Dear Kenneth Feinberg:

We understand that you have a reputation for fair dealing in matters of compensation, particularly in complex matters such as the use of compensation funds for victims of the September 11 attack.  We urge that your criteria not be biased against those with low income.  In particular we suggest that there be a minimum package so that those with very low incomes prior to the disaster will not be both hurt and humiliated.  We also urge that you not discriminate against gay and lesbian couples.  Their unions may not be legally sanctioned, but they have moral and economic force for the persons who have entered into them.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, 
including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the
restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all
those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double
blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those
who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of
marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove
that their union is legitimate. Fortunately both the Red Cross and the State of New York have already 
announced that they will not discriminate against gay and lesbian families. The Department of Justice should
do the same.

issues.

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund." 
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Undoubtedly the overseer of funds along with the Attorney General and
The President all seem to have the same narrow minded view.  How can this be in the
one country where acceptance of all was the founding thought?  Perhaps they need to
re-read the history books, and understand that unless all are accepted, there
will never be a country as a whole.

 I am writing to ask for your help to correct the
inequities contained in the Department of Justices
interim final rule for the September 11th Victim
Compensation Fund of 2001.  The pain my family has
experienced in this tragedy is difficult to
communicate.  The loss of my husband is devastating. 
I would exchange all compensation to bring          back. 
The interim final rule increases the already intense
pain to an even higher level.  I ask you to help bring
some fairness and balance to our lives.  Please give
us a reason to participate in the Fund.  Please adjust
the interim final rule to provide economic and
noneconomic amounts at fair, balanced and acceptable
levels.  Please establish a fair appeal process. 
Please preserve workers compensation payments for
surviving victims.  Finally, please include the
specific calculation formulas, statistics and
assumptions within the rule or the explanatory
materials.

The Interim Final Rule provides little incentive to
participate in the Fund because it seriously
understates our losses and undervalues the
compensation for those losses.  Consequently, the
Interim Final Rule will defeat the intent of Public
Law 10742. 

 When Congress passed the Air Transportation Safety
And System Stabilization Act on September 22, 2001, it
severely restricted our right to sue the airlines,
which bear responsibility for our loved ones deaths
because of lax security procedures.  In exchange for
denying Family Members this right, they provided the
September 11th Victim Compensation Fund of 2001.  The
Fund is supposed to compensate the victims' families
for the types of losses that would have been
recoverable in a lawsuit.  This includes economic
losses, such as lost income, and non-economic losses. 


Non economic losses described in the law are very
broad and inclusive.  They are described as losses
for:  physical and emotional pain, suffering,
inconvenience, physical impairment, mental anguish,
disfigurement, loss of enjoyment of life, loss of
society and companionship, loss of consortium, hedonic
damages, injury to reputation, and all other
nonpecuniary losses of any kind or nature.  The
Interim Rule/Regulation also describes the intention
of the law:

The Fund is designed to provide a no-fault
alternative to tort litigation for individuals who
were physically injured or killed as a result of the
aircraft hijackings and crashes on September 11, 2001
{Interim Rule/Regulation, Summary Paragraph A.1.}. 

The attached regulations have two objectives: (1) To
provide fair, predictable and consistent compensation
to the victims of September 11 and their families
throughout the life of the program; and (2) to do so
in an expedited, efficient manner without unnecessary
bureaucracy and needless demands on the victims.
{Interim Rule/Regulation, Supplementary Information.}.

The Interim Final Rule issued by the Department of
Justice (DOJ) falls far short of these stated goals
and does not comply with the statute passed by
Congress.:

a) Under the Interim Final Rule, noneconomic losses
are limited to $250,000 for my husband and $50,000 for
children and a spouse.  My family would receive only
one-tenth the amount of noneconomic losses recovered
in other air crash and terrorism cases, which commonly
result in awards well into the seven-figure range.

b) The Interim Final Rule understates economic losses
in two ways:  It caps the salaries of high-income
victims and underestimates the lifetime earning
potential of victims at all income levels. 
Independent economists have shown the interim final
rule uses outdated and inapplicable work-life and
life-cycle earnings data to underestimate promotions
and pay increases and consequently provides low
estimates of our loved ones future earnings.

Because the initial award amounts are so low, many
families will receive little compensation from the
Fund after the collateral payment deductions have been
subtracted.  There will be little reason to
participate.  

To compound the unfairness, my family would have
little real opportunity to appeal the determination of
the Fund Master.  A familys award may be increased
above the presumptive award only by showing
extraordinary circumstances beyond those suffered by
other victims or victims families.  This makes the
hearing or appeal to the Special Master extremely
arbitrary, unclear and unfair.

