I hope to God this is not the case, because to rate some people as more deserving or more American than others for reasons of sexual orientation is completely unfair, and domestic terrorism at its worst. You know darn well the laws are far behind the realities, and do not recognize gay couples as married and therefore you can't cop out by saying Well if the state doesn't recognize you as a couple then neither can we... September 11 changed a lot of perspectives and broke into new territory and took risks, this damn well better be one of those times. You can do a little bit of homework -- and chances are their partners would do it for you -- proving a committed relationship, proving a life together, whether it is the same residence, changed / shared last names, children, beneficiary listings, healthcare proxies, wills, and many many many other ways that clearly indicate who the life partner of the 9/11 hero was. These people left behind have been through unspeakable tragedy already, but to then be ignored as if that relationship was less central than any other widow or widower's is completely heartless. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. So many loved ones were torn from their families and partners. Some of the committed couples that were torn apart were not married. These include heterosexual and homosexual couples who were making a life together. It is not the place of the September 11th Fund to judge the victims of September 11th, nor to play favorites. You have shown great moral courage in offering compensation to illegal immigrants, the least you can do is show the same grace towards citizens who also lost their life partners, but happened not to be married to them. Your purpose should be to help those most in need. People whose life partners were killed on September 11th have been greatly traumatized and lost family income they depended on. Because of prejudicial laws they may even lose their homes or other assets and be even more financially devastated by the loss of their life partner than those who were married. Tell me, when Americans responded to September 11th with a flood of donations, did all those checks come in the charities with notes saying "restrict these funds to heterosexual and married victims"? No, because donors wanted to help those who needed help, regardless of their personal characteristics. Did the passengers on flight refuse his heroic efforts because he was homosexual? No, people should be judged on their actions, not on their life partners. Do we restrict the privileges and responsibilities of citizenship to heterosexual married people only? Tuesday, January 29, 2002 9:57 AM Re: $250,000 cap for non-econmic loss. As Mr. Feinberg said on NY 1 last night, firefighters and soldiers killed in the line of duty would receive this amount. I t seems it me that they do a job which comes with the risk of injury or death in the course of normal work duties. People ,who work in office buildings, do not think that they face the possibiltiy of being incinerated by terrorists. I also resent references to the generosity of the government in establishing the victims compensation fund. I think part of the motivation was self-serving. This is wrongful death and a liability issue to me. It is an attempt to protect the airlines,who are at fault for their lack of security. These terrorist were not carrying plastic explosives which could not be detected but metal weapons. The government, itself, is at fault. The F.B.I. and the C.I.A. were asleep on the job and President Clinton was too busy chasing women around the Oval Office while terrorists lived among us. Today, in a lawsuit against Starbucks, a jury awarded 3.5 million dollars to a person who received a serious burn to the hand and the families of the WTC disaster must deduct life insurance payments from their compensation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist Michelangelo Signorile, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping Signorile accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination.
