RE: COMMENTS REGARDING SUBTRACTIONS for the Victims


Dear Sir or Mam,

I for one am totally appalled with the fund for SUBTRACTING
any life insurance or pension benefits from anyone who was
injured or killed during the Attack.

You totally screw any family who planned for their future.
I thank God did not lose any friends, acquaintances, or
family members in this attack, but I feel totally angered at
these subtractions for those families who did.

It seems to me it is the governments' cop-out in the failure
to protect our citizens from terrorists in the first place.
And to further compound the terror, you mess with their
future.  You want to be fair, or so you say, BUT if that is
true then how on earth could you take away and devalue their
life or lives the way you are doing?

I feel that if the FBI and CIA had been paying attention
instead of sitting on their laurels this type of attack
wouldn't have been able to take place in the first place.
You don't want to be sued or the airlines sued so you
cheapskate your way out by such a paltry funding and expect
the grieving families to be happy with all these take a
ways.

I wonder....Is the government so callous, hardened, and
uncaring, that if it were each of your family members being
screwed by these subtractions, would you be so quick to
implement them?  You all by rote, spiel out all the words of
being upset by these actions, yet you crucify a family for
having pensions or life insurance...  How is that fair??

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars
per year might receive thousands of times as much compensation as the survivors of a dishwasher in
one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent
worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It
would be a double blow to the survivors to first lose their loved one and then watch as most of the
taxpayer money went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

Could you please define "victim"  when it come to the 9/11 attack.  It has 
been my experience that is means a life had to have been lost.  

I did manage to get out.  However my life has been turn upside down.  I no 
longer have a job.  When you  go for assistance, I find that you are  treated 
like a heard of cattle.  You are sent from one agency to another being  
informed that the next agency should be able to help  you.  Most of the time 
they take all of you personal information and you never hear from them again. 
 So I was wondering if being unemployed as a results of 9/11 counts as being 
a victim.

I would greatly appreciated an explanation.  thank you.

We applaud the approach you are taking in soliciting wide public comment in fulfilling your
legislative mandate to promulgate regulations governing the fair expeditious distribution of
funds voted by Congress and approved by the President for victims of the terrorist attacks of September 11.

We write to urge that in creating the category of those who qualify as "survivors of someone lost in the crashes" under the fund's regulations, we can best carry out the intent and spirit of the law by compensating all of those who suffered both grievous emotional loss from these murders, and significant financial loss as well.

In providing such compensation, we believe the federal government should take into account all of those who had a close relationship with the murdered victim and whose own financial position will be adversely affected by the death.  Relevant indicia of such a relationship include a shared residence, shared bank accounts for other financial instruments, joint membership in a health plan, a significant sharing of living expenses, etc.  Obviously a wide range of different personal relationships will be covered by this, and we believe that this coverage is wholly appropriate in this instance.  We note that this is the approach taken by Governor George Pataki of New York, where so many of the victims live.

The act we passed was not an effort by the Congress to regulate any set of personal relationships, nor to encourage or discourage people from following nay particular pattern in their living arrangements.  It was simply a prompt response by the Congress to the terrible murders inflicted on America on September 11, in particular by doing what we can to come to the aid of all of those who were victimized by the deaths of people close to them.

Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a major
rule promulgated by the Department of Justice (DOJ), Office of the Attorney General
entitled "September 11th Victim Compensation Fund of 2001"  (RIN:1105-AA79).  We
received the rule on December 21, 2001.  It was published in the Federal Register as an
"interim final rule with request for comments"  on December 21, 2001.  66 Fed. Reg.
66274.

The interim final rule contains certain procedural rules for the administration of the
September 11th Victim Compensation Fund of 2001 that allow the Special Master to
commence operation of the fund and disbursement of payments as soon as practicable.

Enclosed is our assessment of the DOJ's compliance with the procedural steps required
by section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the rule.  Our review
indicates that the DOJ complied with applicable requirements.

(i) Cost-benefit analysis

The Department of Justice did not perform a cost-benefit analysis of the interim final rule.

(ii) Agency actions relevant to the Regulatory Flexibility Act, 5 U.S.C.   603-605, 607,
and 609

DOJ has certified that the interim final rule will not have a significant economic impact on a
substantial number of small entities.  The rule provides compensation for individuals, not
entities.

(iii) Agency actions relevant to sections 202-205 of the Unfunded Mandates Reform Act of
1995, 2 U.S.C.  1532-1535

The interim final rule does not contain either an intergovernmental or private sector
mandate, as defined in title II, of more than $100 million in any one year.

(iv) Other relevant information or requirements under acts and executive orders

Administrative Procedure Act, 5 U.S.C.   551 et seq.

Since the Congress set a 90-day deadline for the issuance of this rule, DOJ found "good
cause"  under 5 U.S.C.  553(a)(2) to forgo the issuance of a proposed rule and the
solicitation of comments as impracticable.  Likewise, "good cause" was found under 5
U.S.C. 553(d) to have the rule effective upon publication rather than the normal 30-day
delay.

