9/11 Fund UNFAIR to Gays

9/11 FUND UNFAIR TO GAYS

In recent interviews, the head of the September 11 Victim Compensation Fund 
(a fund created by Congress to help the families of those who died on 
September 11) has made clear that the partners of gay and lesbian heroes of 
September 11 will not necessarily receive the same benefits as the spouses of 
heterosexual victims of the horrible terror attacks.  

Even fetuses and illegal aliens will be receiving benefits under this problem 
- heck, they've even promised to overlook federal law and NOT arrest and kick 
out the families of illegal aliens, nor will they punish American companies 
that hired illegals in violation of federal labor laws.  

But when it comes to gay and lesbian heroes of the day -             who helped bring down the flight in Pennsylvania, NY Fire Dept.              who died in the line of duty when the first tower fell, and 
             who was              of the plane (American Airlines) that crashed into the             (there are many more) - we are told the law is the law and no exceptions can 
be made.  

ENOUGH IS ENOUGH 

It is time that ALL Americans are treated equally. Please reconsider your 
decision to disallow equal treaatment for Gay and Lesbian partners of those 
who died on September 11. It is an outrage to do otherwise. America is a 
melting pot and no one group should be singled out EVER but particularly when 
existing federal laws are admittedly being overlooked to allow another group 
to receive benefits and not be punished for living in our country illegally. 
Additionally, companies that hire these illegal residents are not being 
punished.

Help all victims of terrorist attack


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex
unions.  They suffer just as grievously for their deceased loved ones
as do other survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups
and individuals who would have the Department of Justice limit
compensation to survivors of heterosexual unions.  They are interested
in a political victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.

Equal Rights for Gay and Lesbian Partners

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Ensure Fair Treatment for September 11th Victims' Families

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed.  Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.

September 11th victim compensation fund

Dear Sir,
I am having a difficult time dealing with all these relief funds set up for victims of the 9/11 tragedy. I, along with thousands of New Yorkers also lost my job as a result of 9/11; the company I worked for was marketing to the Financial sector and on October 3rd I was laid-off. I've gone from a net monthly income of $4,700.00 plus to $1600.00 monthly unemployment benefits. I have been actively seeking other employment but to no avail. I understand the government has extended the unemployment benefit period; but paying us only $405.00 weekly ( the maximum) is hardly adequate to sustain a decent standard of living. 

Everyone and rightly so, is concerned for the victims who have lost their bread winners and we are going to make sure they are provided for; but I think that people in my situation also should get some relief. The government is bailing out the major airlines and other corporations with our tax paying dollars; yet I am relying on $1600.00 to take care of myself. There is something wrong with this picture. What do you think? I hope you have the courage to make light of this matter.

the compensation fund trusting that their gift would be distributed without prejudice. It

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, 
including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars
per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the
restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all
those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double
blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to
those
who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of
marriage is unavailable, these families may find themselves in the traumatic predicament of having to
prove
that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already 
announced that they will not discriminate against gay and lesbian families. The Department of Justice
should
do the same.

*The  funds should have preset rules prior to  any distribution.
*They should be provided solely to those who lost a family member on 9/11.  (Approximately 5,000 families)
*They should NOT be distributed to illegal aliens, visa overstays, or any other non-citizen, or anthrax people.
*The families should be provided  relief  dollar amounts in accordance to the annual wage of the deceased victim.  Higher wage                     earners  had higher mortgages,utilities, credit card bills. Otherwise these families lose everything the deceased worked for.
*The funds received by charity organizations should not enter into the equation.
*The charitable organizations should be investigated for 'bait and switch' misappropriations of  the Liberty Fund. 
*The charitable organizations are thieves and should be prosecuted as such.


*Airlines, and the security companies should not be relieved of liability.

Crisis Relief for All


December  19, 2001

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families 
of the tragedy on September 11th, including the children and families of 
low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader 
earning millions of dollars per year might receive thousands of times as much 
compensation as the survivors of a dishwasher in one of the restaurants 
destroyed.  Justice requires looking far beyond the last paycheck to the 
inherent worth of all those killed, so that a high minimum compensation level 
is set to lessen the disparities. It would be a double blow to the survivors 
to first lose their loved one and then watch as most of the taxpayer money 
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and 
lesbian relationships and families. Gay and lesbian families are especially 
vulnerable when one partner is killed. Because the option of marriage is 
unavailable, these families may find themselves in the traumatic predicament 
of having to prove that their union is legitimate. Fortunately, both the Red 
Cross and the State of New York have already announced that they will not 
discriminate against gay and lesbian families. The Department of Justice 
should do the same.

act on these very important issues.

