September 11 Victim Compensation Fund

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Comments on Rules by Special Master

Gentlemen and Ladies,
      I am sure that I am not the first to state that the primary beneficiaries of the rules and the legislation are the airlines, the insurance  industry and our government which failed in the protection of the life, liberty and property of the thousands of fathers, mothers, husbands, wives, brothers, sisters, children, nieces nephews, friends and neighbors who were publicly incinerated and physically assaulted by two 40,000 ton jet airliners which were murderously conflagrated upon their persons on September 11th.        This tragedy not less horrific than the gas chambers of Hitler's Germany wrecked devastation into the lives of the victims families no less catastrophic and apocalyptic and painful than the collapse of  the two 110 story buidings.  I have witnessed first hand the psychological and emotional damage to my best friend and her daughter by this public event and know first hand the monetary losses in support ,  and the emotional damage from watching the events which has been brought upon these unlucky individuals.  To begrudge them some financial recompense is wrong. To resent their complaints when most now are only beginning to go beyond the shock and reeling of the first months is inappropriate.  A victim compensation fund should compensate victims and the Special Master entrusted with that charge should do all in his  power on behalf of those victims.....not prove sway to political influences and pressures not to pay.
 
       The caps at around 3 million dollars no where approximate the sums of money  any of these victims would  receive in normal litigation  ....what of the millions awarded for a scratched BMW.....and no normal litigation would deduct insurance or charity from its award. What became of the goal of dispensing with the costs and time of litigation. The capped amounts and the deductibles effectively relieve the United States and the elected officials from meaningfully recompensing the victims families.  This is an injustice and not within the original intent of the legislation.  Most individuals employed at the World Trade Center probably had insurance for their families at their own expense.  If they received it as part of compensation they paid the appropriate taxes as a benefit computed as income.  The insurance and charity should not be deductible.  It is my impression that if a survey were taken of the 3000 individuals who died most would not be receiving anything more than a couple hundred thousand - not a meaningful sum- or expense to the taxpayers- under the current plan.  Effectively the deductibles relieve the U.S. of responsibility to a majority of those who died.
 
     The Special Master should go back to Congress forthwith in accordance with his charge and seek amendment of the underlying legislation.  All elected personnel who believe as they should that there must be recompense to those who  suffered for all Americans must promptly amend the legislation to leave insurance and charity undeductible from any amount awarded. This legislation was signed into law within days of September 11th.  It's errors can just as speedily be rectified!!!!

     The Special Master should also make provision more specific than turning over funds in some general way in accordance with state law to  award as is normally done by a formula for the years of dependency for spouses and children thereby apportioning rather than further causing disintegration and damage to these families by potential disputes .

     Tort Reform to  prevent excessive monetary judgments and a plan to be used in cases of mass injury should not begin with the families of those individuals who suffered the worst physical, psychological and financial harm ever sustained by human beings.

     The legislation should permit these individuals to bring suit as well against those terrorist organizations  and individuals - whose funds have been frozen and any amounts ultimately awarded subrograted and allocated as to portions paid by the US through the victim compensation fund awards.

     For a country as rich as the United States and with the waste that we so wrongfully cause in spending unnecessarily - we are morally obligated if we truly believe as we should - that those who died were Heroes and patriots to fairly  recompense the Horrors their families have endured,  and will  continue to endure for their remaining lives.  Some of these costs should be born by taxpayers.

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

about your efforts to ensure that all surviving victims of the September 11

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.

That you recognize the sanctity and legitimacy of gay and lesbian relationships and families as you make these crucial decisions is imperative.  Gay and lesbian families are especially
vulnerable when one partner is killed.  Because the option of marriage is largely unavailable, these families often find themselves in the traumatic predicament of having to prove the legitimacy of their union.  Both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families.  Our United States Department of Justice must follow suit.

As an American, I ask you to keep in mind the gay and lesbian citizens who serve heroically as police, firefighters, soldiers, medical personnel and in other critical occupations.   We also must keep in mind the gay and lesbian Americans who donated to the compensation fund trusting that their gift would be distributed without prejudice.   It would be unconscionable to dispense their monies while denying the legitimacy, worth and humanity of other gay and lesbian Americans.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

equal access for crisis relief

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

about your efforts to ensure that all surviving victims of the September 11

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

important issues.