However, DOJ did publish a Notice of Inquiry on November 5, 2001, in the Federal
Register.  66 Fed. Reg. 55901.  In response to this notice, DOJ received over 800
comments that are discussed in a appendix to the interim final rule.  In addition, comments
on the interim final rule submitted by January 22, 2002 will be considered.

Paperwork Reduction Act, 44 U.S.C.  3501-3520

The interim final rule contains an information collection that is subject to review by the
Office of Management and Budget under the Paperwork Reduction Act.  The preamble to
the interim final rule contains the information required under the Act.  DOJ estimates that
the "Registration/Eligibility Form and Application for Emergency Benefits from the Victim
Compensation Fund" will have an estimated 5,000 claimants with an average burden of
6.0 hours per response or a total burden of 30,000 hours.

The collection has been approved on a emergency basis for 180 days and DOJ is
soliciting comments on the collection for the regular review process.

Statutory authorization for the rule.

The interim final rule is promulgated pursuant to the authority contained in the September
11th Victim Compensation Fund of 2001, Title IV of Public Law 107-42, 115 Stat. 230 (Air
Transportation Safety and System Stabilization Act).

Executive Order No. 12866

The interim final rule was reviewed by the Office of Management and Budget and found to
be a "significant regulatory action" under the order.

Executive Order No. 13132 (Federalism)

The interim final rule does not have sufficient federalism implications to warrant the
preparation of a federalism assessment.

To Whom it May Concern:

I was appalled to read the words of Kenneth Feinberg regarding gay partners 
of the 9/11 heroes not being eligible for the same compensation as 
heterosexual family members.  Illegal aliens will be compensated, but 
AMERICANS who have sexual preferences that offend conservative and religious 
hypocrits will not?  We can ignore Federal immigration law because the 
Attorney General believes this exception is politically acceptable, but 
acknowledging gay partnerships would go against state law and therefore, is 
unacceptable????

I'm ashamed of the manner in which our government chooses to bestow  
equality.

equal benefits for homosexual partners

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

September 11 Victim Compensation Fund

Dear Director Zwick:
I am writing to support the position of the National Gay and Lesbian Task
Force in their letter to you dated November 21, 2001 regarding disbursement
of monies from the September 11 Fund. I agree with the need for the
Department of Justice Department to "include among relatives eligible for
compensation those who lost their life partners or de facto parents or
children, regardless of sexual orientation and marital status." 
The horrific loss of loved ones to a random terrorist act should not be
compounded by our own government denying survivors whatever benefits may be
available simply because we fail to have laws to protect all of our
citizens.

I was appalled to learn that funds from the September
11th fund will be divied up in such a way that
diminutizes important gay and lesbian familial
relationships. The inconsistencies of the policy are
abhorrent. It is especially predujicial of the funds'
allotment when Attorney General Ashcroft is allowing
for immigration law to be compromised, but refuses to
compensate life partners of gays and lesbians killed
in the September 11th attacks. While these individuals
gave their lives on that date, it is apparent their
loved ones' pain and suffering is less than that of
others who too lost loved ones. The judiciousness is
an unfair estimate by accepting what was given
(someone's life, someone's partner's life) but not
giving anything in return.

I am disappointed and angered by the unequitable
standard that has been set when it comes to all
individuals affected by the attacks. It is apparent
that the current administration feels some lives are
held in higher regard than others.

It makes me saddened and ashamed to see our country's
government act with such callous and unfair favor when
it comes to its citizens that gave so much on that
day.

The deaths on September 11th were the result of an attack on all Americans.
Please do not discriminate against the unmarried partners of September 11th

Exaggeration of the award amount

I hope that future public comments by Mr. Feinberg will clarify that,
under the interim rules, the average payout from the fund under the
interim rules will NOT be $1.65 million (which has been repeated over
and over in the press and elsewhere).  Of course, those who take the
time to "read the fine print" know that the average payout under the
interim rules will be much less due to deductions for "collateral
source" income.  But the average member of the public, not directly
affected by the tragedy, is unlikely to take that extra time.  This
disinformation is not helpful to public debate about whether the interim
calculations for presumed economic and non-economic losses are
reasonable compensation for the loss of the victim.
 
Here is but one example of how that kind of misunderstanding skews
public debate about the fund and its rules.  I have read many repeated
comments apparently submitted to you by the voter.com website that
purport to inform you of their latest poll results on the question "Does
the government's aid program for families of Sept. 11 victims goes far
enough?"   I looked at that website and found that voter.com (or whoever
else submits those repeat comments) omitted the rest of the question.
(You can verify this too, unless they have changed the question in the
mean time).  Next to the YES button is the further clarification that
"The families will get an average of $1.65 million each to help them
rebuild their lives."  (Wonder where they got that figure?)  Moreover, a
NO vote (according to the explanation next to the NO button) requires
the voter to believe that that a $1.65 million average payout is not
merely too low -- but is indeed "ludicrous."  Not exactly a fair way to
pose the question if you want to sample true and informed public
opinion.  Hopefully, this attempt to mislead the rulemakers will be
properly ignored.

