Families of gays and lesbians who were slaughtered in the 9/11 attacks must be compensated not on the basis of state laws, which are largely irresponsible to their gay and lesbian constituents, but on the basis of equality and integrity at the federal level. Thank you for your fairness,

comments re victim compensation guidelines

Mr. Kenneth L. Zwick, Director
Office of Management Programs
Civil Division
U.S. Department of Justice

Dear Mr. Zwick:

I am writing in response to the Department's request for public comments
regarding the forthcoming regulations for implementing and administering the
"September 11 Victim Compensation Fund."

I worked in the World Trade Center for 16 years. I lost a dear friend and
many colleagues in the September 11 attack. My friend, and many others who
were lost that day, could have easily escaped the towers, but instead risked
and lost their lives because they chose to help others get out alive. They
didn't wear uniforms, but they were every bit as courageous and selfless as
those who did, and I know they helped save hundreds of people who would
otherwise have been trapped inside the collapsing towers.

As I read their biographies in the newspapers every day, I realize that many
of these heroes who had families and children dependent upon them, were not
legally married. I am particularly concerned about the welfare of the life
partners and the non-biological children of gay and lesbian victims. I
implore you and the Justice Department to draft regulations that ensure that
compensation is available to these victims' families, as it will be to all
the other victims of the attack.

One of the qualities that distinguishes us from our fundamentalist attackers
is our enlightened tolerance for the diversity that flourishes in our great
cities, and throughout our country. The devastating grief and economic losses
suffered by the families of gay and lesbian victims is surely no less than
that of other families. As the terrorists drew no lines in choosing their
victims, our country must draw no lines in compensating those who suffered
the most personal of losses from these horrific attacks.

This country has come together as never before to help support the victims of
terror and the loved ones of those who lost their lives on September 11th.
In the spirit of national unity, the Justice Department would honor these
bonds of love by treating the families of gay and lesbian victims as it does
any other.

Sincerely,

Individual Comment
Brooklyn, NY

Re: Survivors of victims of 9/11

    Dear Sir,

Excluding the families of victims of 9/11 who happen to be Gay/Lesbian is cruel. Please find a way to fix this - I am certain there is something you could do. Loss is
    loss - compassion is compassion.

Help ALL The Victims Of Sept. 11

Attachment 1:

Dear Mr. Zwick:
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you would any other.
Sincerely,
Individual Comment

December 19, 2001

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.

As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Sincerely,

Individual Comment

Special Master Kenneth R. Feinberg
September 11th Victim Compensation Fund
U.S. Department of Justice
950 Pennsylvania Avenue NW
Washington, DC 20530

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th,
including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in
one of the
restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth
of all
those killed, so that a high minimum compensation level is set to lessen the disparities. It would
be a double
blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those
who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because
the option of
marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove
that their union is legitimate. Fortunately both the Red Cross and the State of New York have
already
announced that they will not discriminate against gay and lesbian families. The Department of
Justice should
do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these
very important
issues.

Sincerely,

Individual Comment

Help same sex partners of terrorist victims

Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11 terrorist
attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex
unions. They suffer just as grievously for their deceased loved ones as do
other survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups and
individuals who would have the Department of Justice limit compensation to
survivors of heterosexual unions. They are interested in a political
victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political statement,
Mr. Zwick.

Sincerely,

Individual Comment
Satsuma, FL

Victim Compensation for 9-11-01

Dear Mr.

I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Sincerely,

Individual Comment
Hampton, VA

Comments on Regulations to Implement the
               Victim Compensation Fund Legislation

Dear Mr. Zwick:

Enclosed is a hard copy of an e-mail comment that I submitted. My e-mail server stated that this e-mail was undeliverable to victimcomp.comments@usdoj.gov

Since my e-mail was undeliverable, please accept this mail comment.

The following comments are submitted pursuant to the Notice of Inquiry and Advance Notice of
Rulemaking with respect to regulations implementing Public Law 107-42 establishing the
September 11th Victim Compensation Fund of 20001.

