Shame on Feinberg and the Bush Administration

To Whom It May Concern:

I am horrified and appalled at the treatment of the families of gay and
lesbian victims of the 9-11 attacks. For the administration to single out
gays and lesbians for this contemptuous treatment, especially while allowing
undocumented workers to claim benefits, is more than a slap in the face, it
is a wholesale dismissal of the humanity of these people, many of whom
emerged as heroes that horrible day. All Americans should be equal in the
way their government treats them, however this government believes the
rights of non-Americans are more pressing than the rights of its own
citizens.  This is obscene.

Shame on Mr. Feinberg! Shame on Mr. Bush! Shame on the rabidly homophobic
members of his administration who, behind the scenes, came up with this
heinous idea. You are playing politics with the lives of people who have had
such horror thrown at them. You disgust me.

May your imminent fall from power (you have already fallen from grace) be as
swift and spectacular as it is devastating. Rest assured that I will do
everything legally possibly to hasten this.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars
per year might receive thousands of times as much compensation as the survivors of a dishwasher in
one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent
worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It
would be a double blow to the survivors to first lose their loved one and then watch as most of the
taxpayer money went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

Are you kidding?


To Whom it May Concern

I have just read with horror the fact that one of the heroes of the 911 
tragedy is being grossly discriminated against.
I do not understand.  When I donated money to that fund I understood it would 
help ALL persons who were affected by the terrorist attacks of that date.
Now I am being told that           
, a person recognized as a hero from 
September 11, 2001 and forward, is now being denied rights and benefits to 
his family because he was GAY??????????
Oh yes, let's give the money to the illegal aliens.  They break US laws and 
laws of the states but they get money from the fund.  
But an American citizen who very possibly saved the lives of our lawmakers is 
DENIED benefits to his family because he was gay.   
Something is horribly warped here.  Something is very wrong.
          
was a hero.  I would like nothing more than for my grandchildren 
to grow up to be JUST LIKE HIM!  Gay or not, who cares????  
When people donated to the 9/11 Fund we were told it would assist ALL 
families of ALL victims.  Now you are telling us that it is not true.  You 
have LIED to the American people and taken money under false pretenses.  I 
believe you have committed a crime.

family are having a difficult time making ends meet as a result of this 
terrorist attack.  But he is my personal hero.  A young man who looks at 
those who died, and those who tried to save lives and he knows he can do 
nothing but serve.  I hope his infant son grows up to be just like him and

whose names escape me at the moment.  
I hope he does not grow up to be bigoted, homophobic and unAmerican as the 
persons who operate this fund.

To:  Victim's Compensation Twin Towers [Via FAX #301-519-5956]

You have asked for comments regarding victim's compensation as a result of the 9/11 
tragedy.

I can see no governmental justification for any other than token compensation for Twin
Tower victims.  I think it is admirable for employers to assume whatever obligation they 
feel toward their employees, but I see minimal obligation on the part of the government.  
I applaud the thousands of individual contributors to the victim's trust fund and feel the 
victims are entitled to every penny of this distributed equally to each victim.  In my
opinion, a dangerous precedent will be set if this legislation remains as is.  I say "will be
set" because I hope Congress will re-consider this legislation.  Among the alternatives
would be a cap of some figure, such as $100,000.

And worse still, it is insulting to subtract the life insurance that these prescient individuals
attempted to use to guard against untimely death.

What about other victims of tragedies past and tragedies yet to come?  Are we going to 
do this every time a terrorist act occurs?  We haven't in the past, at least not to this extent.
We'll bankrupt ourselves.

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, 
including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars
per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the
restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all
those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double
blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to
those
who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of
marriage is unavailable, these families may find themselves in the traumatic predicament of having to
prove
that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already 
announced that they will not discriminate against gay and lesbian families. The Department of Justice
should
do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important 
issues.

Interin Final Rule

Just some comments ...

Life Insurance:  Yes, it should be deducted as a "other source compensation".  However, it probably wouldn't hurt to reduce the life insurance compensation by any premiums directly paid by the deceased.

Overriding wishes of the deceased:  As far as the Special Master not agreeing with how the personal representative intends to distribute the compensation, I don't think you should get involved.  As long as the PR is acting according to the will, if any, and the laws of the state in question, the Special Master should not be make this type of value judgment against the express wishes of the deceased.  The 'true' victim is the deceased.  The 'survivors-of-a-victim' are only secondary.  Any overriding of the wishes of the deceased should only be done in a case of unquestionable NEED (poverty-level type 'need', not Wall Street hot shot type 'want'), not just GREED.  State laws (at least my state) have built in provisions for elective-share for a spouse who is really getting screwed, so let that be invoked.  You should follow the determination of the state if at all possible.  There may be very good underlying reasons for provisions of the will which the PR nor you have any notion of.

Economic Compensation:  I really don't understand why these 'survivors-of-victims' will receive, in effect, a life time of handouts when our federal law has explicitly stated that welfare has a 5-year lifetime eligibility limit.  Why isn't there a 5-year limit on this 'welfare' program too?