Support Crisis Benefits for Gay and Lesbian Partners

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Please, show compassion to those victims who were gay
and left bereaved family members. I am not gay but I
have recently become friends with a gay couple who
have a daughter. They are a family just like mine.
Please, honor all who died and make benefits available
to all family members, including the partners of gay
people. Have compassion, haven't we suffered enough
from ignorance and hate?

Recognize gay partners

Dear Sir or Madam,

I certainly hope that what I read today was incorrect, that partners of gay
and lesbians killed 9/11 will be treated differently that those of married
couples. These people were no less in love or in need of their other half,
and should be recognized the same way any other half would be in these
circumstances.

I hope that the help to victims in this tragedy will not be swayed by some
people's personal politics or religion (considering that's what created this
tragedy in the first place) and America will show that it is a land of
people for the people.

OBJECTIONS TO THE INTERIM REGULATIONS

My ojbections to the interim regulations include:  

With regard to ECONOMIC DAMAGES:
1.  The special master has ARTBITARILY chosen to use outdated(1979), national 
data to calculate potential earnings for individuals who were employed in 2 
buildings in New York City.  USE UP-TO-DATE,  NEW YORK DATA TO CALCULATE 
EARNINGS.

2.  An individuals education and occupation should be considered when 
calculating potential life-time earnings.

3.  THE $230,000 CAP ON YEARLY EARNINGS SHOULD BE REMOVED.  My son would have 
reached these earnings at 25 years of age.  Under the current guidlelines his 
earnings will remain the same for the remaining 37 years until his projected 
retirement age of 62.

4.  The current $250,000 offering for non-economic damages is an insult when 
you take into consideration the pain and suffering of those individuals in 
this horrific event.  Some jumped from the building, others died of smoke 
inhalation, others burned, others were trapped in a burning building without 
a way to escape and died when the building collapsed. TO USE THE AMOUNT OF 
$250,000 BECAUSE THOSE GUIDELINES ARE USED FOR THE MILITARY IS A JOKE.  THESE 
INDIVIDUALS WERE CIVILIANS WORKING IN MANHATTEN, NOT MILITARY PERSONNEL.
With regard to the pain and suffering of the vicitims families, it is 
continuous.  We have had a memorial service on Sept. 28, a burial of very 
limited remains  our 24 year old son, on Dec. 22nd and we were contacted on 
Jan 22nd regarding additional remains.  How does a family escape the 
continuous pain and suffering we feel?  How does our family "come to closure" 
as we anticipate additional remains?  How do I protect my deceased sons 
younger brothers?  We are bombarded with ongoing pictures on tv, the 
newspapers, magazines, and constant discussion of the event.  It is expected 
that identifications will continue anywhere from 5-10 years. 
In similar airline litigation, awards range from $2 million - $20 million 
dollars.  If we are unable to litigate, awards should be a minimum of 1 - 2 
million, WITHOUT OFFSETS APPLIED.

5.  I disagree with the process.  All families should be notified in writing 
what the minimum compensation is BEFORE they waive their right to litigate.

6.  Overall, the interim regulations MINIMIZES ALL INDIVIDUALS COMPENSATION.  
Economists report in the case of all 22 -50 year old individuals in the 
securities business, their compensation based on potential earnings is 
devalued 100% , individuals with a bachelors degree or more is devalued by 
30%, a firefighter or policeman is devalued by 27%.

All I ask is for the special master to be fair and honest. If you're 
calculating potential earnings, CALCULATE TRUE POTENTIAL EARNINGS.  If you 
are making a reward for pain and suffering, TAKE INTO CONSIDERATION THE TRUE 
PAIN AND SUFFERING THESE INDIVIDUALS AND THEIR FAMILIES ENDURED.   Remember 
these individuals who lost their lives at work that day
were hardworking, taxpaying individuals who contributed significantly  to our 
economy.  Compensate their families appropriately, as Congress intended.

Kenneth Feinberg's comments


To Whom It May Concern:

 I am saddened by Kenneth Feinberg's comments on "Meet the Press" this past Sunday. I am ashamed that my government would see fit to so openly discriminate against Gays and Lesbians, people who were equally devastated by the events of September 11. I rejoice over the new found freedoms of the women of Afghanistan, but wonder how we can call other governments discriminatory when we won't even acknowledge such a large, politically active, community-oriented group in our own country. 
 
 Is there something that tells you that gays and lesbians grieve less, sacrifice less, or in any way are less affected than other U.S. Citizens by these events? How can you in good conscience say that you will forgive immigration violations to compensate illegal immigrants, yet ignore and marginalize a group of citizens who were legally employed? How can you look into the faces of the loved ones of those who died - people who loved and cared for the victims as much as any spouse - and tell them that they don't count simply because of their sexual orientation? I think the obvious answer is that you decline to look at them at all. For that you should be ashamed, especially to wrap your discrimination in the cloak of warding off lawsuits, an incredibly specious argument and one not worthy of consideration. Not in this country, not in this time. 

I hope that you will reconsider your actions, take the right and moral step and compensate those who lost loved ones, regardless of their sexual orientation. I expect my government to act in a more noble manner.