I am shocked and sickened by the distinctions you have made between heterosexual victims and homosexual victims on the 9/11 tragedy.  How can any right thinking person, especially those to call themselves Christians, deny benefits to the partners of those who died in the terrorist attacks any less worthy of compensation for their losses than any other Americans.  If you can ignore laws that pertain to illegal aliens and their employers, how can you justify not circumventing state laws to recognize the partners of homosexuals.

I am not a homosexuals, but I support their rights on every level.  If you can deny their rights, then how soon will it be before you start denying my rights as a 62 year old single woman.  This government has already decided that I must be penalized for not being married by levying more taxes on single people without children than on married people without children.  What is next.

I implore you to reconsider this unconscionable decision.  Shame on anyone who takes the position that homosexuals do not have the same rights as all Americans.  What has become of our beloved country if you can make such distinctions.

Help same sex partners of terrorist victims


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11 terrorist
attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex unions.
They suffer just as grievously for their deceased loved ones as do other
survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups and
individuals who would have the Department of Justice limit compensation to
survivors of heterosexual unions.  They are interested in a political
victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political statement,

Dear Sir:

The events of September 11, 2001 rate as one of the darkest moments in the history of the United States.  There is no denying that it was a tragedy of unparallel evil that has had an impact on all Americans.  It changed the world that we live in, forever.

Despite the magnitude of this despicable event, I take great exception to the enormity of the funds ($4.6 billion) that will be provided by the government to the victim's families.  I, like millions of people, gave generously to charitable organizations directing that the donations be used exclusively to help those directly affected.  Now, I am being asked to donate additional funds through my taxes.  It seems to me that the one and a half billion dollars that has been donated to charities, plus life insurance benefits, plus social security benefits, plus retirement benefits, plus tax relief, plus free college educations, etcetera, etcetera, should be enough to provide sufficient relief to families of victims. 

It disturbs me that a very dangerous precedent has been established.  In these unsettled times we hear a great deal about the potential for terrorism with chemicals and biological agents.  It is conceivable that many thousands of people might be killed in the future in this manner.  Without even trying, over 5000 people were killed by nerve destroying chemicals in Bhopal, India.  Is our government prepared to hand out money to many thousands of victims?

Were not the terrorist actions of the past just as tragic as September11th.  What about the 270 victims of Pan Am 103 over Lockerbie?  What about the servicemen killed in the barracks in Lebanon?  What about the 17 sailors killed on The Cole in Yemen?  What about the 224 people killed in the embassies in Tanzania and Kenya?  What about the six people killed in the World Trade Center in 1993?  What about the 19 servicemen killed by a bomb in Dhahran, Saudi Arabia in 1996?  How about the 168 people killed in Oklahoma City?  Did they not have the same disastrous impact on families of the victims?  You surely will hear from their families, if you haven't already.  Aside from the magnitude of September 11th, what make it more tragic than the catastrophes mentioned above?  Is it any less tragic than the seven families whose loved ones were killed by a runaway van on the streets of New York last week or the 30 year old mother that died of cancer leaving a husband and baby?  Death is heartbreaking in any form.

I have heard that the reason for the government assistance is to eliminate the potential for legal suits against the airlines, the World Trade Center and others.  Experts agree that the likelihood of successful litigation is remote.  The Al Qaeda is responsible and how is one to sue them?

I do business all over the United States and I am hearing unanimous agreement that the
government has made a terrible mistake with this package of relief.  My colleagues at work, my friends, my family and my  neighbors also speak this sentiment.  We want to know what you had in mind when you voted to provide our tax dollars after we all made generous contributions to aid those families.  I feel confident that my letter is just one of many that you have and will receive on this subject. 

We hear disturbing reports that victim's families are already using compensation for items such as home decorating, purchases of appliances, vacation, etc.

Why is the U.S. government implicitly accepting blame for the attacks of September 11th?

I find it reprehensible that the partners of gay and lesbian victims will not be compensated like everyone else!  Did they not display the same courage?  Feel the same fear?  Fight the same attackers?  Why are some heros "better" than others?  As to the partners of the victims.  Did they not feel the same loss?  Have the same hardships?  Now, on top of all the pain they are already experiencing you are adding ignorance, intolerance and hate!  You should be ashamed!  I hope that you will realize the pain you are causing is so unneccesary.  Please reconsider your decision involving the distribution of funds to include ALL the victims of 9/11.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these
very important issues.