In addition the proposed compensation to the spouses,
children and other innocent victims of the attacks is
out of balance when compared to the generous
compensation to the airlines.  Not only did the law
cap the airlines liability at the limits of their
insurance (which saves the airlines billions of
dollars), but it also provides for direct cash
payments and loan guarantees to the airlines totaling
$15 billion.  The underpayments to the spouses,
children and other loved ones suffering from this
attack will shift the cost of these airline subsidies
and liability limits to the innocent victims of the
attacks.

Please correct the inequity.  Please give us a reason
to participate in the Fund.  Please adjust the interim
final rule to provide economic and noneconomic amounts
at fair, balanced and acceptable levels.  Please
establish a fair appeal process.  Please preserve
workers compensation payments for surviving victims. 
Finally, please include the specific calculation
formulas, statistics and assumptions within the rule
or the explanatory materials.

     I just voted in a vote.com poll as to whether illegal immigrants should receive compensation.  I voted "Yes" because I don't really subscribe to the idea of an illegal immigrant.  Except for vipers in our bosom like al-Qaeda terrorists, we should take everyone.

Re: Victim Compensation Fund

Dear Mr. Feinberg,

I watched with great interest, your interview with Gwen Ifill on The News Hour last night. The
key word that kept coming up during the course of your discussion was "discretion."

For the reasons enumerated below, I want to urge you to be inclusive of life partners, be they 
homosexual, heterosexual, or transgender, as well as de facto children, as you develop
disbursement guidelines for the victim's compensation fund.

1.  When you mentioned that there were decisions that would be left to your discretion, I began
     to ponder how many discretionary decisions are made that affect the daily lives of Gay and 
     Lesbian* Americans.  Because we do not have equal rights afforded to us by the federal 
     government and most state and local, any rights to speak of often hinge on the discretion of
     what we hope will be fair-minded people in the judicial and legislative systems.  We
     frequently wait with baited breath for decisions to be handed down by the courts on whether
     we can adopt, if we can receive a deceased partners benefits, or on the very status of our
     relationship.  It is always our burden to prove our commitment to each other, whereas most
     heterosexual people can easily marry or elect to become de facto husband and wife
     through co-domicile, often recognized as a marriage in many states.  Of course, the legislative 
     side of winning approval of our relationship and attendant rights is one wrought with risks 
     due to supportive legislative fear of losing the next election for their stance on Gay rights. I
     won't even visit the citizen referendums that went around the country in the 90's, which
     attempted to retract local and state laws that recognized Gay relationships.  Until just 
     recently, the military routinely undertook witch-hunts at their discretion, in an effort to boot
     homosexuals from the armed services even with the "don't ask, don't tell" policy in effect.
     Conveniently, some of that has been relaxed because more bodies are needed for the war 
     effort.  It is fortunate for all Gays and Lesbians who choose to serve their country with
     honor and dignity, do so regardless of the fact that their country abandons their rights 
     and personal dignities.

     Unfortunately for Gay and Lesbian Americans, it is not left to our discretion as to whether we 
     pay our taxes.  We work and fit seamlessly into society, yet we do not receive many of the 
     benefits due to our status, or lack thereof, as Gay and Lesbians.  We are diminished both in 
     personal relationships and financially.  In the workplace, we frequently cannot obtain health 
     benefits for our partners, and if we can it is a taxable benefit to the employee.  Yet there are
     people who say they shouldn't have to pay for Gays' benefits, yet we pay for theirs in
     innumerable ways.


2.  I know that this administration has not been an endorser of Gay relationships, but if we 
     remove the context of "Gay" and put surviving partner of a relationship as a party who
     had financial interdependence to the deceased, then I strongly argue that the government
     should include that partner (and children if this applies) in the victim compensation fund.  This
     is purely from a fair and equitable standpoint.  Since September 11th, President Bush has 
     delivered the message numerous times that we treat each other with dignity and respect in 
     America, regardless of our perceived differences.  This is his administration's stance, and 
     thus your opportunity to set an example for that message.

3.  It is easy to review through the eyes of history, how the rights of disenfranchised groups have
     been left to the discretion of a few individuals, sometimes with horrific consequences.  This is 
     a brilliant opportunity for you to use your discretion to help not just some of the people with
     personal relationships to the victims, but all of those who lost someone that they deeply loved 
     in these national tragedies.

benefits for Gay and Lesbian surviving partners


To the September 11 Fund,

I am writing to find out if gay and lesbians are to be denied 
benefits from the September 11 Fund -- if surviving partners and 
their children will be excluded from payments  made to the families 
of the victims of this tragedy.

I can only begin to imagine how complicated the process of disbursing 
payments might be, and I am hoping that the comments of  Kenneth 
Feinberg on NBC's "Meet the Press," March 10, 2002, were incorrect 
(see below for comments).  If changes to state law are being made to 
include illegal aliens (a step I find completely appropriate, and in 
line with the sentiments of unity that moved through us as a nation 
in the wake of September 11), then I am certain we possess the both 
the will and the ability to extend the help to all who need and 
deserve it.

