Inclusion of Alternative Families

Dear Mr. Kenneth Zwick,  

First, thank you for taking the time to invite and consider comments from the public on this issue. The events of Sept 11th will continue to pull at the hearts and consciences of millions of people in many different ways in the weeks and months ahead. As you ponder the administration of the compensation fund, I urge you to consider the feelings and needs of the family members of same sex partners who lost loved ones in this tragedy.  

While our nations laws offers no, or very limited resources and rights to this group of people, legally or financially, many do chose to establish families and households. These family units support, share, and sacrifice on all the same levels as those of heterosexuals, and on many other level as a result of prejudice and lack of legal support. The loss of a loved partner or parent is felt the same way emotionally whether they are homosexual or heterosexual. Financially the ramifications are often more severe for a homosexual family and providing equal support from this fund for surviving partners and children of all same sex relationships is simply the right thing to do.  

Whatever your personal feelings regarding same sex relationships, I merely ask you to believe that  some feelings show no discrimination....such as love.

Dear Mr. Kenneth Zwick,

   My name is          , and I am not a 
lesbian,homosexual,transgendered, or bisexual.  I am a straight, white, 
middle class college student from Lincoln Nebraska.  I received an e-mail 
stating the importance of contacting you so that partners are included in 
the money to be given to families and children who lost those close to them 
on the tragic day of September 11.  During this time of terrorism and 
tragedy,I believe it is time for the U.S. government to take a stand, and 
truley stand united with all of the citizens of the U.S.A.  What better way 
than to include those citizens who are not included in society's views as 
"family" because they are homosexual.  Just because people are attracted to 
members of the same sex does not make them inhuman.  They still lost those 
they loved and their pain is just as important to try to ease as a straight 
couple.  I don't know if this e-mail will make a difference, but I thought 
that I might as well try.  One more thing.. as we as a nation are trying to 
stamp out terrorism, why not look at the terrorism that strikes gays, 
lesbians, transgenders, and bisexuals everyday of their own lives.  There 
are many terrorists in the USA that cause fear in many people close to me, 
through hate crimes, discrimination and prejudice.  Thank you for your time.

Dear Kenneth L. Zwick and Kenneth Feinberg,

I know you have disqualified many of the same-sex partners of the victims of September 11 from receiving any benefits that spouses, children, even fetuses and undocumented workers 
well get.  Please seriously reconsider that policy you have declared.

It is hard enough that gays and lesbians are already denied rights such as marriage and adoption of children in many of our states.  In this particular case, individuals have lost life long committed partners.  Even though many of these  partnerships aren't recognized by society, they are many times equivalent if not better than the traditional "marriage".  A loss of a spouse/loved one is difficult enough.  Denying these people what they deserve is an even greater blow.  I realize you will take the cases on a state's law regarding this matter.  However, I request that you go beyond that.

The fund is money that comes from U.S. Citizens who are both gay and straight.  Therefore, all victims and the ones they have left behind are entitled.  You have even granted this privilege to those unborn and illegal to this country! Please look at this on a case by case basis.  Heroes such as              and              should not be forgotten. One possible solution is that your committee should look at the nature of the relationship: years living together, any property owned together and any children adopted by these individuals. They too, have to pick up their lives and continue to move on without the person they expected to live with for the rest of their lives.  They must also now continue without, in some cases, the additional income to provide for housing and raise children, I implore you to reconsider your decision regarding compensation for surviving partners of the gay and lesbian victims of September 11, 2001.

Victims rights

Dear Sir: I am writing to urge fairness in determining the criteria of who 
should be eligible for financial support following the 9/11 tragedy.  I hear 
Mr. Zwick sidestepping questions about partner benefits and I am concerned 
that the children of gay/lesbian partners will also be left without adequate 
support.  I strongly urge a firm stance to support gay/lesbian partners and 
their children.  These Americans deserve the same support as married couples 
and their children.  To ignore their rights and needs would be an ironic 
victory of Osama Bin Laden and those who hate America.  Don't we have more 
compassion and fairness? I will be curious to see where this Administration 
stands in support of ALL victims.  Thank you.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

gay and lesbian partners of victims of 9/11

I find it very disturbing that illegal aliens and
fetuses can share in the benefits of the 9-11 fund
while gay and lesbian partners may not be able to.

