Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Monday, March 18, 2002 9:49 AM 9/11 Fund Compensation Awards I am writing to express my concern over the comments made recently by Kenneth Zwick regarding the potential of payments being made to partners and families of gay and lesbian victims. It seems that if you're bending the law to include illegal aliens and their families, you should not USE the law as a way to discriminate against gays and lesbians. Using state law as your guide is not a fair way to determine the eligibility of victims' families for money that has been received from around the country and the world. Many of those donations have come from gay and lesbian donors, some of whom have been personally touched by this tragedy, most of whom haven't, but are showing their support and their patriotism toward the 90% of the population that are straight AND the 10% who are gay. Please reconsider using state law as your guide; the states have NOTHING to do with this issue. Please do use the same compassion that is driving you to ignore federal law in some cases to include people who have committed to their partners within a system that doesn't ALLOW them to be legally recognized. These comments represent my own views and not those of the . Determination of noneconomic losses for pain-and-suffering prior to death has proved to be troublesome for the courts for numerous reasons, resulting in wide variation of awards. See generally David W. Leebron, Final Moments: Damages for Pain and Suffering Prior to Death, 60 N.Y.U. Law Rev. 256 (1989). The absence of well-defined legal standards for computing noneconomic loss poses a potentially severe problem for administering the September 11 Victim Compensation Fund of 2001. Indeed, a recent article in the New York Times discusses the various approaches that lawyers plan to use in arguing for noneconomic loss. Case-by-case determination of noneconomic loss will be both time-consuming and expensive. The determination is unlikely to be satisfactory for most claimants given the absence of well-defined metrics. In my view, there is a method for determining noneconomic loss in a manner that is consistent with the case law. See Mark Geistfeld, Placing a Price on Pain and Suffering: A Method for Helping Juries Determine Tort Damages for Nonmonetary Injuries, 83 Cal. L. Rev. 775 (1995). The approach is routinely used by government regulators when setting regulations protecting health and safety. The approach recognizes that there is no true "objective" measure of such losses; instead, the noneconomic loss suffered by each individual depends solely on how the individual evaluates the loss, which depends on her age, wealth, and nature of the risk. Consider the occupants of the two planes that crashed into the World Trade Center. As paying customers, these individuals, like all consumers, consider risk in terms of what they would be willing to pay to eliminate the risk by either insurance (like compensatory tort awards) or safety investments. Suppose at the time of ticket purchase the risk of dying by a hijacking is 1 in 10,000. If each passenger were to consider the monetary equivalent of the terror she would experience prior to death, she would determine that amount by finding the maximum amount of money she would be willing to pay (WTP) to eliminate the risk. The WTP amount makes her indifferent to (1) the state of the world in which she does not face the risk and pays the WTP amount to eliminate it; and (2) the state of the world in which she faces the risk and has higher wealth because she has not paid the WTP amount to eliminate the risk. Valuation of risk in terms of the WTP amount is routinely used by government regulators and has a well-established foundation in welfare economics. Importantly, the WTP amount provides a straightforward method of calculating the total cost of the noneconomic loss for the individual. The individual compares the WTP amount to the amount of loss, denoted L, which is discounted by its probability of occurrence (yielding the expected value of loss). By definition, in the above example: WTP = (1/10,000)L. Consequently, the individual's valuation of the loss L can be computed by multiplying the WTP amount by 10,000. Calculation of noneconomic loss for other victims relies on the willingness to accept (WTA) measure, which makes the individual indifferent between (1) the state of the world in which she does not face the risk; and (2) the state of the world in which she faces the risk and receives the WTA payment to face it. In effect, the WTA measure is the monetary equivalent of the benefit an individual must receive to assume a risk. Again, this measure is used by government regulators and has a solid foundation in welfare economics. The measure yields the individual's implicit valuation of the injury if the WTA amount is multiplied by 10,000 in the above example. As I establish in my previously referenced article, this approach to computing pain-and-suffering damages is consistent with the requirements of the case law and has numerous advantages over the current approach. The approach could be used on a case-by-case basis, as I argue in the article, or could be used for scheduling purposes. In administering the September 11 Victim Compensation Fund of 2001, scheduling is desirable due to the large number of claims, particularly given the lack of direct evidence regarding each individual's final moments before death. These schedules could be based on WTA or WTP measures derived from surveys conducted specifically for the fund, or from sufficiently analogous surveys conducted by government regulators or academics. In the event a new study is required, it must rely on some number for the probability of injury. An assumption along the lines of 1 in 10,000 would yield reasonably good results. The virtue of this approach is that it provides a defensible explanation for the amounts to be used in the schedule. Any schedule is unlikely to satisfy everyone, but any given schedule ought to be capable of justification. Such justification is provided at length in my article, which is attached to this email. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I understand that US law does not protect homosexual relationships, but it also does not protect illegal immigrants who are living and working in the United States IN WILFUL VIOLATION OF FEDERAL LAW. Since this fund was legislated federally and is distributing federal funds we feel we should be treated equally as spouses (since we all had set wedding dates and our fiances had already asked us to be their wives/husbands). When this fund was set up by congressional legislation last September it was to compensate not only for earnings and pain/suffering (which we are the only ones who suffered a financial loss), but also for 'loss of companianship", "loss of domestic service" etc. This should apply to us as fiancees /domestic partners as well. We are concerned with the exclusive effect of this proposal. It appears, however, to have been the intention of the Act to limit compensation to "relatives." If this is construed to mean relatives at law, many deserving individuals with close relationships in fact (i.e., co-habiting partners, survivors of engaged couples, step-children, etc.) who are injured survivors will be excluded. The regulations should more broadly define "relative" to include de facto relatives Please read my attached letter expressing our concerns regarding the non-recognition of fiances/domestic partners in the federal fund. If we are not taken into account then the money will solely be awarded to the parents of the victim, who were not affected financially. You cannot expect that the parents will "do-the-right-thing" and share the award with their son's/daughter's fiance/domestic partner. We have already seen many cases where people have already not taken the "morally correct" approach. We need to be recognized because our partners/fiances had promised to take care of us forever, just as a spouse. A spouse is the first receipient of the fund, and a fiance/domestic partner should receive the identical rights of a spouse and not be punished because they were cheated out of their wedding. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Tuesday, December 11, 2001 7:21 PM sept 11th fund My son died in the WTC disaster. I have a real dilemma in answering the call for comments. It seems that the government is not a non partial observer here, but conveniently, is appointed to determine the compensation plan, and is suggesting to the families of the victims to sign over their right to appeal. This seems to be counter to all logic, I have always viewed the legal system to be, in some degree, a matter of gamesmanship, who has the best lawyer wins. And it seems that the government is advising the victims not to obtain counsel. Am I incorrect in my observation? I am seriously asking this question, not rhetorically. Shouldn't the victim's families have some idea of a dollar figure? What is the reasonable expectation? I don't think that alot of time has to be spent on form design here. There should be some straight forward method of determining who victims and families are, if we can't figure this out, then the whole process is brought to question. What is Fair Compensation? Well, there are some precedents for this question, what were the settlements in other disasters? How do they relate to this one? Somehow I believe that the trauma of this horrific event exceeds anything that we have experienced to date. It serves no purpose now to assign blame, but security measures from an Airline and Government poin of view were seriously lacking. Then there are issues with what I perceive to be the government's position on reducing any award by any collateral sources of income. My son chose to take the responsible route and funded some security measures, this was a cost that he bore, and was a factor in looking at possible alternatives to employment as it factored into his salary requirements. Now to penalize his family for his investment in insurance seems to send a message that says don't be fiscally responsible, if you sacrifice (by purchasing insurance) you will just provide justification for decreasing the amount of a settlement. Does a family suffer less because they have insurance? I can tell you this isn't the case at all. Another quandry that I have is one of trust, frankly, in the Government, to be really fair; this Airline legislation, why is no one worried about how much money is being moved to the Airlines? There seems to be so much concern about the money going to victim's families, where is this money coming from, well, of course, it comes from the citizens. But it is appropriated and managed by the Government, so the Government has this commitment to fund the victims relief, but is it in their interest to minimize the total payout? Won't it make their problem easier to find the funds if the relief to the families are minimized? So now we have a proposal to not go to court, to minimize the costs, the Government is the author of this proposal. Is this fair or self-serving? I have seen our Legal system work, it seems to be based on the adversarial system. Now we are pushing to remove this adversary process. Did the Airlines not have their lobbyists active during the legislative process? How was the dollar amount of the bailout arrived at? Was there give and take by the pro-Airline lobbyists and politicians? Was this as visible as the Victims Relief issue? There seems to be so many examples of civil cases where the original settlement offers are fractions of what our Legal System finally judged to be fair, will the Government offer be fair from the start? The Government seems to have set itself up as the agent of the Airlines in this issue. I would just like to be more confident that the proceedings will be fair. I think more information is necessary to make a decision.