My partner and I made a contribution to the September 11 Fund 
believing that all who needed help would receive it.

victim compensation

Dear Sirs:

Although I feel for the victims of the 9/11/01 tragedy, I do not think the US Government should be involved in any compensation for victims or relatives. This is an area best handled by agencies already in place for collecting and dispursing donations. Private insurance, pensions, gifts and monies confiscated from the accounts of those involved in the acts of terror or other criminal act should be utilized.

The problems of identifying those qualifyng for benefits, trying to determine the harm to those claimants and then having to determine the parity of the benefits is not anything the government should attempt. By no means should any payment to any representing attorney be considered.

If the decision is made to provide compensation, the funds available should be dispursed equally to those qualifying according to class of loss-i.e.,survivor with minor injury-survivor wth disabling injury- survivor with loss of limb- surviving spouse without children from a deceased victim -surviving spouse with children from a deceased vicitim-with no consideration to amounts of collateral compensation. The cost of dispursement in any other manner would soon be as much as the award.

If dispursed equally to all in a particular category, there should be no reason to appeal and therefore no right to appeal. This should not be or become an entitlement program.

I would also ask you to consider the precedent of any action. Will you now consider compensation to any victim or relative of any terrorist act, an act of war, civil unrest, etc. Let charitable organizations and private insurance handle this.

equal rights

I've recently heard of a woman who'se partner was killed in the 9.11 
terrorist acts being denied victim compensation.  This totally flys in the 
face of everything thing that is American, everything that is right.  You 
can not deny someone compensation because they don't fit into what you 
believe is "normal".  This is a manifestation of homophobia in its most 
insidious form.

I demand that you do what right and figure same sex couples into the money 
dispursement plan.

Compensate gay domestic partners of 9-11 victims

Please compensate the gay domestic partners of 9-11 victims in the same way
you?d compensate a grieving spouse.

The U.S. Department of Justice?s September 11 compensation fund is
compensating illegal aliens, who are breaking our federal laws, but not
compensating the domestic partners of gay 9-11 victims.  I have just spoken
with           
 at the DOJ, who confirmed this fact.  DOJ cites as their policy
justification that state laws don?t acknowledge domestic partners.  In fact,
this is homophobic logic.

Yes, most states don?t yet legalize the unions of gay partners.  That doesn?
t change the facts.  Americans use the freedom we have in the ?pursuit of
happiness? in many ways.  Many millions of Americans choose to commit
themselves to partners of their same gender.  Both           
 at the DOJ and myself
have such unions in our families.  Even Dick Cheney has such family members.
When you love someone, you can feel the love and humanity in their families.
You know that their loss upon a death is as deep as anyone?s loss at the
death of a spouse.

The September 11 fund is supposed to compensate people for their grief, not
cause grief.  The Department of Justice should stand for justice.  Here, the
justice should be for those who lost their life partners (in fact, not
according to changeable laws).  Without compensation for gay domestic
partners, the ?Department of Justice? stabs a knife into the already-open
emotional wound of their loss.

As a retired Port Authority of New York and New JerseyPolice Lieutenant, I 
lost many friends and acquaintances on September 11,2001.Â  Unfortunately, my 
brother-in-lawwas also one of those who suffered and died on that day.Â  In 
all, I lost over 40 people who Iknew.Â  I realize that you â?? above all 
â??understand the pain that we, as a family, have been through.Â  I write to you 
today hoping that you willrealize what OUR government is adding to that pain 
and suffering.
My brother-in-law,    , would havecelebrated his 36th 
birthday on September 22nd.Â  Unfortunately, that was not to be.Â  He was a 
director of the    for     located on the     
floor of the NorthTower.Â  No one knows how he died (or howlong he suffered) 
before the collapse, but we do know that he and hiscolleagues were alive 
after the initial impact and knew that there was no helpcoming for them.Â  We 
DO know that hewent to work that fateful Tuesday and did not return to his 
family.
    is married to     and has five smallchildren â??     9, 
    8,     6,     5 and     2.Â  He was also the most loving and 
generousfather to his children that I have ever met.Â On August 10th of 2001, 
he and     closed on a new home inRidgewood, NJ, moving from Stamford, 
Connecticut. Â     wanted to cut his commuting time, so that he could 
spendmore time with his family.
Recently, the US Government devised a formula to assist tohelp the families 
of September 11th.Â  Unfortunately, that formula may exclude     and her 
childrenfrom receiving any compensation for their loss.Â      was well 
compensated during his employment by    for his expertise and 
dedication. He also had the foresightto provide for his family through 
private insurance.Â  As a result of his love and devotion to his family, it 
nowappears that our government wants to penalize his heirs.Â  This is neither 
fair nor equitable.
There is absolutely no reason whysomeone whose sole ambition in life was to 
provide for his family should bepenalized under this plan.Â  Under thepresent 
government formula,     and her five children would not be eligiblefor 
compensation.Â  The only way to knowwould be to apply for the aid and then 
wait for a reply.Â  If the reply is negative, JUST FOR APPLYING,they have 
forfeited the right to sue.Â This is unjust.
 
