His wife shared that honor for the last six years. Now we all have the equal horror of grieving for a wonderful and respectful young man who was killed through no fault of his own, but because he went to work the morning of September 11 on the floor of the North Building of the World Trade Center. What we do not have is equal recognition under the law for the loss that we all equally have. My wife, gave birth to him. We both raised him by providing all the guidance, friendship, substance and mostly love that a child could possibly need and want. After he married, we continued to speak to him several times a week and see both our son and daughter-in-law frequently. His older sister, , was one of his best friends . In recent years they lived over one hundred miles apart, but were always together in their hearts. They spoke to each other a few times a week. We thank you for the opportunity to comment today on the Interim Final Rule. Our comments are as follows: 1. The Regulations and Guidance Should Clearly State that Parents Whose Children Were killed on September 11th Are Presumed to be Eligible for Distribution of all Compensation Awards. Our grief for our son is as great as that of anyone's and what we ask is that this fact be recognized under the law. Our lives have turned into a living hell and we must receive equal compensation for this insurmountable loss and unending pain and suffering that we are struggling to endure. New York State law recognizes that parents are to share in the distribution of any damages awarded in a wrongful death action. Under EPTL Section 5-4.4 , parents of children without children of their own are specifically named distributees, even of they are not recognized by the state as beneficiaries of the estate. The final regulations and guidance to be issued under the September 11th Victim Compensation Fund 2001 should clearly state the same. To do otherwise will create undo confusion and pain on the part of families who have already lost far too much. If the goal of the September 11th Fund is to prevent families from feeling that their only option is to sue, The Fund should clearly provide that other options exist and that compensation to all family members, not just spouses will result. Ambiguity and vagueness is not helpful in this case, but is instead counterproductive for both the families and the government. To neglect to provide the clarity requested here will result in excessive pain and suffering clearly not envisioned when Congress passed Title IV (Victim Compensation) of the Air Transportation Safety and System Stabilization Act (the "Act"). Finally, the regulations wisely anticipate that disputes among family members may ensue. As Special Master to the Fund, you have a unique opportunity to minimize the number of such disputes by providing as much clarity as possible up front so there are as few disputes as possible within the families over the law's intent. This is an incredibly difficult time for the thousand of families effected by the horrific events of September 11th. We urge you not to add to this difficulty by creating conflicting opinions over the intent of your own words and actions. 2 To Deduct Life Insurance and Pension Payments From the Compensation Awards is Counter To Public Policy and is Grossly Unfair to Families Whose Loved Ones Took Responsible Steps to Plan For Their Families' Futures. It is not equitable that insurance and pensions be deducted from the total compensation. Simply because some of the victims had the foresight to provide for their families should not be held against them. This is why in most civil litigation life insurance is not deducted from damage awards. Nor should the fact that some had pensions be held against them. If you want to deduct the pensions that they earned, then the total of the pensions should be included in the gross compensation as part of their earning power over their expected term of employment. The liability for wrongful death should be measured by total potential earnings and pain and suffering to both the victims and their families. Should the regulations not be able to be modified due to the language of the Act itself requiring that compensation must be reduced by collateral sources (Section 405 (b)(6), perhaps an alternative would be to reduce the compensation by a percentage of the total amount of the collateral sources. Nothing in the Act specifies that the reduction must be dollar for dollar. 3 The Claim Form Should Include a Provision Requiring Disclosure of, and to, all Living Immediate Family Members In Order to Ensure a Knowing and Effective Waiver of Suit is made. We are all at a significant disadvantage in that no claim form was provided in the Interim Final Rule to review. Thus, in the absence of such a draft form, one can only speculate what will be asked of the personal representative when making a claim. At a minimum, the form should require the personal representative to disclose the names, addresses, and phone numbers of all living immediate family members. For the purposes of this regulation, immediate family members should be defined to include spouses, children, parents and siblings. In addition, the regulations should also require that effective notice of the filing of a claim (within a reasonable period of time) be given to all such relatives giving them the opportunity to opt in or out. To do otherwise would unfairly affect other relative's right to sue by risking an unknowing waiver of the right to sue. No one should be bound by the actions of others of which they were not made aware. 