401ks/IRAs/etc:  The 'other source compensation' value of these sources needs to be evaluated intelligently, taking into account economic conditions and the eventual recipient of such benefits.  For example, a spouse may be entitled to wait up to 5 years before having to take over a 401k, but if it goes to a non-spouse there may be a 60-90 day time frame.  This can GREATLY impact the ultimate value of what is received.  Make sure a Sept. 21, 2001 document is presented as the supposed 'current' value!  Also, given the variations in when investments may have to be 'cashed in', you should probably consider the types of investments, their current value, their expected future value (relative to 'cash in' time frames).  It is a tricky situation, but even I am able to figure out how best to play this one - get the government to reimburse any losses realized over the last couple years while protecting my ability to make up that loss again by holding off for a while.  This fund shouldn't be providing 'free capital' for 'speculators'.

Question for the Future:  Insurance companies 'rose to the occasion' this time around and agreed not to invoke war/terrorism clauses as far as making good on individual coverage for property and medical.  However, as they have stated, there is no guarantee that they will do it next time.  Given that the initial victim estimates were grossly overstated (at least double of reality), as opposed to 'upping' the amount available to the smaller number of claimants (as potential recipients have suggested you do), I suggest you set aside the 'unneeded' funds for future use in 'making good' on individual insurance claims related to future terrorist actions that may be denied next time around.

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund." 
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.  Who is to judge

Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars
per year might receive thousands of times as much compensation as the survivors of a dishwasher in
one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent
worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It
would be a double blow to the survivors to first lose their loved one and then watch as most of the
taxpayer money went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

Protect Traditional Marriage

Dear Mr. Zwick:

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation.
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died.
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have?Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution." 
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place. 

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.

very important issues.

Comments to September 11th Victim's Compensation Fund

We feel it imperative to voice our opinion regarding the September 11th 
Victim's Compensation Fund.  As the criteria for the fund has been published, 
it has shocked us that it resembles nothing as the impression given when the 
Program was in its planning stage.

Our concerns are as follows:

1. The earnings are based on the years 2000, 1999 and 1998.  In our 
particular case, our brother/son had substantial earnings in the year 2001.  
His income jumped from 50,000+/- in 2000 to over $275,000 as of September 11, 
2001.  2001 was the year in which he began to achieve his success.  Now, he 
is being penalized for that.  
2. A "cap" has been placed on the salaries of $250,000.  How can you have a 
cap of that value when you are dealing with individuals who worked in the 
financial capital of the "world"?  The elite of the elite in the financial 
industry.  Their earnings far surpass yearly incomes of $250,000.  And how is 
the earning potential factored into the equation?  
3. The pain and suffering award of $250,000 is UNCONCIONABLE!  In this 
country, there are lawsuits that surpass that figure by the tens for slipping 
on ice in a parking lot.  According to reports, an average for pain and 
suffering pay out for an airline lawsuit is approximately 2.5 million 
dollars.  Why are our loved ones being penalized so drastically for such a 
horrific death in a terrorist attack?  Nothing about that figure indicates a 
fair settlement in any form.  It is a disgrace to award such a dollar amount 
for such a horrific terrorist attack on the most innocent working 
individuals.  I think it is safe to say that their civil rights have been 
violated in the most brutal of forms.  First, their right to live brutally 
taken from them; and second, their right to be protected by their government, 
which as we have seen over the past years has fallen grossly short.  And now, 
their pain and death is humiliated by such an award.  There is no other word 
to describe that award then "outrage".   

We are once again made to suffer, by the hands of our own government now.  It 
further deepens the wounds in our hearts (that we fear will never heal) 
created by the events of September 11th, that we live with every day since 
then and will continue to for the rest of our lives, that our government 
finds this award to be reasonable and just.  Our loved ones were sacrificed 
in the most brutal way, simply for being successful, working in the "symbol" 
of American greatness and striving for all that America stands for.  Their 
sacrifice is so brutal that even our government, over the past years, pushed 
aside all warnings thinking it could never happen; 

However, we will remain hopeful that our government will see the 
misappropriation of this fund and come to the proper aid of the victims' 
families in a true effort to attempt to try and make whole what was so 
horrifically taken from us and our Country.

Dear Mr. Zwick,

I am writing in response to the Department's request for public comments 
regarding the forthcoming regulations for implementing and administering the

"September 11 Victim Compensation Fund." I strongly urge the Department to 
draft regulations that ensure compensation is available to all victims of 
the attack, including the committed partners and the non-biological children

of gay and lesbian victims. The Red Cross has worked closely with groups in 
New York City and have implemented a similar policy in compensating gay and
lesbians and their families.

It is unquestionable that the devastating grief and economic losses suffered

by the families of gay and lesbian victims are no less than that of other 
families. Just as the terrorists drew no lines in choosing their victims, 
our country must draw no lines in compensating those who suffered the most 
personal of losses from these attacks.

Many Americans lost their lives on September 11, each of whom left behind, 
loved ones. I urge the Department to honor these bonds by treating the 
families of gay and lesbian victims as you would any other.