With all the brilliant minds that we have elected torepresent us, someone 
should be able to come up with a better formula tocompensate the families.Â  
To penalizesomeone for earning over a set amount or to deduct insurance 
monies from asettlement is not a fair or equitable way to try and compensate 
a familyâ??sloss.Â  Based on    's earning potentialand his age ANY court in 
the land would hand over many times what thegovernment is offering.Â  Is it 
fair toforce the widow and five children of a victim to seek justice through 
the courtsystem?Â  Is it fair and just to offerthem nothing when others will 
receive compensation for their losses?Â  Is this the RIGHT thing to do to 
those whohave already suffered so much?Â  It wouldseem that the only thing 
this promotes is litigation.Â  The only ones who profit are the attorneys.Â  
And the only ones who will not be able toget on with their lives are the 
immediate families.
I know you are an extremely busy man with many pressing matterson a daily 
basis, especially now.Â  Ialso know that you are a kind and compassionate 
man.Â  I only hope that you see the inequities of the proposed systemand can 
convince others to change the present formula.
I pray for you and our elected officials and GOD BLESSAMERICA.

9/11 Compensation Comments

Dear Mr. Zwick:

I am writing to you with my comments regarding fair and equitable distribution of payments from the "September 11 Victim Compensation Fund."  
First, I would like to say that I applaud the government (both Executive and Adminstration)  for creating and passing the bill that allowed this fund to be created.  Secondly, that I appreciate the opportunity to be able to comment on the distribution of these funds.
Many people were grievously impacted by the 9/11 tragedy.  Families were torn asunder; 'breadwinners' lost; loved ones disappeared.  Assisting citizens in these circumstances is a trying task; doing it with compassion is a necessity. 
I would urge you to develop and publish guidelines to the appropriate governmental bodies that would allow husbands, wives and children to receive appropriate compensation - whether the individuals claiming benefit are, as most probably will be, legally married or not.  I would urge you to develop rules that encompass compassion to those who may have had long-term relationships, either as partners, spouses, children or parents who may or may not be married.  Loss is loss and it did not respect legal status, sexual orientation nor gender.  Everyone who counted on a person who was lost should be included in consideration for benefits.  Whatever test or 'bar' is developed should include those in legally recognized relationships, but should also include a 'test' for those in 'alternative' relationships - whether joint mortgages, other joint financial 'entanglements', civil union licenses or other objective 'proof' of mutual benefit and mutual care.
In this way, all of those impacted can have the opportunity to be 'cared for' and the government can demonstrate its responsibility to all citizens who were impacted by the heinous acts committed on September 11th.

Gay and Lesbian Partners

Dear Sir:

At this time of tragedy, it has been inspiring to see the outpouring of generosity and good will from the American people.  It is consistent with this spirit that I expect our government to compensate the partners of gay and lesbian victims of 9/11 equally.  As we learned from the heroism of       , one of the brave citizens that confronted the terrorists on the plane that crashed in Pennsylvania, gay men (and women) support and love this country as much as any other American.  In fact, it is despite the lack of equal treatment that gays and lesbians love and support their country.  Even        and his loved ones have been treated differently.  The President did not invite his partner to his address to the nation to sit next to the wives of the other men involved on his flight.  Most Americans do not know that one of the leaders in this effort was gay.

Please do not add to the injustice by ranking the partners of gay and lesbian victims of 9/11 below those of heterosexual partners.  I know that most Americans would support me on this.  Americans do believe in equal treatment of gays, lesbians, and transgendered persons.  Honor that belief in fairness and freedom.

The fact that the calculation only can reach a salary of $231,000 is unfair.  There are plenty of good, hard working citizens who earned a much higher salary who perished that day who should be compensated in an EQUAL fashion.  Two of these fine people happen to include my brothers who worked for            .  It was stated and re-stated by the special master at a meeting in NY that "there would be NO cap."   Treating everyone EQUALLY is the only fair way to go.  Why should my brothers be treated differently because they worked many years and were able to be compensated well for their efforts?  Fair and equal treatment for ALL.

Equal Access to benefits: The American Way, especially with
America under attack

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a diswasher in one of the restaraunts destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayers money went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian famillies are especially vulerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in a traumatic predicament of having to prove that their union is legitimate. Fortunaely, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should 
do the same.

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.
