Please Support Equal Access to Crisis Relief Benefits

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Dear Mr. Zwick:



Although recent news articles indicate that many people are not familiar 
with the proposed rules of the fund and are therefore criticizing the 
"greed' of the victims' families, I want to say that I have read the 
proposal in detail and I believe it is MORE than fair.  In fact, I am 
appalled that these families may even receive that much of my tax dollars.


What has come of our society, that people believe they must be ?compensated? 
for the loss of a loved one?  Certainly there should be some way to help 
those who lose the means to earn a living, but to the tune of hundreds of 
thousand to millions in tax-free dollars?


Social Security includes a provision to help a person if they become total 
disabled and unable to work ? losing their source of income. It only 
provides benefits of less than $20,000 a year in most cases.  Most of these 
beneficiaries lost their ability to earn through no fault of their own ? why 
are terrorist victims valued so much more?


I understand the purpose of the fund is to head off lawsuits that could be 
even more damaging to the economy, and the right to sue for ?compensation? 
is another issue as well.  For now, I hope the government will stand firm in 
this plan, reduce any awards as indicated to account for life insurance, 
etc., and even consider lowering the amount to be paid as a whole.

fair compensation for ALL victim's families

Dear Mr. Zwick:

I am writing in response to the Department's request for public

comments regarding the forthcoming regulations for implementing

and administering the "September 11 Victim Compensation Fund." 

I strongly urge the Department to draft regulations that ensure

compensation is available to all victims of the attack,

including the committed partners and the non-biological children

of gay and lesbian victims.

It is unquestionable that the devastating grief and economic

losses suffered by the families of gay and lesbian victims are

no less than that of other families. Just as the terrorists

drew no lines in choosing their victims, our country must draw

no lines in compensating those who suffered the most personal of

losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom

left behind loved ones. I urge the Department to honor these

bonds by treating the families of gay and lesbian victims as you

would any other.

FW: loss tables

I have just reviewed the tables and am both dissapointed and furious over
the way the figures are shown for a single person. At a meeting I
attended monday night the special master led us to believe that a
reasonable amount of economic loss plus a 250,000 amount for non economic
loss would be considered.
 My son was 38 and earning approximately 30,000. Assuming he worked until
age 62 he would have earned approximately 720,000 before any earnings
adjustment for increases etc.
Based on the table figures, including 250,000 non economic loss we would
get approximately 411,000 before any collateral offset. That would make
his earnings loss worth 161,000 for 24 years-6,500 per year. That seems
to be totally absured and unfair. How can the actual loss of earnings
before any upward adjustments go from 720,000 to 161,000.
In addition if he had one dependent child his award would be 594,000
instead of 411000. The difference should only be the non economic amount
of 50, 000. If he did not have a child he is being penalized on his
economic earnings.

This award amount is totally inadequate and unfair.
In our time of grief when the government is supposed to be helping us
reach a quick settlement they are doing nothing but creating more grief
for us.

Battery Park City, New York

I am concerned about he people who live (or lived) in Battery Park City. I 
don't understand how they could not be classified as "Victims" of the 
terrorist attack.  They certainly are victims and must be classified as 
such.  They were victimized on September 11th, they are our neighbors and 
they need our help.

My best friend was in her apartment only 1 block away when the first plane 
hit.  She was there when the 2nd plane hit. She was there when the towers 
fell.  Her elderly parents were visiting her - so they were there 
also.  THEY WERE IN THEIR APARTMENT ALL DAY AND ALL NIGHT - watching the 
buildings around them burning.  They were evacuated on September 12th.  She 
now has a choice:  (1) return to live in her contaminated apartment and 
hire an environmental expert to decontaminate the salvageable items and 
breathe in contaminated air every day and every night or (2) move to 
another apartment and still hire an environmental expert to decontaminate 
her salvageable items.  Under either option - she will receive NO 
ASSISTANCE FROM THE FUND ESTABLISHED FOR THE VICTIMS.

Some of her neighbors aren't as fortunate as my friend - they don't have 
the money or the financial credit to move.  There are young children and 
elderly retired folks breathing in contaminated air on a daily and nightly 
basis.  They breathe in smoke mingled with contaminated tiny air particles 
made up of dead bodies, office furniture, paper, walls, floors, carpet, 
airplane debris . . .

This is an outrage.  Our government, WE THE PEOPLE, should be helping the 
residents of Battery Park City.  I urge the USDOJ to amend the definition 
of "victim" to include the people of Battery Park City.  The September 11th 
fund was established to help these people - let's help them.

9/11 Victim compensation plan

While no amount of money will replace a loved one, I am totally appalled
that the families of the individuals that died are becoming millionaires
while charities throughout the country are having difficulty meeting the
needs of their constituents.  Americans, by their very nature, have always
been the first to respond in times of tragedy and need.   Everyone was
devastated by the terrorist attack... we're ALL victims.....does that
qualify us for financial assistance as well?