INTRODUCTION

The basic thrust of my comments are to call attention to work of the Presidential
Commission on Catastrophic Nuclear Accidents, , and to
its Report to Congress, volumes 1 and 2, dated August, 1990.

While this report submitted pursuant to the 1988 amendments of the Price-Anderson Act,
(Public Law 100-408) was a comprehensive study of the appropriate means of fully
compensating victims of catastrophic nuclear accidents (greater, than approximately $7.3
billion) many of the issues addressed in the rulemaking to implement the September 11th Fund
were considered in detail in this report from both a legal and public policy aspect. Specifically, with respect to one of the most important issues, the Presidential Commission considered the degree to which payments from collateral sources should be used to offset recovery through a judicial process containing administrative features designed to speed the resolution of cases. The administrative process set forth in the September 11th Fund legislation follows very closely the system set forth in the Presidential Commission report.

COLLATERAL SOURCES

On pages 93 to 95 of its August, 1990 report the Presidential Commission on Catastrophic
Nuclear Accidents recommends that payments from collateral sources should not be used to
offset recovery except when a claimant has demanded plenary adjudication (i.e. trial rather
than than the proposed administrative claim resolution process). Further, the Presidential
Commission recommended that in no case should proceeds from life insurance policies be used
to offset recovery.

I recognize that the September 11th Fund Legislation in Section 405 (b)(6) provides that the
Special Master shall reduce the amount of compensation...by the amount of collateral source
compensation the claimant has received or is entitled to receive as a result of the terrorist attacks. While the definition of collateral source means all collateral sources including life insurance, pension funds, death benefit programs and payments by Federal, State or local governments, an open question is whether collateral source compensation includes receipts from charitable donations. In this regard, the consideration of the pros and cons of subtraction of collateral sources in general discussed by the Presidential Commission on pages 93 to 95 of its report, are germane.

The Presidential Commission noted that the collateral source rule usually bars a defendant from introducing evidence that a claimant had received compensation from collateral sources such as insurers or governmental benefit programs. The rationale seemed to be that the defendant (called the tortfeasor in the report) should be required to pay the full extent of the damages his conduct had caused, and should not benefit through a reduced award as a result of any compensatory payments received by the plaintiff from third parties. The Presidential Commission noted that "although double recovery arguably produces a windfall for the plaintiff, the rule reflects the value judgement that it is preferable to overcompensate a victim than to inadequately penalize a wrongdoer."

The Presidential Commission noted that with tort reform, the collateral source rule has
increasingly been subject to debate. At the time of the 1990 report it was noted that 25 states and two federal statutes had restricted or abolished the application of the rule. The
Presidential Commission felt that the collateral source rule should have little force under the special scheme of the Price-Anderson Act because compensation, rather than deterrence, is the principal goal of the Act. Further, the retributive function of the collateral source rule is also not relevant in the Price-Anderson context because losses are borne by the entire nuclear industry and its ratepayers rather by the tortfeasor.

Nevertheless, reducing awards by the full amount of collateral recovery was veiled by the
Presidential Commission as possibly raising substantial considerations of fairness. Where
collateral protection has been obtained through the payment of premiums for insurance, for
example, reducing awards by the full collateral recovery would result in net economic loss to the claimants.

While the Presidential Commission did not consider charitable contributions in its analysis (a non-issue with respect to nuclear accidents) the fairness argument would seem to apply to
charitable gifts. The charitable contributions whether made by individuals and organizations
irrespective of what other compensation, were made by individuals and organizations
through lawsuit, the plaintiff might receive. An after-the-fact use of these funds to reduce
taxpayer burden was probably not one that was contemplated by the charity contributers and
in at least with respect to this collateral source, the possible "evils" of so-called
overcompensation (if such a concept could even exist in the case of these horrendous deaths)
must yield to basic fairness for the plaintiffs.

OMBUDSMAN

While not considered in the Presidential Commission report, the regulations under the
September 11th Fund legislation should acknowledge that the use of the fund will entail
questions of sensitivity and tact that may be overlooked in the legally-driven compensation
scheme with a 120 day deadline for awards. For this reason I recommend that the rules
establish at the ouset an Office of Ombudsman, not as another source of special pleading, but as an assistant to claimants and others through the bureaurocratic maze.