4 A clear definition of "dependent" as used in the section "presumed non- economic loss" should be given. At a recent meeting attended by Special Master Feinberg the definition of dependent was given to be not limited to that used by the Internal Revenue Service, but intended to include the relatives to who support was or was intended to be given by the victims. In our case this should include the support given to my wife when she was ill with cancer and the support given to me when I had by-pass surgery. In both cases our son was there with us constantly, being of both physical and emotional help to us. Our daughter recently told us of a conversation that she had with our son, that if we would be in need of long-term care they would both contribute to it. These are but a few cases of what should be included in the definition of dependent. The people of this great country have put in your hands the means that will help us begin to shape our future. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. Kenneth Feinberg sounds like mister cop-out on that one. How can he refuse to go against the states on the issue of domestic partnerships while totally supporting people who are here in violation of FEDERAL law? Do you really think that is fair? What exactly does Mr. Feinberg need so that he doesn't get his precious hiney sued by the states? I will be contacting Attorney General Ashcroft to recommend that he consider a similarly generous offer for partnerships as he did for illegal aliens. Saturday, March 16, 2002 9:49 PM Discrimination against gays Mr Feinberg, I would like to take this opportunity to express my outrage at the discrimination displayed by the September 11th Victim Compensation Fund against the gay and lesbian heroes of the tradegy that befell our nation. You claim that you cannot go against state laws, and that equal compensation to ALL victims would do just that. Yet, you have no problem bending United States laws in your compensations for illegal alien. I fail to see the justice in this. How can you place certain victims into second-class status just because of their sexuality? Does it make them lesser heroes? September 11th brought the nation together as one. Differences did not matter any more. We are all Americans. Yet, through this discrimination you dividing this country once again. You are telling the people of this great nation that yes, you are all Americans, except for this one group - they are lesser Americans and do not deserve the same treatment. Wednesday, March 27, 2002 9:53 PM Final Ruling on Compensation March 28, 2002 As a Canadian, I was very heartened to read all the comments posted on this site by US citizens to protest your government's ignorant and unconscionable discrimination against gay members of society. Apparently it is seen as politically OK to single out gays and lesbians and deny them and their loved ones compensation like everyone else affected by the terrorist attack. It is good to know that so many ordinary people value the American ideal even if your so-called leaders do not. Keep up the fight. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." It is a terrible thing that happened to the families of the people hurt and killed in the World Trade Center Buildings. But is giving the families an average of 1.5 million dollars of taxpayer money fair to the other thousands of US families that lose a family member to death by accident or illness each year. As a widow and mother, I have struggled for the last 17 years to keep food on the table and a roof over our head. I have not been able to save money for my son's college education and have been able to put very little money away for my retirement. My husband died at the age of 25 due to a hiking accident four months before our son was born with serious birth defeats. His Social Security was not enough for us to live on, so I have worked. First, let me commend Kenneth R. Feinberg, Special Master, for the work he has done to ensure that the Victim Compensation Fund provides relief for families of those killed or injured in the attacks on our country on September 11th. Although there is no way to truly compensate for their loss the funds will bring help to those in need. The interim final rule follows state laws governing survivor benefits in deciding who is entitled to the money. In some states such as Virginia this means that same-sex partners will be left out. It is unjust not to specifically provide benefits for same-sex partners. Same-sex partners should not be forced to submit a claim for review to receive benefits nor should the decision on whether same-sex partners are entitled to benefits be left to the narrowly tailored discretion of the Special Master. The rule should be re-written to correct this inequity and provide benefits to same-sex partners on the same basis with spouses, parents, grandparents, siblings and children.