This is not a time in our country's history to find
ways to divide us.

If there were a way for gays and lesbians to marry,
they would have. First they die, and now their
memories are being tarnished by good old American
cowards.

Dear Mr. Zwick,

Through a recent email, I have been notified that the proposed September 11 Victim Compensation Fund is being written in such a way that would exclude the families of gay and lesbian victims from being compensated.  I strongly encourage that the department revise the regulations in order to include these families.  To exclude them would be an injustice and a violation of these citizens' civil liberties.

In a country whose leaders preach a decree of equal rights for all citizens, it should only be expected that citizens are treated in that same manner.  The partners and non-biological children of the victims of the September 11 attacks feel no less pain or suffering because they were not part of a "normal" family.  The gay and lesbian victims of the attack deserve the same respect as do the straight victims, and thus their loved ones should be compensated accordingly.  Thank you for your time.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

important issues.

Discrimination against gay Americans

Dear 9/11 fund:

I believe it is outrageous for the 9/11 fund to exclude gay partners from receiving benefits related to this disaster.  The fund's administrators have agreed to provide benefits for fetuses, illegal aliens, and others who might not ordinarily be considered.  Why then are gays being excluded from this outpouring of American fealty and generosity?  Did &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp , &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp , and &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp sacrifice their lives, only to be rewarded with such small-minded hatred?  The terrorists who attacked the United States of America on September 11 were not only attempting to destroy our property and murder our citizens, but also to sew fear, hatred, and mistrust among us.  We must not allow them to succeed.  

I respectfully urge the fund's administrators to reconsider this action.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving
families of the tragedy on September 11th, including the children and families
of low-wage workers and gay and lesbian families.
Under traditional rules based on lost wages, the survivors of a bond
trader earning millions of dollars per year might receive thousands of
times as much compensation as the survivors of a dishwasher in one of the
restaurants destroyed. Justice requires looking far beyond the last paycheck
to the inherent worth of all those killed, so that a high minimum compensation
level is set to lessen the disparities. It would be a double blow to the
survivors to first lose their loved one and then watch as most of the taxpayer
money went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of
gay and lesbian relationships and families. Gay and lesbian families are
especially vulnerable when one partner is killed. Because the option of
marriage is unavailable, these families may find themselves in the traumatic
predicament of having to prove that their union is legitimate. Fortunately,
both the Red Cross and the State of New York have already announced that
they will not discriminate against gay and lesbian families. The Department
of Justice should do the same.