PART-TIME AND VOLUNTEER ASSISTANCE

These are new and untried approaches both for the plaintiffs and judicial and executive
governmental bodies involved. The special master and others involved in carrying out the
provisions of the statute should look to experienced persons such as myself who have been
involved in consideration of the pertinent issues in these and other compensation schemes to
assist on a part-tome compensated or volunteer basis.

Special Master Kenneth R. Feinberg
September 11th Victim Compensation Fund
U.S. Department of Justice
950 Pennsylvania Avenue NW
Washington, DC 20530

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families. Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

Sincerely,

Individual Comment
Mill Valley, CA

gay-amercians

to whom it may concern...
i just wanted to voice my opion about the matter of our gay-amercians. they
deserve the same repect as others. we as amercians are made up of all
people. sept. 11 was a very sad day for us all. but when people came to help
someone did not stand there with a check list of who is gay and who isnt. it
doesnt matter what one may belive in, thats why our nation is know as being
free. we as people choose our way of live but when it comes to choose
weither or not to save a live there isnt a question, you are a hero. those
people who help save people on that day or who lost their life that day in
the process are heros. they deserve the same treatment as any other.
thanks-

Sept 11 Victim Compensation Fund - respect gay rights

Kenneth L. Zwick, Director
Office of Management Programs, Civil Division
U.S. Department of Justice
Washington, D.C.

Dear Mr. Kenneth Zwick:

I am writing in response to the Department's request for public comments
regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."

Mr. Zwick, Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Sincerely,
Individual Comment
Syracuse, New York

I favor a cap of, perhaps, $100,000 on charitable contributions that
will not be considered collateral sources. Clearly, reasonable
charitable contributions were never intended by the donors to offset
government expenditures. To rule them so would create a severe
disincentive to charitable giving. That would not be in the public
interest.

Protect Traditional Marriage

Mr.
Kenneth Zwick
Office
of Management Programs
Department
of Justice
Washington,
DC
Dear
Mr. Zwick:

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation.
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died.
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have? Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution."
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

September 11 Victim Compensation Fund

Kenneth L. Zwick, Director
Office of Management Programs, Civil Division
U.S. Department of Justice

Dear Mr.

I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Sincerely,
Individual Comment

Special Master Kenneth R. Feinberg
September 11th Victim Compensation Fund
U.S. Department of Justice

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to
the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the
disparities. It would be a double blow to the survivors to first lose their loved one and then watch as
most of the taxpayer money went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian
relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the traumatic
predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the
State of New York have already announced that they will not discriminate against gay and lesbian
families. The Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these
very important issues.

Sincerely,
Individual Comment

compensation

Mr. Zwick,

After reading all of the materials regarding the compensation
to
families of the victims of the WTC attack, including the Air
Transportation
Safety and System Stabilization Act, I find the Dept. of Justice?s
interim final
regulations highly inadequate, and showing practically nothing of the
intent
that Congress had laid out. I feel that the method of consideration
does not adequately propose compensation that is just for the horrible
way in which those who lost their lives.

My brother, &nbsp&nbsp&nbsp&nbsp , was a victim of the attack and
losing him
has left a hole in this family that really can?t be replaced. And
although he
didn?t leave any economic dependents, because he was single with no
children, the emotional and mental anguish left us, his siblings and
father,
was devastating. And with these interim regulations others, especially
those
widows with children, are left high and dry by the DOJ because of their
under valuation of economic and non economic rewards. Others in
comparable cases have received so much more. If this government can find

15 billion dollars to bail out the airlines, surely they can find enough
to justly
compensate the families of that horrific day.

Please, we implore the DOJ to do what is right and fair
concerning
this. Don?t let this drag out into long and arduous court battles that
would put
these families through so much more anguish. Let the intent of Congress
come to fruition for the families of the victims, who are all American
heroes.

Special Master Kenneth R. Feinberg
September 11th Victim Compensation Fund
U.S. Department of Justice
950 Pennsylvania Avenue, NW
Washington, DC 20530

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these
very important issues.

Sincerely,

Individual Comment
Toms River, NJ
