all those who lost their life on September 11th have every right to receive any benefits from this fund. On that day we, all AMERICANS were in shock. I will never forget that day as long as i live. Why is it that some people are good for certain things and others are not good at all. If we all work together this country would be a better place. We need to start taking care of are own first, them everyone else second. It did'nt matter who or what your were on that day, everyone came together, held hands and prayed. That's the way it should be. ONE NATION. Please reconsider. You are making a big mistake. Lets work together for peace &amp; harmony.

Support Benefits for Partners

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. 

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

Dear Mr.Zwick,
    
    I represent over 200 firefighters who have sustained a wide range of 
physical injuries on September 11 and in the days and weeks immediately 
following.  It would appear that the definition of "physical harm" 
promulgated in the regulations would not include many seriously injured 
individuals who succumbed to pulmonary injuries as a result of working at the 
World Trade Center.  Moreover, the definition, taken together with the 
phrases "immediate aftermath" and "present at the site" make it difficult if 
not impossible to determine if a firefighter who was present on September 11 
through September 20 would be included or excluded from coverage under the 
Act if he or she  failed to see a doctor within 24 hours of having 
"sustained" the injury.  In most, if not all, of the cases that I am involved 
in, the pulmonary complications began with in 24 hours of the exposure.  
However, the firefighters continued to work without proper protection because 
of representations made by federal and local authorities that the air quality 
was "safe".  

    I, along with many other trial attorneys, have undertaken to represent 
these individuals pro bono with the hope that they would be able to make 
claims under this Act rather than having to commence traditional tort 
lawsuits.  Additionally, since they may suffer from future injuries which 
could be very severe,it is our belief that they fall within the intent of the 
original statute.  The regulations appear to construe the legislative intent 
of this Act to be to the contrary.  I am certain that it was the intent of 
both the House of Representatives and the Senate to adequately protect those 
rescuers who succumbed and will succumb to injury as a result of this event.  
I would hope that the final rule will redefine both "immediate aftermath" and 
"physical harm" to include those who attempted to save lives.

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Since then, lesbian and gay surviving partners of those killed have had

Compensation to families and partners of gay and lesbian victims of 09/11.



Dear Sir:

I reacted with outrage and growing anger concerning the news that the surviving partners and families of the gay and lesbian victims of September 11th won't automatically get benefits.

This, to me, is blatant discrimination. I had thought that there was a new spirit in this country...a spirit of unity. A theme sounded by President Bush....that we are first and foremost Americans. That we are united by a common cause. If there was even one beacon of hope after that terrible day, it should have been that. That we could maybe, just maybe put aside our differences....and be united as one. And that the heroes of September 11th...heroes such as             and            ,        of the New York Fire Department, openly gay men...should be celebrated and honored.

However, I find out that that might not be the case with them. Solely, it appears, because they were gay. As the other gay and lesbian heroes and victims of that terrible day in our country's history.

Please...to honor those victims and heroes....please reconsider your decision. Please show that you do honor those victims and heroes of that terrible day. Give compensation to the surviving partners and families of the gay and lesbian victims of September 11th.

committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

Victims Compensation Fund

I am responding to the request for public input on the regulations governing
the victims of 9/11 Compensation Fund.

It is important that this fund be administered so as to provide equal and
fair treatment to all families of victims.  This means that all "families"
whether traditional male/female or other family arrangements  including 
significant others", gay and/or lesbian families and their children be
treated equally.  

We do not want to resort to some of the same tactics of discrimination used
by the terrorists to compensate those citizens who suffered.  This is not
the time for someone's "political agenda" to be catered to, but instead is
the time for healing and sharing.  "Hate is not a family value."

Beware of entitlement programs

My dear America:

Terrorism is designed not only to bring heartache but
also to riddle a society with unanswerable questions.
Certainly one such question is how to compensate for
the loss of life. Of course, there is no way to
compensate for the loss of a loved one, which is why
naming a fund from which monies will be distributed to
survivors of a terrorist attack a "compensation" fund
is a terrible mistake. But is not the most grave
mistake the United States is poised to make in the
face of these atrocities.

By paying entitlement sums to victims of a terrorist
attack, the government is accepting at least partial
responsibility for the attacks and setting an
extremely unwise precedent. What happens when terror
strikes again or when a natural disaster, like an
earthquake, hits part of the country? At what point
will the government be able to get away without
spending billions upon billions of dollars to
"compensate" for the loss of life?

Of course, our government has a responsibility to
protect its citizens from acts of terrorism. No one
would argue otherwise. But to create an entitlement
program which pays out every time we are caught off
guard by those with previously unimaginable evil in
their hearts is to threaten the very financial
security necessary to prevent future attacks. How many
attacks will it take to spend ourselves into
recession? Then where will the victims' loved ones -
or those of the next attack - be?

Exclusion of Same-Sex Partners

President Bush over the past 6 months has repeatedly stated that the 
terrorist acts that occurred on September 11th 2001 failed.  In "failed" he 
has meant that instead of dividing this great nation the terrorist action 
unified us.  No longer was America a nation that concentrated on what made us 
different, but what made us the same; that we are Americans.  By excluding 
the same-sex partners of the people who perished due to the terrorist acts on 
September 11th 2201 the US Department of Justice is once again dividing 
America.  The USDOJ is taking an entire section of the nation and saying they 
did not suffer any loss from these acts.  The USDOJ is telling the world that 
our period of unity is now over and that Bin-Ladum did succeed in dividing 
our great nation.
    Please don't let Bin-Laden win.  Don't demolish the unity our nation has 
suffered so greatly to achieve.  Honor the memory of the Americans who 
perished due to these terrorist acts by compensating their loved ones 
equally.  Include the American same-sex partners as you have the NON American 
aliens and unborn fetuses families in the distribution program of the 
September 11th fund.

Re: This is the best yet.

I really think that finally government has lost it's mind.  Or you just 
presume that all tax payers are just plain stupid.  I do believe that we 
should have a say on how and where our hard earned dollars are spent.  
Personally, I am writing everyone I know and informing them of this latest 
farce.  In turn, I hope they write everyone they know and inform them of this 
latest plan.  Why don't you people get real jobs?  I feel that something has 
to be done about the disgraceful government waste.  Who then will you blame

To whom it may concern:

I have just been informed that the terms of the 
September 11 Victim Compensation Fund exclude consideration to gay and
lesbian families, their partners and/or dependents.  I
am incredulous that a fund created by Congress to help
the families of those who died on September 11 would
explicitly deny assistance to those in need.  
This blatant exclusion speaks volumes: intolerance,
discrimination and homophobia are never justifiable;
how shameful that these evils are now legimitized by
my government.  It's wrong.  It's dishonorable.  It's
reprehensible.  

I will close by stating that this condition will most
certainly be noted by the International Press.  
The world is watching.

Equal funds

Dear Mr. Kenneth Zwick,



I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.


  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."



Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 



Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Help same sex partners of terrorist victims


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex
unions.  They suffer just as grievously for their deceased loved ones as
do other survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups and
individuals who would have the Department of Justice limit compensation
to survivors of heterosexual unions.  They are interested in a political
victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.