I can not believe that the individuals who responded to the pleas of the
tragedy intended that the "victims"relief fund would generate income making
the survivors rich!  And the inequities of the pipeline......firemen are
worth more than Port Authority security officers....waiter's wives' want
more than $2.8 million dollars!!!  How much is a life worth?...Or have we
decided that priceless, does indeed have a price?

And the audacity of the fact  that this fund is perpetual.  Please!  Not
even life insurance policies guarantee income for life.  What about the
funds that the families have received from the Fireman's fund, the Red
Cross and United Way, as well as, all of the other "charities" established
to help these "victims"?   Shouldn't the distribution of these funds
included in the government handout instead of an addition to it?

Don't get me wrong.....I think that we should come to the aid of others -
not only during times of major tragedy, but whenever there is a need.  But
it's criminal that these victims' receive allocations that far exceed
anyone's actual expectations.  I don't know many individuals under the age
of 30 that earn a 6.6% annual pay increase...nor anyone under the age of 50
that get  5.1% annual increases.

Something is wrong here,  when the American taxpayer is required to pay his
hard earned money to make millionaires out of a national tragedy.  People
get killed all of the time....it's always tragic to those involved.  How
are we going to compensate them?

I think that in its' haste to be generous (and to avoid law suits),  the
government overstepped its' responsibility to ALL Americans.   This issue
should be readdressed before final action is taken.

response to money given to victims families

i do not understand why the government is giving the families compensations 
for love one's deaths.  i am not a heartless person, but why do these 
families deserve government compensation for this tragedy.  people die 
everyday from murders and other tragedies but they are not compensated.  i 
strongly disagree that my taxes should go to these families

Dear Mr. Zwick,

I am writing in response to the Department's request for public comments
regarding the forthcoming regulations for implementing and administering the

"September 11 Victim Compensation Fund." I strongly urge the Department to
draft regulations that ensure compensation is available to all victims of
the attack, including the committed partners and the non-biological children

of gay and lesbian victims. The Red Cross has worked closely with groups in
New York City and have
implemented a similar policy in compensating gay and lesbians and their
families.

It is unquestionable that the devastating grief and economic losses suffered

by the families of gay and lesbian victims are no less than that of other
families. Just as the terrorists drew no lines in choosing their victims,
our country must draw no lines in compensating those who suffered the most
personal of losses from these attacks.

Many Americans lost their lives on September 11, each of whom left behind,
loved ones. I urge the Department to honor these bonds by treating the
families of gay and lesbian victims as you would any other.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

Dear Mr. Zwick: 

           I am Chairman of the            , an organization that represents the interests of 43,000 churches nationwide. I am writing to express our concern about how funds will be disbursed through the September 11th Victim Compensation Fund of 2001. 

           There has been much discussion about providing victim funds to "domestic partners," the unmarried partners of either homosexuals or heterosexuals. 

            The effort to provide funds to non-related sexual partners of those killed in the 9-11 attack is a homosexual-inspired plan to redefine and to undermine traditional marriage as an important cultural institution. 

            Homosexual activist Michelangelo Signorile, writing in Out magazine clearly states the goal of homosexuals to destroy traditional marriage. He says that homosexuals should fight for same-sex marriage and once granted, "redefine the institution of marriage completely. . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can undertake-and one that would perhaps benefit all of society-is to transform the notion of family entirely." 

            To provide victim compensation funds for "domestic partners" of homosexuals or heterosexual unmarried couples is to help accomplish the homosexual goal of redefining and radically altering the notion of family altogether. Such policies will also pave the way for the legalization of homosexual marriages. 

            The traditional family should not be undermined in this way. As social researcher             has stated, "There never was a society throughout all history ... without a family as the central unit for launching the education of children, for character formation, and as the moral agent of society." The "family" Etzioni is referring to is comprised of a husband, wife, and children who are related by blood or adoption. Social scientists understand that children need both a father and a mother in order to develop properly. 

            This traditional family is the building block of our culture and civilization and it should not be redefined or undermined by creating such fake "family" units as "domestic partners" or "civil unions" where two same- or opposite-sex unmarried couples share sex.

            Using the definition of "family" favored by homosexuals, any grouping of two or more individuals could be called a "family" and be entitled to federal victim funds. A number of homosexual and heterosexual swingers are involved in "polyamory" or sex with multiple sex partners. Surely, these groupings of sex partners should not be entitled to 9-11 victim compensation funds, yet if funds are given to "domestic partners," these groupings could legitimately demand federal dollars as well. 

            We are opposed to providing victim compensation to non-family members or to the estates of the deceased individuals. Family members should receive these funds, not the unmarried or casual sexual partners of those who may have died in the 9-11 terrorist attack.

            There is considerable danger in providing funds to a deceased persons estate. How do we know where this money will go? Will the federal government investigate each persons estate and his will for the disbursement of funds from the estate? Will the money go to fund homosexual activism, the KKK, a terrorist group, or the North American Man-Boy Love Association? No one can know for certain unless each last will and testament is scrutinized by a federal agent. 