Dear Mr. Kenneth L. Zwick

The following are my objections to the Victims' Compensation Fund: The airline bailout act gave
the airlines $15 billion of taxpayers' money and capped the airlines'
liabili-
ty for the 9/11 crashes at the limits of their insurance coverage.  It set up the Fund so the airlines'
bailout
would not come at the expense of the victims' families.     
DOJ has ignored the fundamental mandate of the act to provide full and fair compensation to
victims
and their families, and instead created a formulaic federal program based on irrelevant concepts
more
familiar
to the bureaucracy.
.    The DOJ's proposed awards for non-economic damages ($250,000 per victims plus $50,000
for a
spouse and each dependent) are only-tenth the level pain in comparable cases.  For example, a
spouse
was
awarded $5 million in non-economic damages in a lawsuit arising out of Lockerbie.
.    Congress explicitly enumerated a broad range of non-economic damages for which victims
and
their
families shall be compensated.
.    DOJ ignored this, and based its presumed awards on a military group life insurance program
(SGLI)
with a maximum policy of $250,000, and federal statute providing $250,000 to families of fallen
public
safe-
ty officers-on top of other amounts they may receive.
.    DOJ's approach assumes that Congress intended the non-economic damages to be illusory,
because a
$250,000 SGLI payment for a serviceman killed at the Pentagon would wipe out those damages
under
the col-
lateral offset requirement.
.    DOJ's proposed awards for economic damages grossly underestimate actual losses, because
DOJ relied
on outdated, inapplicable work-life and life-cycle earnings data. Forensic economists have
discovered
other
serious flaws in DOJ's methodology.
.    DOJ underestimates promotions and other increases in earnings for victims.  It relied on
federal
civil
service and military retirement system boards that track federal worker incomes and pension
requirements, not
the higher-paying private sector career paths.
.    DOJ's reliance on past 3 years of income (which the Special Master "may average") looks
suspiciously
like a federal pension approach, rather than considering the likely income-earning potential of the
decedent, as
is routinely done in wrongful death cases.
.    The regulations arbitrarily cap a victim's income at $225,000 a year, cutting some families'
compensa-
tion by over 50%.  As a result, many widows will have to sell their homes, deplete their
children's
college
funds, and give up their plans of being full-time parents while their children are young.
.    A family's award may be increased above the "presumptive" award only by a showing of
"extraordi-
nary circumstances" - beyond those suffered by other victims or victims' families.  This makes
the
hearing or
appeal to the Special Master a mere charade.
.    The low levels of the presumptive awards will result in many family members receiving little
or
noth-
ing from the Fund, once the collateral source deductions (which are not required in a court case)
are
made.
.    DOJ should fulfill, rather than flout, the act's intent by revising its rules to compensate victims
and
their families for the types of damages specified by Congress, at levels comparable to those
provided in
the
tort system the Fund was designed to replace.

Sir,

It is with great compassion that I urge your department not to forget all the victims survivors of the September 11th tragedy. It is what the United States is all about, regardless of race, creed, age, sexual orientation. America stands  and is the benevolent care taker and defender of peoples right. Even though we may not always understand the life-path some people pursue. WE Americans do believe in law abiding life style and concept the differences in Americans life style, always think of ourselves as all being Americans..

The children of gay and lesbians people are no less citizens and are in need of financial compensations that the funds can provide. Show your true American spirit by not forgetting these youngsters.

income disparity in compensation

To Whom It May Concern:

I implore you to ensure that all who lost loved ones in the World Trade 
Center, Pentagon, and Pennsylvania be entitled to at least a generous minimum 
compensation level. Under traditional rules, the survivors of a bond trader 
earning millions of dollars per year might receive thousands of times as much 
compensation as the survivors of a dishwasher in one of the restaurants 
destroyed. I believe that justice requires looking far beyond the last 
paycheck to the inherent worth of all those killed, so that a high minimum 
compensation level is set to lessen the disparities. It would be a double 
blow to the survivors to first lose their loved one and then watch as most of 
the taxpayer money went to those who were already well off in the first 
place.

Folks with high level professional jobs most likely were well-insured and 
left their family members with greater resources to fall back upon. Please 
make every effort to ease the pain and hardship of working class families who 
lost their breadwinners. Special consideration also should be given to the 
immigrant parents who worked multiple jobs to create opportunities for their 
children, then young professionals at the WTC. I've heard heartbreaking 
stories of parents in Chinatown whose worlds were shattered after devoting 
their whole lives to ensuring that their children were better off 
financially. Don't let their struggle be forgotten as you allocate relief 
dollars to all the survivors.

I just wnated to write because I heard that gay/lesbian partners that passed away in the 9/11 tragedy, arent going to recieve the benefits of straight partners.  And I think this is extremely tacky.  A persons sexual preferance should not be the determining factor on what they should recieve.  If everyone else is being compensated the same way, then gays and lesbians should not be singled out.  We are supposed to support each otehr during this difficult time, not single them out just because they are not like every one else. If you treat gays and lesbians differently then others, then you havent learned anything about being an American during this tragedy. And I think it is unfair that we are being treated this way.