911 compensation fund


It has come to my attention that partners of gay and lesbians victims of
the 911 attack on the United States will most likely be unable to recieve
compensation for the tragic loses of their loved ones.  However, other
groups of relatives - including those considered ILLEGAL ALIENS - WILL be
allowed to recieve benefits, with the government turning it's eye away
from the laws regarding legal citizens of the US.



I find this policy absolutely unacceptable, and demeaning to the memories
of those gay and lesbian vicitms - some who which were absolute heroes in
bringing down the airliner thought to be heading for Washington D.C.



I ask your administration to reconsider this policy decision, and allow
those partners of gay and lesbians who were killed on September 11th to
also recieve equal financial compensation recieved by ALL other familes of
vicitims of this tragedy.

9/11 compensation

To whom it may concern:

I would like to express my feelings on the compensation plan for the 9/11 victims.  I saw a report on FOXNews today that I thought was pretty disturbing.  A woman wanted more than the alotted 250,000.00 that she would get for her sons death (whom was 21,had no wife or children and they never depended on his financial support), because that was not enough money to cover pain and suffering.  I have a daughter and a husband and God forbid anything happen to them, but I would never be able to put a dollar figure on pain and suffering.  I don't care if you gave me all the money in the world, that would not fill the place of my loved one.  People lose loved ones to all sorts of different circumstances and most are not refunded of there families lives.  And as horrific as this event was, I don't feel as if anyone should get money unless they lost someone that they were financially dependent upon.  I think that 250K is more than enough for people like the above mentioned.  They are just money hungry!  Keep everything the way that it is and give the most money to those who have children and wives or husbands.  Thank you for your time and I hope the rest of America is with me.

Equal basic human rights


December  19, 2001

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Comments on victims compensation fund

My wife died in the attack on the Pentagon. I have two sons, aged 11 and
7.

I strongly disagree that any awards from the victims compensation fund
should be reduced by any other compensation received.

My wife and I prepared for the future by paying life insurance premiums,
contributing to her pension plan, and other steps we took. We made
sacrifices so that the one of us who survived, or our sons, if both of
us were deceased, would be provided for.

It is not equitable that the government should reduce any award my
family might receive from the victims compensation fund by the amount of
compensation we receive from our prior planning, sacrifice and
preparedness.

To take this amount away from any award my family would receive would be
like stealing from us, like punishing us for having prepared for the
future. It would also cheapen and minimize the loss we have experienced,
as though accountants were more concerned with the costs than with
taking care of people. It would make it as though we had never gone
through the effort to budget and to do without to make the premium and
contribution payments, or worse, that we done it for nothing.

Because we planned ahead, my family is not eligible for most of the
financial assistance aid currently available. This is because much of it
is need based. I think this is right. I have not even considered trying
to apply for funds to cover expenses that I am able to meet with the
proceeds from insurance, pension and my regular pay. There are many
people in dire straits who need that money. I would not think of taking
it from them.

So, I am not referring to compensation received from the American Red
Cross and other aid agencies. (For the record, I do not think that
victims' compensation should be reduced by amounts received from those
sources, either.)

If an award to my family is to be reduced by the amounts we've received
from insurance, retirement, pension, etc., I will probably elect to
sue--most likely successfully--American Airlines, Dulles International
Airport, the security services involved, and possibly other entities,
including governments. If I am forced into this course, I will be
required to seek a much larger award than that for which I would be
willing to settle if I did not have to go to court.

For me, the time and aggravation of going through a suit is a minimal
consideration. I do not need the compensation. I can wait years if that
is the case. However, I would much rather accept an award from the
victims compensation fund--probably much smaller than what I might
expect to receive from litigation--if it meant simplifying the process.

I think it would be much less costly to, and in the best interest of,
the taxpayers, for the government to agree to compensate victims without
regard to other compensation received. Keep it simple, be fair, get it
done with. Do the right thing once instead of dealing over and over
again with doing the wrong thing, or with doing only half of the right
thing.

The best solution for my family, and I think other victims, is to
determine a consistent standard, such as loss of
wages, as in our case, and set up a fair formula for pain and suffering.
Determine an award in each case, give it
to the victims and be done with it. Case law provides ample precedent
for doing this quickly and fairly.

For me, in consideration of the needs of my family, the bottom line is
not the amount of the award, nor is it the time it might take for
litigation. It is simply that I do not consider it right that the
insurance, retirement, etc. that my wife and I worked for should now be
discounted.

Do not penalize those who have had the forethought and made the
sacrifices necessary to be prepared for loss.

Justice help all terrorist victims


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.

This importantly should include the partners and children of same
sex unions.  They suffer just as grievously for their deceased
loved ones as do other survivors, and their need for assistance is
just as great.

Please do not give in to the importuning of callous homophobic
groups and individuals who would have the Department of Justice
limit compensation to survivors of heterosexual unions.  They are
interested in a political victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.