            Victim funds should not be simply deposited into a persons estate. The money should go to the widowers, widows, and orphans created by 9-11, not to political causes. 

            Unfortunately, it appears that homosexual activists are more concerned about exploiting the 9-11 tragedy for their narrow political objectives than they are in seeing that victim funds help the widows, widowers, and orphans of 9-11. 

            Let me say it once again: Victim funds should only go to family members related by blood or legal adoption to 9-11 victims, not to unrelated, unmarried acquaintances, estates, or to political causes favored by homosexual activists.

Help same sex partners of terrorist victims


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex
unions.  They suffer just as grievously for their deceased loved ones
as do other survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups
and individuals who would have the Department of Justice limit
compensation to survivors of heterosexual unions.  They are interested
in a political victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.

Victims Relief Fund access

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Dear Mr. Zwick,

I am writing in response to the Department's request for public comments 
regarding the forthcoming regulations for implementing and administering the

"September 11 Victim Compensation Fund." I strongly urge the Department to 
draft regulations that ensure compensation is available to all victims of 
the attack, including the committed partners and the non-biological children

of gay and lesbian victims. The Red Cross has worked closely with groups in 
New York City and have implemented a similar policy in compensating gay and
lesbians and their families.

It is unquestionable that the devastating grief and economic losses suffered

by the families of gay and lesbian victims are no less than that of other 
families. Just as the terrorists drew no lines in choosing their victims, 
our country must draw no lines in compensating those who suffered the most 
personal of losses from these attacks.

Many Americans lost their lives on September 11, each of whom left behind, 
loved ones. I urge the Department to honor these bonds by treating the 
families of gay and lesbian victims as you would any other.

 Victims Compensation Act

My name is &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp .  My husband, &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp was a Firefighter at the 
WTC on 9/11/01.  I am 41 years old and now a widow.   My children are ages 9, 
7 and 3 and will never again be able to have the love and support of their 
father.  If it were not for my husband and his 342 other colleagues there 
would have been many other lives lost and hence, many more claims to pay.  I 
do not understand how my husband's life and particularly his contribution to 
the saving of lives is worth nothing to you.  He did not have to be there.  
He could have run the other way.  Instead, he faced the danger and made the 
ultimate sacrifice.  Why would the $250,000 award I received for a LINE OF 
DUTY death be deducted from this award?  By doing so, you are simply doing 
away with that award, and thereby, not recognizing his sacrifice.  Why would 
you deduct a pension from this award?  The only reason that I will be getting 
a pension is because his death was in the line of duty.  If he had passed 
away at home, I would not receive a pension.  This is simply a benefit 
because his death was on-the-job.  By making this deduction, you are saying 
that he deserves no special financial accommodations just because his death 
was caused by his occupation.  Why would you deduct life insurance?  My 
husband could have elected to accept the $8,500 life insurance policy that 
the Fire Department provides. Instead, he opted to contribute to a special 
life insurance policy ($150,000) each paycheck.  First of all, this cost us 
money, which I doubt you will reimburse us and secondly, why should my 
husband be penalized for looking out for his family?   How can you possibly 
calculate future earnings?  How do you know what increases they would have 
received?  How do you know how many promotions they may have received in the 
future?  How do you know upon retirement that they may not have obtained a 
position that might have proven to be more financially lucrative?  To me, 
this is not a matter of dollars and cents, but rather putting a different 
price tag on each individual's life.  That is the part that is most 
unsettling to me.  Why not just split the money evenly amongst all of those 
who lost their spouse, etc.?   To me that is the only fair and equitable way 
to settle this matter.  This way, NO ONE can claim any bias or favoritism.  
If for some reason, this is not an acceptable option, then some reasonable 
calculation method must be utilized.  YOU MUST NOT LOOK TO SAVE MONEY AT THE 
EXPENSE OF THOSE WHO SAVED SO MANY LIVES!!!  To say our husband's lives are 
worth less than a Stock Broker's or a Bus Boy's is an insult.  Please 
re-evaluate your current plans for the distribution of the funds to ensure an 
equitable settlement for all.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, 
including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the
restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all
those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double
blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those
who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of
marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove
that their union is legitimate. Fortunately both the Red Cross and the State of New York have already 
announced that they will not discriminate against gay and lesbian families. The Department of Justice should
do the same.

Subject: Fund's Unfairness

After reading Governor Keating's article on the unfairness of the Victim 
Compensation Fund I felt I had to comment.  People gave to this fund with the 
intention of giving all the familys of the victims equal funds for their use. 
 To use a person's salary to administer the amount they receive seems very 
unfair.  All familys suffered equally so why not distribute the moneys 
equally?  I hope the Justice Deaprtment reconsiders this method of payment.  
I live in a small city where we lost 10 people at the WTC and they are all 
entitled to the same amount as the lowest paid person on the list.  Please 
reconsider.  I don't think people gave money to be distributed in this way.
